In our January 9, 2001 letter we introduced a water supply plan in which we used Roaring
Fork Preserve Well #8 to show that an adequate water supply was available. Since then
nine more wells, one for each lot and a fire wells have been drilled and tested. The
purroo is o present the results of these investigations. Information
contained in this report covers estimated future domestic water uses, the pump test results
for Wells #1-9A and the fire well; the well construction details; the Basalt Water
Conservancy District contract and the water quality data. A property location map is
attached as Figure 1. The pertinent information for each well is contained in separate
sections of this report.
Water Requirements
Table 1, attached, presents the estimated diversions and consumptive use for the
proposed Roaring Fork Preserve Subdivision. The nine lots will be supplied by one well
for each lot. We have assumed that each of the 9 residences and 4 ADUs will be
occupied by 3.5 people using 100 gallons of wafer per person per day. Water will be
diverted to irrigate up to 7500 square feet of !awn at each residence and each ADU from
the wells. We have included a total of 18 livestock units and 0.5 acres of pond surface
evaporation in the water service plan.
A Fire Well has also been drilled and tested. It will supply the fire protection system which
is to consist of three 10,000 gallon buried storage tanks, a pump and a hydrant.
Legal Supply
Attached is a copy of the existing Basalt Water Conservancy District contract. The
approximate locations of the 10 wells are shown on Figure 1. The well permits for each
well are attached. Well #8 was originally permitted as a monitoring hole. 1t has been
converted to a fee well. The permit for this change is attached for your reference.
Roaring Fork Preserve Wells #1 - #9A and the Fire Well
The attached Table 2 is a summary of the well information. All of the Roaring Fork
Preserve Wells were drilled by the Shelton Drilling Corporation. The wells are located in
the Sections 35 and 36, Township 7 South, Range 88 West of the 6th P.M. The total depth
of the wells range between 36 and 102 feet. They were generally drilled through the
Quaternary Roaring Fork River alluvial material and into the top of the Pennsylvanian Eagle
Valley Formation. We have attached the well construction reports by Shelton Drilling and
figures (Figures 1W - 9W) to illustrate the well construction details.
Pump Test Results
The pump tests were conducted between December 5, 2001 and December 13, 2001,
except for Well #8, which was tested on January 3 and 4, 2001. All wells except the Fire
Well were tested by Samuelson Pump Company utilizing electric submersible pumps
powered by a portable generator. The pump tests were conducted at rates between 10.3
and 15 gallon per minute (gpm). All tests were 4 hour tests as required by the County,
except Well #8, which was tested for 24.5 hours. The drawdown and time data collected
during the tests are presented in Tables T1 - T9. We have plotted the results of the tests
in drawdown vs. time curves as shown on the attached Figures D1 - D9.
Recovery data for the wells following the pump test were collected and are presented along
with the drawdown data in Tables T1 - T9. Figures R1 - R9 are graphs of the recovery
data, showing recovery as residual drawdown. Based on the residual drawdown curves,
all the wells displayed normal recovery characteristics.
Conclusions
The tests indicate that the wells will be able to operate for extended periods at their
respective test rates. We believe that each well will be adequate to serve a single family
residence and an associated dwelling unit on lots 5, 6, 7, and 8.
Water Quality
Water samples were collected from Well #8 during its pump test and sent to Grand
Junction Laboratories for analysis for Nitrates/Nitrites, coliform bacteria, inorganic
chemicals and various physical parameters. Results of the laboratory tests showed that
the water, although considered "hard", is well below the Maximum Contaminant Levels
(MCLS) for all the parameters tested.
Water samples from Wells #1 - #7 and Well #9A have been tested for nitrates / nitrites by
Hazen Research, Inc. of Golden, Colorado. Nitrates / nitrites for all of the wells yielded
values well below the MCL of 10 mg/I. The wells were also tested for coliform bacteria by
the State Laboratory in Grand Junction. The bacteria tests for all of the wells indicated that
coliform bacteria were absent from the samples. Results of the analyses are summarized
below and copies of the lab results are attached in each well's section of this report. We
recommend that the wells and associated water system components receive a final
disinfection prior to human consumption of the water.

Waste Water Disposal
It is proposed that the waste water requirements for the subdivision wiil be met through the
use of ISDS systems. The water supply wells and the leach fields will be located to provide
the maximum amount of separation.

ORDER GRANTING APPLICATION FOR ALLOTMENT CONTRACT
ROARING FORK PRESERVE, LLC
CONTRACT NO. 367
Application having been made by or ort 5ehaif of :.oaring Fork Preserve. LLC and hearing
on said Application having been duly held, it is hereby ordered that said Application be granted and
that the attached Water Allotment Contract for 0.33 cubic feet of water per second (150 gpm) from
the District's direct flow rights and 3.5 acre feet per year of storagelaugmentation water owned or
controlled by the District is hereby approved and executed by and on behalf of the Basalt Water
Conservancy District, for the beneficial use of the water allotted in the attached Contract. upon the
terms. conditions and manner of payment as therein specified and subject to the following specific
conditions:
1. The Applicant has acknowledged that the Iand to be benefitted by the attached
Contract is described on Exhibit "A" attached hereto and incorporated herein by this reference.
The Applicant shall establish a Homeowners Association or other entity acceptable
to the District for the ongoing payment of charges due under the approved Contract following
subdivision of the property (see Exhibit A hereto). The Applicant shall give notice to purchasers of
all or any part of the subject property of the obligation of this Contract, and shall record such notice
in the records of the Clerk and Recorder of Garfield County, Colorado. Applicant and his successors
and assigns shall comply with all rules and regulations now existing or hereafter adopted by the
District, including to enibrce payment of charges due under the approved Contract by present and
future owners of all or any part of the real property served under this Contract.
3. The Appiicant shall provide the District proof that the proposed land use of the land
to be benefitted by the water allotted hereunder has been approved by the applicable governmental
authorities having jurisdiction over such land use. including evidence satisfactory to the District that
each lot or parcel to be benefitted hereunder is legally subdivided.
4. Any well permits issued on the basis of this Allotment Contract shall be applied for
and issued in the name of the Applicant or the Homeowners Association (see paragraph : hereof).
By acceptance of this Contract. Applicant acknowledges that within two years of the
date hereof or such later date as the District may approve. the Appiicant shall tile with the Water
Court of Water Division No. 5 a water rights pian of augmentation for utilization of water allotted
hereunder at the location and for the purposes hereinabove set forth, or the Applicant's water
allotment as provided in this Contract may be included in a water rights plan of augmentation to be
tiled by the District with the expenses thereof to be shared prorata by the Contract holders included
in such plan: provided that inclusion of the Applicant's water allotment in the District's plan of
augmentation shall be at the District's sole discretion.
In the event the District includes the Applicant's water allotment in the District's Application
for a plan of augmentation, Applicant will provide such information and assistance, including
testimony, as may be needed for judicial approval of he pian. The District makes no warranty that
it will secure approval of the plan. The District may establish an augmentation plan fee to be paid
by the holder of any Contract or amended Contract to be included within a plan of augmentation to
be filed by the District, which fee shall be payable in advance of the inclusion of such Contract in
a District plan of augmentation and may be based on the District's good faith estimate of the
anticipated expense of such plan of augmentation. If such augmentation plan fee paid by a Contract
holder exceeds the Contract holder's prorata portion of the actual expenses incurred by the District
in completing said plan of augmentation, the District shall refund such excess to the Contract holder.
Conversely, if such augmentation plan fee paid by the Contract holder does not cover the Contract
holder's prorata portion of the actual expenses incurred by the District in completing said plan of
augmentation, then Applicant shall pay the remaining balance of its portion of the actual expenses
upon the District's providing the holder with a statement for the same. To the extent that the District
is caused additional costs because of objections filed specifically due to the inclusion of Applicant's
Contract in the tiling, such additional costs may be charged specifically to Applicant and not shared
on a prorata basis by all Contractees.
However, by acceptance of this Contract, Applicant acknowledges that it shall be responsible
for any adjudication of the water right associated with the Applicant's pond, if it is determined that
the structure is a water storage r-ight ("pond") rather than a well. The Contract allots
storageiauatnentation water of the District to augment evaporative losses from the surface area of
the structure. but the Applicant acknowledges that the District will not be responsible for
adjudicating a water right or priority date for the pond in any future water rights plan of
augmentation tiled by the District. In its sole discretion, the District may include the augmentation
of the evaporative losses from the pond in a future augmentation plan filing (as above described),
but only after the Appiicant provides the District with a decree of court which adjudicates the water
right and priority associated with the pond. In the event that the District includes the augmentation
of the evaporative losses in a future augmentation plan filing, the Applicant shall pay the District's
costs associated with the plan as above described).
6. Any and all conditions imposed upon the release and diversion of water allotted
hereunder in any water rights plan of augmentation or other water rights decree of the Water Court
for Water Division No. 5 shall be incorporated herein as a condition of approval of this contract.
Granting of this allotment contract does not constitute the District's representation that the Appiicant
will receive a well permit or water rights decree for the land to be benefitted hereby.
7. If Applicant intends to divert water through a weil or wells. Applicant shall provide
the District a copy of Applicant's valid well permit for each such well before the District is obligated
to deliver water for the benefit of Applicant hereunder. Applicant must comply with the weil-
spacing requirements set forth in C.R.S. §37-90-137, as amended. if applicable. Compliance with

said statutory well -spacing criteria shall be an express condition of the extension of service
hereunder. and the District shall in no way be liable for an Applicant's failure to comply.

MEMORANDLI.OF WATER ALLOTMYIENT CONTRACT
The Basalt Water Conservancy District (the "District") has granted Water Allotment
Contract No. 367, dated the 17th day of July, 2000, ("Contract"), to extend to the owner4.$) of the real
property described on Exhibit "A" attached hereto and incorporated herein by this reference, the right
to beneficially use water or water rights owned. leased, or hereafter acquired by the District for such
real property Iocated in the County of Garfield, State of Colorado.
The Contract is subject to various conditions which may include well permit requirements
of the Colorado Division of Water Resources and Water Court approval of an augmentation plan or
substitute supply plan. Assignment of the Contract requires the District's consent and Applicant's
payment of an assignment fee.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water nght or preclude another owner of a vested
water eight from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2. unless approval
of a variance has been granted by the State Board of Examiners of Water 'Nell Construction and Pump Installation
wntractors in accordance with Rule 18,
3) approved pursuant to CRS 37-90-137(2) for the construction of a weil, appropriating ground water Tributary to the Roaring
Pork River, as an alternate point of diversion to the Baseit Conduit, on the condition that me wail shall be operated only
when the Basalt Water Conservancy District's Substitute water supply plan, approved by the State Engineer. :s in effect and
when a water allotment contract between the well owner and the 3asalt Water Conservancy District for the release of
repiacement water from Rueoi Reservoir in effect, or under an approved plan for augmentation. BWCD contract 1f-367.
4) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family dwelling, the
irrigation of not more than 7,500 square feet of gardens and lawns, and the watering of two head of livestock. All use of
this
well will be curtailed unless the water allotment contract or a plan for augmentation is in effect. This well is known as
ELS # 1.
5) The maximum oumoing rate o1 this weir sealf not exceed 15 GPM.
6) The average annual amount of ground water to be appropriated snail not exceed 0.89 ace•foot.
7) The owner shalt mark :me well in a conspicuous place with well permit numberls), name of the aquifer, and court case
number(s) as appropnate. The owner shall take necessary means and precautions to preserve these markings.
3) This well snail be constructed not more tnan 300 feet from the location specified on this permit.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance nas been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well. appropriating ground water tributary to the Roaring
F=ork River. as an alternate point of diversion to the Basalt Conduit, on the condition that the well shall be operated only
when the Basalt Water Conservancy District's substitute water supply plan, approved by the State Engineer, is in effect and
wnen a water allotment contract between the well owner and the Basalt Water Conservancy District for the release of
replacement water from Ruedi Reservoir is in effect, or under 3n approved plan for augmentation. 3WCD contract #387.
4! The use of ground water from this well is limited to ordinary household purposes inside one (1) single famity dwelling, the
irrigation of not more than 7,500 square feet of gardens and lawns, and the watenng of two head of livestock. Alt use of
this well will be curtailed uniess the water allotment contract or a plan for augmentation is in effect. This well is known as
WELLg2.
5) The maximum pumping rate of this well shall not exceed 15 GPM.
8) The average annual amount of ground water to be appropriated shall not exceed 0.89 acre-foot.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water lights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well spall be in compliance with the Water Well Construction Rules 2 CCR 402-2. unless approval
of 3 variance has been granted by the State 3oaro of Examiners of Water Well Construction and Pump installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well. appropriating ground water tributary to the Roanng
Fork River. as an alternate point of diversion to the Basalt Conduit, on the condition that the well shall be operated only
when the Basalt Water Conservancy District's substitute water supply pian, approved by the State Engineer, is in effect and
when a water allotment contract between the welt owner and the Basalt Water Conservancy Oistrict for the release of
replacement water from Ruedi Reservoir is in effect. or under an approved pian for augmentation. SWC contract 367.
a1 The use of ground water from Itis well is limited to ordinary housenold purposes ;reside one (11 single family dwelling, the
irrigation of not more than 7.500 square feet of gardens and lawns, and the watsnng of two need of tivestocx. All use of
this well wilt be curtailed unless the water allotment contract or a. plan for augmentation is in affect. This well is known as
WELL 4.
5) The maximum oumping rate of this well shall not exceed 15 GPM.
8) The average annual amount of ground water to be appropriated shall not exceed 0.89 acre-foot.
7) The owner shall mark the well in a conspicuous place with well Permit riumberis), name o1 the aquifer. and court case

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water nght from seeking relief in a civil Court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2. unless approval
of a variance has peen granted by the State 3oarc or Examiners of Water Welt Construction and Pump Installation
Contractors in accordance with Rule 18.
3) approved pursuant to CRS 37-90-137(2) for the construction of a well. appropriating ground water tributary to the Roaring
Fork River, as an alternate point of diversion to the Basalt Conduit, on the condition that the well snail be operated only
when the Basalt Water Conservancy District's substitute water supply plan, aoproved by the State Engineer, s in effect and
when a water allotment contract between the well owner and the Basalt Water Conservancy District for the release of
rsplacement water from Rued Reservoir is in effect, or under an approved plan for augmentation. 3WCD contract 4367.
4) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family dwelling and
an accessory dwelling unit. the irrigation of not more than .7,500 square feet of gardens and lawns, and the watenng of two
head of livestock. All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in
effect. This well is known as WELL At 5.
5) The maximum dumping rate cf this well shall not exceed '5 GPM.
6) The average annual amount of ground water to be appropnated snail not exceed 1.23 acre-feet.

The owner shall mark the well in a conspicuous glace with well permit numberts), name of the aquifer, and court case
numoer(s) as aoprooriate. The owner shall take necessary means and precautions :o Preserve these markings.
3) This welt snail be constructed not more than 200 feet from the location specified on this permit.
9) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annuaily) and submitted to the Division Engineer upon

CONDITION$ OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does riot assure the applicant that no injury will occur to another vested water right or preclude another Owner of a vested
water right from seeking relief In a civil tour action.
2) The construction of this well shall be in cprnoliance with the Water Weil Construction Rules 2 CCR 402-2. unless approval
of a variance ras been granted by the State board of Examiners of Water Well Construction and Pump installation
Contracxrs in accordance with Ruler 8.
3) Approved pursuant to CRS 37-90-137(2) for the construction of a well. appropriating ground water tributary to the Roaring
Fork River. as an alternate point of diversion to the Basalt Conduit, on the condition that the welt snail be operated only
when the Basalt Water Conservancy District's substitute water supply plan, approved by the State Engineer, is in effect and
when a water allotment contract between the well owner and the Basalt Water Conservancy District for the release of
replacement water from Ruedi Reservoir is In effect, or under an approved clan for augmentation. SWCD contract #367.
4) '"he use or ground water from this well is limited to ordinary household ourcoses inside one (9) single famiiy swelling and
an accessory dwelling unit, the irrigation or not more than 7.500 square feet of gardens and lawns. and the watering of two
head of livestock. All use of this well will be curtailed unless the water allotment contract or a plan for augmentation is in
effect. This well is known as WELL 7.
5) The maximum pumping rate of this well shall riot exceed 15 GPM.
6) The average annual amount of ground water to he appropnated shall not exceea 1.23 acre-feet_
7) The owner snail mark the well in a conspicuous place with weal permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shalt take necessary means and precautions to preserve these marxings.
g) This well shat) be constructed not more than 200 feet from the location specified on this permit.
9) A totalizing clow meter must be installed on this well and maintained in goon working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the iJiyisldn Engineer upon
request.
