When we spoke to the building and planning they told us we could build the bigger ADU and turn the existing ADU back to a studio after completíon of our 1,000 sq ft proposed ADU. I understand the confusion and was concerned this would be a problem, so I hope thís helps clarify that after it is finished and before final inspection, we will convert the existing ADU back to a studio. During zoníng complíance review for the project, some questions were raised relative to the total number of existing structures and their structure uses on parcel number 2L23253OAO48. Garfield County Community Development Department records show an existing primary dwelling residence built circa L993 and a subsequent additíon in 2001. More recently in 201"9 there was a request to create an 516 sq ft ADU for which I understand the building fínal inspection has been performed. With one main residence and an existing ADU, the request for a 2"d ADU ís not allowed per the Garfíeld County Land Use and Developtnent Code. ls there any new information I can factor ínto my review of this lot to benefit your case, such as one of the following: 1. Separate land use application review or approval process underway with our Planníng staff? 2. Recent removal of one or more of the existing building structures on the property? lf so, please identify which ones... 3. Have you demolished the main house or recently approved ADU? 4. Has there been an unfortunate property loss of a dwelling on the existing lot due to fire, flood or other peril? 5. Perhaps your lot was more recently re-subdivided or split? f so, coulcl you provide the land use file number and/or name of Planner who handled the case? lf all existing structures stand and shall remain intact with their current respective uses, building application BLRE-06-21-690E wuuld necessarily be denied due to non-compliance witlr zoning regulations, and I would, therefore, advise owner(s) to submit ín writing a request to withdraw the buílding application.
