Dear Mark:
Attached is a formal letter to the Board of Commissioners requesting an amendment to
the above exemption. I trust the letter includes those items we discussed that will be
necessary for their consideration of our request.
Regarding the well easement for Tracts A & B, we are working on getting that prepared
and should have it done before the meeting with the Commissioners.
In reviewing the schedule of the Commissioners and the amount of paperwork that
needs to be done prior to the meeting, if we can get on the February 5th agenda, that
would be appreciated. That will give you some time to get the letter that we need to
send out prepared and any other matters completed we may need to address.
I plan on going to Rifle the week of the 8th, probably the last part of the week. If the
sign is available for posting by that time, I will put it on the property then. I can come to
your office to pick up the materials if need be. Please let me know.
Mark, thanks again for you prompt response on this matter. It is greatly appreciated.

Dear Commissioners:
We are requesting your approval of an amendment of the above exemption that was
granted in 1982. This exemption involves property that has been held in our family
since about 1923. The subject property is held in joint ownership between Jack & Irene
Wigington and Jaedro, Inc., a family corporation established to hold the half interest of
Janice, Edward, and Ron Bell.
The original exemption divided a 40 acre parcel into three tracts. A 5, a 10 and a 25
acre tract were created to meet an interest we had at that time to eventually establish
separate family ownership for each. However, that never materialized and no plats or
separate deeds were ever filed or ownership changes made.
We are requesting an amendment of this exemption to change the size of the parcels.
The parcel designations of A, B, and C, remain the same, only their relative size is
changing to conform to a more natural boundary along the Rifle Creek Canon Ditch
that runs through this 40 acre parcel.
We are requesting that the size of Tract "A" be reduced from 5.0066 acres to 3.894
acres; Tract "B" reduced from 10.0348 to 3.198 acres; and, Tract "C" increased from
25.3263 acres to 33.359 acres.
The following additional information is provided.
Mineral rights for this 40+ acre parcel are held jointly by Wigington and Jaedro and are
not subject to any leases or other encumbrances. Mineral rights will remain with each
of the tracts.
There are 32 inches of #80 priority irrigation water from the Rifle Creek Canon Ditch
deeded to this 40 acre parcel. We will deed 3 inches of water to Tract "A", 3 inches to
Tract "B" and 26 inches to Tract "C". Ditch rights will remain with each of the tracts.
There are two wells on this 40 acre parcel. Well #1 (Permit #30853) is located on Tract
"B". This serves an existing residence on Tract "B" and also has served a residence on
Tract "A" for approximately 25 years. An easement has been established to ensure that
Tract "A" has access to the well for maintenance.
Well #2 (Permit #122254) currently exists on Tract "B". However, upon approval of
this request, its location will be on Tract "C". The State Engineer's Office recently
stated that this is an approved well and can be put in operation at any time. A pump
installation form will need to be submitted to the State Engineer's Office when that
occurs. It is a domestic well approved for 15 gpm.
Attached is a sketch of the subject property with the owners of property within 200 feet
listed. Also enclosed is a listing of those property owners with their mailing addresses.
We will forward notices as required by the County to those owners and present proof
of the mailings as part of this request for approval. As you will note, the 40 acre parcel
to the east of this parcel is owned by Jack and Irene Wigington. The 40 acre parcel to
the north of this parcel is owned jointiy by Wigington and Jaedro. Properties to the
west are across County Road 233. We believe there should be no significant impacts on
adjacent properties with the minor changes we are requesting.
We will sincerely appreciate your consideration and approval to amend the original
exemption and establish new tract sizes per this request. We would like to create
deeds for these new parcels to transfer property within our family by March 1.

A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION
REGULATIONS FOR JAC1- AND IRENE WIGINGTON AND JAEDRO, INC.
WHEREAS, Jack and Irene Wigington and Jaedro, Inc. have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the definition of
the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d)
as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted
January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 40 acre tract
described as follows: that parcel of land as described in Book 499, Page 497 as filed
in the Office of the Clerk and Recorder of Garfield County, Colorado into 3 tracts
of approximately 5, 10, and 25 acres each, more or less, which proposed divided tracts

Attached is an easement that has been prepared for the purpose of providing access to the
well on Tract B by the owner(s) of Tract A in the above exemption.
This easement has been created to reflect the ownership of the Tracts, assuming the
Board of Commissioners approve the amendment request.
If the amendment is granted, we will then get the easement signed and recorded. This
easement was a recommendation you suggested to ensure that the access to the well was
not encumbered.

In 1982, Jaedro, Inc. (a Colorado corporation) and Jack Wigington were granted an exemption
on 80 acres of jointly owned agricultural property in Garfield County. The exemption turned the
original 80 acres into four parcels. Parcel A was 5 +- acres, Parcel B was 10 +- acres, Parcel C was
25 +- acres and the last parcel was 40 acres.
In the original exemption, Parcels A & B were established as square rather than following the
lay of the land, therefore they contained some cropland and some pasture. This amendment would
move the east boundaries of A & B on a line that would follow the irrigation ditch that transverses the
property. Parcels A & B would then have only pasture and Parcel C would have all the cultivated
ground. The irrigation ditch would still furnish water for all parcels as it does now. Fences could be
built on property lines so as not interfere with farming operations. The change would make parcel A
3.894 acres, parcel B 3.198 acres, and parcel C 33.359 acres.

in Garfield County, Colorado, described as follows:
Tract "B" of the Wigington/Jaedro Exemption, (Garfield County
Exemption 82-275, as amended) located in the Northeast Quarter of the
Southwest Quarter, Section 3, Township 6, Range 93 West of the 6th P.M.
Tract "B" includes a domestic well (hereinafter "Well"), (Permit #30853) that serves a
residence on Tract "B" and also serves a residence located on Tract "A" of the
Exemption (as amended). The location of the Well on Tract "B" is:
Starting at the NW corner of the Northeast Quarter of the Southwest
Quarter, Section 3, Township 6, Range 93 West of the 6th P.M.; thence S.
01°07'22"W along the West Line of said NE1/4SW1/4, a distance of 285.43

Thanks for your time on Wednesday and your direction on our interest to amend the
above exemption. This is property that has been held in our family since about 1923.
The subject property is held in joint ownership between Jack & Irene Wigington and
Jaedro, Inc., a family corporation established to hold the half interest of Janice,
Edward, and Ron Bell.
Attached is a copy of an exemption that was granted in 1982 to divide a 40 acre parcel
into three tracts. It was granted on our request to establish 5, 10 and 25 acre tracts
to meet an interest we had at that time to eventually establish separate ownership's for
each. However, that never materialized and no plats or separate deeds were ever
filed or ownership changes made.
We are requesting an amendment of this exemption to change the size of the parcels
per the attached property descriptions shown on the SurvCo, Inc. documents. The
parcel designations of A, B, and C, remain the same, only their relative size is changing
to conform to a more natural boundary along a ditch.
A sketch is attached showing the original exemption in solid lines and the proposed
amended parcels in dashed lines. Also, adjacent property ownership is shown.
I believe the only parcel that would be directly affected by this change is the Woodring
parcel. That parcel has remained in the same ownership since the original exemption
was granted. An adjustment of the property line between parcel B & C is the only
change that would be adjacent to property not owned by Wigington/Jaedro. That
should not have any impact on the Woodring parcel since it is across County Road 233
from the Woodring parcel.
We anticipate that we will be creating deeds for these new parcels in February 2001 to
transfer property within our family. We will sincerely appreciate County approval to
amend the original exemption and establish new tract sizes per our request.
