In accordance with and pursuant to the provisions of the Garfield County 2013 Land Use
and Development Code, as amended, and the Director's Decision Letter dated January
20, 2022, a Minor Amendment Director's Decision dated March 22, 2022, and second
Minor Amendment Director's Decision dated April 3, 2023, the Community Development
Department hereby authorizes the following activity:
The replacement of a 4-inch natural gas pipeline with a 6-inch natural gas pipeline, also
known as the Phase 1V of the Cottonwood Pass Pipeline Replacement Project
(PDAA-8936)
The Land Use Change Permit is issued subject to the conditions set forth in the Director's
Decision Letter and Amendments as set forth in Exhibit "C", and shall be valid only during
compliance with such conditions and other applicable provisions of the Garfield County
2013 Land Use and Development Code, as amended, Building Code, and other
regulations of the Board of County Commissioners of Garfield County, Colorado.

DIRECTOR'S DETERMINATION: Minor Modification to Director's Decision for
Administrative Review of RIVING Phase 4 Pipeline Development, # PDAA-8936
Dear Anna:
This Director's Determination letter is provided to you as the authorized
representative for the RMNG's Second Minor Modification Application, dated
1/13/23, .associated with the Rocky Mountain Natural Gas Phase 4 Pipeline
Development in Garfield County (Original File #PDPA-09-21-8858). Your
Application for a Minor Modification to the Director's Decision has been considered
in accordance with Section 9-103.K of the Land Use and Development Code.
According to Section 9-103.K such requests are processed according to Section
4-1.06, Amendments to an Approved Land Use Change Permit. In accordance
with Section 4-106(B)(1)(a) the Director has made a determination that the request
can be reviewed as a Minor Modification and has accepted the current submittal
requirements as adequate.
The provisions of Section 4-106 provide for a Decision by the Director of the
Community Development Department as to whether the proposed amendment
meets the criteria for a is a Minor Modification or Substantial Modification. The
Application requests the following revisions to the Applicants original
representations:
• Revisions to the construction schedule which will now occur in 2023 and 2024.
• Revisions to the length of pipeline trenching and boring requested by the
affected property owners.
• Reduction in the number of Temporary Work Areas (TWA's) and revisions to
their locations due to the increased boring. All TWA's will remain directly
adjacent to the pipeline alignment and easements.
• Revisions to the total area of TWA's which will now be 1.42 acres in size.

• Reduction in the total surface area disturbance from 7.74 acres to 5.45 acres.
In reviewing the information submitted, the Director has determined that the
Review Criteria of Section 4-106.0 for determining this proposed amendment to
be a Minor Modification, has been. met, as follows:
1. Comply with all requirements of this Code;
The minor modification request meets the requirements of the Code.
2. Do not conflict with the Comprehensive Plan;
The minor modification request does not conflict with the Comprehensive
Plan.
3. Do not change the character of the development;
The minor modification request does not change the character of the
development and reduces the impacts on property owners.
4. Do not alter the basic relationship of the development to adjacent property;
The minor modification request does not change the basic relationship of
the overall development to adjacent properties, maintaining TWA locations
adjacent to the pipeline alignment and easements.
5. Do not change the uses permitted;
The minor modification request does not change the uses permitted and
reduces the number of TWA's.
6. Do not require amendment or abandonment of any easements or rights -of -
way;
The minor modification request does not require abandonment of any
easements or rights of way.
7. Do not increase the density;
The minor modification request does not increase the density of the
project.
8. Do not increase the zone district dimensions to an amount exceeding the
maximum dimension in the applicable zone district in Table 3-201; and
The minor modification request does not increase the zone district
dimensions to an amount exceeding the maximum dimensions in the
Rural Zone District.
9. Do not decrease the amount of the following to an amount below the
minimum required in the applicable zone district:
a. Amount of dedicated Open Space;
b. The size of or change in the locations, Iighting, or orientation of
originally approved signs;

Based on the criteria found in Section 4-106(C), the Director has found your
amendment request to be a Minor Modification and has approved your requested
Minor Modification as documented in your 1/13/23 submittals, subject to the
following conditions:
1. All conditions of the original Director's Decision and First Amendment, attached
as Exhibit A, except as amended, shall remain in effect and all representations
contained in the Amendment Application dated 1/13/23 shall be conditions of
approval unless specifically altered by the deciding authority.
2. Prior to initiating construction, the Applicant shall confirm that all required
permits have been updated and remain in effect.
3. Prior to initiating construction, the Applicant shall confirm compliance with
original Condition #8 and confirm completion of an updated raptor/avian survey
and monitoring plan, including any mitigation measures.
4. Compliance with the supplemental project information dated 3/14/23 including
Temporary Workspace Areas (TWA's) as shown on the plans attached as
Exhibit B.
As a Minor Modification this Director's Decision is not subject to BOCC Call-up
review period and takes immediate effect.

proposed 7.74 acres of surface disturbance.
b. Which shall be held until vegetation has been successful
according to the Reclamation Standards of the Garfield
County Weed Management PIan. Reclamation Standards are
cited in Sections 4.06, 4.07 and 4.08 of the Weed
Management Plan.
c. Is in a form accepted by the County Attorney.
Condition ##2 Condition #4 of the original Director's Decision dated January 20,
2022 shall be amended to read:

representative documenting all surface use agreements and
ditch crossing agreements and a statement as required by

Decision dated December 20, 2021 attached as Exhibit A, shall
remain in full force and effect.

Dear Anna:
This letter is regarding the Director's Decision for your Administrative Land Use Change Permit
Application for the construction and operation of RMNG's proposed Phase 4 pipeline development
Garfield County File # PDPA-09-21-8858. Your Application has been reviewed in accordance
with the Administrative Review procedures contained in the Land Use and Development Code as
amended. Said provisions require a Decision by the Director of the Community Development
Department on whether to approve, approve with conditions, or deny the request.
The Director's Decision is based on the following findings:
1. That proper public notice was provided as required for the Director's Decision.
2. Consideration of the Application was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested parties were given the opportunity to
provide input prior to the Director's Decision.
3. That for the above stated and other reasons the proposed Land Use Change Permit for the
construction and operation of the RMNG Phase 4 pipeline development is in the best interest of
the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County.
4. That with the adoption of conditions, the application is in general conformance with the
2030 Comprehensive Plan, as amended.
5. That with the adoption of the Conditions of Approval the application has adequately met
the requirements of the Garfield County Land Use and Development Code, as amended.

The Director's Decision is hereby issued approving the Application subject to the following
conditions:
1. All representations made by the Applicant in the application for the construction and
operation of RMNG Phase 4 pipeline shall be conditions of approval, unless specifically
altered by the deciding authority.
2. The construction and operation shall be done in accordance with all applicable Federal, State,
and local regulations governing the operation of this type of facility including all
requirements of the Colorado Air Pollution Prevention and Control Act, C.R.S., Title 25,
Article 7.
3. Prior to the issuance of the Pipeline Development Permit, the Applicant shall provide the
County with a revegetation security:
a. In the amount of $21,850, based upon the Applicants proposed 8.74 acres of surface
disturbance.
b. Which shall be held until vegetation has been successful according to the Reclamation
Standards of the Garfield County Weed Management Plan. Reclamation Standards are
cited in Sections 4.06, 4.07 and 4.08 of the Weed Management Plan.
c. Is in a form accepted by the County Attorney.
4. Prior to the issuance of the Pipeline Development Permit, the Applicant shall provide
executed copies of all required surface use agreements and ditch crossing agreements and a
statement as required by Section 9-102(E)(2)(c)(3) of the Land Use and Development Code
regarding surface use agreements.
5. Prior to the issuance of the Pipeline Development Permit, the applicant shall update the
Emergency Response Plan to meet the requirements in Section 9-102 (I) of the Land Use
and Development Code regarding the reimbursement of emergency service providers.
6. Prior to the issuance of the Pipeline Development Permit, the applicant shall provide the
following for review and approval by the County Consulting Engineer and Community
Development Director:
a. The Erosion Control Measure Installation Details of Appendix D of the Stormwater
Management Plan for review.
b. The Black Hills Spill Response Plan of Appendix F of the Stormwater Management
Plan for review.
c. A detail of the gas main trench cross section and a detail of the boring section that
will be used for construction.
d. Documentation that all Stormwater Management Plan signatures and approvals
have been secured.
7. Installation of the pipeline shall comply with the "Conditions to all Pipeline Grading and
Installation Permits for Garfield County". Deviations from these requirements may be

permitted upon prior review and approval by the Garfield County designated engineer and
Garfield County Community Development.
S. In order to reduce project construction related -affects to nesting birds brush clearing and
grubbing activities will occur outside the nesting season for migratory birds. If construction
withing nesting season becomes necessary, the Applicant will first conduct a Migratory Bird
Treaty Act survey and monitoring plan within and adjacent to the pipeline ROW.
9. The applicant shall comply with all State and County noise requirements.
10. The applicant shall comply with all Garfield County Road and Bridge requirements.
11. Once the construction of the pipeline is complete the applicant shall submit a statement from
a qualified professional engineer certifying the completion of the project in compliance with
the Land Use Change Permit. A digital copy of the surveyed pipeline as -built will be
provided to the Community Development Department.
12. ShouId the pipeline be abandoned and removed, it shall be subject to the revegetation and
weed management requirements in this application or one approved by the County
Vegetation Manager at that time.
13. This Pipeline Development Permit only permits Phase 4 of the pipeline as defined in this
application.
The Land Use and Development Code requires notification to the Board of County Commissioners
for their review and potential tail -up of the Director's Decision. The Board review is for a period
of 10 calendar days commencing on the date of the Director's Decision. The call-up period shall
expire on January 30, 2022. Once the call-up period has passed with no request for review or
public hearing, and provided all relevant conditions of approval have been resolved the Land Use
Change Permit will be issued. Pursuant to the Land Use and Development Code, the Applicant
has one year from the date of the Director's Decision to satisfy all conditions of approval or request
an extension.

Good morning Glenn,
This email is a follow-up to your phone call yesterday after 4pm requesting additional information pertaining to the
previous and current TWA locations. Per your request, please find attached an overview map depicting the previously
proposed and current temporary work space areas (TWAs). On the attached map I have depicted the locations of the 6
TWAs previously noted in RMNG's initial application request in 2021 and the 2 new locations that have replaced them.
To quickly summarize what's depicted on the map:
At Panorama and Buck Point: 2 TWAs (@7,100 sqft in total size) on the West side of the pipeline ROW were
DELETED and one TWA @1,945 sgft in size was ADDED to the East side of the ROW.
o PURPOSE: access to ROW.
South of CR 122: 4 TWAs (@7,820 sgft in total size) on McNulty were DELETED. (Note: 2 of these TWAs were at
the request of the McNultys. With the intent to bore their parcels, all TWAs on their parcels are no longer
necessary).
North of CR 122: one TWA (@60,000 sqft in size) ADDED on X-Bar.
o PURPOSE.,1) to accommodate the larger bore equipment with associated materials (bore and ream
rods, water tanks to recycle drill mud, etc.) required for the long bore under CR 122 and the McNulty
parcels and 2) to accommodate the semi -trucks that must transport said equipment/materials (larger
turning radius of semi -trucks, safe egress/ingress of semi -trucks).
l hope the attached map with above summary description provides the clarity needed to finalize and issue the Land Use
Permit for this project.
