Roadway and Design Standards ............................................................................................. 9 BJU N23-496 Central Delivery Point Article 4 Section 203.B.5. - Project Description Administrative Review Application Narrative Administrative Review Caerus Piceance LLC Garfield County, Colorado 3 | Page 1001 17th Street, Suite 1600 2022 Denver, CO 80202 1) Introduction Caerus Piceance LLC (Caerus) (Also known as Caerus Oil and Gas LLC and Caerus Operating LLC) is pursuing an Administrative Review (AR) in Garfield County for the development of a central delivery point site, the BJU N23-496 Central Delivery Point (N23 CDP). The proposed site will be located on private property, owned by Caerus, approximately 13 miles north of Parachute, Colorado. The site use will be defined as Material Handling. The N23 CDP’s main function will be to accommodate three-phase separation, storage, and transfer of produced gas, condensate, and produced water from three nearby well sites. 2) Description The following narrative addresses the requirements for the Project Description under Article 4 Section 203.B.5 of the Garfield County Land Use and Development Code (LUDC). The purpose of the proposed facility will be to accommodate three-phase separation, storage, and transfer of produced gas, condensate, and produced water from three nearby well sites within the North Parachute Ranch (NPR) operations area. The CDP will reduce overall acreage disturbance for each well site serviced by the subject CDP. Typically, separation of fluids occurs on each individual well site. The proposed CDP will serve as a centralized three-phase separation facility, eliminating the need for separation to occur at each individual three well sites. No product separation or fluid storage will take place on three well sites; thus, reducing the acreage size of the three well sites. Caerus is the surface owner of the subject parcel. The proposed CDP will support the following three COGCC approved well pad located in the North Parachute operations area: • BJU /M23A-496: 27 wells • BJU B26-496: 30 wells • NPM G35-496 Pad: 22 wells Table 1 details information on the well pads that will be supported by the N23 CDP. Location of the associated well pads and pipeline right-of-way are depicted on the Associated Well Site and Pipeline Map, provided in the Maps and Plans tab. The facility will only service wells operated by Caerus (the Applicant and Surface Owner) and will not provide services to third parties. Caerus will be the sole Operator and user of the subject site. The proposed site is approximately 2.34 acres after initial grading activities. After construction of the facility, interim reclamation will occur. The acre size of the site will be reduced to 1.02 acres; resulting in long term disturbance of 1.02 acres for the proposed site. Three phase separation will occur at the CDP facility, with oil being separated, and measured through a LACT Meter, dumped to, and sold from the oil tank battery. Gas will be separated, measured, and will flow into an existing gas gathering line, carrying the gas to the Story Gulch Compressor Station or Middle Fork Compressor Station, where compression and dehydration activities will occur. Measurement of the gas, on the gathering facility pad, will be the custody transfer and allocation point. Subject to permit approval, equipment availability, and wildlife timeframe stipulations, construction of the N23 CDP facility will occur in 2022. After the facility is constructed and associated pipelines are installed, interim reclamation will take place. Colorado Oil and Gas Conservation Commission Permit The CDP will be a production facility, as defined by the Colorado Oil and Gas Conservation Commission (COGCC) below: PRODUCTION FACILITY means any storage, separation, treating, dehydration, artificial lift, power supply, compression, pumping, metering, monitoring, flowline, and other equipment directly associated with a well. COGCC approved the Form 2A Location Assessment on January 14, 2021, prior to COGCC rule changes which occurs on January 15, 2021. The location does not require an Alternative Location Assessment (ALA). No additional COGCC permits for this Location as required at this time. A Process Flowline Diagram, which details proposed flowlines to be installed at the facility, is included in the Maps and Plans tab. N23 CDP Equipment: • (3) Three Phase Separators • (3) Aerial Water Coolers • (3) Oil Storage Tanks with Secondary Containment • (1) Oil LACT Skid • (1) VOC Combustor Liquid Knockout Drum • (1) Knockout Drum Liquid Pump • (1) VOC Combustor • (1) Gas Meter Skid • (1) Fuel Gas Skid • (1) Instrument Air Skid • (1) Electrical Transformer • (2) Electrical Racks • (1) Control Room Skid / Building The N23 CDP facility will require the installation of one building. The Master Control Center (Identified on the Site Plan as the “Control Building”) will house the control room. o Estimated dimension: 15 ft by 10 ft. o Approximately 150 sq. ft o Caerus will obtain a building permit from Garfield County Community Development Department. Building will be state certified. Pipelines Each well site supported by the N23 CDP will have a dedicated pipeline that will connect the well site to the subject facility. Table 3 provides details on pipelines that will be connected to the N23 CDP. The stages and estimated timeframe of each stage is listed below: • Initial Grading Activities – Completed (Grading Permit located in the Grading and Drainage tab) • Facility Construction – 30 days • Interim Reclamation – 10 days • Production – 30 years At this time of application submittal, Caerus does not have a timeline for final grading and reclamation activities. On average in the North Parachute Ranch operations area, a well site may be produced for 30 years. Reclamation standards and closure procedures at the time of closure will influence time interval associated with reclamation activities. Inspection activities will occur throughout operations at the site and will coincide with other stages. Inspection activities will vary and may include (but not limited to): noxious weed and stormwater inspections, government agency compliance inspections, housekeeping, maintenance, and sampling. Caerus will obtain all necessary permits from the Garfield County Community Development Department as required before the start of any future construction activities at the CDP site. Caerus did obtain a grading permit and completed grading activities prior to pursing a land use change permit application due to wildlife timing Pipeline Diameter (Inches) Description G35 12 Will transfer gas from the G35 well pad to the N23 CDP. The proposed site is located on Caerus’s property and within the NPR operations area. The CDP site is critical to Caerus’s ability to drill the proposed natural gas wells within the NPR operations area. 4) Location The proposed CDP site plan is designed to be approximately 2.4 acres during initial construction, reducing to 1.02 acres after interim reclamation. The facility will be easterly located on parcel 1917-274-00-012, the Southeast ¼ of the Southwest ¼ of Section 23, Township 4 South, Range 96 West of the 6th Principal Meridian, Garfield County. The subject parcel is approximately 9,333 acres. An access road to the site location is maintained and owned by Caerus, the Applicant. The site will be located in subzone Resource Lands-Plateau. The site is located approximately 15 mapped miles north of Parachute, Colorado. The site is located approximately 7 miles from County Road 215. Caerus Piceance LLC, the applicant, is the owner of the property. Due to parcel size and length of the deed, an abbreviated version of the parcel deed pertaining to project area’s legal description is provided in the Parcel Details tab. Caerus can provide the deed in its entirety to the Community Development Department upon request. In accordance with C.R.S. §24-65.5-101, a copy of the mineral interest owner of the subject property is located in the Parcel Details tab. Rio Blanco County borders the subject parcel to the north. Adjacent parcels located to the north in Rio Blanco County are zoned Agricultural. The Adjacent Parcel Map is located in the Parcel Details tab. An address list of real property adjacent to parcel 1917-274-00-012, the mailing address for each of the property owners and the appropriate portion of a Garfield County Assessor’s Map showing the project site location and all public and private landowners adjacent to the subject parcel are provided in the Parcel Details tab. 6) Section 4-202 Waiver of Submission Requirements 6.1) Section 4-203 J. Development Agreement Caerus requests a waiver for the Development Plan, Section 4-203(J) of the Garfield County Land Use and Development Code. The proposed site is an industrial use and will solely be owned by the applicant. The Development Agreement is not applicable to the proposed site because the applicant does not seek to enter into a development agreement. 6.2) Section 4-203 K. Improvement Agreement Caerus requests a waiver for the Improvement Agreement, Section 4-203(K) of the Garfield County Land Use and Development Code. The site will not require the installation of public utilities nor will increase demands on public facilities. The site location is remote and is currently used for oil and gas activities. The Improvement Agreement is not applicable to the proposed site because the remote location will not require the installation or improvements of public facilities. 6.3) Section 4-203 L. Traffic Study Caerus requests a waiver for the 4-203L.1.c Study Preparation, which states the study can be completed by a professional engineer. The development of the N23 CDP will not increase vehicular traffic during the production phase of operations since vehicles will access the proposed site from other oil and has locations within Caerus’s private property. Average daily traffic will increase on CR 215 for 40 days in 2022. Based on the N23 CDP projected maximum vehicular trips for 2022, the VPD will increase 0.1% when averaged for the entire 2022 year. CR 215 will see only an increase in traffic during the initial development during 2022. The increase in average daily traffic during the site’s lifespan is not expected to be significant on roads generally used by the public. Long-term traffic impacts are not anticipated from the development of the N23 CDP. The Traffic Summary provides traffic routes, roadway analysis, trip generation and distribution from the proposed site. 7) Section 4-118 Waiver of Standards 7.1) Section 7-104. Source of Water Caerus requests a waiver for the standard Source of Water, Section 7-104 of the Garfield County Land Use and Development Code. The proposed facility will not require water for personnel or for the proposed use. The N23 CDP will not have personnel staffed at the site on a regular continuous basis. During construction and interim reclamation activities, personnel will access the site daily until the facility is in full operation. Once facility operations are established, the site will be accessed 2-3 times per week. Due to the minimal presence of employees onsite, drinking water use will not be required onsite during operations. Drinking water will be provided to personnel in the form of bottled water. 7.2) Section 7-105. Central Water Distribution and Wastewater Systems Caerus requests a waiver for the standard Central Water Distribution and Wastewater Systems, Section 7-105 of the Garfield County Land Use and Development Code. The proposed use, material handling, is not served by an existing public collection system or treatment facility nor is an on-site wastewater treatment system proposed. During operations, personnel will not be required to be manned at the site other full-time. Due to the minimal presence of personnel onsite, a wastewater use will not be required onsite. A portable toilet will be located onsite. The portable toilet will be provided and maintained by Western Colorado Waste. 7.3) Section 7-106. Public Utilities Caerus requests a waiver for the standard Public Utilities, Section 7-106 of the Garfield County Land Use and Development Code. The proposed use, material handling, does not require the use or installation of any public utilities. Caerus will utilize electrical power from existing generators operating at the Caerus Divide Road Water Treatment Facility. Caerus will install above-ground electrical lines to transfer electrical power to the N23 CDP. This will reduce emissions and noise at the CDP by utilizing an existing electrical source. 7.4) Section 7-107 F. Roadway and Design Standards In accordance with Policy 01-14 Waiver for Roads and Demonstration of Compliance, Caerus requests a waiver for the Roadway and Design Standards, Section 7-107 of the Garfield County Land Use and Development Code for Caerus’s existing private access roads. The access road within the perimeter of the proposed site will be built to meet all the 7-107 Roadway Standards set forth in the LUDC. BJU N23-496 Central Delivery Point Article 4 Section 203.B.5. - Project Description Administrative Review Application Narrative Administrative Review Caerus Piceance LLC Garfield County, Colorado 10 | Page 1001 17th Street, Suite 1600 2022 Denver, CO 80202 Like many of the historical roadways in Garfield County, Caerus’s private access and roadways were established prior to the Garfield County’s roadway standards. Caerus’s roadways are maintained to provide safe access to sites and are inspected for stormwater compliance. Roadways were designed for oil and gas transportation vehicles and equipment. These roads are not intended for or allow public access. Caerus’s enforces reduced vehicular speeds and specific safety driving measures. All roads located on the subject parcel are maintained by Caerus to achieve optimal safety, including speed restrictions, regular road maintenance, dust controls, and snow maintenance. The N23 CDP is located within Caerus’s North Parachute operations area. The site is located approximately 7 miles from the public road, County Road 215. To access the site, vehicles will travel on Caerus’s privately owned and maintained network of access roads. These private access roads are safe and adequate for oil and gas associated vehicular access. A Professional Engineer (P.E.) from KLJ assessed the private roadways and determined that the roadways are safe and adequate for the proposed and current industrial traffic. The P.E. Assessment Letter (Policy 01-14), which includes photos and cross sections, compares the existing roadways to Table 7-107 Roadway Standards. Grading activities were completed for site preparation prior to the submittal of the Land Use Change application due to wildlife timing stipulations set forth by CPW, COGCC, and the BLM. GENERAL PROJECT DESCRIPTION The Applicant is proposing a Central Delivery Point (CDP). The CDP will separate liquids (water and hydrocarbon condensate) and will handle gas produced from 73 wells on 3 separate sites approximately a couple hundred yards to about a mile away from the CDP location. The CDP will consist of a 3-phase separator, generator, combustors, and additional equipment. Water and gas will be piped to the compressor station and oil will be stored on site then trucked off. Pipelines do not exceed 12 inches. The CDP will allow for increased interim reclamation by permitting separation to occur at a centralized location rather than the source well sites. The Oil and Gas Location was approved by COGCC on January 14, 2021 and the site does not require an Alternate Location Analysis. The Land Use & Development Code (LUDC) categorizes this type of use as a Materials Handling facility. In the past similar CDP facilities were processed as Limited Impact Land Use Change Permits. Recent changes to the LUDC now require CDP facilities in the Resource Lands Zone District to be reviewed and acted upon following an Administrative Review Land Use Change Permit. Materials Handling facilities are considered Industrial Uses and are subject to the standards of Additional Standards For Industrial Uses per Section 7-1001 of Article 7, LUDC. 2 The applicant has stated that they intend to seek a Waiver from the Road Standards of Section 7-107 and a Waiver to the submittal requirements for a Traffic Study. Please note the requirements for a Waiver to the Road Standards require compliance to the Community Development Departments Policy 01-14 Waiver for Roads & Demonstration of Compliance to be submitted with the application. Notice will be in accordance with Section 4-103.B.3. which includes certified mail to mineral owners and surface property owners within 200 feet. II. COMPREHENSIVE PLAN The CDP is located within the Resource Production/Natural designation of the Future Land Use map. III. SUBMITTAL REQUIREMENTS The submittal requirements are outlined in Table 4-201 Submittal Requirements with complete description in Section 4-203. The following items are highlighted: 1) General Application Materials a) A narrative description of the use including operational details on the type of installation and equipment proposed. b) Evidence of Ownership and Authorization to represent including any lease documentation associated with the proposal. c) Title Commitment for the property d) Statement of Authority for the Little Living Trust. e) Letter of authorization from the property owner authorizing Katy Middleton to submit and act on the application. f) A listing of all property owners (with addresses) within 200 ft. g) Completed Mineral Research form. h) The Application form, signed by the property owners i) Copy of this pre-application summary j) Required Fees k) Payment Agreement Form 2) Vicinity Map 3 3) Site Plan - including utility locations, installations, and any site features.
