At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Roonr, Garfield County Plaza Builditg, in
Glenwood Springs on Monday, the 19th day of July, 2004, there were present:

when the foltowing proceedings, among others were had and done, to-wit:

A R3SOLUTION CONCERNED \ryITH THE APPROVAL OF A CONDITIONAL USE
PERMIT TO ALLOW THE APPLICA¡{T CERISE RANCH L.L.C. TO CONSTRUCT A
coMMUNITy BUILDING ON LOT 1, CERISE RANCH SUBDIVISION, PHASE I TO
GARFIELD COuNTy, ON CERISE RANCH ROAD
WHEREAS, the Board of County Commissioners of Ga¡field County, Colorado, has
reseived applieatign from Cerise Ranch L.L.C. for a Conditional Use Permit. The Conditional
Use Permit would allow the applicrnt to have a Community Buikling on their property at
tlre 3.804 acre site located on the lot identified as Lot I Cerise Ranch Subdivision, Phase I to
Garfield County on Cerise Ranch Road and Highway 82.
WHEREAS, the Conditional Use Permit request for a "Community Building"
specifTcally will allorv a Community Building of 1,200 sq. ft. with a multipurpose roon\ workout
area, two restrooms, mechanical equipment a¡ea and an outdoor swimming pool.
WHEREAS, the subjeot property is located in the AgriculturaVResidentiaVRural Density
(A/R/RD) zone district which contemplates a "Commuuity Building" as a Conditional Use
within that district; and
WHEREAS, the Board held a public hearing on the 19ú day of July, 2004, upon the
question of whether the above-described Conditional Use Permit should be granted or deniedo at

which hearing the public and interested persons were given the opportunity to express their
opinions regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has m,ade the following determination of frct:
1. That proper publication and public notice was provided as required by law for the hearing
before the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and complete,
that all. pertinent facts, matters and issues were submitted and that all interested parties
were heard at that hearing.
3. That the application is in compliance with the Garfield County Zoning Resolution of
1978, as amended.
4. For the above stated and other reasons, the proposed use and permit is in the best interest
of the health, safety, merals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
NOVi, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Conditional Use Perrrit be and hereby is approved to allow for an
Comrnunity Building at the site identifred in the application, upon the following specific
conditions:
L The Ownet shall be required to gain any and all applicable land use permits for any
additional construction on Lot 1.
2. The Appticani shall landscape and screen the proposed use as shown in the proposal
layout plan in the application and as shown in Figure 1. of the final staffreport.
3. rWetlands determinations for the Cerise Ranch Subdívision, Phase 1 Final Plat shatl be
observed and no building shall occur in these areas.
4. The approval of the community building and pool on Lot I does not effect the existing
approvals for residential buildings on Lot l, all previous approvals remain in place for
Lot 1.
