Said property was divided and conveyed as greater than 35-acre tracts. The County appreciates the supplemental submittals and engineering details/plans that your have provided in support of your Grading Permit Application. This letter outlines certain conditions that will be required prior to the issuance of the Grading Permit. This letter and the determinations contained herein are in reliance on the legal representations provided by your Attorney (correspondence dated 1117l22from John Mallonee, Balcomb & Green). Said legal representations indicated that you have retained authorization to complete road grading associated with the Grand Hogback Properties. Garfield County is prepared.to issue your grading permit subject to the following conditions that will need to be fully addressed prior to the issuance of the grading permit. a. You shall formally amend your Application to update the engineering submittals and remove the westerly intersection and any encroachments onto other adjacent properties. The amendment can be accomplished through signed correspondence by an authorized representative indicating as follows: i) that the grading shall be as reflected in the Engineered Plans submitted by Roger Neal, High Country Engineering, dated 8131123 and Drainage Report dated 8129123; ii)that the grading is 108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (970) 94s-82r2 for completion of a roadway serving the Grand Hogback Ranches development; and iii) that the Applicant is Dow Rippy, representing West Divide LLC. b. Prior to the issuance of your grading permit, you shall provide the County with a copy of an approved driveway access permit or license for all improvements plarrnecl withill the Town Right-of-Way for the central intersection access onto the Town's Street, as shown on Sheet P&P-1 of the High Country Engineering Grading Plans (a copy of the permit has been received). c. Prior to the issuance of your grading permit, you shall provide the County with a copy of an approved Watershed Protection Permit issued by the Town of New Castle for the area included within the amended grading permit. d. Prior to the issuance of the grading permit, you shall provide stormwater management plans for the disturbedigraded area immediately adjacent to the westerly intersection. This shall include protection from soil erosion and dehris/mr¡d impacts on adjacent properties and right-of-way. Said improvements shall be designed by a Licensed Engineer and shall be installed and inspected by the County prior to you initiating any additional grading on the balance of the permit. e. Priorto issuance of the grading permit, you shall provide verification that County Road and Bridge has issued you an access permit for the eastern most intersection and provide revegetation security to the County Vegetation Manager in the amount $2,500 based on your estimate of 42,780 sq.ft. of roadway slopes to be revegetated. f. All remaining review fees due to the County shall be paid prior to issuance of the grading permit. g. Compliance with all representations contained in the Application and Supplemental Engineering shall be conditions of approval. lf the amended application and above conditions are not met within 60 days of your receipt of this letter the application shall be considered withd rawn. Please note that the westerly intersection being removed from the current grading permit along with grading on the adjacent properties is still subject to a stop work order from the County and will require future grading permit. To conduct our preliminary review, we have been in receipt of the following information: t. A four (4) sheet set of drawings prepared by HCE dated as stamped on 5/26/23. These are drawings of a portion of the internal access road and proposed ties to CR 335 with proposed details for construction. Notable from New Castle's perspective is the absence of design of the modifications previously proposed on the access that was revised, now opposite the Riverpark Condominium project. 2. The 6119/23 Letter from Balcomb & Green to David McConaughy. 3. A5/25123 Drainage report prepared by Hieh Country Engineering for the access road represented in the four-sheet set of drawings. 4. A revegetation bond for the portion of access road represented. 5. Response comments to our 2/8123lelter. 6. 6lt9l23 Watershed Permit application. 7 . Revised plans prepared by HCE on the roadway for Lots 5-13 stampe d 8l3Ll2O23 GENERAT OBSERVATIONS MADE WITH THE PROPOSAL Note that our prior letter of 2/8/23 recommended design modifications to the previously submitted design for ties to the portion of County Road 335 that are now under ownership and maintenance of the Town of New Castle. Likewise, our letter identified concern for the Town of New Castle is the fact that the drainage report stops short of providing any calculations, recommendations or proposed improvements that would mitigate the increased flow anticipated to exist as a result of the modified drainage conditions observed to exist as a result of the mass grading that has occurred upstream ofthe existing drainage infrastructure across and under CR 335 and through Riverpark Subdivision. The report does not evaluate the impacts of the grading activities on these culverts and whether or not the existing infrastructure (that crossing CR 335 and through Riverpark) is capable of handling the increased flows. Given such, we cannot grant a right of way permit, nor a watershed permit until an application that is prepared to fully address these issues is submitted, reviewed and accepted. The information submitted in July along with the watershed permit were intended to address the access to lots 5- 13 only and deals solely with the eastern roadway tie to CR 335 (across from the Riverpark east roadway tie). We have reviewed the watershed permit data and right of way permit data for this driveway and access road and have determined that the submittal for both is now acceptable for both permits. The watershed permit has a reclamation bond provided and the August 3t,2023 revised design of the drivewaytie to CR 335 is acceptable to the Town. The Town subsequently has issued the right of way permit and this letter is intended to serve as the watershed permit for the roadway serving Lots 5-L3 only. A boundary and improvements map or sketch of the land subject to the application containing sufficient detail and drawn at a scale to accurately illustrateo review and assess the location of all proposed activity and existing structureso and illustrating the existing direction of slope (contours) and direction of surface runoff. A Garfield County grading permit is pending, though should not be required for this activity. 8. A detailed description of the impacts or potential impacts the activity may have on any surface or subsurface water sources or courses, including wetlands; The Drainage Report included with this application fulfills this requirement. 9. A detailed description of the impacts or potential impacts the activity may have on existing vegetation, trees nnd groundcover; There will be an area of approximately 1.5 acres of disturbance within the project boundaries that will be required to be re-vegetated to Garfield County standards. The projected cost of re-vegetation will be approximately $5,000 per acre, for a total of $7,500 for the project area. 10. The only thing that I am unclear of is the entire proposed access road covered with all weather driving surface at this time. I think that only parts of it are covered from my site visit. I will need to come and inspect the road when it is complete covered with all weather driving surface, (road base or crushed asphalt) .
