1. Install stormwater controls prior to any other dirt work and comply with State
Stormwater Permit Waiver.
2. Locate all utilities prior to any work.
3. Control all noxious weeds and revegetate all disturbed areas not part of the road
improvements. Coordinate with Steve Anthony, Garfield County Vegetation
Manager on revegetation and weed control.
4. Provide erosion control until seeded areas can be established
5. Provide dust control as needed during construction.
6. Maintain all drainage on subject properties from entering neighboring properties
other than historic drainage.
7. Compliance with all representations contained in the Application and
Supplemental Engineering from High Country Engineering, dated 8129123 and
8131123, consistent with County Consulting Engineer review.
8. Comply with all other required permits including Watershed Protection and
Driveway/Access Permits.

This letter is in regard to your Grading Permit Application, submitted to the Community
Development Department (File No. GRAD-7638) for your property located adjacent to the
Town of New Castle and also known as the Grand Hogback Ranches. Said property was
divided and conveyed as greater than 3S-acre tracts. The County appreciates the
supplemental submittals and engineering details/plans that your have provided in support
of your Grading Permit Application.
This letter outlines certain conditions that will be required prior to the issuance of the
Grading Permit. This letter and the determinations contained herein are in reliance on
the legal representations provided by your Attorney (correspondence dated 1117l22from
John Mallonee, Balcomb & Green). Said legal representations indicated that you have
retained authorization to complete road grading associated with the Grand Hogback
Properties.
Garfield County is prepared.to issue your grading permit subject to the following
conditions that will need to be fully addressed prior to the issuance of the grading permit.
a. You shall formally amend your Application to update the engineering submittals and
remove the westerly intersection and any encroachments onto other adjacent
properties. The amendment can be accomplished through signed correspondence by
an authorized representative indicating as follows: i) that the grading shall be as
reflected in the Engineered Plans submitted by Roger Neal, High Country
Engineering, dated 8131123 and Drainage Report dated Bl29l23; ii) that the grading is

for completion of a roadway serving the Grand Hogback Ranches development; and
iii) that the Appllcant is Dow Rippy, representing West Divicle LLC.
b. Prior to the issuance of your grading permit, you shall provide the County with a copy
of an approved driveway access permit or license for all improvements planned within
the "fown Righlof-Way for the central intersection access onto the Town's Street, as
shown on Sheet P&P-1 of the High Country Engineering Grading Plans (a copy of the
permit has been received).
c. Prior to the issuance of your grading permit, you shall provide the County with a copy
of an approved Watershed Protection Permit issued by the Town of New Castle for
the area included within the amended grading permit.
d. Priorto the issuance of the grading permit, you shall provide stormwater management
plans for the disturbed/graded area immediately adjacent to the westerly intersection.
This shall include protection from soil erosion and debris/mud impacts on adjacent
properties and right-of-way. Said improvements shall be designed by a Licensed
Engineer and shall be installed and inspected by the County prior to you initiating any
additional grading on the balance of the permit.
e. Priorto issuance of the grading permit, you shall provide verification that County Road
and Bridge has issued you an access permit for the eastern most intersection and
provide revegetation security to the County Vegetation Manager in the amount $2,500
based on your estimate of 42,780 sq.ft. of roadway slopes to be revegetated.
f . All remaining review fees due to the County shall be paid prior to issuance of the
grading permit.
g. Compliance with all representations contained in the Application and Supplemental
Engineering shall be conditions of approval. lf the amended application and above
conditions are not met within 60 days of your receipt of this letter the application shall
be considered withdrawn.
Please note that the westerly intersection being removed from the current grading permit
along with grading on the adjacent properties is still subject to a stop work order from the
County and will require future grading permit. Please contact us if you, your Attorney or
Engineer have any questions regarding next steps toward issuance of your grading
permit. Thanks in advance for working with us on these final steps toward approval.

l, Dow Rippy, Manager of Grand Hogback Ranches and West Divide Ranch, LLC have
the authority of Grand Hogback Ranch Tract Owners to complete the improvement of
graveling the road and entrance as depicted in High Country Engineering Plans and
drawings with permits issued by the Town of New Castle, and Garfield County Road
and Bridge between Tracts 4-15.
As to the watershed protection permit previously requested by the Town of New
Castle, this has been rescinded for Tracts 4-lífor the purpose of completing this
driveway and entrance to Grand Hogback Ranches depicted in HCE drawings as
evidenced by issuance of the driveway permit on file.
Stormwater management willbe implemented as depicted on HCE plans which have
been approved by your engineer Chris Hale.
Revegetation security bond will be provided.
The outstanding engineering billwillbe paid.

has prepared a "Vegetation Management and Reclamatlon Plan" ("\y'egetation Management Plan")to meet
the conditions of approval for a Gradlng Permit as required by the County of Garfield (hereinafter "County")
for its approval of GRAD - 7638i and,
Whereas, said principal is required under the terms of the GRAD - 7638 to provide security
for the faithful performance and completion of the "Vegetation Management and Reclamation
Plan" in accordance to the Reclamation Standards section in the Garfield County Weed
Management Plan, The Reclamation Standards at the date of permit issuance are cited in Sections
4,06, 4.07 , and 4,08 of the Garfield County Weed Management Plan (Resolution #16-12).
Now, therefore, we, the principal and Harco Natlonal lnsurance Company as surety, are
held and firmly bound unto the Garfield County Board of .County Commissioners, (the "County") as
Oblige, in the penal sum of Two Thousand and Flve Hundred and 00/100 dollars ($2,500'00)
lawful money of the United States, for the payment of which sum well and truly to be made, we bind
ourselves, our heirs, successors, executors and administrators, jointly and severally, firmly by these presents.
The conditions of this obligation is such that if the above bounded prlncipal, his/her or its

Introduction
As requested, on Novembet 3,2023, representatives of Fligh Country Engineering Inc. visited Tracts
17 &.18, Grand Hogback Ranches to evaluate the apparent stability of the surface soils.
0bservations
It appeared that grading has recently occurred within Tracts 1 7 & 18. Other stock plied materials were
also observed within the site. Flowever, no evidence mud, nor debris was observed escaping the'site.
The surface soils appeared to be generally stable at the time of the site visit. ' '

Recommendations
1. A grading permit should be obtained from appropriate governing agencies, priot to continüation of
additional grading at the site. : :
2. Perimeter linear erosion control measures should be installed along the northerly limits of the
recently graded areas to as a preventative to intercept possible future mud or debris from potentially

Dear Glenn,
The purpose of this letter is to follow up with our review of data prepared by High Country Engineering and Balcomb
and Green for the watershed permit application to the Town of New Castle following their review of our February
8,2023 review letter to you.
To conduct our preliminary review, we have been in receipt of the following information
t. A four (4) sheet set of drawings prepared by HCE dated as stamped on 5126/23. These are drawings of a
portion of the internal access road and proposed ties to CR 335 with proposed details for construction.
Notable from New Castle's perspective is the absence of design of the modifications previously proposed
on the access that was revised, now opposite the Riverpark Condominium project.
2. the 6h9/23 Letter from Balcomb & Green to David McConaughy.
3. A5/25/23 Drainage report prepared by High Country Engineeringforthe access road represented in the
four-sheet set of drawings.
4. A revegetation bond for the portion of access road represented'

GENERAL OBSERVATIONS MADE WITH THE PROPOSAL
Note that our prior letter of 2/8/23 recommended design modifications to the previously submitted design for ties
to the portion of County Road 335 that are now under ownership and maintenance of the Town of New Castle'
Likewise, our letter identified concern for the Town of New Castle is the fact that the drainage report stops short
of providing any calculations, recommendations or proposed improvements that would mitigate the increased flow
anticipated to exist as a result of the modified drainage conditions observed to exist as a result of the mass grading
that has occurred upstream ofthe existing drainage infrastructure across and under CR 335 and through Riverpark
Subdivision. The report does not evaluate the impacts of the grading activities on these culverts and whether or
not the existing infrastructure (that crossing CR 335 and through Riverpark) is capable of handling the increased
flows.
The review of the data submitted does not adequately address our concerns for the western most access tie to
County Road 335 (through the Town owned and maintained portion) nor does it address the drainage, erosion

control or sediment concerns related to the mass grading that has occurred on the property (Lots 14-18) west of
the western most tie to County Road 233. Given such, we cannot grant a right of way permit, nor a watershed
permit until an application that is prepared to fully address these issues is submitted, reviewed and accepted.
The information submitted in July along with the watershed permit were intended to address the access to lots 5-
13 only and deals solely with the eastern roadway tie to CR 335 (across from the Riverpark east roadway tie). We
have reviewed the watershed permit data and right of way permit data for this driveway and access road and have
determined that the submittal for both is now acceptable for both permits. The watershed permit has a
reclamation bond provided and the August 3t,2023 revised design of the driveway tie to CR 335 is acceptable to
the Town.
The Town subsequently has issued the right of way permit and this letter is intended to serve as the watershed
permit for the roadway serving Lots 5-13 only.

This permit is being sought for roadway ties to a section of CR 335 through the Town
of New Castle and unincorporated Garfield County - specifically the road identified in
the Plans, through Tracts 4-13 described above. The general environmental
characteristics of the subject land and surrounding area ate undeveloped with shrub
vegetation among Camborthids-Rock soil conditions'
5. A vicinity map showing the land on which the proposed development is to occur
and all lots, tracts, parcels or other lands adjacent thereto, and illustrating any
wetlands, lakes, ponds, springs, watercourses or other bodies of water and water
wells;
Stamped Plans and Profîles by High Country Engineering, Inc., as well as a letter from
SGM, Inc. are attached that we believe fulfill this requirement.
6. A boundary and improvements map or sketch of the land subject to the
application containing sufficient detail and drawn at a scale to accurately
illustrate, review and assess the location of all proposed activity and existing
structures, and illustrating the existing direction of slope (contours) and direction
of surface runoff. A profcssionally prepared boundary and improvements survey
may be required if the town englneer deems it necessary in order to adequately
assess an application;
Stamped Plans and Profiles by High Country Engineering, Inc., as well as a letter from
SGM, Inc. are attached that we believe fulfill this requirement. No existing structures
are in the vicinity of the operations.
7. A listing and copy of all federal, state or local permits or approvals required or
obtained for implementation of the activity;
A Stormwater Management waiver has been obtained from CDPHE in the past, and the
requirements can be met again. A Garfield County grading permit is pending, though
should not be required for this activity.
8. A detailed description of the impacts or potential impacts the activity may have
on any surface or subsurface water sources or courses, including wetlands;
The Drainage Report included with this application fulfills this requirement.
9. A detailed description of the impacts or potential impacts the activity may have
on existing vegetation, trees and groundcover;
There will be aî area of approximately 1.5 acres of disturbance within the project
boundaries that will be required to be re-vegetated to Garfïeld County standards. The
projected cost of re-vegetation will be approximately 55,000 per acre, for a total of
$7,500 for the project area.
10. A detailed description of the impacts or potential impacts the activity may have
on soils, including a description of the nature and condition of existing soils and
any planned grading, excavating, filling or surfacing;
The Drainage Report included with this application fulfîlls this requirement.
11. A detailed description of the impacts or potential impacts the activity may have
on existing drainage patterns and land contours, including comparative runoff
and absorption calculations for the subject land and any impacted adjacent land,
both pre- and post-development;
Starnped Plans and Profìles by High Country Engineering, Inc., a letter from SGM,
Inc., and Drainage Report from High Country Engineering. Inc. are attached that we
believe fulfill this requirement.
12. A detaited description of any proposed wastewater or sewage disposal system to
be installed and a copy of the designed/engineered plans, including soils and

Here are the dimensions and seed varieties.
I included the the roadway slopes and added 15%for best measure. I didn't include the pasture work that we talked
about. I think this will only confuse things. We established that pasture grading falls under agriculture practice.
The seed rate is about double normal to accommodate for broadcast seeding application. I will put seed down this
spring and again this fall if necessary. Please reach out to me for any changes ideas etc.
I also will continue weed monitoring and treatment in the spring and fall seasons.

I have reviewed the access road for the proposed Grand Hogback Ranches, and I am ok with the proposed access
alignment and county road entrances (intersections as shown) for the lots. The only thing that I am unclear of is the
entire proposed access road covered with all weather driving surface at this time. I think that only parts of it are
covered from my site visit. I will need to come and inspect the road when it is complete covered with all weather dríving
surface, (road base or crushed asphalt) . As far as your access permit I am ok with the issuance of the access permit
from the county.
Please let me know if you have any quest¡ons or concerns.
