you or your Structural Engineer provide us with this information?

Mr. and Mrs. White:
New information has recently come to our attention regarding your new single-family residence located at Panorama
Ranch — Homestead 13, and given the nature of this new information the Building Dept. is left with no choice but to
issue a "Stop Work" order on your project until the issue as described below is resolved.
The Building Department's approval of your building permit was based on a representation illustrated on the site plan
contained in your application. The site plan referenced Resolution 87-1, a recorded document (Reception #451659
dated 8/25/1993) that granted approval by the Panorama Ranches Homeowner's Association allowing placement of a
home on Homestead 13 within an existing 100 -foot "Conservation & Equestrian Easement" which is located generally at
the north end of Homestead 13. This recorded document does not satisfy the legal requirements of Amending the Final
Subdivision Plat for Homestead 13 to reflect this modification to the easement across your property.
In order to rectify this problem, we suggest you make an appointment with one of our planners who can guide you
through the "Amended Final Plat" process to complete the outstanding legal requirements which can ultimately allow
you to build within this easement. My suggestion is for you to contact Glenn Hartmann, our Planning Manager, who can
assist you in understanding the approval process and associated timeline for completing an Amended Final Plat for
Homestead 13, which subsequently will then allow you to proceed with construction.
We appreciate your understanding and cooperation on this matter and look forward to helping assist you through the
Amended Final Plat process. Please contact myself or Glenn Hartmann — who I have copied on this correspondence — if
you have any questions or would like to set up a Pre -Application meeting with Glenn to discuss the next steps in the
approval process.

A RESOLUTION OF THE PANORAMA RANCHES HOMEOWNER'S
ASSOCIATION GRANTING A VARIANCE TO THE PROTECTIVE
COVENANTS OF THE PANORAMA. RANCHES SUBDIVISION
Whereas, the Board of Directors of the homeowner's
association has the authority to grant a variance to
the covenants and;
Whereas, section # 34 of the subdivision covenants
recorded with Garfield' County, Colorado in'Book 536
Page 809 allows for variances from compliance with any
of the terms or provisions of the covenants and;
Whereas, due to the topography and natural
obstructions on lot # 13 a variance is justified and;
Whereas, on July 5, 1987 the Board of Directors
held a board meeting and unanimously approved a
variance;
Therefore, be it resolved that a variance has been
granted to lot # 13 to allow for encroachment into the
equestrian and conservation easement be granted upon
the following conditions:
1) That the encroachment not exceed 40 feet in
depth (north to south) by 150 feet in width (east to
west).
2) That the following described property:
A parcel of land beginning at the NW corner of
homestead 12, thence N. 53 45' 00" E. 56.64 feet to the
south boundary of Buck Point Road right of way; thence
easterly along said south right of way boundary to a
point due north of a point' 150 feet west of the NE
corner of homestead 13; thence west along the north
boundary line of homesteads 13 and 12 a distance of
571.15 feet to the point of beginning.

Good morning Dave and Glenn. As the HOA Board's consultant to the Architectural Control Authority (ACA),
the purpose of this email is to report to you the progress that has been made regarding the proposed
development for Lot 13, owner Martin White. The ACA and the HOA Board met on site last Friday, September
7, to review the proposed development, consider the flagged property boundaries, flag poles, model, plan set,
and exterior materials and colors. Several neighbors were in attendance as was the contractor, Mr. White and
myself.
The Board and the ACA considered the proposed location of the home and the topography. They also
discussed the County's requirement to submit a plat amendment application in order for the house to be built
in the proposed location given the equestrian easement. And the fact that the County has issued a Stop Work
Order.
Mr. White requested the ACA to approve his project as proposed with the condition that he pursue the plat
amendment. In addition, Mr. White asked the ACA and the Board to consider supporting his effort to get his
project moving along while he pursued the plat amendment rather than holding up the project until the plat
amendment was approved and an amended plat recorded.
The ACA considered Mr. White's request and approved his project with the condition that he must meet all
County requirements to amend the plat and record the amended plat. Mr. White must provided a copy of the
amended plat to the ACA once recorded.
Subsequent to that meeting, the HOA Board approved Mr. White's request to allow him to request the County
lift the Stop Work Order and let him proceed with construction while at the same time pursue his plat
amendment submittal
The HOA Board and the ACA realize that their recent decisions do not negate any neighbor from seeking an
appeal of the ACA decision per Section 14 of the CC&Rs. Or prevent anyone noticed of this amended plat
application from addressing their concerns via the County's review process. The ACA and the HOA Board
understand that Mr. White, if he elects to start construction prior to recordation of an amended plat, does so
at his own risk.
The HOA Board wants to make sure that they are notified via the public notice requirement of the submitted
application. Please send any public notice for the HOA Board to:

Sorry to be a pain about this. Do you have a deed, title commitment, or written easement agreement with the owner of
the property? The easement should show up in your closing information for the lot. We cannot trespass across a lot to
do inspections. Worst yet is to do the work and have the present or future owner of the property sue you for
trespassing.

Andy, thank you for your response. After speaking with my surveyor about this 30 foot access area, I am lead to believe
that in revising the final plat to meet resolution 87-1 that we should have what the county would require then. This is all
so very confusing to me , and I'm just grateful for all you guys are doing to help me get through this. With that said, I
sent an email with all the above attachments asking Glen Hartmann to review and let me know if this was sufficient info
to accomplish this amended or revised final plat, that would cover these issues. I'm really willing to do whatever I have
to here, I just need you guys to let me know if I need more than what's here please?

Glen,
I am representing Hank and Barb Borkowski, the owners of the property adjoining Homestead 13, about
the proposed house. I was President of the HOA in 1987 when we passed a resolution granting a
variance to the Equestrian/Conservation easement for Homestead 13. It is my understanding through
the grapevine that Garfield County is requiring a plat amendment to consider an encroachment on the
easement because it is shown on the final plat and that a "stop work order" has been issued to the
owner or builder. The Borkowski's object to the proposed house location and have filed an appeal with
the Panorama Board of Directors. I am trying to get up to speed on what the County is requiring and the
status of a plat amendment application if there is one. Please let me know what is going on with all this
so I can let the Borkowski's know.

Thanks for your email ... Glenn had informed me that you have now completed all requirements for the Amended Final
Plat for Lot 13 in Panorama Ranches. As a result, the Building Dept. has lifted the "Stop Work" order which was issued on
Sept. 7, 2018 for this property.
