PROJECT INFORMATION AND STAFF COMMENTS
¡. GENERAL PROJECT DESCRIPTION
The Applicant is requesting approval of an Administrative Land Use Change Permit for
the insiallation of a booster compressor. The compressor is proposed to be 1380
horsepower and will be housed in a steel building on an existing pad operated by
Williams. The existing pad includes pipeline infrastructure and was originally planned for
a booster compressor for the Kokopelli field. The compressor will be outfitted with a
hospital-grade muffler to limit noise produced from the facility. The facility will operate24
hours a day, 365 daYs a Year.
The Application indicates that the facility will take approximately eight weeks to install.
Constiuction traffic will consist of 2-3 truck trips per day. Once the facility is installed
minimal maintenance traffic will be generated. The facility will be accessed using existing

II. LOCATION - SITE DESCRIPTION
The immediate area where the facility will be located consists of a developed graded
area that is used by Williams for pipeline infrastructure. The proposed development will
slightly increase the fenced and disturbed area (0.07 acres). The approximately 690-
acre parcel is improved with numerous oil and gas related facilities. Other Land Use
Change Permits issued for the property include a pump station and pipeline
infrastructure.
The location of the booster compressor is generally level, with significant topographic
changes over 500' away. The nearest adjacent property is owned by the Bureau of Land
Management and is 318' from the compressor station at its closest. The nearest building
not related to oil and gas infrastructure is more than half a mile away.

Vegetation within the immediate area includes modified pasture, reclaimed ROWs re-
seeded with native and non-native grasses and forbs, scattered pinyon juniper
woodlands, sagebrush shrublands, and some scattered mountain shrubs. The site is
located on a mesa above the Colorado River.

III. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS

IV. STAFF COMMENTS AND ANALYSIS
ln accordance with the Land Use and Development Code, the Applicant has provided
detailed responses to the Submittal Requirements and applicable sections of Article 7,
Divisions 1,2, and 3, including Section 7-1001lndustrial Use Standards. The Application
materials include an lmpact Analysis and related consultant reports, technical studies,
and plans.
7-101 : Zone District Use Requlations
A Booster Compressor is a permitted use in the Rural Zone District, provided that the
application is approved through an Administrative review process. The proposed use
demonstrates general conformance with applicable Zone District provisions contained in
the LUDC. Thié includes dimensional requirements and other descriptions for the Rural
Zone District as detailed in Article 3.

7-102: Co ive Plan
The Updated Comprehensive Plan 2030 designates the site as RMH (Residential
Medium High Densiiy). Excerpts from the Land Use Description Section Chapter 2 and
Section 8, Ñatural Resources and Section 9, Mineral Extraction are provided below'

The Community Development Department received a referral comment from
CPW on this application that requested development occur outside of specific
periods. This request was included as a Condition of Approval. This comment is
discussed in further detail in response to SectionT-202 Wildlife Habitat Areas. As
identified in the above statements, the Comprehensive Plan is very supportive of
this requirement.
Section 9 - Mineral Extraction (Relevant Sections\
Policy 1:
Supþorf the tegat rights and priviteges of surface and mineral owners to extract
and.develop their interesfs as well as the legal rights and privileges of private
property owners and the general public to have the mineral estate developed in a
reasonable manner and to have adverse impacts mitigated.
Strategy vii:
Continue to consider the use of facilities that are appurtenances to oil/gas
development activities (compressors, etc.) appropriate in allland uses so
long as they meet the respective mitigation requirements of the LUCD to
maintain compatibility with surrounding land uses.
Policy 2:
Mineral resource extraction activities will protect critical wildlife habitat as
identified by state and federal agencies and preserue or mitigate natural
drainage patterns from the impacts of extraction activities'
Strategy i:
Discourage development within critical wildlife habitat designations
that cannot be designed, constructed and conducted so as to have
a minimum adverse impact upon such habitat or impacted wildlife
species.
The Mineral Extraction Section of the Comprehensive Plan supports the development of
mineral resources with appropriate mitigation. As submitted and with identified mitigation
and conditions of approval, the application is in general conformance with the
Comprehensive Plan.
7-103: C oatibilitv
The Application has provided information on neighboring land uses indicating the general
character of the arca. The request demonstrates general compatibility with adjoining
uses provided proper mitigation is implemented and compliance with conditions and
COGCC regulations are maintained. The subject property is adjacent to BLM property
with develoþed oil and gas infrastructure. The subject property is currently improved with
a variety of oil and gas infrastructure and the proposed compressor will require limited
add itional d isturbance.

7-104 & 105:Source of Water & Waste
Water Svstems
The Application represents that the facility
will be unmanned and will not require
potable water. Staff agrees with this
assessment and recommends that OSHA
requirements are followed for the provision
of water and wastewater during
construction.
7-106: Public Utilities
The applicant has indicated that public
utilities are not required to support the
project.
7-107 & Roadwavs
The Applicant provided an engineered
analysis and supplement that described the
existing roadways that are used to access
the proposed compressor location. This
analysis indicated that very little traffic uses the road (less than 20 trips per day). The
engineering review indicated that the existing road exceeded the requirements for a
Primitive/Driveway as defined in the Land Use and Development Code. However,
because of the number of facilities on a road, Staff felt that a Waiver request from the
dimensional requirements was appropriate. The applicant responded to the Roadway
Waiver Criteria as identified in Policy 01-14.
The road has historically been used for oil and gas construction and maintenance traffic
and no issues were identified by the engineering report. Additionally, the engineering
review states that "the road appears adequate for the proposed booster compressor
activities and current traffic needs relating to oil and gas operations occurring on Jolley
Mesa". The engineered analysis was reviewed by the County designated engineer and
no issues were noted. This analysis meets the criteria for granting a Waiver from Section
7-107.
The road has a shared maintenance agreement that was provided as part of the
application. No safety or structural issues were identified as part of the review. The
provided engineering analysis did recommend that the road continue to be maintained.
The access to the property is entirely on private roads from County Road 311. The
applicant provided mapping and easement documentation demonstrating legal access
to the booster compressor location. This includes crossing an adjoining property owner,
the Bureau of Land Management, and the subject property owner.

7-108: Natural Hazards
The Application provided an engineering report on
natural hazards including soils, geology, and
slopes. The report indicated that hazards have a
low probability of impacting the site and that no
mitigation is needed at this time. The report was
reviewed by the Garfield County Consulting
Engineer who did not identify any issues. Garfield
County Hazard Mapping shows that portions of
690-acre property have potential slope issues, but
no areas of concern were located in the immediate
vicinity of the proposed booster compressor area.
The information supports a determination that the
proposed use is not subject to significant natural
hazard risks.
7-109: Fi Protection
The application was reviewed by Colorado River Fire Rescue who had no concerns
provided that the operator complies with industry standards for the compressor building.
The fire district also requested that a Knox Padlock be installed on the exterior of the
gate.
7-201 : Aqricultural Lands
The application will require only minimal additional disturbance for the installation of the
booster compressor. Access will be via existing roads. Additional impact on agricultural
operations is not anticipated.
7-202: Wildlife Habitat Areas
The Applicant provided an Environmental lmpact Report, completed by WestWater
Engineering and dated July 2019. The report indicates that impacts to Flora and Fauna
are anticipated to be minimal as the facility will be installed in an already disturbed area.
The report did recommend that the booster compressor use appropriate mufflers to meet
COGCC 800 series rules to reduce noise impact to wildlife and also suggested that
project construction be scheduled outside of the bird nesting season (May 1S-July 15).
The application was reviewed by Colorado Parks and Wildlife (CPW). As part of their
review CPW indicated that the organization supports the measures taken by Terra
Energy to minimize impacts to wildlife in the area. Additionally, CPW requested that
construction and installation be completed prior to December 'l't if possible. lf activity
was required to continue into the wintertime period, CPW recommended daily timing
restrictions for vehicle traffic from 1Oam - 3pm in order to minimize disturbance to
wintering game.

7-203: Protection of Water Bodies
The application did not identify any waterbodies within the proposed booster compressor
area. The absence of water bodies was verified by Staffs site visit.
7-204: Drainaqe and Erosion
The Applicant provided a Drainage and Erosion Report and no issues were identified
from the review of the County Consulting Engineer. The report included a Drainage Plan
which showed the proposed direction of surface flow and required Sedimentation Traps.
Overall disturbance of the property will be 0.62 acres (this includes the already disturbed
area). This is less than the 1.O-acre threshold that triggers a CDPHE Storm Water
Management Plan.
7-205 Environmental Quality
Air quality permits from CDPHE associated with the booster compressor will be required.
A recommended condition of approval should call for the Applicant to obtain and keep
current all permits as required by the CDPHE and maintain compliance with all conditions
contained therein.
7-206: Wildfire Hazards
The site is located in an area mapped with a high wildfirehazard. The site plan and site
visit reflect an existing separation between the proposed location for the booster
compressor and natural vegetation. The compressor will be housed in a steel building.
The application was reviewed by Colorado River Fire Rescue and no issues were
identified with wildfire hazards.
7-207 Natural and Geoloqic Hazards
The Geologic Hazard Report addresses a broad range of potential hazards including
landside, rock fall, soils, alluvialfans and slopes. No significant hazards to the proposed
facility were noted in the report and the site is not located within a flood plain.
Reclamati
The Applicant has included a reclamation plan that addresses re-vegetation and
reclamation issues for the compressor installation. The application was reviewed by
Garfield County Vegetation Management and no issues were identified. Additionally, the
applicant is required to obtain a Permit 2A from the COGCC for the installation of the
booster compressor. This means that the development and installation will be subject to
COGCC Rule 1000 for Revegetation.

The proposed use is compatible with typical oil and gas exploration and production
activities. The applicant has indicated that the building will be painted a shadow grey to
minimize visual impacts. The site has been designed to account for parking, circulation,
and loading activities.
7-303: Landscapins
As an industrial use landscaping submittals and standards are not applicable to the
proposal.
7-304: Liqhtinq
The proposed booster compressor will include three external downcast flood lights on
the compressor building. These lights will be required to meet all County requirements.

F. Noise
The booster compressor will be housed within a steel building and equipped with
hospital grade mufflers. As part of the required submittal of the Form 2A to the
COGCC the applicant will be required to meet applicable noise requirements. The
Land Use and Development Code allows that any noise generated from this
facility is subject to COGCC requirements. The applicant has provided a noise
report that appears to indicate that applicable requirements will be met. This
includes a statement anticipating that the noise at the nearest property boundary
will be 47.8 dB(A).
The noise analysis is adequate for the issuance of the Land Use Change Permit.
However, Staff recommends a Condition of Approyal that once the facility is
operational, the applicant take noise readings and provide a demonstration that
any proposed noise mitigation is adequate and functioning.
G. Ground Vibration
The applicant has described the technology that will be used to mitigate vibration
from the compressor. This includes anti-vibration pads located between the skid
and the concrete. The application was reviewed by the Garfield County Consulting
Engineer and no issues were identified. lf the County receives any complaints
regarding vibration, the applicant will be required to demonstrate that they meet
this standard. Additional mitigation may be required.
H. Hours of Operation
The operation of the booster compressor is required 24 hours a day - 7 days a
week. However, the facility is generally unmanned and minimaltraffic is generated
once construction is complete. Staff is supportive of the request to allow full
operation of the facility.
l. lnterference, Nu nce. or Hazard
No issues are anticipated with regards to these requirements.
SUGGESTED FINDINGS
1) That proper public notice was provided as required for the Director's Decision
2) Consideration of the Application was extensive and complete, that all pertinent
facts, matters and issues were submitted and that all interested parties were given
the opportunity to provide input prior to the Director's Decision.
3) That for the above stated and other reasons the proposed Land Use Change

Permit for the Kokopelli Booster Compressor is in the best interest of the health,
safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4) That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5) That with the adoptions of conditions and approval of a waiver regarding hours of
operation and roadway standards, the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as
amended.
VI. RECOMMENDATION
The following recommended conditions of approval are provided for consideration as
part of the Director's Decision for approval of the Application.
1) All representations made by the Applicant in the application shall be conditions
of approval unless specifically altered by these conditions of approval.
2) The Kokopelli Booster Compressor shall be operated in accordance with all
applicable Federal, State, and local regulations governing the operation of this
type of facility.
3) The facility shall maintain compliance with all applicable CDPHE permits,
including but not limited to, SPCC Plans and air quality permits (APEN permit)
for the site.
4) The Applicant shall maintain compliance with all required COGCC permits and
forms for the facilitY.
a) Prior to operation of the facility the Applicant shall supply Garfield County
Community Development with a demonstration that all required COGCC and
CDPHE permits have been issued.
5) The facility shall maintain compliance with COGCC and County Noise
Standards and Regulations. Within 30 days of initiating operation of the booster
compressor the Applicant shall provide on-site noise readings to confirm
compliance with the noise requirements. lf compliance is not confirmed or if
future compliance issues are identified, the Applicant shall provide additional
noise mitigation in order to achieve compliance and may be subject to further
noise testing.
6) The facility shall comply with Garfield County lighting requirements in Section 7-
304 including, but not limited to that exterior lighting is downcast and shielded.

7) Prior to the issuance of the certificate of occupancy for the building, the
applicant shall be required to install a Knox Padlock on the access gate, as
required by Colorado River Fire Rescue.
8) The operation of the facility shall comply with industry standards regarding fire
protection, fire detection, and fire extinguishers.
9) The installation and construction of the facility shall meet the following
timeframes:
a) The Applicant shall installthe facility in compliance with Colorado Parks and
Wildlife recommendations includ ing req uirements that construction and
installation of the facility occurs outside the December 1st to April 30th big
game winter period if possible. lf activity does occur within the wintertime
period vehicle traffic shall be restricted from 1Oam-3pm.
b) The Applicant shall install the facility according to recommendations provided
within the WestWater Engineering Report dated July 2019. The report
recommends that project construction shall be completed outside of the
nesting season, which is considered May 15 to July 15 for species in this
atea.

Holy Cow. That is quite the study for a single compressor on an already disturbed and established site. We went from
20-30 per year to appears just 1-.
A building permit will be required for the building. There is some additional grading but the site itself is already
developed and I do not see a need for a separate grading permit. Chris will be reviewing as well with Steve looking at
the weeds all4 of them.

This letter is to advise you that I have reviewed File Number: GAPA-04-20-
8785, Jolley Mesa LlC-Kokopelli Booster Compressor and building, located at
Latitude: 30.5085 by Longitude: -107.5721, approximately 1.0 miles south of the
Jolly Cabin, in New Castle, CO.
After talking to Bryan Hotard with Terra, I have determined that Terra has
industry standards to follow as in fire protection, fire detection and fire
extinguishers in their compressor buildings. As long as the industry standards are
followed CRFR has no concerns for the building of the compressor building and
installing the compressor.
'We are requesting that since the compressor and building will be inside a locked
gate thatTerra purchase and install a Knox Paddlock to insure CRFR access in the
event of an emergency or fire. Knox Paddlock information can be obtained
through my offtce.
I have no further requirements or concerns with this proposed building and
compressor on this property. This addition to the property will only add minor
impacts to CRFR or our response to that area.

Polvfluoroalkvl substances in firefiehtinq foams
PFAS are a famity of human-made substances that do not occur naturatty in the environment.
They have been used for decades in food packaging, carpets, personal care items, ski waxes,
other househotd items, and firefighting foam due to their abitity to resist heat, oit, stains,
grease, and water. Human contact with these chemicals is widespread, and nearty atl people
have some measurable levets of the chemicats in their btood. Human health toxicity
information is onty avaitable for about ten of the thousands of these chemicats. However,
despite the timited information, this toxicity information suggests that exposure to some PFAS
can cause a range of negative heatth outcomes. Heatth effects from these chemicats may
inctude pregnancy comptications, tiver damage, high chotesterol, and others. More research is
underway to better understand these heatth consequences. When PFAS is reteased into the
environment, it can get into water, especiatty groundwater, and contaminate drinking water
suppties. Pursuant to House Bill19-1279, firefighting foam manufacturers wi[[ be prohibited
from knowingty setting or distributing firefighting foam to which PFAS chemicals have been

added. CDPHE has prepared an action ptan summarizing how we witl protect Cotoradans from
risks posed by PFAS.l
Due to the potential for contamination from the use of ftuorine free firefighting foams, the
appticant should coordinate with [oca[ fire departments to evatuate whether PFAS-free foam
can provide the required performance for the specific hazard. lf PFAS-containing foam is used
at this location, then the appticant shoutd be required to properly characterize any waste
that leaves secondary containment, vacuum/drum up any contaminated soiI and property
dispose of it in accordance with sotid and hazardous waste regulations. lf any PFAS-containing
foam leaves secondary containment, the applicant should be required to conduct appropriate
soil sampling and water quatity monitoring.

Dear Mr. Watter,
Thank you for the opportunity to comment on the Terra Booster Compressor apptication in
Garfietd County. Colorado Parks and Witdtife (CPW) has a statutory responsibitity to manage
att witdtife species in Cotorado; this responsibitity is embraced and futfitted through CPW's
mission to protect, preserye, enhance, and manage the witdtife of Cotorado for the use,
benefit, and enjoyment of the people of the State and its visitors. CPW encourages Terra
Energy Partners (TEP) and Joltey Mesa LLC to afford the highest protection for Cotorado's
witdtife species and habitats.
The proposat is to 'instatt a booster compressor that was previousty located on the KP 23-17
Pad approximatety 1.25 mites north of the new location. lt witl. be tocated within a pipetine
facitity (pig tauncher) operated by Wil,tiams, located on Joltey Mesa LLC property in the SE of
Section 20, Township 6 South, Range 91 West, 6th P.M. The existing tocation woutd be
expanded stightty to the north side of the pad to accommodate the compressor white
maintaining space to the southeast and southwest of the compressor for Wiltiams to safety
operate their existing pig tauncher. The existing chain [ink fence surrounding the facility will
be routed around the new disturbance boundary. The existing access road (off County Road
311), near the entrance to the facitity, would be regraded to maintain access.
TEP anticipates construction to take approximatety eight (8) weeks for the compressor to be
instatted and operationat, and once constructed it witt operate 24/7 except during
maintenance operations. TEP estimates that truck traffic to the site witl be 2-3 truck trips per
day during construction activities, and periodic once the compressor is operationat. TEP ptans
to commence instaltation immediatety upon receiving approval of the Garfietd County and the
COGCC Form 2A permits. CPW provided pre-application feedback to TEP in September 2019
regarding the proposed compressor station. To CPW's knowtedge, TEP has not yet submitted a
Form 2A apptication for this site to COGCC.

The proposed compressor station location and access road are located within mute deer
severe winter range and winter concentration area, and etk winter concentration area. TEP
proposes to install a chain-tink perimeter fence around the facitity to prohibit wildlife from
entering. Additionatty, TEP ptans to construct a steet buitding to house the compressor and
instatt a hospital-grade muffler to minimize noise. The facitity witt be in compliance with
COGCC Rute 802 for noise abatement and will comply with the ResidentiatlAgriculturat/Rural
maximum permissibte noise levets (50db - 55db) as stated in this rule. TEP has atso posted
speed restriction atong the access route to the facitity to ensure safety for personnel and to
minimize the potential for witdtife retated traffic accidents.
CPW supports the proposed measures taken by TEP to minimize impacts to witdtife in this
area. CPW understands that TEP initiatty intended to instat[ this compressor station during
summer of 2020, but has obviousty incurred detays. CPW is aware of game damage issues west
of Jottey Mesa, and is concerned that winter activity at this tocation may further exacerbate
the concentration of big game animals and game damage on adjacent private property. CPW
recommends that TEP perform construction and instattation prior to December 1st if possibte,
to avoid the big game winter time period of Dec. 1-Aprit 30. lf activity witt continue into the
winter time period, CPW recommends daity timing restrictions for vehicle traffic from 1Oam -
3pm to minimize disturbance to wintering big game.

Thank you for the opportunity to review and provide comments on this application
My office is likely the most common receiver of citizen questions, concerns and complaints
related to possible oil and gas activity impacts to Garfield County citizens. lt is with this in mind
that I have reviewed the application. The proposed land use change will occur on rural lands
on the co-applicant's property.
According to the application materials, including siting information, proximity to surrounding
lands and land uses, the sound study data and planned noise mitigations, I see no unresolved
nuisance issues with the application. I have no nuisance concerns with the application and no
mitigation suggestions beyond the mitigations outlined in the application packet.
