AÌPROVING A VARIANCE FOR MINIMUM SBTBACK, PROTECTION OF
\ryETLANDS AND WATERBODIES, FOR A PROPERTY LOCATED AT 1962 COUNTY

A. Ralph E. & Renae D. Besler Revocable Trust rnade an application to the Board of
Adjustment of Garfield Cor:nty, Colorado, (the "Board") requesting the Board grant a variance from
Unified Land Use Resolution of 2008, ç7-ZA3 A.I. Minimurn Sefback, Protection of Wetla¡ds and
Waterbodies,
B. The Ralph E. & Renae D. Besler Revocable Trust is the owner of real property as
identified in a Quitclaim Deed recorded at Receptio¡r No. 596423 in the Office of the Ga¡f,ield
County Clerk & Recorder, more practically described as 1962 CR 132 (Mitchell Creek Road) and
encompassing an arca of I .184 acres and as identifiecl in ,
C. The subject properfy is contained within the Rural Zone District and issuance of the
requested variance witi not effect the requirement for the parcel to comply with the zone district
standards contained within the Unified Land Use Resolution of 2008 (ULUR).
D, The Ralph E. & Renae D. Besler Revocable Trust specifically requests tlie Board grant a
va¡iance from $?-203 A, I . of the ULUR which requires a minimum setback of thirfy-five feet (3 5')
from the typical and ordinary highwater mark on each side of a rvaterbody, to fifteen (15') as
indicated by the building enveiope identified in aftached Exhibit A,
E. Garfield Cotrnty is a legal and political subdivision of the State of Colorado, for which the
Board of Courty Commissioners is authorized to act.
F. The Board of Courty Commissioners of Garfield County has appointed the Garfield
County Board of Adjustment,
H. The Board of Adjustment conducted a public hearing on August 3,20A9, upon the
question of whether the requested variance should be approved, denied, or whether any action should
be taken on this matter.

1. Proper posting and public notice were provided as required for the meeling before the
Board of Adjustment.
2. The meeting before the Board of Adjustment was extensive and cornplete, that all
pertinent facts, matters and issues were submitted a:rd that all interested parties were
heard at that meeting.
3. The above stated a¡rd other reasons) the proposed Varianse h¿u been delermined to be in
the best interest of the health, safety, morals, convenience, orde¡ prosperity and welfare
of the citizens of Garfïeld County.
4. The application has met the standards artd requirements for Variance pursuant to Article
4, Division 3 of the Ga¡field County Unified Lar:d Use Resolution of 2008.
RESOLUTION
NOW THEREFORE, BE IT RESOL\rED by the Board of Adjustment, Garfield Counfy,
Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Variance from $?-203 ,{.1. Minimum Setback, Protection of Wetlands and Waterbodies
is hereby approved subject to compliance with the following conditions:
l. Construction of a single family home on the parcel shall comply with the building
envelope restrietion atached as Exhibit A and that all activities related to construction of
the singie farnily home occur inside of the designated envelope.
