We have reviewed the above referenced proposal to separate 39.32 acres
into two tracts of 19.6 acres each. The proposed source of water for one of
the tracts is well 126257. The applicants seek an additional well for the
other tract.
Permit number 126257 was issued pursuant to CRS 1973, 37-92-602
(3)(b)(II), as the only well on 39.32 acres. The conditions of approval
restrict this well to serving one single-family dwelling. The well has been
constructed.
Unfortunately, the conditions on the existing permit prohibit
issuing any additional well permits on the 39.32 acres. Also, the
conditions do not allow the well to serve more than one dwelling.

Gentlemen,
This letter is in regard to your request for Exemption from the definition
of Subdivision which was conditionally approved by the Garfield County
Board of County Commissioners on February 19, 1985. Enclosed is a listing
of the conditions of approval which must be satisfied prior to final
approval of your exemption. In addition, an exemption plat of your property
must also be submitted prior to final approval. The Garfield County
Subdivision Regulations contain specific technical requirements for this
plat and should be consulted. Following the proper approvals from the
County Surveyor and the Board this plat will need to be recorded in the
Garfield County Clerk and Recorders Office, a procedure which does require
a ten dollar fee.
Information and assistance in completing these requirements is available
at this office, in addition to copies of the Subdivision Regulations.
Your completed plat should be submitted and conditions of approval satisfied
no later than 120 days from the date of conditional approval or June 19, 1985,
as required in the Subdivision Regulations, unless an extension is requested.
Please contact this office if you have any further questions or concerns
regarding your exemption.

V. PLANNING COMMISSION RECOMMENDATION
On June 8, 1983, the Planning Commission recommended approval of the
Sketch Plan and exemption from full subdivision review witn tne following
conditions:
1. That the County Road and Bridge supervisor approve a driveway access
to tract B onto County Road 241.
2. That the road right-of-ways for County Road 241 shall oe shown on the
final plat prior to the signing of the resolution.
3. That an approved well permit oe obtained from the Division of Water
Resources prior to final plat approval.
4. That the applicants must comply with the requirements of Section
5.04.02 of the County Zoning resolution prior to the issuance of any
building permits on slopes of 40% or greater.
5. That a $200.00 school assessment fee be paid to the County prior to
final approval.
6. That no additional lots may be created on eitner of the two subject
parcels through tne exemption process.
The following additional conditions are recommended due to changes in tne
application and regulations since the Planning Commission recommenaation.
7. That the plat include easements for access and maintenance to tne well
and for the irrigation ditcn. That each tract receive a deedea 1/2
interest in the well.
8. That all crossing of irrigation ditches and drainage swales by access
roads be culverted in accordance with appropriate engineering
standards.
9. That the recorded plat comply with current County regulation regarding
technical requirements including signature blocks and legal
descriptions of lots created.
10. That all proposals of the applicant be considered Conaitions of
Approval, unless stated otherwise by the Board.
11. That plat notes be included on the final plat containing conditions #4
and #6.

APPLICATION FOR DRIVEWAY PERMIT
Application Date July 25, 191a_
Mathew Van Hnnse (herein called "Applicant") hereby requests permission and author-
ity from the Board of County Commissioners to construct a driveway approach(es) on the right-of-way of

Applicant submits herewith for the consideration and approval of the Board of County Commissioners,
a sketch of the proposed installation showing all necessary specification detail including (1) frontage
of lot along road, (2) distance from centerline of road to property line, (3) number of driveways re-
quested, (4) width of proposed driveway(s) and angle of approach, (5) distance from driveway to road
intersection, if any, (6)\size and shape of area separating driveways if more than one approach, and
(7) setback distance of building(s) and other structures or improvements.
The applicant binds and obligates himself to construct and maintain the driveway approach(es) in
accordance with the provisions, specifications, and conditions enumerated in this document.
GENERAL PROVISIONS
FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is
to be constructed by him for the bona fide purpose of securing access to his property and not for the
purpose of doing business or servicing vehicles on the road right-of-way.
SECOND: The Applicant shall furnish all labor and materials, perform all work, and pay all costs in
connection with the construction of the driveway(s) and its appurtenances on the right-of-way. All
work shall be completed within 30 days of the Permit date.
THIRD: The type of construction shall be as designated and/or approved by the Board of County Commis-
sioners or their representative, and all materials used shall be of satisfactory quality and subject to
inspection and approval of the Board of County Commissioners or their representative.
FOURTH: The traveling public shall be protected during the installation with proper warning signs and
signals and the Board of County Commissioners and their duly appointed agents and employees shall be
held harmless against any action for personal injury or property damage sustained by reason of the ex-
ercise of the Permit.
FIFTH: The Applicant shall assume responsibility for the removal or clearance of snow, ice or sleet
upon any portion of the driveway approach (es) even though deposited on the driveway (s) in the course
of the county snow removal operations.
SIXTH: In the event it becomes necessary to remove any right-of-way fence, the posts on either side of
the entrance shall be securely braced before the fence is cut to prevent any slacking of the remaining
fence, and all posts and wire removed shall be turned over to the District Road Supervisor of the Board
of County Commissioners.
SEVENTH: No revisions or additions shall be made to the driveway(s) or its appurtenances on the right-
of-way without the written permission of the Board of County Commissioners.
EIGHTH: Provisions and specifications outlined herein shall apply on all roads under the jurisdiction
of the Board of County Commissioners of Garfield County, Colorado, and the Specifications, set fo rth
on the reverse hereof and incorporated herein as conditions hereof.
