The propefiy is located at approximately 5242 County Road 300, approximately 0.75 miles southwest of the Battlement Mesa Community, in Section 24,T75, R96W. The facility is accessed by private roadways off of County Road 300 including a portion of what is known as Daybreak Drive. The property is zoned (R) Rural PROJECT INFORMATION AND STAFF COMMENTS I. GENERAL PROJECT DESCRIPTION The Applicant is requesting an Administrative Land Use Change Permit for a booster compressor that will replace 6 existing well head compressors located on the Ursa Speakman A Well Pad. The Facility will include the following equipment: . One booster compressor with a natural gas driven motor. Sound walls on two sides of the compressor unit. Assocíated flowlineso Removal of 6 existing well head compressors The proposed facility will be located on an existing developed well pad with no new site disturbance required. lt will utilize existing roads. After construction no additional traffic will be generated. The facility will operale 24 hours a day, 365 days a year. Daily 1. inspections/monitoring of the facility will occur typically between 7:00 a.m. and 7:00 p,m. Lighting will only be utilized for unscheduled nighttime maintenance activities. The existing well pad has previously been approved by the COGCC and is currently in operation. By Resolution No. 2014-41 Gadield County also approved an injection well for the site (see attached), lmprovements on the site are shown on the site plan and include the gas wells, suppoñing infrastructure, storage tanks and the injection well. The boostercompressorwill be subject to all applicable COGCC and CDPHE Permitting. The site is covered by a statewide bond for reclamation and reclamation plans are included in the Application submittals. A noxious weed management plan has been prepared for the site. The facility is anticipated to operate for the economic life of gas wells in the area which is estimated to be more than 20 years. Benefits outlined in the submittals include efficiency of operation and reduction in noise generation. II. LOCATION - SITE DESCRIPT¡ON The site is currently a developed COGCC well pad with approximately 12 existing wells and plans for up to a total of 25 wells for the site. Land uses within 1,500 ft. include agricultural uses, natural gas extraction, public lands and a portion of open space within the adjoining Battlement Mesa PUD. Developed portions of the PUD including RV uses 2 and residential homes are slightly fañher f rom the site, estimated at another 150 ft. northeast of the site (total distance of 1,650 ft. +/-). Rural residential homes and properties are also located immediately west and nofth of the site and some distance south of the site. The site slopes up moderately from the County Road with the well pad graded and leveled. The site is graded to slope down from the well pad on the north, west and east perimeters. The site slopes up to the south with a significant change in grade (cut slope) and the access road alignment. Native vegetation surrounding the site is generally sagebrush, with some pinion and juniper woodlands. No additional native vegetation will be removed for the proposed facility and the placement of the project on an existing well pad will minimize additional impacts. The site is located on a terrace above the Colorado River which is approximately 2,000 ft. to the northeast. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS Public Notice was provided for the Director's Decision in accordance with the Garfield County Land Use and Development Code, as amended and included mailing notice to all property owners within 200 ft. and any mineral rights owners on the propefty. The Applicant has provided evidence of compliance with the notice requirements. Comments from referral agencies, County Departments and the public are summarized below and attached as exhibits. 1. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering:. Provided technical questions regarding previous conditions, noise, and weeds. 2. Garfield County Road and Bridge Department, Dan Goin District 3 Foreman:. lndicated that the driveway was up to standards. 3. Gadield County Vegetation Manager, Steve Anthony:o lndicated that the Weed lnventory and Management plan was acceptable 4. Grand Valley Fire Protection District, Rob Ferguson, Deputy Fire Chief o lndicated that they had no objections to the booster compressor. 5. Garfield County Oil and Gas Liaison, Kirby Wynn:. Noted the reduction in noise levels as a beneficial change. 4 6. Town of Parachute: Stuaft McArthur, Town Administrator:. Commented that the facility is not located within their watershed protection area. 7. Battlement Mesa Concerned Citizens: Doug Saxton: . Provided comments expressing concerns on existing nuisance noise impacts and noted ongoing impacts if the compressor is not fully enclosed. 8, Additional referral agencies that did not submit comments include: (a) the Colorado Department of Public Health and Environment (b) Bureau of Land Management; (c) (d) Battlement Mesa Service Association; and (d) Battlement Mesa Metro District. STAFF COMMENTS AND ANALYSIS ln accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Afticle 7, Divisions 1,2,and3, including Section 7-1001 lndustrial Use Standards. TheApplication materials include an lmpact Analysis and related consultant repofts, technical studies, and plans. 7-101 - 103: Zone District Requlations. Comprehensive Plan & Compatibility The proposed use demonstrates general conformance with applicable Zone District provisions contained in the Land Use and Development Code and in particular Article 3 standards for the Rural Zone District. The Comprehensive Plan 2030 designates the site as RMH (Residential Medium High Density). Excerpts from the Land Use Description Section Chapter 2 and Section 8, Natural Resources and Section 9, Mineral Extraction are provided below. Chapter 2 - Land Use Designations Residential Medium High (RMH): Small farms, estates, and clustered residential subdivision; density determined by degree of clustering and land preserued in open condition. Section 8 - Natural Resources /ssues*The county maintains high air quality standards, however there may be a propensity for air pollutants to exist in the western paft of the county 5 Goals 1. Ensure that natural, scenic, ecological, and critical wildlife habitat resources are protected and /or impacts mítigated. 4. Ensure the appropriate reclamation of lànd after extraction processes. Policies 1. The County will encourage and cooperate with the protection of critical habitat including state and federally protected, threatened, or endangered species. Section 9 - Mineral Extraction Goals Ensure that mineral extraction is regulated appropriately to promote responsible development and provide benefit to the general public. 2. Ensure that mineralextraction actívities mítigate their effects on the natural environment, including aír quality, water quality, wildlife habitat or impoftant visual resources. 3. ln working with mineral extraction projects, the county wíll protect the public health, safety and welfare of íts citízens. Policíes 2. Míneral resource extraction activities will protect critical wildlife habitat as identified by state and federal agencies. Development within these designations that cannot be designed, constructed and conducted so as to have a minimum adverse impact upon such habitat or these wildlife species shall be discouraged. 4. Facílities that are appurtenances to oil/ gas development activities (compressors, etc.) are considered appropríate in all land uses so long as they meet the respectìve mitigation requirements of the LUDC to maintain compatibility with surrounding land uses. The location and design of the proposed facility is in general conformance with the Comprehensive Plan Policies subject to proper mitigation of impacts. 1 6 Comprehensive Plan Future Land Use Map - Excerpt 354 300 Ursa Speakman Site 300 \I * tT-I-\.'tl- The Application has also provided information on neighboring land uses indicating the general character of the area. The request demonstrates general compatibility with adjoining uses provided proper mitigation is implemented and compliance with conditions and COGCC regulations are maintained. 7-1O4 & 105: Source of W r & Waste Water Svstems The Application represents that the facility will be unmanned and will not require potable or fresh water. The Application indicates that portable toilets will be provided and a will serve letter is provided from the service provider, Redi Services. Compliance with OSHA standards should be required as employees will be working on the site for monitoring, maintenance, and installation purposes. 7-106: Public Utilities The site is served with electricity to be provided by Holy Cross Energy. The compressor will be natural gas powered. 7-107: Access & Roadwavs The Applicants access their property from County Road 300 via private roads including Daybreak Lane. The roadway has previously been evaluated for compliance with the County Roadway Standards contained in Section 7-107. That review included an assessment stamped by a professional engineer that indicated that the roadway meets 7 the county standards and provides a safe and adequate access. An update memo from the Applicant's engineer, Matrix Design Group suppofting the previous determinations. Previous traffic studies were submitted for the Speakman A Pad and an update memo was provided with this Application addressing traffic. The memo outlines a minimal amount of temporary traffic associated with installation of the booster compressor. 18 daily trips (two way) are anticipated for the duration of the three day construction period. Once installed no additional traffic is anticipated as monitoring and maintenance traffic is already accessing the site for the existing facilities. The Application includes a dust control plan applicable to the site. The previous traffic studies for the Speakman site indicated that all intersections where site traffic will be turning are expected to be adequate, no requirements for County or State permitting, and no deficiencies were identified. WELLS)= Red Triangles 8 7-108: Natural Hazards The Application and previous studies provide significant information on natural hazards including soils, geology, and slopes. The information supports a determination that the proposed use is not subject to significant natural hazard risks. 7-109: Fire Protection The Application includes an Emergency Response Plan for the site that includes emergency notification number and contacts including the Grand Valley Fire Protection District. The Fire Protection District maintains facilities and equipment within the Battlement Mesa PUD. 7-201 : Agricultural Lands With no new disturbed areas no additional impacts on nearby agricultural lands are anticipated, The well pad is not currently fenced and the proposed facility does not propose any changes. 7-202: Wildlife Habitat Areas The Applicant has provided an Environmental lmpact Report, completed by WestWater Engineering, dated February 2O14. The study notes that the project is placed within the boundaries of an existing development and therefore avoids cumulative impacts on habitats. The Report concludes that "The development of the project is not expected to significantly affect any critical environmental resources." The current Application wíll not result in any additionalsite disturbance and is estimated to reduce noise generation from the site. 7-203: Protection of Water Bodies Potential impacts on water bodies has been addressed by the Storm Water Management Plan (permit), drainage plans, and Spill Prevention Containment and Countermeasures Plans for the site. The site location is on a terrace above the Colorado River which is approximately 2,000 ft. to the northeast. Dry Creek is located approximately 1,645 ft. to the west and a drainage swale is located east of the site. Distance from these features along with the stormwater and drainage plans for the site mitigate the potential for impacts. The Application included an update memo from the Applicant's engineer Matrix Design Group on the drainage plan indicated no increase in imperviousness of the site and no impact to the overall drainage analysis previously conducted. Previous conditions related to drainage should remain in place. Monitoring of water quality and erosion control measures during construction was recommended. 9 7-204: Drainaqe and Erosion (Stormwater) The Applicant has provided a copy of the State Storm Water Management Permit and grading and drainage plans for the site. The Applicant has also provided Best Management Practices including areas already stabilized and re-vegetated. An update memo from the Applicant's Engineer on drainage was provided and supported the previous drainage study indicating that no increase in imperuiousness would result from the proposed booster compressor. Compliance with the existing drainage plans for the site shall be required. 7-205 Environmental Quality Air quality permits f rom CDPHE associated with the booster compressor will be required. A recommended condition of approval should call for the Applicant to obtain and keep current all permits as required by the CDPHE and maintain compliance with all conditions contained therein. Storm Water Management Permits, lnstallation of Best Management Practices, SPCC Plans, and Reclamation and Erosion Control Plans address protection of water quality. 7 -206: Wildfire Hazards The site is located in an area mapped with low to moderate wildfire hazard. The site plan and site visit reflect an existing separation between the proposed location for the booster compressor and natural vegetation. The Emergency Response Plan has a section on Wildfire mitigation. 7-207 Natural and Geoloqic Hazards The Geologic Hazard Repoñ addresses a broad range of potential hazards including landside, rock fall, soils, alluvialfans and slopes. No significant hazards to the proposed facility were noted in the report and the site is not located within a flood plain. 7-208: Reclamation The Applicant has included a reclamation plan that addresses re-vegetation and reclamation issues for the well pad. 7-301 & 302: Compatible The proposed use is compatible with typical oil and gas exploration and production activities on a well pad. Large areas of the site plan are available for parking, circulation, and loading activities. 10 7-303: Landscaping As an industrial use landscaping submittals and standards are not applicable to the proposal. 7-304: Liqhtinq No permanent lighting is proposed and the Application makes reference to only using lighting during unscheduled night time maintenance activities. Any lighting shall be required to meet the County standards for being down directed, shielded, and oriented toward the interior of the site. 7-305 Snow Storage Adequate portions of the site plan are available for snow storage and can be accommodated by the drainage and storm water management plans. 7-306 Trails Trails standards are generally not applicable based on the industrial nature of the proposal and surrounding uses. 7-1OO1 INDUSTRIAL USE STANDARD S The Application represents that the facility will comply with all the lndustrial Use Standards contained in Section 1001. The Application contains a variety of documents to support compliance and the following summary addresses key issues.o The facility is currently visually screened along the north and eastern portions of the well pad by changes in elevation and topography.o Hours of operation are 24 hours a day, However other support, maintenance or monitoring activities will be conducted between the hours of 7 a.m. and 7 p.m. as represented in the application. All industrial products and wastes will be stored in accordance with all applicable state and federal regulations.. The Application includes details on the Waukesha, Model 5794GSl Compressor Unit that will be utilized. Supplemental information on the noise estimates for the compressor unit indicate that it will be in compliance with the 50 dBA nighttime limit. The noise at 350 ft. from the compressor unit is estimated to be 45.2 dBA without any additional noise mitigation. The Applicant is also proposing to install noise walls on the northeast and north sides of the unit which will further reduce sound from the unit.o The Applicant should conduct noise readings once the compressor is in operation to confirm compliance with noise standards. lf future noise complaints are received, additional on-site noise readings should be required to assess if additional noise mitigation is needed and confirm compliance with noise standards.o No other nuisance or ground vibration hazards are anticipated based on type of use. L7 V 1 SUGGESTED FINDINGS That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all peftinent facts, matters and issues were submitted and that all interested pafties were given the oppoftunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons the proposed Land Use Change Permit for the Ursa Speakman A Booster Compressor is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoptions of conditions and approval of a waiver regarding hours of operation, the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. VI. RECOMMENDATION The following recommended conditions of approval are provided for consideration as part of the Director's Decision for approval of the Application. That all representations made by the Applicant in the application shall be conditions of approval unless specifically altered by the conditions of approval. 2 That the Ursa Speakman A, Booster Compressor shall be operated in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. Gondition Prior to Issuance 3 Prior to issuance of the Land Use Change Permit, the Applicant shall confirm that the site is currently in compliance with all existing conditions of approval for the injection well on the site as documented in Resolution No. 2014-41. Other Conditions 4. The facility shall maintain compliance with CDPHE Storm Water Management Permits, Drainage and Grading Plans, Reclamation Plans, SPCC Plans and Erosion Control Plans for the site. The Applicant shall monitor and update if necessary water quality and erosion control measures during construction and during operation of the facility. 1 L2 5 6 I I 7 The Applicant shall maintain all required COGCC permits and forms for the facility and shall comply with all conditions or requirements of said permits and forms. The facility shall maintain compliance with COGCC Noise Standards/Regulations at the residential 50 dBA standard or less. Within 30 days of initiating operation of the booster compressor the Applicant shall provide on-site noise readings to confirm compliance with the noise limit. lf compliance is not confirmed or if future compliance issues are identified, the Applicant shall provide additional noise mitigation in order to achieve compliance as confirmed by a qualified professional. As represented in the Application the facility shall have only temporary lighting for unscheduled night time maintenance. All lighting shall comply with Section 7-306, with all lighting to be directed inward and doward toward the interior of the site. The booster compressor facility and associated equipment shall be painted a non-glare neutral color to lessen any visual impacts. The Applicant shall maintain all required CDPHE permits for the facility including any applicable air quality, APEN permits. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan and agreement between Ursa Operating Company and CPW. .l0. The Director of the Community Development Department is authorized to approve, deny, or approve with conditions an Administrative Land Use Change Permit application pursuÍu¡t to the Land Use and Development Code of 2013, as amended (Code). F. The Director Issued a Dìrector's Decision letter on May 30, 2014, for approval with conditions for the Ursa Speakman A Injection Well. G. In response to a request for call-up received from property owners in the Battlement Mesa area, the Garfield County Board of County Commissioners (Board) determined, by a majority vote at a public meeting held on June 9, 2014, to exercise its authority to call-up the application at a scheduled Board public hearing on July 14,2014. H. The Board is authorized to approve, deny or approve with conditions an Adminishative Review Land Use Change Permit pursuant to the call-up provisions contained in Section 4-112 ofthe Code. I. The Board of County Commissioners opened a public hearing on the 14ú day of Jul¡ 2014 far consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. J. The Board closed the public hearing on the l4th day of July, 2014, to make a flnal decision. K. The Board, on the basis of substantial competent evidence produced at the aforemeniioned hearing, has made the following determinations of fact: 1. The Administative Review Land Use Change Permit for a Small Injection Weil, also known as the Ursa Speakman A Injection Well, is hereby approved subject to compliance with the following conditions: That all representations made by the Applicant in the application shall be conditions of approval unless specifïcally altered by the conditions of approval of the Board. That the Ursa Speakman A lnjection Iü/ell shall be operated in accordance with all applicable Federal, State and local regulations goveming the operation of this type of facility. Prior to issuanc.e of the Land Use Change Permit, the Applicant shall provide updated drainage information and/or designs adequate to address the refenal comments from the County's Consulting Engineer, Cb¡is Hale. Prior to issuance of the Land Use Change Permit, the Applicant shall provide an updated site plan including designation of kuck circulation areas within the well pad to be used for truck delivery taffic. The site plan shall also address circulation pattems to be implemented when aciive drilling and placemcnt of a drili rig on the well pad occurs. Prior to issuance of the Land Use Change Permiq the Applicant shall provide an updated dust control plan for the site and access roads with more specifics on the timing of watering and application of dust suppressing chemicals. The plan shall include the well pad area surrounding the injection well facilities. The facility shali maintain compliance with CDPIIE Storm Water Management Permits, Drainage and Grading Plans, and Reclamation and Erosion Control Plans for the site. The Applicant shall maintain all required COGCC perrnits and forms for the facility and shall comply with all conditions or requirements of said permits and forms. 8. If frrture compliance issues are identified, the Applicant shall provide noise mitigation in order to achieve compliance along with a technical evaluation by a qualified professional to confirm compliarce The Applicant shall comply with all SPCC Plan provisions and shall keep the plan current and updated for any changes to the facility. 10. As represented in the Application, the facility shall have only termporary lighting for unscheduled night time maintenance. All lighting shall comply with Section 78A4, Lighting Standards, with all lighting to be directed inward and doward toward the interior of the site. Facilities and storage tanks shall be painted a non-glare neutral color to lessen any visual impacts. 11. The Emergency Response Plan shall be updated to include a section on response to and prevention of field or wild land fìres. Separation between the injection well pad facilities and native vegetation at the perimeter of thp site shall be maintained. 12. The Applicant shall maintain all required CDPHE permits for the facility including any applicable air quality APEN permits. 13. The Applicant shall comply with the referral comments from Colorado Parks and Wildlífe (CP!Ð, including compliance with the Battlement Mesa Wildlife Mitigation Plan. Said plan and agreement between Ursa Operating Company and CPW includes a limitation on trucking to between the hours of 10;00 a.m. and 3:00 p.m., when and where possible, compliance with COCCC Noise Regulations and use of bear proof trash containers for all food related frâsh. 14. The Applicant shali compiy with the access representations and Traffic Report including limiting trucking to the designated haul route and the limitation to a maximum of 20 daily \ryater truck deliveries to the facility. The haul route is defined by the two maps in the Applicant's Traffi.c Study. The access map (I-70 to Speakman Pad) and the haul route map (Speakman Pad to Watson and Monument Ridge Pads) shall be considered the haul route. The daily trucking limitation may be calculated based on a weekly average to account for minor operational variations. Trucking of water to the site shall utilize watertight tanks and shall comply with all COGCC or CDOT requirements for hauling of production water. 15. The Applicant and property owner shall provide the County with a plan for minor re- grading and re-seeding of disturbed portions of the Speakman property outside of the Injection.Well facility.
