RESOLUTION
WHEREAS, J. Randy Wilson and Robert L. Howsam have peti-
tioned the Board of County commissioners of Garfield County,
Colorado, for,.an exemption under C.R.S. 1973, 30-28-101(d) for the
division of a 50 acre tract into 4 tracts of approximately 5.1,
10..1, 10. and 15. acres, more or less, and more particularly de-
scribed on the attached Exhibits A, B, C and D.
WHEREAS, the Petitioners have shown to the satisfaction
of the Board of County Commissioners of Garfield County, Colorado,
that they desire said exemption for the purpose of re -sale into
single-family residential acreage, and
WHEREAS, Petitioners have demonstrated to the satisfaction
of the Board that there is a reasonable probability of locating
domestic water on each of said 5.1, 10.1, 10. and a5. acre tracts,
that there is adequate ingress and egress to said tracts, that
the location of septic tanks will be permitted by the Colorado
Department of Health, that the requested division is in accord-
ance with the general purposes and intent of the subdivision
regulations of the State of Colorado and the County of Garfield
and that said division will actually restrict the density of
housing within said area and should therefore be exempted from
the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S. 1973, 30-28-101(d).
NOW, THEREFORE, upon motion of /:

and unanimously carried said
50 acre tract of land is hereby exempted from such definition and
transfer of said tract may be made by division into 4 tracts of
5.1, 10.1, 10. ands. acres, more or less, all as is more fully
described in the Petition pertaining hereto. A copy of the
instrument or instruments of conveyance when recorded shall be
filed with this Resolution.
This exemption is granted upon the condition that Peti-

tioners have a survey made and metes and bounds descriptions of
the parcels described on Exhibits C and D within, months of
the date hereof and said description then attached hereto and
recorded with the original of this Resolution.

EXHIBIT "A"
A parcel of land situated in the E2SE4 of Section 32,
Township 5 South, Range 90 West of the 6th P.M., County of
Garfield, State of Colorado, and being more particularly de-
scribed as follows:
Commencing at a point on the northerly right-of-way line
of that certain parcel of land conveyed to the Board of County
Commissioners of Garfield County in a Deed recorded June 13,
1932, in Book 159 at Page 378 as Reception No. 112868, and the
intersection with the East line of the E2SE4 of said Section 32;
thence in a northerly direction and along said east line E2SE4
a distance of 600.00 feet to the true point of beginning; thence
on an angle to the left of 79°44'00" a distance of 430.00 feet;
thence on an angle to the right of 81°28'19" a distance of 396.81
feet, more or less, to a point on the southerly right-of-way line
of a county road as now constructed and in use; thence on an
angle to the right of 57°26'41" and along said right-of-way a
distance of 175.00 feet; thence on an angle to the right of
20°35'00" and along said southerly right-of-way a distance of
265 feet, more or less, to the point of intersection with the
east line of the ESE4 of said Section 32; thence on an angle to
the right of 100°14'00" and along said east line of the E2SE4
said Section 32, a distance of 610.00 feet to the true point of
beginning, containing 5.00 acres, more or less.

EXHIBIT "B"
A parcel of land situated in the ESE of Section 32,
Township 5 South, Range 90 West of the 6th P.M., County of
Garfield, State of Colorado, and being more particularly descri-
bed as follows;
Beginning at a point on the northerly right-of-way line
of that certain parcel of land conveyed to the Board of County
Commissioners of Garfield County in a Deed recorded June 13,
1932, in Book 159 at Page 378 as Reception No. 112868 and the
intersection with the east line of the ESE4 of said Section 32;
thence in a westerly direction and along said northerly right-of-
way line a distance of 645.00 feet; thence on an angle to the
right of 81°47'46" and in a northerly direction a distance of
843.59 feet, more or less, to a point on the southerly right-of-
way line of a county road as now constructed and in use; thence
on an angle to the right of 57°07'14" and along said southerly
right-of-way line a distance of 225.00 feet; thence on an angle
to the right of 122°33'19" a distance of 396.81 feet; thence on
an angle to the left of 81°28'19" a distance of 430 feet, more or
less, to a point on the East line of the ESE4 of said Section
32; thence on an angle to the right of 79°44'00" and along said
east line a distance of 600 feet, more or less, to the point of
beginning; containing 10.00 acres, more or less.
EXHIBIT "C"
All that part of the EZ of the SWC of Section 32, Tp. 5
S., R. 90 W., 6th P.M., County of Garfield and State of Colorado,
which lies northerly of the right-of-way line of that certain
parcel of land conveyed to the Board of County Commissioners of
Garfield County in a deed recorded June 13, 1932, in Book 159
at Page 378 as Reception No. 112868, containing approximately
50 acres, except for the following:
1. That part described on Exhibit "A."
2. That part described on Exhibit "B."
3. That part lying northerly of the road through
the property being the same road which crosses
the easterly boundary at a point which is
approximately feet south of the north-
east corner of said E2 of the SWC and crosses
the westerly boundary at a point which is
approximately feet south of the north-
west corner of said EZ of the SWC.

EXHIBIT "D"
All that part of the E2 of the SWC of Section 32, Tp. 5
S., R. 90 W., 6th P.M., County of Garfield and State of Colorado,
which lies northerly of the right-of-way line of that certain
parcel of land conveyed to the Board of County Commissioners of
Garfield County in a deed recorded June 13, 1932, in Book 159
at Page 378 as Reception No. 112868, containing approximately
50 acres, except for the following:
1. All parcels described on Exhibits "A", "B" and "C"
hereto.
