GENERAL PROJECT DESCRIPTION Xcel Energy is proposing three line rebuild projects throughout the County. General alignment mapping of the transmission lines and project summaries were provided at the pre-application meeting and are attached. Outlined below are brief descriptions of the three projects: Mitchel to Rifle-Ute: Originally Built in the 1940's - 1960's, approximately 25 miles, steel H frame structures, helicopter use is likely. Rifle-Ute to DeBeque: Originally constructed in the 1960's, approximately 32 miles, use of a variety of structures including single pole weathered steel or brown fiberglass self- supporting or guyed structures, helicopter use may be required. Hopkinsto Basalt: Originallyconstructed in 1909with upgrades inthe 1990's, 11 miles, H frame, monopole, and 3-pole dead end weathered steel or brown fiberglass self-supporting or guyed structures. Helicopter access is likely. STAGING AREAS _ HELICOPTER USE The project is part of Xcel Energy's Wildfire Mitigation Program. Most alignments will utilize existing right-of-way/easements. Some minor realignments may be implemented and would require acquisition of new right-of-way/easements. Creation of staging areas was discussed and subsequent to the meeting preliminary information on potential staging areas was provided. Most are located directly adjacent to the transmission line alignment on property already associated with the projects. Where staging areas are separate for the transmission line alignment additional Land Use Change Permitting may be required. Helicopter use for staging areas needs to be addressed and likely will require additional meetings with Staff to determine if additional permitting is required. Helicopter use raises questions regarding noise and safety considerations. RIGHT-OF-WAY, OWNERSHIP, PUBLIC NOTICE Documentation of right-of-way/easement and as appropriate other authorizations or agreements for the rebuild will be a key component of the application submittals and will include review by the County Attorney's Office. The County Attorney's Office will also be essential in reviewing compliance with the public notice requirements including mailing to adjacent property owners within 200 ft. and mineral rights owners on the surbject properties. It is highly recommended that prior to formal application submittal the Applicant's research, mailing lists and legal description for the project be reviewed with Staff and the County Attorney's Office. Atl owners of property on which the transmission line will be rebuilt will also be noticed. The Public Notice publication and posting as well. Publication is in the Rifle Citizen Telegram (one time publication required). Posting should be placed in location where the alignment crosses a public right-of-way such as County Roads and in other locations where visible from a public right-of-way. Given the length of the projects, staff recommends that the Applicant provide in the Application submittals a map showing proposed locations for posting notice signs, for review by Staff. GENERAL NOTES County Staff has determined that the Location and Extent Review is the appropriate review process for the re-build project and is consistent with State Statutes. Please advise us of ) any changes in p¡ans or project descriptions as that may affect the determination and/or require updates to the pre-application summary and related information. Xcel Energy plans to meet with the Board of County Commissioners to provide them with updates and information on the rebuild projects with a meeting currently scheduled for April 4th. The Location and Extent Application will also be referred to adjacent municipalities and Towns for their comments. II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS . Prior to the start of construction, a surveyor will stake pole locations, off‐sets, temporary construction  areas, and other locations of importance where field delineation is beneficial.    2. Appropriate PSCo staff, line construction contractor, foundation contractor, earthwork contractor, and  erosion control contractor will meet on‐site to review the delineated construction impact limits.  3. Flagging or paint used to delineate where perimeter erosion control measures should be placed based  on disturbance limits defined by PSCo construction team (item 2 above).   4. PSCo erosion control plan developer, PSCo Environmental Analysist, or erosion control install contractor  may collect multiple representative topsoil soil samples for analysis along the transmission line. This  analysis would focus on the potential for possible soil amendments (primarily nitrogen, phosphorus, and  potassium) during seeding. 3 – 6 samples are expected based on the varying soil conditions along the  line.   5. Erosion control contractor team will install perimeter erosion control measures, typically construction  fence, boundary fence, sediment control logs, rock logs, and vehicle tracking control per the  requirements identified in the State Stormwater Management Plan (SWMP).   6. Only as necessary for project, trim and remove vegetation for off‐site disposal that will directly impact  site grading or access. PSCo to utilize trimming as much as practicable to keep root structure in place.    7. In areas where grading is required, strip topsoil (assume top 4 inches of soil) for reuse on site. Topsoil to  be segregated from other material. Topsoil to be placed along access or in other areas adjacent grading.  Topsoil may be transported from immediate work area due to space constraints. Topsoil that is  2    stockpiled for more than 14 days will be seeded for temporary stabilization. Topsoil stockpiles that are  to remain dormant for more than 14 days are to have side slopes no steeper than 1H:1V.   8. Topsoil stockpiles may be placed on undisturbed adjacent ground. In this event, PSCo will place a  separation fabric, i.e. Mirafi 140N or like, to provide a physical indicator as to where the stockpile ends  and native ground begins. PSCo has had success with this approach as it reduces unwanted disturbance  of native ground and allows an undisturbed but lightly ‘compressed’ topsoil layer to bounce back once  topsoil and separation fabric is removed.   9. Once permanent cut slopes are graded, they will be covered in topsoil within 14 days and seeded and  mulched within another 14 days. This will allow permanent cut/fill face revegetation to commence as  soon as possible. Work areas where active construction is anticipated, i.e. flat pads, are not to be topsoil  covered until heavy construction work has ceased. Once heavy construction of permanent pads has  ceased, topsoil cover is to be completed within 14 days and seeding and mulching to follow within  another 14 days.   10. Subgrade excavation material, from grading or pole excavation, will be spread on the access road,  exported from the site for off‐site disposal, or stockpiled in immediate or near‐by work area for future  use, particularly in areas with temporary grading impacts that are to have grades restored. Like the  topsoil above, subsoil that is stockpiled on undisturbed ground is to have a separation fabric below the  stockpile to clearly distinguish between native grade and stockpile material. This will minimize  disturbance of the native grade and allow this compressed native grade to bounce back once stockpile  and separation fabric is removed.  11. Once construction is completed at a site for permanent grading impacts, i.e. conductor pull/tensioning  pads and access roads, the site soil is to be ripped to loosen the subgrade due to soil compaction during  construction. Following decompaction, topsoil is to be placed at a depth of 4 inches in a loose manner  ready to accept seed. Unlike most topsoil requirements, rock of various gravel sizes less than 6 inches  diameter may remain in the topsoil layer.  12. Once construction is completed at a site for temporary grading impacts, the site rough grades are to be  reestablished and the subgrade soil is to be bucket compacted to a ‘firm’ condition. Following  compaction, topsoil is to be placed at a depth of 4 inches in a smooth but loose manner ready to accept  seed. Unlike most topsoil requirements, rock of various gravel sizes less than 6 inches diameter is  expected in the topsoil layer and is indicative of native topsoil in this area.  13. Soil amendments are to be added per soil analytic recommendations via mechanical broadcast or  hydraulic application. Site seed mix is to be spread at appropriate rates given application type, hydraulic,  drill, or hand broadcast. The amendment and seed application will vary substantially based on  disturbance type site access and soil conditions. In cases of hydraulic application, the seed mix may be  applied with the liquid amendment or hand broadcast but in no case is seed to be mixed and applied  with mulch.  14. Final erosion control cover for seeded areas will vary based on access to disturbance areas. Truck or  tracked access areas will have either straw crimp mulch (on grades less than 10 percent and low rock  content soil) or a high quality hydraulically applied mulch, i.e. Flexterra HP‐FGM or like, on grades  exceeding 10 percent. PSCo generally does not support using erosion control blankets on this project  due to concerns about reduced blanket to soil contact and due to longer life blankets having a high  synthetic content with leads to a wildlife entrapment hazard.  15. PSCo will change erosion control inspection schedule from weekly to monthly inspections once initial  stabilization measures (seeding and mulching) have been completed. If there are areas of concern  3    identified during the monthly inspection that need to be addressed (i.e. erosion or lack of revegetation  growth), the revegetation contractor will return to the site to address identified issues.   16. Per the required State (SWMP) and local (Grading Permits), PSCo will continue to maintain structural  erosion control measures across the project until no longer necessary. These will primarily include  down‐gradient sediment control logs but may include other control measures. These measures will be  removed when no longer required and seed will be hand broadcast in areas where removal has exposed  or disturbed less vegetated soil.   17. The existing transmission line must be rebuilt because it has reached the end of its operational life. The approximate 8-mile rebuilt transmission line would follow the existing route connecting the existing Debeque Substation, located near the Town of De Beque to Una Substation, located near Una (Project). Approximately 4.5 miles of the proposed transmission line occurs within Garfield County jurisdiction (45 proposed transmission poles) and approximately 3.4 miles occurs in Mesa County jurisdiction (35 proposed transmission poles) (Figure 1-1). The Project also crosses Bureau of Land Management (BLM) and the Town of De Beque jurisdictions. This Location and Extent (L&E) Review application only addresses the portion of the Project located within Garfield County jurisdiction. PSCo is currently coordinating with BLM, Mesa County, and the Town of De Beque on the portions of the Project located in those jurisdictions. This L&E Review application package was prepared per the requirements of Section 4-111, Table 4-201, and Section 4-203 of the Garfield County Land Use and Development Code (Code) as well as Xcel Energy’s Pre-Application Conference with Glenn Hartmann, Rita Ruderman, Joe Kenworthy, and Brian Bolton attending on behalf of Garfield County and Jen Chester, Braleigh Jay, Brooke Hines, David Dean, Crystal Bravo-Cogar, and Jennifer Bell on behalf of Xcel Energy. The Pre-Application Conference was held on December 2, 2021. 1.1 Regulatory Framework Garfield County, Mesa County, Town of De Beque, and BLM land use permit regulations apply to the Project. Descriptions of the regulatory requirements are provided in the following sections and in Table 1- 1. Any applicable land use, environmental, and construction permits will be obtained prior to the start of and during construction as required by these regulatory frameworks. 1.1.1 Garfield County This Garfield County L&E Permit application is being submitted for the 4.5-mile portion of the line within Garfield County jurisdiction. Forty-five proposed transmission line poles (poles 36 to 80) are within unincorporated Garfield County. Location and Extent Review Application Introduction Public Service Company of Colorado 1-2 Burns & McDonnell   1.1.2 Mesa County A Mesa County Conditional Use Permit application will be submitted in May 2022 for the 3.4-mile portion of the line within unincorporated Mesa County. Thirty-five proposed transmission line poles (poles 1 to 35) are within unincorporated Mesa County. 1.1.3 Town of De Beque A Town of De Beque Special Review Use permit application will be submitted in May 2022 for the 0.59- mile portion of the line within the Town of De Beque. Seven proposed transmission line poles (poles 1 to 2 and 18 to 22) are within the Town of De Beque. 1.1.4 BLM A BLM right-of-way (ROW) grant amendment application was submitted to the BLM in September 2021 for the 1.68-mile portion of the line within BLM jurisdiction (0.06 miles in Garfield County and 1.62 miles in Mesa County). The BLM is in the process of preparing an Environmental Assessment under the National Environmental Policy Act to evaluate the Project. The original line was constructed within a utility easement corridor held by PSCo. PSCo has made use of the existing easements and is in the process of obtaining additional easements along the Project where needed. Permanent and temporary easements will be recorded in Garfield County following execution of the necessary landowner agreements. Names and addresses of property owners crossed by the proposed 6670 Transmission Line Rebuild ROW within Garfield County are provided in Appendix B. 2.3 Authorization from Property Owners The Garfield County Code requires an application for a land use permit be submitted by the owner of the land for which the permit is proposed, or by an applicant acting through written authorization signed by the owner consenting to submission of the application. Xcel Energy recognizes why the Code requires either an owner applicant or the written consent of the owner in the course of land use permitting generally speaking; however, the Code does not specifically recognize the practical exception to this requirement which arises when the applicant is an entity with the power of eminent domain. Respectfully, because of this exception, Xcel Energy does not believe that this requirement serves the interests of the affected landowners or Xcel Energy in this land use permit application. With regard to the proposed Project, Xcel Energy is in the process of obtaining all land rights necessary for its construction; however, Xcel Energy has not finished that process. If Garfield County requires Xcel Energy have landowner consent prior to the time that it can submit its application, Garfield County is effectively requiring Xcel Energy to obtain possession of all property rights for the land use permit as proposed before applying for the permit. This puts Xcel Energy and the landowners in a difficult position. The unintended consequence of such a requirement would be to force Xcel Energy to move forward and condemn property interests for the proposed project before application submittal, and that is contrary to how Xcel Energy approaches landowners on whose property a project would cross. The practice of Xcel Energy has been to apply for and obtain local land use permit approval and thereafter Location and Extent Review Application Application Components Public Service Company of Colorado 2-2 Burns & McDonnell   finalize securing outstanding land rights from landowners along a project’s permitted route. While discussions and negotiations with landowners start early in the process, often in advance of applying for a land use permit, those negotiations frequently do not conclude until the landowner and Xcel Energy know that the project is permitted. Because Xcel Energy has the right to exercise the power of eminent domain pursuant to C.R.S. § 38-2-101(1), and specifically pursuant to C.R.S. § 38-5-105, it is our position that this approach satisfies the intent of the Code requirement for a landowner’s signature on the application or their written consent for its submission. Xcel Energy respectfully requests based on the relevant power of eminent domain related to this Project and application that the Code requirement be deemed satisfied, and any further landowner signature requirements be waived. 2.4 Authorized Signatures on the Application Authorized signatures from PSCo representatives are provided on the completed Land Use Application in Appendix A. As discussed in Section 2.3, Xcel Energy respectfully requests based on the relevant power of eminent domain related to this Project and application that the Code requirement for a landowner’s signature on the application be deemed satisfied, and any further landowner signature requirements be waived. 2.5 Statement of Authority A Statement of Authority is provided in Appendix B. 2.6 Application Fee As indicated in the Pre-Application Conference Summary, provided in Appendix C, no application fee is required. 2.7 Payment Agreement Form Appendix D contains the Payment Agreement Form for reference only since no fees have been determined due by Garfield County as of the filing of this L&E Review Application. 2.8 Pre-Application Conference Summary Garfield County staff provided a Pre-Application Conference Summary following the Pre-Application Conference held on December 2, 2021, which is provided as Appendix C. At the Pre-Application Conference, County Staff determined that Location and Extent Review is the appropriate review process for the Project and is consistent with State Statutes. 2.9 Vicinity Map A Vicinity Map is provided in Chapter 1. Location and Extent Review Application Application Components Public Service Company of Colorado 2-3 Burns & McDonnell   2.10 Names and Addresses of Property Owners within 200 feet and Mineral Rights Owners Names and addresses of property owners within unincorporated Garfield County within 200 feet of the Project centerline are provided in Appendix E along with a map (Figure E-1) showing the properties. A map (Figure E-2) showing proposed locations for posting notice signs is also provided in Appendix E. PSCo will not provide written notification to mineral estate owners regarding the public hearing for the Project. A state statute called, “The Surface Development Notification Act (C.R.S. 24-65.5-101 et seq),” provides that before the date scheduled for the initial public hearing by a local government on an Application for Development, the applicant must send a notice of that hearing by certified mail to mineral estate owners (owners or lessees of the mineral estate under the property which is the subject of the application) not less than 30 days before the schedule hearing date. An Application for Development covers a wide range of surface development land use approvals pursuant to the Act. However, certain named development activities are specifically exempt from that definition, one of which includes applications with respect to utility electric lines such as PSCo’s transmission lines. The transmission line rebuild is exempt from the statutory mineral estate owner mailing notification requirements, and, therefore, PSCo will not be including a list of owners of the mineral estate under the property which is subject to the L&E Permit application. 2.11 Site Plan A Site Plan is provided in Appendix F. 2.12 Narrative Description PSCo is proposing to rebuild the existing 69 kV transmission line between Debeque and Una Substations to replace aging infrastructure and continue delivery of economic, safe, and reliable electric service to customers in Garfield County and on the western slope of Colorado. The existing transmission line was originally constructed in the 1960s, with some poles installed in the 1940s. The line has reached the end of its serviceable life and needs to be rebuilt. Due to the transmission line’s age and ongoing growth and development in Garfield County since inception, access to the line is limited, making construction, operation, and maintenance a challenge. Rebuilding the transmission line within the existing easement is preferred due to the potential impacts on the environment, community, and residents in Garfield County. The transmission line will be rebuilt to current industry standards that include additional measures to reduce wildfire risk and use of the existing transmission line corridor and access routes. PSCo is implementing measures, including the rebuild of major transmission lines such as 6670, to reduce the risk of fire ignitions caused by the operation of electric equipment, in order to minimize the potentially Location and Extent Review Application Application Components Public Service Company of Colorado 2-4 Burns & McDonnell   devasting impacts caused by wildfires. PSCo has always worked to reduce the risks presented by wildfires. However, recent increases in the occurrence of severe weather events has impacted both the frequency and intensity of wildfires in Colorado. This has driven an increased focus on efforts and investments that can mitigate wildfire risk (Xcel Energy 2020). The proposed approximate 8-mile rebuild of Transmission Line 6670 involves replacing all existing poles and cables (conductor and shield wires) between the Debeque and Una Substations. Transmission Line 6670 provides a source of power for communities in Garfield and Mesa Counties. The Project is needed to continue to transfer power in these communities and maintain system reliability. Approximately 4.5 miles of the existing 8-mile transmission line occurs within Garfield County, and 0.06 of those 4.5 miles are under BLM jurisdiction. The remaining approximately 3.4 miles are located within Mesa County. The existing transmission line route begins at the Debeque Substation, near the Town of De Beque, continues northeast through Mesa County, enters Garfield County approximately 0.2 mile east of US Highway 6, and continues northeast through Garfield County to the Una Substation. The rebuilt transmission line will follow the existing route within Garfield County. The current ROW width is 30 to 50 feet and will be widened to accommodate design upgrades. The rebuilt transmission line will be constructed within a 75 to 110-foot-wide ROW along the Garfield County portion, to provide safe and reliable access for construction, operation and maintenance. The majority of the ROW will be 75 feet wide; some areas will require a 110-foot ROW where long spans of 1000 feet between poles are planned. Additional area is also needed in specific locations for guyed poles. The line is planned to continue to be operated at 69 kV but will be designed to accommodate 115 kV for future needs. Negotiations will be required with landowners along portions of the existing route to acquire additional ROW width where the existing easement documentation does not meet the minimum 75-foot width requirement. Existing and new ROW easements will require vegetation management to create a safe working and operational space around the improved facilities. Please reference the Site Plan in Appendix F for more details. The following sections provide additional details about the Project. 2.12.1 Pole Construction The rebuilt transmission line will be constructed with 115 kV capable transmission poles and strung with new conductor and optical ground wire. The rebuilt line will be operated at 69 kV initially, but it could be operated at 115 kV to meet future demand. The rebuilt transmission line will be constructed with single pole weathered steel poles and guyed poles. Pole details are provided in Appendix G. Easements will be needed for ground access for construction and maintenance, staging areas, and pulling/tensioning sites The existing easements date back to the 1920’s 2.12.2 Construction Methods Construction of the Project will occur in phases including the following activities: construction access development and vegetation clearing; equipment mobilization and material delivery; hole auguring and foundation construction; pole placement; conductor stringing, and restoration of temporary disturbance areas. Access road improvements, grading, temporary staging yard set-up, and vegetation work will be required prior to construction. Access routes will allow construction crews and vehicles to access transmission line pole locations, pulling/tensioning sites, and material staging areas. Staging yards will be used to stage construction equipment and materials such as temporary construction trailers, cranes, and poles. Vegetation management may be required prior to, or in conjunction with, construction within the existing and expanded ROW. Trees and vegetation growing near the ROW pose a risk to the line by causing downed lines, power outages, and wildfires. Vegetation management crews prevent the risk of these occurrences by implementing various types of treatment including removing, pruning, and mowing vegetation, and use of approved herbicides to treat vegetation to allow safe operation of the transmission line. Depending on current levels of vegetation encroachment and ROW needs, the extent of vegetation management will vary along the rebuilt transmission line corridor. Following initial preparations, holes will be augured for transmission poles. Once holes are augured, the poles are set and backfilled. Some poles may require foundations that are set in the augured holes with a concrete enforced steel cage. Transmission poles will be placed in the holes or on the foundation using a crane or helicopter. Ground installation of poles involves assembling poles in the material staging area. Once assembled, the poles are transported via truck to the installation locations where a crane will lift the pole into place. Helicopter installation involves assembling the poles in a material staging area, then transporting them via helicopter to the installation locations to be lowered into the hole or onto a foundation. Location and Extent Review Application Application Components Public Service Company of Colorado 2-7 Burns & McDonnell   There are advantages to using a helicopter for installation because it permits access to areas that are not feasible for vehicle ground access, minimizes construction impacts due to erosion and disturbance, and improves construction efficiency. Any areas requiring helicopter construction methods will follow Federal Aviation Administration (FAA) safety requirements such as evacuation of residences located near poles where work will occur. PSCo and their construction contractor will coordinate with the FAA during helicopter operations and obtain any necessary permits. PSCo and the construction contractor will provide residents with prior notice should evacuation be required. Following setting of the transmission poles, conductor wire is strung using a temporary pulley system which is attached to the insulators. Pulling/tensioning sites are required at specific angles, so the conductor wire is pulled in line with the poles, remaining in alignment. Once the conductor is in place, the existing poles will be removed by crane or by helicopter depending on terrain and access, and the Project will be energized. Throughout construction, wind erosion control best management practices (BMPs) including the application of water or other dust palliatives will be implemented if needed. Following construction, all temporary work areas within the ROW will be restored. PSCo’s Revegetation Plan is included in Appendix H. 2.12.3 Visual Mitigation Construction, operation, and maintenance of the existing transmission line have been challenging due to development and vegetation encroachment. The rebuilt transmission line will be constructed within a 75 to 110-foot-wide ROW to provide safe and reliable access for future construction, operation, and maintenance, and to rebuild the line to current design standards. PSCo is negotiating with landowners along the existing transmission line route to obtain additional ROW width where the existing easement does not meet the minimum width requirement. Vegetation management will be required within the existing and new ROW to create a safe working and operational space around the transmission line. As discussed in Section 2.12.2, vegetation management will be required prior to, or in conjunction with, construction. Trees and vegetation growing near the Project ROW can cause downed lines, power outages, and wildfire. Vegetation management crews will work to prevent these situations from occurring, by implementing various types of treatment methods such as removing, pruning, and mowing vegetation and the treatment of vegetation with approved herbicides allowing for safe operations. The level of vegetation management work will vary along the rebuilt transmission line depending on the level of vegetation encroachment and additional ROW needs. However, vegetation removal is not Location and Extent Review Application Application Components Public Service Company of Colorado 2-8 Burns & McDonnell   anticipated to create a visual impact to the overall region as a whole and following construction, the work areas and ROW will be restored. The Revegetation Plan for disturbance areas is provided in Appendix H. The transmission poles for the rebuild will be different from those currently in place and will change the overall visual appearance of the transmission line. As indicated in Table 2-1, existing brown wood poles will be replaced with single pole brown/rust colored weathered steel and guyed poles to comply with updated design standards. The rebuild poles on average, are taller than the existing poles to comply with current materials and their corresponding design standards. Existing transmission poles along the transmission line in Garfield County vary from 40 feet to 65 feet in height and new poles will vary from 55 feet to 105 feet. Topography, span length, and adjacent land uses influence the necessary height of transmission poles. Additionally, the rebuild of the transmission line to current design standards will dramatically decrease the number of poles on the landscape in Garfield County from 70 to 45 reducing the overall visual impact of the facility in the region. There may also be temporary visual impacts associated with the Project during construction due to the need for temporary access roads, the presence of construction vehicles and active work areas, and the use of cranes and helicopters for pole installation. These visual disturbances are not anticipated to remain during the general operation of the transmission line. There is an existing visual impact from the presence of the existing transmission line. The Project would rebuild the existing line to update its materials and bring it into compliance with their current design standards. Accordingly, it is not anticipated the Project would impact the character of the surrounding area or create new significant visual disturbances due to the line being rebuilt within the existing alignment and the significant reduction in poles required for the transmission line with the use of the updated materials and their corresponding current design standards. While the poles will be taller than the existing poles, their overall appearance will not materially change because they will be weathered steel so as to blend in with the surrounding landscape. Any visual disturbance resulting from Project construction will be temporary due to the use of temporary roads and vegetation clearing. Visual disturbance due to vegetation clearing in temporary work areas will be restored to pre-construction conditions lessening the visual impact as a result of the Project. Visual simulations are included in Appendix I. 2.12.4 Easement and Access Information Proposed construction access routes will allow construction crews and vehicles to access transmission line pole locations, pulling/tensioning sites, and material staging areas. Existing public and private roads Location and Extent Review Application Application Components Public Service Company of Colorado 2-9 Burns & McDonnell   will be utilized during construction and operation of the Project. Access through private property is being obtained from landowners by PSCo. Where road improvements are needed, PSCo will secure the necessary permits to comply with County regulations including grading, stormwater, and erosion control permits. If new access is required, PSCo will secure the necessary permits from the County, municipality, or Colorado Department of Transportation (CDOT), as required. 2.12.4.1 Temporary Access Routes and Improvements Construction access routes proposed for the Project will allow construction crews and vehicles to access transmission line pole locations, pulling/tensioning sites, and material staging areas. Public and private roads that currently exist will be utilized by PSCo during Project construction, where feasible. Permits for grading, stormwater, and erosion control will be secured where road improvements are needed. PSCo will engage in landowner negotiations where access roads traverse private property and access is necessary. Access to the existing and new pole locations will be required during construction in the form of temporary access routes to remove old poles and install new ones. Some temporary access will be required only for crews to walk in and access the pole locations with light machinery. A detailed Grading Plan outlining the locations of proposed temporary access and the improvements needed will be provided prior to construction, as required. 2.12.4.2 Staging Areas and Additional Easements PSCo plans to utilize two temporary staging areas for the delivery, storage, and distribution of materials to support the Project; one in Mesa County and one in Garfield County. The proposed staging area in Garfield County, referred to as the 5-Mile Ranch Staging Yard, is currently under review via a separate permitting process with Garfield County and is not discussed further in this application. Additional easements will be necessary for placement of pulling and tensioning machines for stringing conductor wire. Grading may be required at some pulling/tensioning sites to level out the area for equipment placement. Any permits required for grading of these sites will be obtained for this work. Upon completion of construction, all equipment will be removed from the sites and will be restored generally consistent with preconstruction conditions. 2.12.5 Traffic Information The need for vehicle traffic controls in Garfield County are not anticipated. If roadway traffic controls are determined to be necessary, Traffic Control Plans as applicable to Garfield County will be submitted. Location and Extent Review Application Application Components Public Service Company of Colorado 2-10 Burns & McDonnell   2.12.6 Construction Duration and Timing Construction is anticipated to begin in mid-2022, pending permit approvals. Construction activities are expected to be completed and the Project will be put into service by the end of 2022. See Table 2-2 below for the anticipated Project schedule. The typical construction workweek will be six days per week and 10 hours per day. Section 3.1 and Chapter 4.0 describe how the Project generally conforms with the Garfield County Comprehensive Plan 2030, as amended February 26, 2020. 3.1 Conformance with Garfield County Comprehensive Plan Land use within the existing transmission line easement will remain the same. The Project will remove and replace aging infrastructure with current materials and rebuild the transmission line to current industry standards that includes an additional measure to mitigate wildfire risk (i.e., steel poles replacing wood). Rebuilding the existing transmission line to current industry standards will provide for continued delivery of safe and reliable electric service to customers in Garfield County and western Colorado. The purpose of the Garfield County Comprehensive Plan is to protect the safety and welfare of residents of the County from malfunctions that can result from deteriorating infrastructure. By maintaining an adequate and clear ROW, interferences and disruption to delivery of electrical service will be prevented. A detailed narrative describing how the Project conforms to the Garfield County Comprehensive Plan 2030 sections, goals, and objectives is provided below in Chapter 4.0. Location and Extent Review Application References to the Comprehensive Plan Public Service Company of Colorado 4-1 Burns & McDonnell   4.0 REFERENCES TO THE COMPREHENSIVE PLAN Garfield County Comprehensive Plan 2030 outlines key policies and strategies that support the County’s vision for 2030 (Garfield County 2020a). The Vision for Garfield County is dedicated to managing and directing growth to dedicated Urban Growth Areas (UGAs) and other areas that can accommodate growth cost effectively, in order to create thriving communities while promoting a diverse, sustainable and healthy economy, protecting wildlife, maintain or improving the quality of our natural environment, and preserving the County’s rural and western heritage (Garfield County 2020a). The following sections outline how the Project supports specific components of the Garfield County Comprehensive Plan 2030. 4.1 Chapter 2 Future Land Use Chapter 2 of the Comprehensive Plan outlines five major themes to support future land use in Garfield County. One theme focuses on development in UGAs and 3-Mile Areas of Influence, which are preferred locations for municipality expansion. According to the Garfield County Future Land Use Map, there are no UGAs near the Project, but approximately 1.5 miles of the transmission line fall within the 3-Mile Area of Influence for Parachute (Garfield County 2020b). Additionally, the majority of the transmission line falls within the future land use designation of Residential Medium High which may include small farms, estates, residences, and clustered residential subdivisions. Where the ROW crosses through Una, the future land use designation is classified as Industrial which may include indoor manufacturing, outdoor equipment storage, business parks, energy processing and uses that produce odor, noise, light, and/or emissions. The character of the Project matches that of similar development that may occur within these future land use designations. Further, the project supports future development in the area by upgrading the existing electric infrastructure to ensure safe and reliable service. 4.2 Chapter 3, Section 4 – Economics, Employment, and Tourism The vision of Chapter 3, Section 4 of the Garfield County Comprehensive Plan 2030, emphasizes economic development in and around County population centers. The Colorado State Demography Office (CSDO) projects that from 2017 to 2040 the county's population will increase by an average of 1,287 persons per year. This is a 55% increase from the annual average between 2001 and 2017. The CSDO projections highlight important planning considerations concerning where and how to accommodate future growth, and how to ensure that public infrastructure and services will accommodate this growth (Garfield County 2020a). By strengthening the existing infrastructure and ensuring continued reliable Location and Extent Review Application References to the Comprehensive Plan Public Service Company of Colorado 4-2 Burns & McDonnell   energy service to Garfield County, this Project supports the growth of industrial, commercial, and residential uses in the surrounding areas. 4.2.1 Policy 3 – Visual, Traffic and Environmental Impacts Visual, traffic, and environmental impacts of new or expanded industrial development upon tourism, quality of life resources, and community character will be considered. The Policy 3 strategy is to ensure that impacts from industrial development are adequately mitigated to minimize negative impacts on tourism, quality of life resources, and community character. 4.2.1.1 Visual Section 2.12.3 of this application details the anticipated visual impacts of the Project and associated mitigation measures. Because the Project involves replacing an existing transmission line along the same easement corridor and with less poles on the landscape than the existing transmission line, it is not anticipated that the Project will result in a new negative visual impact to the surrounding community. Indeed, the total reduction in the number of poles associated with the transmission line will reduce the visual impact compared to the existing transmission line. Furthermore, the transmission poles will be weathered steel material to blend with the surrounding landscape. 4.2.1.2 Traffic Traffic impacts from Project operations are not expected, because the Project would not generate trips more than those already needed for the existing transmission line for maintenance or emergencies. Planned maintenance will occur along the line at the same frequency as it does for the existing line. No operational impacts to daily traffic flows are anticipated. During construction, there would be temporary disruptions to traffic from equipment and materials accessing the line. PSCo does not anticipate that any traffic controls will be needed for this Project. However, as discussed in Section 2.12.5, if roadway traffic controls are determined to be necessary, PSCo would submit Traffic Control Plans as applicable to the County. 4.2.1.3 Environmental Impacts The approximate 4.5-mile area where the line will traverse Garfield County is primarily zoned rural with some industrial and resource lands. The line will be rebuilt to current design standards that include additional measures to reduce wildfire risk and would use the existing transmission line corridor and access routes, where possible. PSCo will obtain any necessary environmental clearances and approvals prior to construction, and any required environmental mitigation measures will be implemented. As discussed in Section 1.1.4, PSCo has applied for a BLM ROW grant amendment, and an Environmental Assessment is being prepared for the Project. Location and Extent Review Application References to the Comprehensive Plan Public Service Company of Colorado 4-3 Burns & McDonnell   4.2.2 Policy 4 - Economic Resiliency and Diversity Policy 4 aims to strengthen the County's economic resiliency for employment and income generation by continuing to diversify the economy (Garfield County 2020a). Several strategies associated with this policy focus on encouraging growth and expansion of existing industries within Garfield County. The Project will not only revitalize and strengthen the electric infrastructure within Garfield County, but it is designed with the ability to operate at 115 kV to meet the future demand from the development that Garfield County is encouraging. 4.2.3 Policy 5 - Locations that possess physical features and community facilities and services Policy 5 encourages commercial and industrial development in areas with appropriate community facilities and services (Garfield County 2020a). While the Project will continue to provide electric service to the same area as the existing line, the line can be operated at 115 kV to support future demand, potentially making the area more attractive to developers. 4.3 Chapter 3, Section 8 - Natural Resources The vision of Chapter 3, Section 8 of the Garfield County Comprehensive Plan 2030 emphasizes the need to protect and/or mitigate the impacts to biological resources. The Project will be constructed along the existing alignment within the County, reducing the impacts to surrounding land use and resources. PSCo will implement any required mitigation measures to protect natural resources, as required by the BLM ROW grant or other environmental clearances for the Project. 4.3.1 Policy 2 - Avoid disturbance and mitigation impacts Policy 2 discusses the need to avoid disturbance to wildlife habitat and mitigate potential negative impacts that cannot be avoided. The land use along the Project route within Garfield County is primarily shrubland. Project construction may impact nesting raptors if construction takes place during their breeding seasons. If PSCo constructs during breeding season, raptor nest surveys will be conducted prior to construction to determine whether active nests are present near the Project. Additionally, seasonal restriction on construction activities would reduce disturbance to birthing big game animals and animals with dependent young. Potential impacts to wildlife habitat would be temporary and limited to the construction phase. In areas where grading is necessary, PSCo will revegetate the area after construction is complete; the Project's Revegetation Plan is included as Appendix H. Because the Project involves rebuilding an existing transmission line almost entirely in place, it is not anticipated that the Project will result in new, permanent, adverse impacts to wildlife.
