As you will recall from our discussion, Garfield County calculates building size according to the following definition included in the Land Use and Development Code: "fur4rea - The totol habitobte horizontal floor qred of all floors in o building, measured from exterior wall to exterior wall, exclusive of unfinished bosement, gqrqge, storoge areo, ond utility rooms." Accordingly, the garage area shown on the main level plan is exempt from being counted in the total area of the ADU on this project, but other habitable spaces - including the bathroom, office and mudroom - are not, resulting in a floor area > 1,OOO sq. ft. Since the 1,000 sq. foot is an absolute maximum size allowed as a "use by right" and not simply a guide, the additional area proposed at the main level is not allowed under our current ADU regulations. Our suggestion is for your clients to apply for a land use permit allowing this structure to be built as a "secondary dwelling unit" - which, on their piece of property, can include up to 3,000 sq. feet area. As we discussed, the land use change application will be processed through our Planning Department, and I would suggest that you contact Patrick Waller to schedule a Pre-Application conference to more clearly understand the associated requirements, timeframe/schedule and fees. My expectation is that the approval process shouldn't be overly cumbersome on a large parcel like this one. A building permit has already been issued for this project from the Building Department - albeit without the lower level floor additions as shown on your most recent plans emailed to us. Your clients can move forward with the barn structure + upstairs ADU as already approved but without completing any work related to enclosing those new rooms. Then, following issuance of the Land Use Change Permit for a Secondary Dwelling Unit, they can simply finish off those areas as they ultimately would like to in accordance with the larger area limitations allowed under the definition of "secondary Dwelling Unit". lf they proceed along those lines, the bottom line is that they should be able to accomplish what they want to do, but doing so after obtaining the additional land use approvals for a secondary dwelling unit allowing them to build larger than the 1,000 sq. foot ADU size limitations. Hopefully this information is helpful to you and your clients, and I will copy Patrick Waller on this correspondence so that he is up to speed with our recent conversation, as well. Attached is the ADU we discussed that is proposed to be in the upper level of a barn. , 'square footage is 881-SF. The lower level is a garage, shop, home office, and bath - all independent from the function, or need of the ADU. As we touched on - since a secondary dwelling unit classifies as a Administrative review and approval, we want to work within the ADU 1O0O SF requirements, but looking for clarification of the main level separate uses from the ADU.
