To whom it may concern,
YOU, THE PROPERTY OWNER, ARE HEREBY NOTIFIED THAT IN ACCORDANCE WITH
ARTICLE 10 of TITLE 25 of the Colorado Revised Statutes (the On-site Wastewater Treatment
Act), specifically C.R.S. Sections 25-10-104(2), 25-10-106, 25-10-110, 25-10-112, and Garfield
County Onsite Wastewater Treatment Systems (OWTS) Regulations adopted in 2018 and
incorporated into Garfield County Regulations by Resolution No. 2018-36 (the "Regulations"), that
your Onsite Wastewater Treatment System (OWTS) is not in compliance. Specifically, the system
was installed without an OWTS permit, as required by Garfield County OWTS Regulations section
43.4. B.1, which states: Prior to installing, altering, or repairing a system, the applicant must obtain
a permit from the local public health agency. According to our records, a permit application was
not submitted for the repaired OWTS, and as such an OWTS permit was not issued.
TO BRING THIS SYSTEM INTO COMPLIANCE:
1. Within 2 business days of receipt of this notice, YOU SHALL contact Garfield County
Public Health to acknowledge receipt of this NOV and to discuss the process and timeline
to bring the system into compliance;
2. Within 1 week of receipt of this notice, YOU SHALL apply for a repair OWTS permit
application and pay the applicable fee, -
3. After the OWES permit application is submitted and the applicable fee is paid, GARFIELD
COUNTY PUBLIC HEALTH SHALL review the previously submitted materials to determine
if the designed repairs meet Garfield County OWTS Regulations;
4. If our review indicates the repaired OWTS does not meet current Garfield County OWES
Regulations, YOU SHALL hire an OWTS professional to design a regulatory compliant
OWTS and submit it to Garfield County for review PRIOR to installing or altering the
existing system; and,
5. After any alterations to the existing unpermitted repaired system are made, YOU SHALL
contact Garfield County Public Health for a final inspection of any and all alterations to the
existing system, prior to backfilling any components of the system.
If the above steps are not taken, a Cease -and -Desist Order Hearing will be scheduled, and at
such hearing the Garfield County Board of Health may issue or determine the followin
Garfield County Public Health Department — working to promote health and prevent disease
• A Cease -and -Desist Order –Cease use of OWTS;
• Monetary Fines; and
• Other remedies available by law.
