We have reviewed plans for a new residence for Kitselman to be located at Elk Springs, Filing 6, Lot 43. However, before
we can finalize our review and issue a building permit we need to receive copies of the following items:
A. Soils Report — Please provide a digital copy of the soils report as referenced on the Structural plans.
B. Engineered Site Grading & Drainage Plan — Per the Final Plat for Filing 6, an Engineered Site Grading & Drainage
Plan is required prior to issuance of a building permit. As illustrated on the submitted site plans (Sheets A1.0 and
A1.2), site drainage located above the residence is shown to drain onto the driveway and towards the residence,
and there is not a drainage swale shown on the "high side" of the driveway to direct uphill drainage away from
the building. These items should be addressed on the Engineered Site Grading & Drainage Plan.
Please address these outstanding items at your earliest opportunity so that we can finalize our review and issue permits.

Thanks for sending over a copy of the soils report. For clarification, the Site Grading & Drainage Plan as referenced in
my prior email is required to be prepared by a Colorado licensed Professional Engineer (Civil Engineer) per Elk Springs
Filing 6 Plat Notes ... so it's not just a simple edit of your architectural site plan. We require (2) full-size copies
submitted to our office with the Engineer's wet seal stamp affixed so that we can insert into the plan set for approval.

The HOA may choose to enforce plat notes or not, but we simply do not have that discretion available to us. The Building
Department is charged with compliance with specific plat notes as shown on the final plats for many of the subdivisions
throughout the County. In effect, the final plat and plat notes contained therein are legal requirements under which
development within these subdivisions must comply.
Unfortunately, this specific requirement for an Engineered Site Grading & Drainage Plan applies to Elk Springs
properties and we can't simply disregard it. I would encourage you to always review final recorded plats (and plat notes)
of all subdivisions located within the County to become familiar with specific requirements that may apply, as these will
be verified by the Building Department during plan review.

Hi Dave,
Thanks for your comments and clarification on the site grading and drainage plan. Sounds like Garfield County
is enforcing plat notes, that the HOA is not enforcing. See email below for our Elk Springs approval status. We
were green lighted by the ARC.
My client's construction loan doesn't have a line item for a civil engineer because the HOA told us we didn't
need one, and it was not part of Garfield County's Building Permit Checklist. While I understand the position
you're in, this will significantly derail our schedule. Appreciate your consideration.

Plat Notes.'
1. Prior to the issuance of a building permit, the owner of each lot shall
prepare and submit a soils and foundation report, a grading and drainage
plan, and a geologically acceptable building site prepared and certified
by a professional engineer. All improvements she be constructed in
accordance with such engineering recommendations, which shall be a
condition of Los Amigos Ranch Architectural Control Committee approval and
the building permit.
2. The recommendations of the Colorado State Forester acid the Fire Chief as
set forth in the Supplemental Declarations dated September 28, 1992
et. seq. shall be followed in the construction of all structures.
3. All lots shall obtain central potable water service pursuant to agreement
with the Red Canyon Water Company or its successor in interest, the Los
Amigos Ranch Homeowners Association, Inc.
4. All lots depicted hereon lie within the Spring Volley Sanitation District
and shall obtain central sewer service pursuant to the Rules and Regulations
of the District.
5. Open hearth solid—fuel burning fireplaces are not allowed.
6. Each dwelling unit is allowed one dog.
7. Noxious weeds are the responsibility of the property owner.
8. The BLM has reserved mineral interests on the property and there
may be mineral extraction activities on the property in association
with these mineral rights,
9. Elk Springs Filing 6, a Subdivision of Los Amigos Ranch PUD, is part of the
Los Amigos Ranch Planned Unit Development as approved by the Board of County
Commissioners of Garfield County, Colorado, most recently on June 17, 1996
in Resolution No. 96-34, which is recorded in the records of Garfield County,
Colorado, on June 18 1996 as Reception No. 494584 in Book 982 at Page 103
The real property described on the within Final Plat is subject to all terms
and conditions of the Amended and Restated Declaration of Covenants, Conditions
and Restrictions for Los Amigos Ranch Planned Unit Development, recorded in the
records of Garfield County, Colorado, on February 15, 7991 as Reception No.
421306 in Book 799 at Page 48 and the Supplemental Declaration for Los Amigos
Ranch Planned Unit Development recorded in the records of Garfield County, Colorado, on
