The well permit on site (#266499) is residential at this time and is subject to the Colorado Division of Water Resources (DWR) policy 2011-3 which states: 1. A business may be conducted on the property as long as: a. The property has a home that is the primary single -family residence for the party engaged in the business. b. The business has no on-site employees that use water other than the party living in the single-family residence. c. No additional water will be diverted or consumed as a result of the business being conducted on the property; specifically, no custom ers will use the drinking and sanitary facilities, and the business will not create any demand on the ground water beyond those demands typically associated with the uses described on the well permit. Please see attached letter from DWR for further clarification. According to the representations made on your email dated June 30, 2021, you are following those policies. If you wish to expand the water uses on your site in such a way as to exceed DWR’s policy, you should amend your well-permit to commercial use in accordance with their policies and regulations. This NTP is valid only if the referenced access permit has not expired. Access permits expire one year from the date of issue if not complete or under construction. Your permit will expire on 06/13/2019. Access Permits may be extended twice, each time for a one-year period, in accordance with Section 2.3(11-3), of the Access Code. You must obtain a new NTP following the suspension of work through the winter. You shall notify the CDOT Inspector Tim Holbrook, at (970) 379-1001, at least 48-hours prior to commencing construction within the State Highway right-of-way. All construction shall be completed in an expeditious and safe manner and shall be finished within 45-days from initiation. You must also contact the CDOT Inspector upon completion of access construction to request a final insp ection, prior to any use, as allowed by this permit. All materials and construction shall be completed in accordance with all applicable Department Standards and Specifications, and constructed in conformance with 2 CCR 601-1, State Highway Access Code, including any additional terms and conditions of the Issued Permit. A fully endorsed copy of the issued access permit and NTP shall be available for review at the construction site during construction. Rein, State Engineer/Director MEMORANDUM Date: June 30, 2021 To: Philip Berry, Planner Garfield County Community Development Department From: Megan Sullivan, Water Resource Engineer Re: Wood Small Contractor Yard, Land Use Change Permit; GAPA-04-18-8636 We have reviewed the additional information regarding the land use change request to allow a Contractor’s Yard to support a hot air balloon business, on a 0.24-acre portion of an approximately 2.09-acre property, located in part of the SW1/4 of Section 32, Township 7 South, Range 87 West of the 6th P.M., at 16695 Highway 82, Carbondale. According to the information provided in the original referral materials, the property currently has an existing single family residence, an ADU, an artist studio above a three car garage, access road and utilities in place. The applicant does not propose to create a new lot or change the size of the existing lot. The current water supply to the parcel is provided by an existing well. The application also indicates an existing individual septic serves the existing single-family dwelling, ADU and artist studio above the three car garage. According to the application materials, the applicant intends to store and maintain equipment for their hot air balloon ride business. The applicant’s plans may include a bathroom in the office in the building (barn) once it is built. The materials state that the applicant will not be hosting any customers and employees will be limited to four, most of whom live on the property. The applicant has indicated that employees may use the facilities within the existing three car garage/loft located beside the storage yard. Well Permit No. 266499 was issued November 9, 2005 for historical uses for an existing well, located in the SE1/4 of the NW1/4 of Section 32, Township 7 South, Range 87 West of the 6th P.M. The applicant provided additional information to the Division of Water Resources in 2020 regarding the historical use associated with this well and the permit was amended to reflect the actual historical uses of ordinary household purposes inside two single family dwellings (the main residence and ADU), fire protection, the watering of domestic animals and poultry, and the irrigation of not more than 4,356 square-feet of home gardens and lawns. This well, known as the Agua Fria No. Uno Well, is decreed for domestic use and lawn and garden irrigation of less than one acre, with a priority date of December 31, 1955 and a pumping rate of 15 gpm according to Division 5 Water Court case no. W2818. As outlined in the State Engineer's Guideline 2016-1, a well permitted to serve a single family dwelling (or dwellings) may also serve an auxiliary living space as long as the following criteria for the living space are met: Philip Berry June 30, 2021 Wood Small Contractor Yard Page 2 of 2 • The accessory living area cannot be rented, leased, or permanently occupied by a party other than a member of the family that would otherwise live in the main single-family dwelling, including by those providing a service on the site in exchange for their residency, such as a nanny or caretaker. • The accessory living area cannot use water for non-residential purposes such as businesses, manufacturing, or a facility providing restrooms for customer or public access, etc. • The accessory living area cannot contain kitchen facilities, defined for the purposes of the State Engineer's Office as containing either a stove or oven or a 240-V electric hookup or equivalent gas piping for cooking facilities; or a refrigerator more than 6 cubic feet in size. A wet bar with a sink and a refrigerator no more than 6 cubic feet in size is acceptable. The well may be used to supply facilities in structures other than the main residence and ADU as long as the uses comply with Guideline 2016-1. However, well permit no. 266499 does not allow for drinking and sanitary purposes for parties not living in the single-family residence and the ADU. SEO Policy 2011-3 Concerning Commercial Activities on Property Served By Residential Exempt and Small Capacity Wells (Amended March 1, 2018), does allow incidental commercial activity on a property served by a well operating under a residential type well permit as long as the following requirements are met: • The property has a home that is the primary single-family residence for the party engaged in the business. • The business has no on-site employees that use water other than the party living in the single-family residence(s). • No additional water will be diverted or consumed as a result of the business being conducted on the property; specifically, no customers will use the drinking and sanitary facilities, and the business will not create any demand on the ground water beyond those demands typically associated with the uses described on the well permit. • As long as the applicant does not exceed allowed uses under well permit no. 266499, this office does not object to this Land Use Change application for the Contractor’s Yard.
