when the following proceedings, among others were had and done, to -wit:

RESOLUTION CONCERNED WITH AMENDING RESOLUTION NO. 78-125
FOR ADRIANA VANLEE4AN
WHEREAS, Adriana VanLeewan has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an e-,:emption from the
definition of the terms "subdivision" and "subdividec, land" under C.R.S.
1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02 21 (d)
and 3.02.01 for the division of a 131 acre tract described as follows:
into 3 tracts of approximately 2.232, 4.025 and 2.77
acres each, more or less, which proposed divided tracts
are more particularly described as follows:
Tract A: A trach of land situated in the S't-SNE% of Section
12, Township 5 South, Range 92 [Jest of the 6th P.M., being
more particularly described as follows:
Beginning at a point on the southerly right-of-way line
of County Road No.226, whence the Northwest Corner of
said Section 12 bears N 7042'35" 14 a distance of 43.80.784
feet; thence Southeasterly and following a curve to the
right, having a radius of 1121.83 feet, and a central. angle
of 1°31'59" for an arc -length of 30.04 to a point on the
centerlin e of a proposed access easement, chord for the above
said curve bears S 52°13'20" E for a distance of 30.0 feet;
thence S 52°55'14 and along the centerline of the above
mentioned access easement a di3tance of 12.76 feet; thence
southwesterly along a curve to the right, having a radius
of 257.63 and a central angle of 40'45', for an arc -length
along the centerline of the above said accesE easement of
183.23 feet; thence S 77°50' 14 and along the centerline of
the above said access easement for 90.00 feel"; thence
southwesterly along a curve to the left having a radius of
80.00 feet and a central angle of 77°40'30", for an arc-
lengLli along the centerline of the above said access easement
of 108.44 feet: thence N 89'50'30" 1•7 a distance of 30.00 feet
to the west line of the above said access easement: thence N
89°50'30" W a distance of 57.31 feet; thence N 00°09'30" E
a distance of 386,61 .feet; to a point on the southerly right-
of-way .line of County Road No. 226; thence S 88'35'E and
along the souilerly right -of: -way line of said County Road No.
226, a distance of 63.32 feet; thence along a curve to the
ric-ht having a radius of 302.96 feet and a central angle of 35'
40' .for an arc -length, along the southerly right-of-way line of
said County Road No. 226, of 188.59 feet; thence S 52'55E.
and along the southerly right-of-way line of: said County Road
No. 226, a distance of 169.34 feet more or less to the Point
of Beginning. Containing 2.232 acres more or less. Including an
easement and right-of-way as shown for ingress and egress,
per Garfield County Commissioners Resolution No. 78-125.
Including but not limited to one (1) share of Farmers Irrigation
;;tock.
Tract B: A tract of land situated in the S1�NE'4 of Section 12
Township 5 South, Range 92 West of the 6th P.M. being more
particularly described as follows:

Beginning at a point in the southerly right-of-way line of
County Road No. 226, whence the NW Corner of said Section 12
bears N 70°27'14"W. a distance of 4437.47 feet; thence south-
easterly along a curve to the right and following the southerly
right-of-way line of said County Road No. 226, said curve
having a central angle of 11°15'21" and a radius of 1121.83
feet, for an arc -length distance of 220.33 feet; thence S.
38°35'42" E. and continuing along the southerly right-of-way
line of said County Road No. 226, a distance of 321.60 feet;
thence S 47°1441" E and along the southerly right-of-way line
of said County Road No. 226, a distance of 70.27 feet; thence
S 37°17'W a distance of 200.08 feet; thence N 52°17'W a distance
of 510.11 feet; thence along a curve to the right having a
radius of 191.72 feet and a central angle of 40'07' for an
arc -length distance of 134.24 feet; thence N 12'10'W a
distance of 130.00 feet to the centerline a proposed 60 foot
access easement; thence at right angles to the previously mentioned
course and along the centerline of a 60 foot access easement N 77°
50' E. a distance of 30.00 feet; thence along a curve to the
left having a radius of 257.63 feet and a central angle of 40°
45' for an arc -length distance, along the centerline of said
access easement, of 183.23 feet; thence N 3705' E. and along
the centerline of said access easement, a distance of 12.76 feet;
to a point on the southerly right-of-way line of said County
Road No. 226; thence southeasterly and along the southerly
right-of-way line of .said County Road No. 226, along a curve
to the right having a radius of 1121.83 feet and a central
angle of 1°32'00" for an arc -length distance of 30.04 feet
more or less to the Point of Beginning. Containing 4.025 acres
more or less.
Parcel C: A tract of land situated within the West z Northeasty
of Section 12, Township 5 South, Range 92 West of the Sixth
Principal Meridian, Garfield County, Colorado, being more
particularly described as follows:
Beginning at a point on the Southerly right-of-way line of
County Road No. ._26 whence the Northwest Corner of said Section
12, bears N 69°43'16" W. a distance of 3688.52 feet.; thence
along said southerly right-of-way line S 88°35'00" E a distance
of 307.24 feet to the northwesterly corner of the Wayne Gannett
property as recorded in Book 540 at Page 869 of the Garfield
County, Colorado, Records. Said Northwesterly corner being
a No. 5 rebar with cap L.S. No. 10871; thence leaving said
southerly right-of-way line S 00'09'30" W. along the Westerly
line of said property recorded in said book 540 at page 869,
a distance of 392.73 feet., said distance recited as 386.61
feet. in said book 540 at page 869, to the Southwesterly corner
of said property recorded in said book 540 at page 869, said
Southwesterly corner being a No. 5 rebar with L.S. No. 10871;
thence N. 88°44'17" W a distance of 307.22 feet; thence N. 00°
09'30" E. a distance of 393.56 feet to the point of beginning.
containing 2.77 acres more or less.
(in the State of Colorado and County of Garfield); and
IMEREAS, the Petitioner has demonstrated to the satisfaction of
the Board of County Commissioners of Garfield County, Colorado, that the
proposed division does not fall within the purposes of Part 1, Article 28,
Title 30, Colorado Revised Statutes 1973, as amended, for the reason that
the impact created does not warrant a full subdivision review; and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there is
a reasonable probability of locating domestic water on each of said tracts,
that there is adequate ingress and egress to said tracts, that the location
of septic tanks will be permitted by the Colorado Department of Health, that
the requested division is not part of an existing or larger development and
does not fall within the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield, and should,
therefore, be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d),
