Oldcastle SW Group, lnc. dba United Companies requests a temporary change of use for our Glen's Pit regarding Hours of Operations per CDOT's recommendation to allow for the production of asphalt for the ramp paving project at night. CDOT has recommended modifying project scheduling & traffic safety program to include paving (United Companies) to be done at night for the specified period set forth in the attached schedule primarily as a safety measure to protect the traveling public. This request is project specific to the 20231-70 Ramp Paving Project and will not apply to other projects not related to this project. We feel this project request will pose minimal impacts to the adjacent properties. GENERAL PROJECT DESCRIPTION The applicant proposes operating overnight for approximately 20 days to allow for CDOT resurfacing projects on l-70 Ramps at West Rifle, Rifle, Mamm Creek, and Silt exits. The uses would occur at an existing asphalt facility located in a former gravel pit, and the proposal is to allow operations from 7- pm to 6 am to allow resurfacing to be done at night. The uses would involve transporting millings from the work sites to the asphalt facility, making asphalt at the facility, and transporting facility to the on-ramp work sites. No crushing would be done during the extended temporary use hours. The applicant should provide all previous approvals and indicated how all COA's will continue to meet except for those specifically beíng requested to be changed through the Temporary Use Permit. lf any COA's will be impacted, the application will be called up to the BOCC. lf no COA's will be impacted, then the application may be decided by the Director. The application should carefully address the impacts and compliance with Article 7 Standards, especially as called out for Temporary Uses (Section 7-1301 and Section 4-L2O.8.5. Light, noise, and traffic are anticipated to be the largest impacts. Haul routes, light studies, and similar items should be provided for review. 1 Notice will have to be mailed and posted L5 days prior to a decision date. Only property owners of parcels within 200 feet of the subject parcel will receive notice, and notice will be posted facing adjacent rights-of-way. Section 4-L20 lists application materials required for temporary uses. The Director may waiver or require additional submittal requirements in accordance with Section 4-720.8. The following list can function as a checklist for your submittal. ! Years engaged in contracting business under present trade name: 70 Years 10 Glen's P¡t - Garfield County Temporary Use lntroduction United Companies requests a temporary use change from Garfield County Land Use Development Code 4-120 in order to produce asphalt from the Glen's Pit near Rifle, CO for the supply of paving work on the l-70 Ramp Paving Project. This project requires the production and shipping of hot mix asphalt to the project locations outside of the current operating hours of the Glen's Pit. The paving was awarded to the Applicant, United Companies, the week of July 24th. The project requires that paving be conducted during night hours (7 PM to 7 AM) for approximately 20 nights between August 15th and September 30rh. CDOT recommended this project requirement for traffic and safety reasons. The Glen's Pit has current operating hours of 7 am to 7 pm Monday through Saturday as part of its existing land use approval. These hours are typically sufficient to meet project needs. The Glen's Pit is open year-round and is utilized primarily for special projects. Public projects like the l-70 Ramp Paving occasionally require work hours outside of the 7 am to 7 pm timeframe. The extended hours are intended to minimize disruption to public activity, in this case, the use of the interstate and ramps, and to expedite project completion. 1 . Project Standards ln order to facilitate this project, United Companies addresses the temporary use change standards as listed under Article 7, standard 7-1341. A. The applicant. or a member of the applicant's hausehold. has not applied for a permit for the same or similar use more than twice within the prior twelve (12) month period. a. Project is in full compliance with local and state permit requirements. 11 2. lntent & No Greater lmpacts Operating hours limitations are intended to prevent operational impacts from spilling over into typically quieter and calmer times of the day, usually before sunrise and after sunset. The activities themselves are usually permissible as long as impacts from those activities are constrained. With this waiver request at Glen's Pit, United is requesting to conduct activity beyond the standard hours but is not requesting to expand or increase impacts. See the specific impact discussion in Table 1. Potential lmpacts and Mitigations. All other limitations, conditions, and restrictions in place for the Glen's Pit are unchanged by this request. 3. Project Activity Description Asphalt will be the only materialthat needs to be shipped from Glen's Pit during this project. No other mining or processing activity willtake place at the Glen's Pit after 7 pm and no other outside trucking willtake place during operating hours. All standard permit limits and requirements will still be in place and enforced. Since crushing is a primary noise source at sand and gravel mines, crushers are not used at this site, which will minimize noise impacts during the additional operating times. As asphalt will be the only product that will be produced on during night hours (7 PM to 7 AM), it should be noted that this will also limit the areal extent of activity during those extended hours. Activity will be confined to the asphalt plant, material feed stockpiles, site entrance, and site road during that time. Outside of the area outlined in Figure 2, operations will not be allowed to take place after normal operation hours in accordance with the currently approved permit. All asphalt loads willtravel via US6 as shown on and Figure 3. Trucks will proceed from the Glen's Pit through internal haul roads, enter US6, and proceed to the project ramp locations. 12 4. Potential lmpacts and Mitigation The potential impacts that may come from this temporary use change request and the mitigations for them are shown in Table 1. 4.1.Table 1. Potential lm and Mitioations Lighting Lights on plants and trucks after sundown. Sundown is typically at 8-8:30 pm in the Rifle area during August, limiting the time period needing light. All plant and pit lighting will be downcast and only within the pit below the surrounding grades This will prevent any residential areas from being impacted. See Figure 4. for that lighting area. Conclusion By approving the requested temporary use change for the referenced project, Garfield County will allow United Companies to meet the needs of a necessary infrastructure project in a timely and responsible matter. All existing noise, glare, and traffic limits will remain in place and be enforced. United will operate during the extended hours in a manner that does not lead to greater impacts. Throughout Western Colorado, public infrastructure construction projects increasingly require nighttime and evening activities. lt is common practice for local governments to approve variances, waivers, and temporary plans to facilitate these activities. When nighttime construction is facilitated by local material suppliers, it cuts down on totaltruck miles which leads to reduction in project costs and carbon emissions. Furthermore, allowing nighttime construction minimizes disruption in the lives of community members by minimizing closures and ending construction projects quicker. Construction brings annoyance and frustration to people frequently, but making the frustration short is always preferable to making it long. This waiver request satisfïes the requirements of the Garfield County Code by achieving the intent of the Temporary Use Standard and not creating greater impacts than the standard would allow. 19 \ 7.
