HomeMy WebLinkAboutStop Work Letter 05.03.2022108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (970) 945-8212 West Divide Ranch LLC 10031 County Road 311, Silt, CO 81652 New Castle, CO 81647 ATTN: Dow Rippy May 3, 2022 Dear Dow: This letter is to reaffirm our stop work order and our direction to you that you need to formally file a grading permit application for your grading work and road construction on your property just outside the Town of New Castle off of County Road 335, also known in your marketing as the Grand Hogback Ranches. As early as last November and again during a site visit in January 2022, you have been advised that the work you have completed on the property does require a grading permit as confirmed by our Building Inspectors. Your references to agricultural operations are certainly acknowledged, however your activities (developing a road to access numerous 35+ acre lots that you have created) extend well beyond typical agricultural operations and well beyond work required by the Division of Reclamation Mining and Safety (as confirmed by conversations with the DRMS Project Manager). Your preliminary grading information has been reviewed and determined to not be complete and a more detailed grading plan and engineering information is required. The Grading Permit Application form which you have obtained through our offices and our several meetings have provided good direction on the Application requirements. A summary of submittals requirements for a Major Grading Permit is provided below: - Your application needs to include engineering details on final grading and road construction. - Your application needs to include a copy of your CDPHE State Storm Water Management Permit. Community Development Department 108 Eighth Street, Suite 401 Glenwood Springs, Colorado 81601 (970) 945-8212 - Your application needs to include site management, erosion protection measures, and related best management practices for the site. - Your application needs to be prepared by a licensed engineer and your application will be referred to the County Consulting Engineer. - A payment agreement form needs to be provided and the cost to the County to review the application will be passed through to the Applicant. - Thank you for meeting with Steve Anthony, County Vegetation Manager on site regarding revegetation and weed management. A bond/security needs to be provided in an amount approved by the County prior to issuance of the permit. - Your application will need to include all related access permits for your new road construction. This includes permits from the County Road and Bridge Department for access off of the County Road and from the Town of New Castle for access of roads that have been annexed by the Town. The above requirements are consistent with the information and instructions attached to the Grading Permit application packet. Our site visit earlier this year was most helpful and our phone conversations and meetings since then are much appreciated, however, this stop work order is necessary to ensure completion of your permitting and may impact our ability to issue building permits, grading permits, or Land Use Change Permits on property affected by your work.
