Hey Patrick:
I've got a building permit from August Teague (Harry's son, I presume) and his plans include a "Guest Quarters" that is
totally separated from the primary residence — in fact, it's actually located on the opposite side of a 3 -car attached
garage with its own separate exterior entrance. Other info FYI: Lot size = 2.001 and Parcel ID No. is 239329102024. I
haven't found anything on the Plat that would indicate it's a problem, but I also know that Coryell Ranch is Aspen Glen's
first cousin and ADUs are definitely a no -no there.
Can you please take a closer look and let me know if you see any problems with inclusion of an ADU at Coryell Ranch. At
a minimum, he needs to provide us with a building permit for the ADU, but I'd like for you to let me know if there's a
bigger issue here.

Thanks for the question. I have dug into this research previously. Long story short Accessory Dwelling Units are not
permitted within Coryell Ranch. There has been some previous discussion regarding "guest/caretakers quarters" (an
term that a previous Land Use Code used), but the allowance of those uses was explicitly removed from the PUD zoning
as part of the approval process as well. We met with some representatives from the HOA a while back and laid out the
process they would need to go through for an amendment to the PUD, but haven't heard from them in quite a while.
From my perspective, he has the option to go through the PUD Amendment process (a heavy lift for one property owner
with no guarantee of approval) or to amend his plans to demonstrate to the Building side that there is no separate
dwelling unit on the property.

August:
The Building Dept. has reviewed your plans for a new residence to be located at Coryell Ranch, but unfortunately we
cannot approve plans as submitted to our office because of the inclusion of Guest Quarters (or "Accessory Dwelling
Unit" as per Garfield County Land Use Code) which is shown on the opposite side of the attached garage from the main
residence. For clarification about this matter, we referred it to Patrick Waller, a Senior Planner in our Planning Dept.
Please refer to Patrick's email response to me — as copied below my signature line — wherein he states that ADUs
(including "guest/caretakers quarters") are specifically not allowed in Coryell Ranch PUD.
Based on this explanation, I would suggest that you either contact Patrick directly — who I have also copied on this email
— and/or your HOA/DRC. Based on those follow-up conversations and depending upon your preference, the Building
Dept. will need to see either: (a) revised plans without an ADU/guest quarters, or (b) you will need to otherwise obtain
approvals for this ADU from Garfield County's Planning Dept. before we can approve for building permit.
Sorry for any inconvenience this may cause, and thank you for your attention in getting this issue resolved.

Here's the revised plan for August Teague's proposed residence in Coryell Ranch. They took out the kitchen from the
ADU shown on opposite side of 1,000 SF garage from main residence, but did not remove the bathing facilities
(tub/shower) as I told them that they needed to do, in order to meet GarCo requirements. Can you please let me know
where the "No ADUs in Coryell Ranch" requirement stems from? I don't see it as a plat note, so don't know if it's
contained in the PUD Guide or not.
Also, I have copied Andy in on this to get his take on whether or not they can have the bathing facilities in this renamed
"Workout Room" ... soon to be ADU again after C.O. is issued. Again, I will include a big red boxed note that this area
cannot be used as a guest quarters/ADU/second dwelling unit as per Coryell Ranch guidelines, but I need to know
exactly what legal instrument to cite in this note.

I wanted to run this one past you, as it's a little convoluted, and want to make sure that you and I are on the same page.
The attached drawing revision from the Architect shows a minor modification to the layout of an ADU as shown on
previously submitted plans — which as you have seen in my correspondence with Patrick Waller is specifically not
allowed in Coryell Ranch PUD (due to water source limitations).
The revised floor plan now references this totally detached habitable space — it's fully separated from the main
residence by a 1,000 S.F. 3 -car garage — as a "Workout Room". The kitchen has been deleted (see clouded area on
drawing) but the bathroom still contains a shower/tub even though I had told the Architect that it needed to exclude
bathing facilities (our standard line with regard to powder baths as being acceptable). Question is: Does this meet our
"straight -face test" for not being an ADU?
As discussed with Patrick previously, I believe that we should issue a Condition of Permit that gets recorded into our
Laserfische files that an ADU is specifically not allowed, and we can flag it as such with a big bold red boxed note on
drawings too. That provides us with coverage should a neighbor complain at some point down the road that the County
shouldn't have allowed an "illegal" ADU. But, in addition, should we also require them to remove the bathing facilities as
currently shown on this revised plan, which is similar to what we've always required from other property owners in
similar situations when ADUs are specifically not allowed?

The shower or bath restriction is limited to an accessory structure as per definition of accessory structure. It would
make some sense a workout room would have a shower. I would say redline the No ADU and call it good.

Just wanted to let you know that I visited with Andy Schwaller today, and we'll be able to accept the amended floor plan
layout for a "Work -Out Room" as you recently sent to me via email, including the bathtub/shower as shown.
However, as per our prior conversation, the permit will clearly state that a Guest Living Quarters or "Accessory Dwelling
Unit" is specifically not allowed within Coryell Ranch. I expect us to be ready for building permit issuance within the next
couple of days, and your Contractor should receive a call from Lindsay at our office no later than Wednesday with final
balances due & pick-up instructions.
