DANIELSON State Engineer We have reviewed the above referenced proposal to separate 39.32 acres into two tracts of 19.6 acres each. The proposed source of water for one of the tracts is well 126257. The applicants seek an additional well for the other tract. Permit number 126257 was issued pursuant to CRS 1973, 37-92-602 (3)(b)(II), as the only well on 39.32 acres. The conditions of approval restrict this well to serving one single-family dwelling. The well has been constructed. Unfortunately, the conditions on the existing permit prohibit issuing any additional well permits on the 39.32 acres. Enclosed is a listing of the conditions of approval which must be satisfied prior to final approval of your exemption. In addition, an exemption plat of your property must also be submitted prior to final approval. The Garfield County Subdivision Regulations contain specific technical requirements for this plat and should be consulted. Following the proper approvals from the County Surveyor and the Board this plat will need to be recorded in the Garfield County Clerk and Recorders Office, a procedure which does require a ten dollar fee. Information and assistance in completing these requirements is available at this office, in addition to copies of the Subdivision Regulations. Your completed plat should be submitted and conditions of approval satisfied no later than 120 days from the date of conditional approval or June 19, 1985, as required in the Subdivision Regulations, unless an extension is requested. PLANNING COMMISSION RECOMMENDATION On June 8, 1983, the Planning Commission recommended approval of the Sketch Plan and exemption from full subdivision review witn tne following conditions: 1. That the County Road and Bridge supervisor approve a driveway access to tract B onto County Road 241. 2. That the road right-of-ways for County Road 241 shall oe shown on the final plat prior to the signing of the resolution. 3. That an approved well permit oe obtained from the Division of Water Resources prior to final plat approval. 4. That the applicants must comply with the requirements of Section 5.04.02 of the County Zoning resolution prior to the issuance of any building permits on slopes of 40% or greater. 5. GENERAL PROVISIONS FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is to be constructed by him for the bona fide purpose of securing access to his property and not for the purpose of doing business or servicing vehicles on the road right-of-way. SECOND: The Applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with the construction of the driveway(s) and its appurtenances on the right-of-way. All work shall be completed within 30 days of the Permit date. THIRD: The type of construction shall be as designated and/or approved by the Board of County Commis- sioners or their representative, and all materials used shall be of satisfactory quality and subject to inspection and approval of the Board of County Commissioners or their representative. FOURTH: The traveling public shall be protected during the installation with proper warning signs and signals and the Board of County Commissioners and their duly appointed agents and employees shall be held harmless against any action for personal injury or property damage sustained by reason of the ex- ercise of the Permit. FIFTH: The Applicant shall assume responsibility for the removal or clearance of snow, ice or sleet upon any portion of the driveway approach (es) even though deposited on the driveway (s) in the course of the county snow removal operations. SIXTH: In the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall be securely braced before the fence is cut to prevent any slacking of the remaining fence, and all posts and wire removed shall be turned over to the District Road Supervisor of the Board of County Commissioners. SEVENTH: No revisions or additions shall be made to the driveway(s) or its appurtenances on the right- of-way without the written permission of the Board of County Commissioners. EIGHTH: Provisions and specifications outlined herein shall apply on all roads under the jurisdiction of the Board of County Commissioners of Garfield County, Colorado, and the Specifications, set fo rth on the reverse hereof and incorporated herein as conditions hereof.
