The construction and operation shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility including all requirements of the Colorado Air Pollution Prevention and Control Act, C.R.S., Title 25, Article 7. 3. Prior to the issuance of the Pipeline Development Permit, the Applicant shall provide the County with a revegetation security: a. In the amount of $21,850, based upon the Applicants proposed 8.74 acres of surface disturbance. b. Which shall be held until vegetation has been successful according to the Reclamation Standards of the Garfield County Weed Management Plan. Reclamation Standards are cited in Sections 4.06, 4.07 and 4.08 of the Weed Management Plan. c. Is in a form accepted by the County Attorney. 4. Prior to the issuance of the Pipeline Development Permit, the applicant shall update the Emergency Response Plan to meet the requirements in Section 9-102 (I) of the Land Use and Development Code regarding the reimbursement of emergency service providers. 6. Prior to the issuance of the Pipeline Development Permit, the applicant shall provide the following for review and approval by the County Consulting Engineer and Community Development Director: a. The Erosion Control Measure Installation Details of Appendix D of the Stormwater Management Plan for review. b. The Black Hills Spill Response Plan of Appendix F of the Stormwater Management Plan for review. c. A detail of the gas main trench cross section and a detail of the boring section that will be used for construction. d. Documentation that all Stormwater Management Plan signatures and approvals have been secured. 7. Installation of the pipeline shall comply with the "Conditions to all Pipeline Grading and Installation Permits for Garfield County". In order to reduce project construction related -affects to nesting birds brush clearing and grubbing activities will occur outside the nesting season for migratory birds. If construction withing nesting season becomes necessary, the Applicant will first conduct a Migratory Bird Treaty Act survey and monitoring plan within and adjacent to the pipeline ROW. 9. The applicant shall comply with all State and County noise requirements. 10. The applicant shall comply with all Garfield County Road and Bridge requirements. 11. Once the construction of the pipeline is complete the applicant shall submit a statement from a qualified professional engineer certifying the completion of the project in compliance with the Land Use Change Permit. A digital copy of the surveyed pipeline as -built will be provided to the Community Development Department. 12. ShouId the pipeline be abandoned and removed, it shall be subject to the revegetation and weed management requirements in this application or one approved by the County Vegetation Manager at that time. 13. This Pipeline Development Permit only permits Phase 4 of the pipeline as defined in this application. The Land Use and Development Code requires notification to the Board of County Commissioners for their review and potential tail -up of the Director's Decision. The Board review is for a period of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall expire on January 30, 2022. Once the call-up period has passed with no request for review or public hearing, and provided all relevant conditions of approval have been resolved the Land Use Change Permit will be issued. Per your request, please find attached an overview map depicting the previously proposed and current temporary work space areas (TWAs). On the attached map I have depicted the locations of the 6 TWAs previously noted in RMNG's initial application request in 2021 and the 2 new locations that have replaced them. To quickly summarize what's depicted on the map: At Panorama and Buck Point: 2 TWAs (@7,100 sqft in total size) on the West side of the pipeline ROW were DELETED and one TWA @1,945 sgft in size was ADDED to the East side of the ROW. o PURPOSE: access to ROW. South of CR 122: 4 TWAs (@7,820 sgft in total size) on McNulty were DELETED. (Note: 2 of these TWAs were at the request of the McNultys. With the intent to bore their parcels, all TWAs on their parcels are no longer necessary). North of CR 122: one TWA (@60,000 sqft in size) ADDED on X-Bar. o PURPOSE.,1) to accommodate the larger bore equipment with associated materials (bore and ream rods, water tanks to recycle drill mud, etc.) required for the long bore under CR 122 and the McNulty parcels and 2) to accommodate the semi -trucks that must transport said equipment/materials (larger turning radius of semi -trucks, safe egress/ingress of semi -trucks). l hope the attached map with above summary description provides the clarity needed to finalize and issue the Land Use Permit for this project.
