HomeMy WebLinkAboutDirector's Determination 02.05.2020Garfield County February 5, 2020 Chuck Cole 2321 County Road 100 Carbondale, CO 81632 DIRECTOR DETERMINATION — Charles W Cole III Revocable Trust Secondary Dwelling Unit (File No. GAPA-12-19-8766) Dear Mr. Cole, This letter is provided to you, as the authorized representative for Garfield County File GAPA-12-19-8766 pertaining to the Land Use Change Permit for a Secondary Dwelling Unit (SDU). This letter is notification that your request for approval to construct an SDU has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request. The conditions of approval are as follows: Conditions to be Satisfied Prior to Issuance of the Land Use Change Permit: 1. Prior to issuance of the Land Use Change Permit, the Applicant shall submit to the County the following for the well serving the SDU: a. A current pump test that meets the standards in Section 4- 203(M)(1)(b)(5)(a). The pump test shall include representation by a qualified professional that the pump rate is adequate for the proposed use. 2. Prior to issuance of the Land Use Change Permit, the Applicant shall provide documentation in conformance with the specific standards of Policy 01-14 Waivers for Roads and Demonstration of Compliance. Or, alternatively, the applicant may choose to upgrade the current driveway to meet the County Roadway Standards contained in Section 7-107 and Table 7-107 LU&DC. The applicant will be required to provide documentation by a professional engineer that all driveway improvements have been made in conformance with the County Roadway Standards Section 7-107 and Table 7-107 LU&DC. 1 Operational Conditions' 3. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 4. At time of building permit, the Applicant shall submit a statement from a qualified professional indicating the feasibility of an Onsite Wastewater Treatment System for the SDU. 5. At time of building permit, the Applicant shall submit a grading and drainage plan from a qualified professional verifying that the proposed grading and drainage is practical. 6. A detailed, scaled site plan shall be submitted with the Building Permit illustrating. that the proposed parking meets the standards of Section 7-302 LU&DC. 7. The SDU shall be subject to all Garfield County Building Code Requirements. The property owner shall obtain all necessary Garfield County Building Permits for new construction, modifications and/or expansions to the structure. 8. The property owner shall obtain a Garfield County Onsite Wastewater Treatment System (OWTS) permit prior to installation of the system. 9. Any new fencing on the property shall comply with the Colorado Parks and Wildlife specification for wildlife -friendly fencing. 10.AII exterior lighting shall be downcast and shielded and comply with Section 7-304, Lighting Standards, of the Land Use and Development Code of 2013, as amended. 11.The Applicant shall comply with all Additional Standards for Residential Uses contained in Section 7-701.B, Secondary Dwelling Units, of the Land Use and Development Code of 2013, as amended. Notice of this decision will be provided to the Board of County Commissioners who has the ability to `call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period (February 16, 2019).
