Zz g=o_ /arrEXEMPTIONAPPLICABILITYThe Boa¡d of County Commissioners has the discretionary po\Ã/er to exempt a division ofland from the defi¡ition of subdivision ancl thereby from the procedure in these Regulations,provided the Board ,jeiernrines rhar such exelnption wiil not impair or defeat the statedpurpose of the Subdivision Regulations nor be detrimental to the general public welfare. TheBoard shall make exemption decisions in accordance with the requirements of theseregulations. Following a review of the individual facts of each application in light of therequirements of these Regulations, the Board may approve, conditionally approve or denyan exemption. An application for exemption must satis&, at a minimum, all of the reviewcriteria listed below. Compliance with the review criteria, however, does not ensru'eexemption. The Board also may consider additional factors listed in Section 8:60 of theS ubdivision Regulations.A.No more than a total of four (4) lots, parcels, interests or dwelling units will becreated from any parcel, as that parcel was described in the records of the GarfieldCountv Clerk and Recorder's Office on January l, 1973. In orderto qualifu forexemption. the parcel as it existed on January l. 1973, must have been 35 acres orgreater in size at that time and not a part of a recorded subdivision, however, anyparcel to be divided by exemption that is split by a public right-of-way (State ofFederal highway, County road or railroad), preventing joint use of the proposed tracts.and the division occurs along the public rìght-of-way, such parcels thereby createdmay. at the discretion of the Board, not be considered to have been created byexemption with re-eard to the four (4) lot, parcel, interest or dwelling unit limitationotherwise applicable. Asingle family house occupies the property. The owner of the property, Mr. Wallace Thatcherintends to convey the property on north side of the Sweetwater Road to his soq James. JimThatcher intends to construct a house on this land. Attached is a deed showing the parcel was inexistence prior to 1973.As referenced above, the property is split by the Sweetwater Road (Garfield County Road 150).The proposed split of this property will be along this roadway. As part of the title research donein preparing this application, a Road Viewers Report filed in the County Clerk's Office inSeptember 24,1895, includes a reference to a 60 foot strip of land taken by the county from thegovernment for the purpose of the Sweetwater Road. See attached record. The proposedexemption plat would rededicate this 60 foot wide rigtrt ofway to Garfield County. 'We believethat this subdivision request is processed as an Exemption.The property is suitably zoned for the intended use for a single family residence. There is areasonable location on the property to construct a house without undue earthwork and the landpossesses no hazards related to its intended use. Although the property is not located within theGypsum Fire District, the district does respond to calls in this area on a pay for service basis. AllFire Trucks responding to fires in this area carry 2,000 gallons of water and have equipment topump out of nearby water sources. Sweetwater Creek is located on Lot 1, approximately 500feet from the proposed house location.There is a ditch running across the property. IvIr. Thatcher owns water rights in the ditch whichhe has used to irrigæe meadows his meadows. 'We have applied to the Colorado Division OfWater resources for a "Household Use Only''well permit.
