Payment to be made as follows: We may ask for a deposit to start work. Any payments not received when due shall bear interest at the rate of twenty percent (20%o) per annum. In the event Mullçnax must file a mechanic's lien or initiate collection efforts for payment, the prevailing party in any such litigation shall be entitled to recover reasonable attorney's fees and costs. Any dispute between the parties shall be governed by the laws of the State of Colorado, and venue shall be the County in which the work was performed. All material is guaranteed to be as specified. Unless agreed to in writing, all permits, engineering, testing and inspections necessary for any and all work performed by Mullenax Roofing shall be the sole and exclusive responsibility of the Owner/General Contractor. All work to be completed by Mullenax in a workmanlike manner according to standard practices. Any alteration or deviation from above specifications involving extra work or expense will be performed only upon written change orders and will become an extra charge over and above this estimate. All work to be performed by Mullenax may be delayed due to strikes, materials supply issues, accidents, inclement weather, acts of God, or other matters beyond Mullenax's control. Owner/General Contractor shall carry fire, tornado and other necessary insurance. Mullenax maintains general liability and lVorkmen's Compensation Insurance. NOTE: This Estimate is not a binding contract until signed by the Owner/General Contractor AND an authorized agent of Mullenax Construction and Roofing, Inc. and may be withdrawn by Mullenax if not accepted and delivered to Mullenax within 30 DAYS.
