County in Section: 32 Township: 75 Range: 87W and owned by Bruce and
Pamela Wood

ln accordance with and pursuant to the provisions of the Garfield County Land
Use and Development Code, as amended, the following activity is hereby
authorized by Land Use Change Permit:
"Contractor's Yard, Small" (GAPA-04-18-8636), as sfiot¡l/n on the Site Ptan
Attached as Exhibit B
The Land Use Change Permit is issued subject to the conditions contained in the
Director's Determination letter dated October 2,2018 (Exhibit C), and shall be
valid only during compliance with such conditions and other applicable provisions
of the Garfield County Land Use and Development Code, as amended, Building
Code, and other regulations of the Board of County Commissioners of Garfield
County, Colorado.

DIRECTOR DETERMINATION - Administrative Review Land Use Change
Permit - Wood - Contractor's Yard, Small -

Dear Mr, and Mrs. Wood;
This letter is being provided to you in regards to a Administrative Review
Application for a Conlractors Yard, Srnall on your property. The proposed use is
located in Section: 32 Township: 75 Range: 87W on a part of the property known
by Assessor's Parcel No. 2391-322-00-006 and located at 16695 Highway 82'
Carbondale.
The Director's Determination on the Application is based on the following findings
and subjecÌ to the Applicant's representatìons and condilions of approval.
1. That proper public notice was provided as required for the Director's
Decision.
2. That the Application does adequately meet the requirements of the Land
Use and Development Code of 2013, as amended, with approval of lhe
following Waivers: Section 7-1001(B) - Setbacks, and Section 7-1001(DX3)
- Storing Setþacks.
3. That the application is in general conformance with the 2030
Comprehensive Plan, as amended.

A Director,s Decision is hereby issued approving the Application as shown on
Exhibit A and with the following conditions'
Corlditions Prior to lssuance of the La¡-r.d Use Chanoe Permit
1. The applicant shall address noxious weeds on the property as required by
Garfield county Vegetation Management in Exhibit 14 of the staff Report.
A demonstration of compliance with this condition will be provided by the
Vegetation Managemenl Department'
2. The applicant shall either obtain an update from the Division of water
Resources indicating that the uses on the sile are in compliance wiih the
existing well permit or the applicant shall obtain a new well perm¡t that
accounts for all uses of the well on the property.
3. The applicant shall supply a grading and drainage plan from a qualified
professional for the proposed use, acceptablê to the Garfield county
àesignated engineer. Any required improvements from that plan shall be
required to be installed prior to the issuance of the Land use change
Permit.
4. The applicant shall obtain a notice to proceed from cDoT and complete
required improvements to the access.
5. The applicant shall install a solid six foot tall fence as indicated on the site
plan.
ô. The applicant shall submit â pump test that meets the standards in
Section 4-203(MXlXbXSXa). A statement from a qualified professional
shall be submitted to Community Development thât stâles the well will be
adequale to supply water for the proposed uses'
7. The applicant shall supply a water quality lest for all contaminanls listed in
Section 4-203(MX1)ib)(5)(c) of the Land Use and Development Code. lf
any contaminants exceed required standards, the applicani shall supply a
ietier from a qualrfred professional detailing required improvements that
need to be eompleted to ensure that the water distribut¡on system meets
required water quality standards. Any identified improvements shall be
instailed prior to the issuance Land Use Change Permit.
General Conditions
8. All representations of the Applicant contained in the application including
the sìte plan and overall dimensions of the contractor's yard shall be
considered conditions of approval unless specifically modified by the
Conditions of APProval.

9. Slorage of vehicles and trailers assoc¡ated with the contractor's Yard use
shall be limited to 4 vehicles and 6 irailers as indicated in the application,
1 0. The operation of the contractor's yard shall be done in €¡ccordance with all
applicable Federal, State, and local regulations governing the operation of
this type of facility including, but not limited to, LPG slorage.
11.All activity and structures associated with the Contractors Yard, with
exception to the äccess road, shall be contained wilhin the area identified
on the Site Plan and shall be at least 25 feet back from all property lines.
12. ldling of vehicles on sìte shall be minimal.
13.The applicalion was spectfically for the Small Contractor's Yard' The
application represented that there wâs no residêntial occupancy above the
barn. The approval of the Small Contractor's Yard in no wây indicates
approval for any unknown Land Use and Development Code violation on
the site.
14.fhe access road from the Highway 82 Frontage Road shall be maintained
to the standards outlined in Section 7-107'
lS.Vehicular access to the Contraotor's Yard shall be limited to the western
access point onto the Parcel.
1 6. No portion of the Contractor's Yard shall extend over the septic tânk or leech
field.
't7.All lighting shall be the minimum necessary and shall comply with Section
7-304 ofthe Land Use and Development Code.
18.The operator acknowledges that Garfield County has standards for
lndustrial Uses as described in Section 7-1001 of the Land Use and
Development Code. These stândards shall be applicable 1o this use except
as modified by this aPProval.
19.Any activity that will generate noise, odors, or glare beyond the property
boundaries shall be conducted between the hours of 7:00 a.m. to 7:00 p.m.
Monday through Saturday. Vehicles and trailers are permitted to exii and
enter thê site outside of lhose hours,
This Determination will be fonryarded to the Board of County Commissioners for a
period of 10 days so thal they may determine whether or not to call up the
application for furlher review. According to the Land Use and Development Code,
Section 4-112(A), "a call-up may be initiated by the BOCC, the Director' the
Applicant, or any affected Adiacent Property Owner." Should this time period pass
with no request for review or public hearing, the decision shall be final.
