RE: Director's Decision Central Aggregates Floodplain Development Permit
(File No. FDPA-10-19-8758)
Dear Mark:
This letter is sent to you as the representative for the Central Aggregates Floodplain
Development Permit, for property located at 25028 Hwy. 6 & 24, Rifle, CO 81650. The
Application requested approval for placement of a Manufactured Office and related
infrastructure within a portion of the 100 year floodplain on the property. The site is also
known by Assessor's Parcel No. 2177-171-00-044.
The Director's Decision on the Application is based on the following findings:
1. That proper public notice was provided as required for the Director's Decision.
2. Consideration of the Application was extensive and complete, that all pertinent
facts, matters and issues were submitted and that all interested parties were given the
opportunity to provide input prior to the Director's Decision.
3. That for the above stated and other reasons the proposed Central Aggregates
Floodplain Development Permit for an office facility and supporting infrastructure is in the
best interest of the health, safety, convenience, order, prosperity and welfare of the
citizens of Garfield County.

4. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That with the adoptions of conditions the application has adequately met the
requirements of the Garfield County Land Use and Development Code, and Floodplain
Development requirements, as amended.
The Director's Decision is hereby issued approving the Central Aggregates Floodplain
Development Permit for an Office Facility and supporting infrastructure, subject to the
following conditions:
1. That the Applicant comply with all Federal Emergency Management Agency
(FEMA) requirements, Army Corp of Engineers Requirements and Floodplain
Development requirements of the Garfield County Land Use and Development Code
applicable to the proposed development.
2. That all representations made by the Applicant in the application, including the
Floodplain Report prepared by Sopris Engineering, dated October 16, 2019 shall be
conditions of approval unless specifically altered by the conditions of approval contained
herein.
3. The Applicant shall comply with the following conditions consistent with the referral
comments from the County's consulting engineer, Michael Erion with Resource
Engineering, dated January 21, 2020:
a. Prior to issuance of the building permit for the proposed office use, the Applicant
shall provide an updated anchor design with a current Colorado PE stamp.
b. After the new office building is constructed, a final as -built Elevation Certificate
shall be submitted to the County.
4. That the Applicant shall include a copy of the pre -construction elevation certificate
with the Building Permit Application and shall survey the foundation elevation prior to
installation of the office to insure the proper elevation.
5. The Applicant shall comply with the following conditions at the time of building
permit submittal, consistent with the referral comments from the County Chief Building
Official, Andy Schwaller and Anna Cochran, County Environmental Health:
a. That the Septic Tank anchoring and overall installation will need to be designed by
a licensed professional engineer as per the OWTS Regulation 43.8K for use of the system
in a floodplain. Compliance with all County Permitting shall be required including but not
limited to Section 43.8.K and 43.12.0 of the County's OWTS Regulations.

b. The office structure shall meet Section 1612 of the 2015 IBC for flood mitigation.
Specifically, Section 1612.5 shall require a professional engineer to design the foundation
for the modular office at a minimum finished floor elevation with flood flow through or flood
proofing of the structure.
c. The modular office structure shall meet the minimum requirements of the County
and the Division of Housing requirements for a non-residential or commercial
manufactured unit.
6. Connections to the City of Rifle Water system shall comply with all City
requirements and permitting and shall be designed to be watertight and resistive to
impacts from floodwaters and high groundwater.
7. At the time of Building Permit submittal, the Applicant shall provide an evacuation
plan for posting in the office that includes procedures for shutting down the OWTS Holding
Tank System in the time of a flooding event.
8. The Applicant shall maintain compliance with the existing Gravel Pit Special Use
Permit and all conditions associated with that approval.
9. Consistent with the Application submittals, the Applicant shall not impact any
wetland areas and shall maintain compliance with Land Use and Development Code, 35
ft. water body setback.
This Director's Decision will be forwarded to the Board of County Commissioners for a
period of 10 days so that they may determine whether or not to call up the application for
further review. Once this time period has passed with no request for review or public
hearing, and provided all relevant conditions of approval have been met the Floodplain
Development Permit will be issued. Pursuant to the Land Use and Development Code,
the Applicant has one year from the date of the Director's Decision to satisfy all conditions
of approval or request an extension.

Hi All: I will proceed to get the floodplain permit recorded and provide a copy to the Applicant and the Building
Department. I've attached the Director's Decision Letter with all relevant conditions a couple are required at the time of
building permit (updated engineer stamp on achoring, evacuation plan, include pre -construction elevation certificate,
and a number of Andy Schwaller referral comments in condition #5). Thanks for the good news Brooke. That is the

I just received payment for the floodplain development engineer referral review from William Lee in
the amount of $1,416.50. They are now paid up in full and we are good continue the review of their
building permit application.
