Dear Glenn:
Here is the additional information as requested by Garfield County Planning andZoning
to explain various parts of the non-substantial deviation change filed by Union Telephone
Company:
1.) Tñe ,ôutottt for the delay in getting the First Amendment approved by No I I
Enterprises LTD is the Draft First Amendment contain an escalation of l l}YotentaI
increase every third year of a29 year lease which is truly unacceptable. Several phones
call back andforth tó tandowner and lessee finally came to agreeable rental increases of
10olo cost. The lease parcel was changed from a 100 foot by 100 foot parcel to a 60 foot
by 60 foot parcel because ofthe high square foot cost for the larger parcel and was not
affordable. The term period was one year to year with landowner's right to a cancel the
lease at any time, again not acceptable, Changes to the first Draft was sent with Union
TelephoneCompany and notice that the Drawings needed a minor change per the Rio
Blanco County ıh*ger. These changes was completed and sent in for obtaining final
approval ofthe lease.
Z.i eutfro¡zed officers of the Company that can sign off on the on leases has not change
since the original agreement was signed. I (Rex Headd) can still sign off on permits but
leases still and has to be signed by the authorized offrcers of the company.
3.) The property owners within 200 feet of the communication site is still the Bureau of
Land Management and Twin Buttes Land Company LLC.
4.) A "opyãf th" amended signed lease is attached with revised drawings and material
list for the Rio Blanco County and Union Telephone Company equipment.
5.) The 464 square feet usage was determined for the addition of the Rio Blanco County
Equipment nuitaing and County associated vehicle parking and the main reason was the
enlargement of the 50' by 50' parcel to a 60' by 60' parcel. The total usage area is 3600
rq.r*é feet for Union Telephone Company and Rio Blanco County operations'
The lands is strictþ used for communications and is zoned commercial. The location is
in a rural area and Union's facilities will blend in with the other communication facilities
already in operation. Cultural survey and clearance covered a four to five acre parcel
which includes the enlarged communication parcel. The location is also in the area
where there will be no interference with existing towers in operation.

is attached and incorporated by this referenoe as Exhibit A. Lessee has completet'l the
l'equil'Èments of Garfield County for the issuance of a ContJitional Use Perrnit for tlte
implorreme.nts desclibed in the Lease, By this First Amendntent, Lessee proposes, and
Lessol., accepts a modification of the Lea.se in the mamìel' antl upon the temrs set folth
below.
2. Terms, For valuable consic'leration, the t'eceipt an¿l sufficiency of which is
äcl<nowledged, the Pafiies aglee that the Le¿se shall be amcncled as follows:
A. The Lea.¡ed Premise.r. The Leased Pt'emises ale heleby enlarged to
constitute a 60 foot by 60 footpalcel of land as depicted on tlt<; map titlached and
incorporated as Exhibit B.
B. Pernütted Uses. In addition to the uses set fbrth in lhe Lease, the
Leased Premises mây be uscd by the Rio Blanco County Sheliffs Departrneut (a
perrnitted Sublessee) to erect anrl maintain a 2A fuot by 30 foot utitity shed
("County Building") together with a 1000 gallon pl'opâne tanl< to proviclc fr:el for
the backup generatot' located inside the County tluilcling, The
telecomlnutrications [owor', notw'ithstanding anything to the contrary in the LeasÈ,
may be electecl to a height of 120 feel. Lessee may enlarge the concrcte pad site
for the fower to 30 leet by 30 feet. Suble.ssee rnay install on the Cell Tower two
six-foot colrununication dishes and associated equiprnent and hardware, including
antôrnas. The list of adt'litional equipment perrnilted by this First Amendrnent is
attached as Exhibit C. No less than annually, Lessee shall identify in writing all
users of each towel'ofher than Lessc'.e and provide such docttrnent to Lessot'.
C, Lea.¡e Term. Notwithstancling anything to the contrary stated
elsewhere ín the Lease, the amended term ("lnitial Amendecl Têrtn") shall be fol a

Re-Douglas Pass Commun¡cation Site - Regulations and lnterference

FAA notification requirements:
Title 14 CFR Part 77 - Code of Federal Regulations is the Regulatory Policy that establishes the
requirements to provide notice to the FAA of Communicat¡on Towers, and other structures. The Union
Telephone proposed Douglas Pass Communication Site is exempt from notification to the FAA according
to the standards set forth in section 77.9 {a)-(el, as it is less than 200 ft. AGL, and more than 20,000 ft.
from any airport. The d¡stance from an airport was verified both through a physical search for nearby
airports on maps, and through the use of the FCC's TOWAIR tool (see attached TOWAIR search results).
FCC notification requirements
ln general, if the FAA does not require notification to build a tower, The FCC also does not require
permission to build the tower. There are some types of licensed radio services that do require location
specific permission from the FCC to use. The only license of thís type to be used by Union Telephone on
this site is Point to Poínt Microwave. Union Telephone Company has gone through the required process
to obta¡n permission to use this radio service at this location.
lnterference to Others:
With the exception of the Point to Point Microwave, the frequencies to be used by Union Telephone
Company at the Douglas Pass Communication Site are all licensed exclusively to Union Telephone
Company for this geographical area; therefore, no direct radio interference can occur. This leaves only
the possibility of indirect interference, or inter-modulation between users. While it ¡s ¡mposs¡ble to
completely rule out the potential for inter-modulation at this site, modern radio equipment and
construction methods are built in such a manner that interference between users is not likely to occur.
ln the unlikely event that radio interference does occur, Union Telephone will work with the affected
parties to eliminate the ¡nterference.
The radio service most likely to be affected by interference at this site is Point to Point Microwave. ln
order to receive a license to use this radio service, Union Telephone has gone through an independent
coordination agency to verify that the proposed Microwave paths will not interfere with any previously
licensed Microwave paths. lf Microwave interference does occur as a result of Union Telephone's new
paths, the burden lies with Union Telephone to mitigate the interference.

Hi Rex: I have not heard back from Carey Gagnon, Acting County Attorney, but thought I would still get you an interim
update. With the lease we should be all set in terms of completeness (pending feedback from the Attorney) but we
should address the delays you experienced. This is in part necessitated as your original submittal date for the Non-
Substantia I Amendment was August 3L, ?OLL.
Please provide us with a cover letter to go with the new amended lease addressing: (1) Brief explanation for the delay;
(2) Confirmation that all authorizations including "authorizations to represent" are still currenU (3) Confirming that your
list of property owners within 200 ft. is still current; and (4) A copy of Exhibit "C' from the amended lease including the
updated list of equipment (Ex. C was not attached to the copy of the lease we received).
Your letter should also address the difference between the Application which indicates the leased area would be
increased to 100 ft. by 100 ft. and the amended lease which only increased the area to 60 ft. by 60 ft. Your application
contains a site plan and it would be great for you to confirm that it is still current and that the sizes and locations of the
various buildings including the Sheriffs building have not changed. As we discussed by phone, if you could provide a
letter or email from your telecommunications engineer confirming the FAA compliance findings contained in his June 8,
2011 memo are still current/applicable to the new taller tower that would be great. This could include an updated
Towair including the new proposed height of the tower.

THIS FIRST AMENDMENT is made this IOut of iÏtfi í-'., ,2llz,by and
between Union Telephone Company, a Wyoming Corporation ('Lessee") and #11
Enterprises, Ltd., or its assignee (olessor"'), who may be referred to collectively as the
"Parties,"
1. Baclcground. The Lessor and the Lessee's pledecessor in interest enteled
into a Communication Site Lease ("Lease") on or about 4pri1.24,2009, a copy of which
is attached and incorporated by this reference as Exhibit A. Lessee has completed the
rcquircments of Garfield County for the issuance of a Conditional Use Permít for the
improvements described in the Lease. By this First Amendment, Lessee proposes, and
Lessor, accepts a modification of the Lease in the manner ancl upon the tems set fofih
below.
2. Terms. For valuable consideration, the receipt and suffrciency of r,vhich is
acknowledged, the Parties agreethal,the Lease shall be amended as follows:
A. The Leased Premises. The Leased Premises are hereby enlarged io
constitute a 60 foot by 60 foot parcel of land as depicted on the map aftached and
incorpolated as Exhibit B.
B. Permitted Uses. In addition to the uses set forfh in the Lease, the
Leased Premises may be used by the Rio Blanco County Sheriffs Department (a
permitted Sublessee) to erect and maintain a 20 foot by 30 foot utility shed
("County Building") together with a 1000 gallon plCIpane tank to provide fuel for
the backup generator located inside the County Building. The
telecommunications tower, notwithstanding anything to the contrary in the Lease,
may be erected to a height of DA feet, Lessee may enlatge the concrcte pad site
for the tower to 30 feet by 30 feet. Sublessee may install on the Cell Tower two
six-foot communication dishes and associated equipment and hardware, including
antènnas. The list of additional equipment permitted by this Filst Amendment is
attached as Exhibit C. No less than annually, Lessee shall identify in writing all
users of each tower other than Lessee ancl plovide such document to Lessor,
C, Lease Term. Notwithstancling anything to the contrary stated
elsewhere in the Lease, the amended telm ("Initial Amended Tèrm") shall be for a
period of three years, which shall. end. on the last day of April 2015, Unless
sooner telminated, and there are no uncured events of Default, tþe Lease, as
modified by this First Amendment, shall automatically renev¿ for an aclditional
five (5) successive three-year terms ('oRenewal Telm").

11. Fnvjron¡nentalMattgrs
Lessee shall not ur¡e or permit the Properly to be used for the manufasft¡re, storage use, or
disposal of any substance olassified or categorized as ahazrr:dous material or subsüance by
arly applicablo federal, stiate or local environmental law, regulaÍion or ordinance (together
"Envh'onrnental RegUlations')n nor will Le,ssee do or permlt a{ry aú, or omission on the
Property ttrat is Ín violation of Lessee undo¡ this Lease. Iæssee will indemnify and hold
harmless from and against all cost, oxpense, losseso liabilìties, and damages of âny nature
(including without limitation response and remediation costs, attomeys fees, consultant and
expert fees) in any way arising 'from or lelated to the violation of Lesseo's promises contained
in this Section. The provisions of this $eotion shall survive the termination of this Lease by
expiration of the Term or othorwÌse, Lessee shall immediateþ provide to læssor a copy of

Re-Douglas Pass Communication Site - Regulations and lnterference

FAA notification requirements:
Title L4 CFR Part 77 - Code of Federal Regulations is the Regulatory Policy that establishes the
requirements to provide notice to the FAA of Communicat¡on Towers, and other structures. The Uníon
Telephone proposed Douglas Pass Communication Site is exempt from notifieation to the FAA according
to the standards set forth in section 77.9 (a)-(e), as it is less than 200 ft. AGI and more than 20,000 ft.
from any airport. The distance from an airport was verified both through a physicalsearch for nearby
airports on maps, and through the use of the FCCs TOWAIR tool (see attached TOWAIR search results).
FCC notification req uirements:
ln general, íf the FAA does not require notification to build a tower, The FCC also does not require
permission to build the tower. There are some types of licensed radio services that do require location
specific permission from the FCC to use. The only license of this type to be used by Uníon Telephone on
this site is Point to Point Microwave. Union Telephone Company has gone through the required process
to obtain permissíon to use this radio service at this location.
lnterference to Others:
With ihe exceptíon of the Point to Point Microwave, the frequencies to be used by Union Telephone
Company at the Douglas Pass Còmmunication Site are all licensed exclusively to Union Telephone
Company forthis geographical area; therefore, no direct radio interference can occur. This leaves only
,the possibility of indirect interference, or ínter-modulation between users. While it is impossible to
completely rule out the potential for inter-modulation at this site, modern radio equipment and
construction methods are built in such a manner that ¡nterference between users is not likely to occur.
ln the unlikely event that radio interference dses occur, Union Telephone will work with the affected
parties to eliminate the ínterference.
The radio service most likely to be affected by interference at this site is Point to Point Microwave. ln
order to receive a license to use this radio service, Union Telephone has gone through an independent
coordination agency to verify that the proposed Microwave paths will not interfere with any previously
licensed Microwave paths. lf Microwave ínterference does occur as a result of Uníon Telephone's new
paths, the burden lies with Uníon Telephone to mitigate the interference.

I. DESCRIPTION OF THE PROPOSED AMENDMENT
#1 I Enterprises LTD has formalized a "First Amendment to Communication Site Lease" to
affow an increase in tower height to 120 ft. along with related support structures and
infrastructure for co-location of telecommunication facilities with the Rio Blanco Sheriff
Department. The proposal includes in addition to the tower, a utility shed with a propane
tant to provide fuel for the backup generator located inside the County Building. As
previously approved the proposal included a45 - 53 ft. tall communications tower, Union
Telephone's support buildings, related infrastructure for electric power, and a propane tank
for generator operation in the event of a power outage.
The site is served by an existing private access road on #11 Enterprises LTD property off
of County Rd. 256. The location is on the east side of the summit of Douglas Pass in the
very wesiern part of Garfield County. The facility will be fenced for security purposes and
will be unmanned with maintenance on a monthly basis or more often as needed.
The tower and foundation will be designed by structural engineers and will be free standing
and not anticipated to require any wire supports. Construction of the tower is projected to
take approximately 3 weeks. The support structures will require building permits and the
applicant has represented that detailed soils analyses and engineered foundations will be
completed for all structures.

Future Amendment
At the time of the original approvals the Applicant advised the County and submitted
documentation reflecting their plans to work with Rio Blanco County and the Rio Blanco
Sheriff's Office to facilitate co-location of county cornmunication equipment on the
proposed tower. Conditions of approval #3, #9, and #10 in the original Resolution of
Approval No.2011-36 included provisions in anticipation of the current non-substantial
amendment request. lnformation on the amendment request was included in the
application materials sent out to the referral agencies.

The proposed site is a fairly level location st¡rrounded by steeper slopes associated with its
Douglas Pass location. lt has excellent exposure for communication connections with
otherfacilities north and south of the proposed facility. The site and neighboring terrain has
native vegetation typical of its rural and remote ranching focation"

III. AUTHORITY - STAFF ANALYSIS
A. Pursuant to Sectíon 4-107( X5Xa) of the Garfield County Unified Land Use
Resolution of 2008, as amended (ULUR) the Director of the Building and Planning
Department has the authorityto make decisions regarding whetheran amendment request
constitutes a non-substantial modification to an existing Land Use Change
PermilApproval. The ULUR also contains relevant procedures (Section 4-107), the
definition and criteria for making a non-substantial change determination (Section 16-101 -
see excerpt below), authorization for the Director to administratively approve an
amendmentApplication and notice procedures and a call-up period forthe Board of County
Commissioners (Section 4-1 07(AX6)).

l\lon-substantial Change. A non substantial amendment may be made to
an approved Land Use Change Permit if it meets all of the following criteria
as determined by the Director:
/s consr.sfentwith action(s) taken during previous Land Use Change Permit
approval;
Does not change the use category of the proposed development between
residential, commercial and industrial uses;
Does not change the basic character of the approved use of land on which
the activity occurs, including basic visual appearance and method of
operation;
Does not constitute a new land development activity;
Does not violate any Land Use Code standard;
Does not substantially increase off-site impacts (including but not limited to
increased traffic, water use, wastewatergeneration, etc.) in the sunounding
neighborhood;
Does not substantially increase the need for on-site parking or utilitíes;
Does not increase the floor area of the use by more than five (5) percent or
decrease the open space on the site by more than five (5) percent; and
Does not endangerthe public health, safety orwelfare. (Resolution 2010-30)
B. The Application has been found to be complete and has been reviewed by Planning
Staff and the County Attorney's Office has reviewed the amended lease and related
documentation.
C. Staff review of the criteria for a non-substantial change supports an affirmative
finding that the Application meets the criteria subject to compliance with conditions of
approval. No additional off-site impacts are anticipated including traffic, water use and
parking demand. While the proposed tower will be taller than the existing towers on the
site, impacts including visual are not considered significant given the location of the tower.
D. The Applicant shall be required to comply with building code requirements and
zoning provisions, drainage and storm water requirements, and site reclamation.

E. Condition #3 of Resolution 2011-36 established size limitations on the overall
square footage of communication buildings on the site, addressing the need for Sheriffs
Department structures associated with the co-location. Compliance with the total limitation
of 464 sq.ft. of communication buildings will be required. The 464 sq.ft. limitation was
calculated not including generator enclosures and propane storage and the current
proposal is consistent with the Applicant's past representations.
IV. STAFF RECOMMENDATION
Planning Staff supports a Director determination that the amendment request be
considered a non-substantial change and supports Director approval of the proposed
amendment to the Land Use Change Permit - Approvals, to allow construction of the
additional tower height and related improvements subject to the following conditions:
1. Compliance with all prior approvals including but not limited to Resolution No. 2011-
36 and conditions of approval contained therein shall remain in effect.
2. The approval is for a leased area 60 ft. by 60 ft. containing the proposed tower and
support structures consistent with the First Amendment to Communication Site
Lease (dated June 9,2012).
3. The Applicant shall provide confirmation in writing that all authorizations to
represent in regard to the Application are current and that the list of property owners
within 200 ft. is still current.
4. The Applicant shall provide a copy of Exhibit "C" outlining an updated list of
equipment and the size of all proposed support structures.
5. The Applicant shall provide an update from your telecommunications engineer
confirming the FAA compliance findings contained in his June 8,2011 memo are
still current and applicable to the new taller tower proposed for the co-location
facility.
6. The Applicant shall provide an updated site plan which shall be attached as an
exhibit to the Amended Land Use Change Permit issued for the non-substantial
Amendment request and shall demonstrate compliance with all conditions of
approval including the limitations on communication building square footage.
