Enclosed please a variance or Non-Substantial Change Permit to amend or modify the
Land Use Change Permit referred to Resolution20ll-36. The used of # 11 Enterprises
Lands is strictly communications and zone commercial. The location is in a rural area
and Union's facilities will blend in with the other communication facilities already in
operation. Cultural survey and clearance covered a four to five acre parcel which
includes the enlarged communication parcel. The location is also in the area where there
will be no interference with existing towers in operation.
Attached is the Statement of Non-Substantial Deviation which includes the change in
tower height to 120 feet and the enlargement of the parcel to a 100 foot by 100 foot

I. DESCRIPTION OF THE PROPOSAL
#11 Enterprises LTD has a lease agreement with Union Telephone Company for a
Gomrnunication Facility at the Douglas Pass Site. The proposal includes a
communications tower, support buildings, related infrastructure for electric power, and a
propane tank for generator operation in the event of a power outage. The site will be
served by an existing private access road on #11 Enterprises LTD property off of County
Rd. 256. The location is on the east side of the summit of Douglas Pass in the very
western part of Garfield CountY.
The proposed tower is approximately 45 ft. in height with antenna extensions up to a height
of 5i ft. per the Appticanfs plans. The towerwill support antennas for cellular phone and
related communication needs in the Douglas Pass area. The facility will be fenced for
security purposes and cornmunication equipment and emergency generators will be
housed in the support buildings. The facility will be unmanned with maintenance on a
monthly or more often as needed.
The tower and foundation will be designed by structural engineers and will be free standing
and not anticipated to require any wire supporls. Construction of the tower is projected io
take approximately 3 weeks. Thê support structures will require truilding permits and the
applicånt has represented that detailed soils analyses and engineered foundations will be
completed for all structures.

Future ftmcndment
TheApplicant has advised the Gounty and sulrmitted docun'¡entatian reflecting their plans
to worl< with Rio Blanco County and the Rio Blanco Sheriff's Office to facilitate co-location
of county communicaiion equipment on the pr-oposed tower. The co-loeation will require an
increase the height of the Tower to 120 ft. and an additional support building with a
propane backup tank. The additional height and facilities will improve $heriff's CIffice
communication and public safety throughout western Garfield County, Mesa and Rio
Blaneo Gounties. lt is the Applicant's intent upon receipi of a Land Use Change Permitfor
the eurrent application to submit a f¡¡ture request for a non-substantial amendment to allow
the additional tower height needed by Rio Blanco County. lnformatisn on the future
amendment request was included in the ap¡rlication materials sent out to the referral
ageneies.

The proposed site is a fairly level location surrounded by steeper slopes associated with its
Douglas Pass location. lt has exeellent exposure for eommunication connections with
otherfacilities north and south of the proposed facility. The site and neighboring terrain has
native vegetation typical of iis rural and remote ranching loeation.
The proposed tower is lscated adjacent to two other active communiçation towers and
evidence of several other abandoned facilities are also found in the general vieinity. The
two existing towers are 80 ft. and approximately 30 ft. in height. Each tower also has srnall
existing support structures and power. The proposed tower will be located just north and
west of the primary existing tower. ln the site photograBh below, the proposed tower
location is to the left of the picture near the existing evergreen vegetation.

Statement of Non-Substantial Change
The non-substantial deviation or change consists of the following:
The non-substantial change is consistent with actions taken during the previous Land Use
Change Permit approval. The non-substantial deviation does not change the use category
of the proposed development between the landowner and the intended commercial use of
the property. The non-substantial change does not change the basic character of the
approved use of the land, in which, the activity occurs, including visual appearance as
three other towers (60'&,80') already exist on the landowner's property. The deviation
does not constitute a new land development activity nor violate any Land Use Code
standards. Traffic at the communication site will only increase by one vehicle unit, being
the SherifPs communication technician and water and wastq generation is a non issue at
the site.
The non-substantial change consists of increasing the size of the communication parcel
from a 50 foot by 50 foot parcel to a 100 foot by 100 foot parcel inside a 594 acre rural
parcel to allow other users to share the tower and parking space. Increasing the tower
height from a 45 foot tower to a 120 foot tower will also allows space on the tower for
the Rio Blanco County SheriffDepartment (911 Emergency Response) and other users in
the future. The extra area is also needed to increase of the tower foundation base for the
higher tower to a32 foot by 32 foot from the 13' by 13' foundation base. The parcel
increase is to allow the Rio Blanco Sheriff Department to share the tower andplace a 12
foot by 28 foot building on the increased parcel. The parcel size increase will also allow
other users to share on the tower including Garfield County Communications. This
action does not endanger the public health, safety or welfare by this non-substantial
change.
Union Telephone Company requests Garfield County to consider approval of these non-
substantial changes by approving the Land Use Change Permit or Variance Permit.

is P. O. Box 88, DeBeque, Colorado 81630 and UNION TELEPHONE COMPA¡IY ('LesseeD),
whose address is P.O. Box 160, Mountain View, Wyoming 82939, upon the following background
and terms:.
A. Lessor owns real property in a portion of the*NW llA*of ,ürc SE 1/4, Sebtion 25,
Township 5 south, Range toz west, oú p.trrt., in Garfield county, colorado, more particularity
described in the attached Exhibit "A";
B. Lessee is authorized by the Federal Communication Commission to provide "8"
frequency cellular communication service to the public in Garfield County, Colorado; and
c. Lessee placement of communication facilities ("Communications Facilities") on the
above-described rit" *iff provide improved cellular communication coverage and service to the
public; and
D. Lessee desires to lease the unimproved 50' x 50' sqr¡are parcel of land described in
Exhibit 0.A,, and associated ingress and egress from Lessor, and Lessor is willing to lease such space
to Lessee;
NOW, THEREFORE, in consideration of the mutuat promises, covenants and agreements
contained herein, the parties agree as follows:
1. The Leased Premises.
(a) Lessor, for and in consideration of the payment of the rentals and the performance of

2. Terrr and Renewal.
(a) Initial Tenn. The initial term of this lease shall be one (1) year, from the lut day of
March, 2009, during and until ttre tast day of April, 2010 unless soonef terminated as
provided for in this lease.
(b) Renewal terms. so long as Lessee is not then in default, Lessee shall have the rigþt to
renew this Lease for five (5) successive renewal temrs (*Renewal Terms") of one year each,

predates Lessee o"r,rp*"y and use under this Lease Agreement' All operations by Lessee
shall be lawful and in complianc" *itr, all Federal coámunications commission ('FCC")
requirements. In addition, no tansmitter shall deliver more than 100 watts per frequency at
the combiner outPut.

Lessee will not permit any liens or encumbrances against the leased premises for work or

10. Indemnification
Lessee covenants and agrees to indemnifu, defend and hold proceedings, claims, demands,
losses, costs, damages, ã*p"rrs"r and legat fees whatsoe-ver which may be brought against
Lessors, theír emplıy""r, ãgents, membérs, affiliates, subsidiaries, parlners, property of Ty

except as expressly provided to the contrary in this Lease.
13. MiscellaneousProvisions.
The following provisions are also integral parts of this agreement:
(a) Subject to any prohibition against assignment co¡tained elsewhere in this l-ease or
àppücable iaw, this Lease is binding upon and shall inne to the benefit of the parties
successors and assigns.
(b) ln any action to enforce this Lease, the prevailing party shall be entitled to collect its
reasonable attomey's fees from the non-prevailing party.
(c) This agreement shall be construed in accordar¡ce with Colorado law. Its provisions are
ìeverable, *ðth" unenforceability of one provision shall not affect the remaining provisions,
which shall remain fully enforceable according to their terms. Notwithstanding any arg_umer.tt
or theory to the contary, this Agreement is a lease which is governed by the law in Colorado
relatingio the relationship of landlord and tenant. This Agreement is not intended to create an
easemãnt, license or *y other servitude other than those that are specifically expressed as
appurtenant to the landlord/tenant relationship create by this Agreement.
(d) Any legal action concerning this Lease shall be brought in Garfield County, Colorado.
(e) Any party executing this Lease on behalf of an entity wa¡ranis that he or she has the
àútnority tó bond the entiff for which he or she signs to thc terms of this Lease.
(Ð The headings used in this Lease are inserted for reference and shall not be deemed to
ùmít or affect the meaning or interpretation of any of the terms of this Lease.
(g) This Lease constitutes the entire understanding and agreement between the parties
ìãíating to its subject matter and supersedes all prior agreements, representation or
understandings between the parties.
(h) No waiver by any party of any part of this Lease shall be effective unless in writing
and clearly expressed. No single waiver shall be continuing waiver or consent to any
subsequent breach ofthis Lease by the other party'
This Lease may not be modified except in vrniting signed by the parly against whom
the modification is sought to be enforced.
Time is of the essence with respect to the performance of any term of this Lease.

I. DESCRIPTION OF THE PROPO.SAL
#11 Enterprises LTD has a lease agreement with Union Telephone Company for a
Communication Facility at the Douglas Pass Site. The proposal includes a
communications tower, support buildings, related infrastructure for electric power, and a
propane tank for generator operation in the event of a power outage. The site will be
served by an existing private access road on #11 Enterprises LTD property off of County
Rd. 256. The location is on the east side of the summit of Douglas Pass in the very
western part of Garfield County.
The proposed tower is approximately 45 ft. in height with antenna extensions up to a height
of 53 ft. per the Applicant's plans. The towerwill support antennas for cellular phone and
related communication needs in the Douglas Pass area. The faciìity will be fenced for
security purposes and communication equipment and emergency generators will be
housed in the support buildings. The facility will be unmanned with maintenance on a
monthly or more often as needed.
The tower and foundation will be designed by structural engineers and will be free standing
and not anticipated iãieqrire any wirð suppórts. Construction of the tower is projected.to

applicant has represented that detailèd soils analyses and engineered foundations will be
completed for all struotures.

native vegetation typical of its rural and remote ranching location.
The proposed tower is located adjacent to hruo other active communication towers and
evidence of severai o*rer abandoned facilities are also found in the generalvicinity. The
two existing towers are g0 ft. and approximately 30 ft. in height. Ëach tower also has sma[l
existing support structures and power- The proposed towerwillbe located just north and
