Assistant County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 7010 -03 A RESOLUTION CONCERNED WITH THE APPROVAL OF AN EXTENSION FOR THE LAND USE CHANGE PERMIT FOR THE HIGH MESA RV PARK TO COMPLETE REQUIRED CONDITIONS OF APPROVAL TO DECEMBER 31, 2020 Parcel ID: 2407-193-00-189 (RV Park Site) 2407-193-00-162 (Daybreak Realty, LLC) 2407-244-00-124 (James and Monique Speakman) Recitals A. On September 21, 2009, the Board of County Commissioners of Garfield County (the Board), Colorado, approved with conditions a Land Use Change Permit Application submitted by High Mesa Partners, LLC, Daybreak Realty, LLC and James and Monique Speakman (the Applicant) to construct a 119 space RV Park as memorialized in Resolution 2009-72. B. The subject property is located off a well pad access road off CR 300, approximately 1 mile south of Battlement Mesa Planned Unit Development (PUD). C. On May 16, 2011, the Board approved a second 1 -year extension to September 21, 2012 as approved in Resolution 2011-30. E. On August 20, 2012, the Board approved a third extension of 2 years to September 21, 2014 to meet the required conditions of approval as approved in Resolution 2012-77. F. On September 15, 2014, the Board approved a fourth extension of 1 year to September 21, 2015 to meet the required conditions of approval as approved in Resolution 2014-54. G. On September 21, 2015, the Board approved a fifth extension of 2 years to September 21, 2017 to meet the required conditions of approval as approved in Resolution 2015-55. 1-1. On September 5, 2017, the Board approved a sixth extension to December 31, 2018 to meet the required conditions of approval as approved in Resolution 2017-42. I. On October 15, 2018, the Board approved a seventh extension to December 31, 2019 to meet the required conditions of approval as approved in Resolution 2018-54. J. Consistent with Section 4-101(I)(1) and (3) of the Land Use and Development Code, as amended, the Applicant submitted a request on the 26th of November for an eighth extension to meet the required conditions of approval. K. On December 16, 2019, the Board considered a request from the Applicant for an eighth extension to meet conditions of approval for the High Mesa RV Park to December 31, 2020 upon the question of whether the request should be granted, granted with conditions, or denied at which meeting the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Application. L. The Board of County Commissioners closed the public meeting on December 16, 2019, to make a final decision. M. The Board, on the basis of substantial competent evidence produced at the aforementioned public meeting, has made the following determination of facts. 1. Proper public notice was provided as required for the public meeting before the Board. 2. The public meeting before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted and all interested parties were heard at those hearings. 3. The request for an extension was properly set and heard before the Board pursuant to Section 4-101(I)(1) and (3) of the Land Use and Development Code, as amended. The additional extension has been determined to be in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. RESOLUTION NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that: A. The forgoing Recitals are incorporated by this reference as part of the Resolution. B. An extension to complete conditions of approval for a Land Use Change Permit for the High Mesa RV Park is approved and the new deadline for completion of conditions of approval shall expire on December 31, 2020.
