HomeMy WebLinkAbout4.0 Directors DeterminationGaffield Couln$ Community Development Department April22, 2016 Ursa Operating LLC 792 Buckhorn Drive Rifle, CO 81650 Attn: Rob Bleil Tilda Evans, Olsson & Associates 760 Horizon Drive, Suite 102 Grand Junction, CO 81506 RE: Director's Decision Ursa Speakman A Booster Compressor (GAPA-12-15-8410) Dear Rob and Tilda: This letter is in regard to the Director's Decision for your Administrative Land Use Change Permit Application for a booster compressor located on the Ursa Speakman A Well Pad, located at approximalely 5242 County Road 300 and known by Assessor's Parcel No. 2409-244-00-124. The property generally located in Section 24,T75, R96W of the 6th P.M, Your Application has been reviewed in accordance with the Administrative Review procedures contained in the Land Use and Development Code as amended. Said provisions require a Decision by the Director of the Community Development Department on whether to approve, approve with conditions, or deny the request. The Director's Decision is based on the following findings '1. That proper public notice was provided as required for the Director's Decision. 2. Consideration of the Application was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested pafties were given the opportunity to provide input prior to the Director's Decision. 3. That for the above stated and other reasons the proposed Land Use Change Permit for the Ursa Speakman A Booster Compressor is in the best 1 1 2 3 interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoptions of conditions and approval of a waiver regarding hours of operation, the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. The Director's Decision is hereby issued approving the Application subject to the following conditions: That all representations made by the Applicant in the application shall be conditions of approval unless specifically altered by the conditions of approval. That the Ursa Speakman A, Booster Compressor shall be operated in accordance with allapplicable Federal, State, and local regulations governing the operation of this type of facility. Prior to issuance of the Land Use Change Permit, the Applicant shall confirm that the site is currently in compliance with all existing conditions of approval for the injection well on the site as documented in Resolution No. 2014-41. 4. The facility shall maintain compliance with CDPHE Storm Water Management Permits, Drainage and Grading Plans, Reclamation Plans, SPCC Plans and Erosion Control Plans for the site. The Applicant shall monitor and update if necessary water quality and erosion control measures during construction and during operation of the facility. The Applicant shall maintain all required COGCC permits and forms for the facility and shall comply with all conditíons or requirements of said permits and forms. The facility shall maintain compliance with COGCC Noise Standards/Regulations at the residential 50 dBA standard or less. Within 30 days of initiating operation of the booster compressor the Applicant shall provide on-site noise readings to confirm compliance with the noise limit. lf compliance is not confirmed or if future compliance issues are identified, the Applicant shall provide additional noise mitigation in order to achieve compliance as confirmed by a qualified professional, As represented in the Application the facility shall have only temporary lighting for unscheduled night time maintenance, All lighting shall comply with Section 7-306, wíth all lighting to be directed inward and doward toward the interior of the site. The booster compressor facility and associated equipment ^¿ 5 6 7 I shall be painted a non-glare neutral color to lessen any visual impacts. I The Applicant shall maintain all required CDPHE permits for the facility including any applicable air quality, APEN permits. The Applicant shall comply with the Battlement Mesa Wildlife Mitigation Plan and agreement between Ursa Operating Company and CPW. 10. A waiver regarding hours of operation is approved allowing the Applicant to operate the booster compressor on a 24 hour basis as represented in the submittals. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential call-up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Directo/s Decision. The call-up period shall expire on May 2nd, Once the call- up period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved the Land Use Change Permit will be issued. Pursuant to the Land Use and Development Code, the Applicant has one year from the date of the Director's Decision to satisfy all conditions of approval or request an extension.
