Dear Ms. Hashmi:
The purpose of this correspondence is to provide information for the redevelopment of the Mind
Springs building located at 6916 Highway 82 in Garfield County. As you are aware, the project
proposes to redevelop the professional building into two uses. The upper floor will be residential
and be divided into 8, one-bedroom apartments and 1, two-bedroom apartment. The lower level
will be self-storage units. Our understanding is that the improvements will be done to the building
interior and exterior improvements to the building will be cosmetic with the site layout being
unchanged. Minor trenching to make new utility connections may be necessary. The project may
also make some improvements to plantings in landscaped areas but no changes are proposed to the
amount or shape of hardscape. Attached in the Appendix is a Vicinity Map of the area. Refer to
the architectural drawings for further details concerning interior building layout.
POTABLE WATER
The assumptions for residential water use are 100 gallons per person per day (GPPPD) and that
there are two people per bedroom. This yields the anticipated water demand and would be 2,000
gallons per day (GPD); 2.24 acre-ft of water per year. No water demands are anticipated from the
self-storage units. The water demands were converted to gallons per minute to determine design
flowrates. Peaking factors of double the average-day demand was assigned to the peak-day
demand and double the peak-day was used for the peak-hour demand, or four times the average-
day demand. These are typical peaking factors. The peak-hour demand calculated is a flowrate
of 8.3 gpm. Calculations are attached in the Appendix.
Water is to be provided by an existing well, permit #32058. Well permit information is attached.
Aqua Tec Systems, Inc. performed a 4-hour pump test on the well where the pump rate started at
20 gallons per minute (gpm). The well production dropped through the test until the last 30
minutes where the well averaged 8 gpm. The well recovered 4.8 feet, over 50% of the drawdown,
in 60 minutes.
According to Aqua Tec, the well is equipped with a 10 gpm, Goulds, 3 horse-power pump. This
is sufficient to provide the peak-hour demand. However, the well production rate estimated from
the pump test is 8 gpm. Based on this difference, storage is recommended to equalize any

discrepancy between the peak-hour demand, the pump capacity, and/or well production capacity.
The minimum recommended storage volume for potable water usage would be equal to the peak
day demand, or 4,000 gallons. More storage is likely to be warranted for other potential water
needs.
The well water was sampled and sent to the Colorado Department of Public Health and
Environment (CDPHE) for a water chemistry analysis. The analysis identified that Coliform was
present and identified other secondary contaminants. Mr. Alan Leslie with Environmental Process
Controls has reviewed the water quality analysis and believes that disinfection will mitigate the
Coliform. Additionally, he is of the opinion that the secondary contaminants can be removed with
cartridge filters and/or water softening equipment. Correspondence is attached in the Appendix.
Environmental Process Controls was contracted in the past to manage the Mind Springs existing
water system and it is our recommendation to rehire them or other qualified company to operate
and maintain the proposed system.
The maximum residential occupancy of the building is anticipated to be 20 people. The threshold
for water system permitting with the CDPHE is 25 people. Permitting with the CDPHE is not
required. However, the Owner should be aware that exceeding the design occupancy would not
only overextend the capacity of the water system but could initiate permitting requirements for a
Community Water System with the CDPHE.
Mr. Craig Corona of Craig Corona Water Law is working on a Substitute Water Supply Plan, West
Divide Contract, and changing the use and ownership of the well. Refer to that correspondence
for further details concerning legal supply of water.
SANITARY SEWER
Sewer service for larger density was investigated. Pumping uphill to the Spring Valley Sanitation
waste water treatment plant (WWTP) is cost prohibitive. Connection into the Caverns Springs
WWTP was denied permission. The only available alternative is to use the existing onsite
wastewater treatment system (OWTS).
The existing OWTS system was designed by Gamba and Associates and permitted through
Garfield County. The system is designed for a flow of 1600 GPD. Sewer flows per Garfield
County OWTS regulations assumes 75 GPD and two persons per bedroom. The estimated
wastewater flow from the proposed project will be 1500 GPD and is less than the designed
capacity. Permit information and design drawings of the existing system is included in the
Appendix.
The threshold for OWTS permitting with the CDPHE is 2,000 GPD. Permitting with the CDPHE
is not required. However, the Owner should be aware that exceeding the design occupancy would
not only overextend the capacity of the OWTS but could initiate permitting requirements with the
CDPHE.

The OWTS equipment has sat dormant for some time. It is recommended that the pumps and
pumping system be serviced and the system inspected by a qualified professional to verify that it
is in working order and in good repair. Any necessary repairs would need to be performed prior
to occupancy.
TRAFFIC
A traffic analysis was performed by Kimley-Horn and Associates. The purpose was to anticipate
any mitigation that might be necessary due to increased traffic from Mind Springs. The scope of
the analysis was to determine the number of dwellings that could be constructed before a revised
CDOT Access Permit would be necessary and before construction of roadway widening would be
required to accommodate any necessary turn lanes from increased traffic queueing. Based on their
analysis there would need to be greater than 155 dwelling units. Since the proposed 9 apartments
is substantially less than 155 units, no turning lanes nor access permit should be required. The
memorandum form Kimley-Horn is attached in the Appendix.
UTILITIES
Holy Cross Energy provides power service to the building currently and has provided a will serve
letter for the proposed redevelopment attached in the Appendix. Certain requirements will be
necessary for the meters at the time of building permit. Correspondence elaborating this was
provided in an email that is also attached.

Re: Replacement absorption field for the Colorado West Regional Mental
Health Center (CWRMHC) ISDS
Dear Andy:
The following are the percolation test results and some design notes for the
proposed replacement of the Colorado West Regional Mental Health Center -
Individual Sewage Disposal System (ISDS) to be located at 6916 Highway 82,
Glenwood Springs, Colorado 81601.
The existing system consists of a three septic tanks installed in a parallel
arrangement, with a drywell designed by Schmueser Gordon Meyer (SGM)
sometime in 1993. The existing drywell appears to be overloaded, and the new
design is intended to resolve some other problems the system has been having
also.
The proposed effluent disposal system is also a drywell system, although
significantly larger, and located well away from the original system, and served
by a pump to be located in the vicinity of the existing tanks and drywell.
Three percolation test pits, and a nine-foot deep profile hole were excavated in
the general area of the proposed absorption field, prior to any design work being
performed. The excavation revealed neither ground water nor bedrock to the
depth of the profile hole.
The soil in the profile hole was fairly consistent throughout its depth, with many
rocks of varying sizes from '!4-inch to 6 and 8-inch, mostly weathered basalt,
with some very fine basalt sands and some silts. The profile hole was
excavated well within the proposed area of the drywells.
Gamba & Associates, Inc. performed percolation testing in the general area of
the proposed absorption field. The holes were excavated by a trackhoe to a
depth of 3.0 to 3.5', with the actual percolation holes excavated by shovel to
1.4' to 1.8' below the backhoe excavations. The holes were pre-soaked the day
prior, and again on the morning of the percolation testing. No water was
observed in the percolation holes upon arrival.

The percolation tests were conducted on August 22, 2003, and the results are
presented in the attached "Percolation Test Results Form". Since the
percolation test holes were not within the ultimate area of the proposed
absorption field, the WORST (slowest) percolation rate for the bottom 6-inches
of all three holes was used for the design: 30 min.fin., (value rounded up from
29.25 min.fin. for hole #2). In addition, the four feet below the bottom of the
proposed drywell will be excavated to confirm that there are neither confining
layers nor groundwater within that depth. The presence of any confining layer
or groundwater will necessitate a revision in the design. If the final percolation
rates reveal an average rate of less than 5 min.fin. then an additional 4-feet of
material will be removed, and replaced with a compacted layer of Class 6
Aggregate Base Course, which, by our tests, has a percolation rate of from 11
to 16 minutes per inch.
The final site of the absorption field was determined based on the required clear
zone to the domestic potable water well, and the minimum lot setbacks.
During the excavation for the proposed drywell area, the soil will be observed
by, or under the responsible charge of a licensed Geotechnical Engineer, for any
obvious differences in composition at all depths from 3-feet below existing
ground to the proposed bottom depth of 12-feet below existing ground, or the
existence of any unsuitable layers. If the Geotechnical Engineer believes, based
on his/her observation of the excavation, that there are any unsuitable layers
encountered, these layers will be omitted from the allowable sidewall area. At
least two, and up to three additional percolation tests will be performed at the
proposed bottom of the drywell area. The fmal size of the drywell field will be
based on the results of these additional percolation tests.
The proposed site for the drywell is situated to the east of the existing parking
area, and approximately 16-feet higher than the parking lot. HP Geotech has
been onsite and observed the general area of the proposed drywell, and
recommended that the absorption field be located as far back from the slope as
is practical. The proposed design complies with that recommendation.
In addition to observing the excavation for any potential problem soil layers the
Geotechnical Engineer will also be asked for his/her opinion as to the relative
risk for effluent emerging from the slope above the driveway during the lifetime
of the system. Recommendations of the Geotechnical Engineer will be followed
to the extent practical, but the site constraints make the proposed location of the
drywell the only feasible location on the property.

The entire area, including the Colorado West Regional Mental Health Center,
and many adjoining properties, have experienced repeated problems with septic
systems failing. Gamba & Associates, Inc. (G&A) has conducted, as part of a
separate project, an extensive evaluation of the area, and produced a preliminary
design, and cost estimate for a sanitary sewer system to provide service to the
whole area. The cost of such a system became prohibitive for the parties willing
to participate in the construction, and the plan was never extended beyond the
preliminary design and analysis stage. For these reasons, the proposed design
is presented as the best of the economically feasible alternatives at this time.
This report has been prepared according to generally accepted engineering
practices for the design of Individual Septic Disposal Systems within Garfield
County. The conclusions and recommendations submitted in this report are
based upon data obtained from our field investigations of the proposed site.
There is some possibility that the nature and extent of the subsurface soil across
the site may not have been discovered during our investigations and may require
additional fieldwork. If further excavation reveals conditions different form
those described, our office should be notified of these findings as soon as
possible.

Dear Andy:
The above described ISDS system has been installed and completed in
substantial compliance with the six-sheet set of design plans dated and stamped
October 23, 2003. In my opinion, the design drawings will adequately serve for
as-built drawings.
There had been one unresolved issue relating to the construction, concerning a
previously unknown vertical pipe found in the excavation for the force main.
The concern was that this pipe might have been an old, an-abandoned potable
water well. We had asked the contractor to observe the removal of this pipe.
The contractor sent us a letter detailing what they found when exploring this
pipe. According to their letter, the pipe in question did not appear to be a well,
as it was only 10 to 12-feet long, and had no other connections. A copy of that
letter is attached for your files.
If you have any questions, please do not hesitate to call.

I am forwarding the Earthworks Jetter of February 28th to Garfield County along
with my Jetter stating that the ISDS system has been constructed in general
accordance with the plans and specifications. A copy of that letter is attached.
I would have preferred that my request to be present at the time of removal of the
pipe/casing had been adhered to, but there may have been a misunderstanding, or
Earthworks may not have been able to reach me.

I am writing in response to your letter to Joseph Beyer, dated February 17, 2005
regarding the suspected abandoned well.
When we excavated the area down the 6" steel casing wa~ exposed. We removed the
steel pipe that was only 10'-12' long. There was no pipe below or any sign ofa well or
hole beyond the bottom of the pipe. With no evidence of a well being present, (i.e. water
service piping, or septic service) we assumed the steel pipe was used for another purpose
and removed. This was discussed last year and I thought the issue was taken care of. 1
apologize for any misunderstanding.

RE: SH-82 CDOT Access Permit Determination
This memorandum has been prepared to document the results of a State of Colorado Department of
Transportation (CDOT) access permit determination and sensitivity analysis for the Mindsprings affordable
housing residential redevelopment project located at 6916 State Highway 82 (SH-82) in Garfield County,
Colorado. This analysis includes evaluating different development affordable housing unit numbers to
determine when access permits would be needed at the intersections of Spring Valley Road/SH-82 and
Marand Rd/SH-8 based on CDOT guidelines of allowing up to a 20 percent increase in traffic before needing
an Access Permit. To determine this, existing traffic volume counts along with project traffic determinations
added to each intersection through trip generation, distribution, and assignment were performed, as
outlined in the following sections.
Existing Traffic Volumes
Existing peak hour turning movement counts were conducted at the study area intersections during the
morning and afternoon peak hours on Thursday, February 23, 2023. The counts were conducted in 15-
minute intervals during the weekday morning and afternoon peak hours of adjacent street traffic from 7:00
AM to 9:00 AM and 4:00 PM to 6:00 PM, respectively. Traffic volume counts are attached.
Unspecified Development Traffic Growth
According to information provided on the website for the Colorado Department of Transportation (CDOT),
the 20-year growth factor along SH-82 in the vicinity of the site is 1.25. The 20-year growth factor equates
to annual growth rate of 1.1 percent. This annual growth rate was used to estimate near term 2025 traffic
volume projections at the key intersections.
Trip Generation, Trip Distribution, and Traffic Assignment
Site-generated traffic estimates are determined through a process known as trip generation. Rates and
equations are applied to the proposed land use to estimate traffic generated by the development during a
specific time interval. The acknowledged source for trip generation rates is the Trip Generation Manual 1
published by the Institute of Transportation Engineers (ITE). ITE has established trip rates in nationwide
studies of similar land uses. For this study, Kimley-Horn used the ITE Trip Generation Report average rates
that apply to Affordable Housing (ITE Land Use Code 223), for traffic associated with the development.
Distribution of site traffic on the street system was based on the area street system characteristics, existing
traffic patterns, existing and anticipated surrounding employment, school, and attraction information, and
the proposed access system for the project. The directional distribution of traffic is a means to quantify the
percentage of site-generated traffic that approaches the site from a given direction and departs the site
back to the original source. Project traffic assignment was obtained by applying the project trip distribution
to the estimated traffic generation of the development.
CDOT Access Permit Evaluation and Associated Improvements
The threshold for requiring an access permit along Colorado Department of Transportation (CDOT)
roadways occurs when project traffic is anticipated to increase the existing access traffic volumes by more
than 20 percent.

SH-82 is categorized as an E-X roadway with a 55 mile per hour speed limit at the intersection with Spring
Valley Road and a 65 mile per hour speed limit at the intersection with Marand Road. As such, turn lanes
requirements are to be designed per the State Highway Access Code (SHAC). According to the State
Highway Access Code for category Expressway, Major Bypass (E-X) roadways the turn lane warrants are
as follows:
• A left turn deceleration lane is required for any access with a projected average daily left turn
ingress volume greater than 10. The transition taper length will be included within the required
deceleration length. If the projected peak hour left ingress turning volume is greater than 10 vph, a
left turn lane with deceleration, storage, and transition taper lengths is required for any access.
• A right turn lane with deceleration and taper lengths is required for any access with a projected
peak hour right turn ingress turning volume greater than 10 vph.
• A right turn lane with acceleration and taper lengths is required for any access with a projected
peak hour right turning volume greater than 10 vph.
Based on the Affordable Housing (ITE Land Use Code 223) trip generation, the trip distribution, the traffic
assignment, and the existing traffic volumes collected it was found that a CDOT Access Permit would be
needed at the Marand Road and SH-82 intersection if the Mindsprings development is planned to have 156
dwelling units or greater. Likewise, an Access Permit would also be needed at the Spring Valley Road and
SH-82 intersection if the Mindsprings development is planned to have 262 dwelling units or greater. With
the need for access permits, auxiliary turn lanes to and from the east leg of each intersection would need
to be considered. The following provides the improvements that would be identified with each access
permit.
If the Mindsprings development is planned to have 156 or more affordable housing dwelling units, an
Access Permit would be needed at the Marand Road and SH-82 intersection which would identify that a
southbound left turn lane, northbound right turn lane, and northbound acceleration lane from the westbound
right turn would all be warranted. A permit here would trigger identification of improvements of each of these
three turn lanes as follows:
• The southbound left turn lane would need to be extended from 175 feet with a 150-foot taper to
860 feet (800 feet of deceleration length plus 60 feet of storage) with a 300-foot taper. Of note, no
project traffic is anticipated in this southbound left turn movement, but CDOT may require turn lane
extension regardless.
• The northbound right turn lane would need to be extended from 175 feet with a 225-foot taper to
800 feet with a 300-foot taper.
• The northbound acceleration lane from the westbound right turn would need to be extended from
200 feet with a 200-foot taper to 1,380 feet with a 300-foot taper. Of note, no project traffic is
anticipated in this westbound right turn movement, but CDOT may require acceleration lane
extension regardless.
If the Mindsprings development is planned to have 262 or more affordable housing dwelling units an Access
Permit would also be needed at the Spring Valley Road and SH-82 intersection. An access permit here
would identify that a southbound left turn lane, a northbound right turn lane, and a northbound acceleration
lane from the westbound right turn would all be warranted. A permit here would trigger improvements of
each of these three turn lanes as follows:
• The southbound left turn lane would need to be extended from 75 feet with a 125-foot taper to at
least 760 feet (600 feet of deceleration length plus 160 feet of storage) with a 225-foot taper. If the
development is greater than 262 dwelling units, this southbound left turn lane would need to be
extended even further.
• The northbound right turn lane would need to be extended from 200 feet plus 160-foot taper to a
length of 600 feet plus 225-foot taper. Of note, no project traffic is anticipated in this northbound
right turn movement, but CDOT may require turn lane extension regardless.
• The northbound acceleration lane from the westbound right turn would need to be extended from
125 feet with a 125-foot taper to 960 feet with a 225-foot taper.

Conclusion
Based on the Affordable Housing (ITE Land Use Code 223) trip generation, the anticipated project trip
distribution, the associated traffic assignment, and the existing traffic volumes collected, it was found that
a CDOT Access Permit would be needed at the Marand Road/SH-82 intersection if the Mindsprings
development is planned to have 156 dwelling units or greater. Likewise, if the Mindsprings development is
planned to have 262 dwelling units or greater, a CDOT Access Permit would also be needed for the Spring
Valley Road and SH-82 intersection. Each of these permits would likely come with a requirement for the
project to extend existing turn lanes along SH-82. Therefore, for Mindsprings to avoid a CDOT Access
Permit, the development will need to include no more than 155 dwelling units in the Mindsprings affordable

This letter serves as an additional project description and narrative to the engineering narrative &
impact analysis.
The existing structure was previously used as a radio station, a detox facility, a mental health and
addiction facility, and offices
The proposal is to convert the existing structure to indoor mini-storage (lower level) and 9 (10
bedrooms) apartment type units (upper level). We are working closely with John Plano, Building
Official in regards to potential building code requirements, which will be further addressed when the
project is ready to be submitted for a building permit.
ARTICLE 4-203G, IMPACT ANALYSIS
Adjacent Land Use: The property has a mobile home park to the South; a mini-market (Thunder River)
complex and fueling station to the North; a heavy equipment construction (Gould Construction) to the
Northeast, a mini-storage (Royal Mini Storage) to the East, and Colorado Highway 82 to the West.
Site Features: There are no water bodies on or near the site. The property is developed with an
existing structure and parking lots.
Soil Characteristics: This section is not applicable, as the site is completely developed.
Geology and Hazard: This section is not applicable, as the site is completely developed.
Groundwater and Aquifer Recharge Areas: This section is not applicable, as the site is completely
developed, inclusive of an approved and operating OWTS system.
Environmental Impacts: This section is not applicable, as the site is completely developed
Nuisance: By approving the Change of Use for this property, the property will be inhabited on the
upper level by residents, which has a maximum of 10 bedrooms. The lower level will be an indoor
mini-storage with no or minimal impact to adjacent properties.
Hours of Operation: We expect the mini-storage to have operating hours from 6am to 10pm daily.
The facility will not be staffed with employees.
ARTICLE 7 OF THE LAND USE CODE:
7-101: Currently zoned as Commercial, Limited (CL), the proposed development will add much needed
employee housing in the area and requires a Limited Impact Review for the change of use.
7-102: The proposed development & land use change meets the general conformance with the
County’s comprehensive plan through the application for much needed housing.
7-103: The proposed development is completely within an existing structure, so there will be no
change to the scale and nature of the development. The proposed use of housing is compatible with
the adjacent mobile home park.
7-104 through 7-108: See Civil Engineering Report
7-109: We will be required to install a 13 R sprinkler System (903.2.8 2015 IFC & 903.3) that would be
based on a 4 head calc. to provide the water supply. The water system in that area is well water access
only. The tank above Thunder River supplies the three hydrants along the frontage road. We may be
required to install a tank and pump system and will defer to the Carbondale Rural Fire District for
additional information, who will be on the referral list for this project.
7-201 through 7-208: This section is not applicable, as the existing building will remain ‘as is’ with
development within the structure.
7-301: The proposed development will be within an existing compatible structure with minimal
exterior changes to the structure. The only potential exterior change will be incorporating legal egress
windows as necessary.
7-302: There are 62 available parking spaces on the site. The required parking for this change of use is
2.5 spaces times 9 units, or a total of 23 parking spaces. There is not a county standard for parking
requirements to serve an indoor storage facility. However, there are an additional 39 parking spaces
available for this use. The mini-storage can be similar to a Wholesale establishment in the land use
code, which requires 1 space/2000 square feet; or a Manufacturing establishment in the land use code,
which requires 1 space/1000 square feet. With the lower level (mini-storage) of the building at
approximately 9500 square feet, between 5 and 10 parking spaces would be required, which is far less
than the 39 that are available. If we were required to use a most restrictive 1 space/300 square feet,
we would still only need 32 of the 39 available spaces. We have provided 2 handicap accessible
spaces, along with 12 compact spaces as allowed by the Land Use Code.
The access road varies in width from 22’ to 25’, which would serve a legal two-way traffic through the
parking lot for residential, yet a little shy for commercial in portions of the parking areas.
A loading area can be provided at the North end of the building, whereas access is directly into the
lower level (mini-storage)
7-303 through 7-306: This section is not applicable, as the proposed change of use is within an existing
structure.
Divisions 4 – 12 of Article 7 have been reviewed and they do not apply to this project.
We hereby request a waiver from Garfield County’s Landscape Plan
Section 4-203.F Landscape Plan
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: There are no changes to the existing landscaping or site
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: There are no changes to the existing landscaping or site
3. The waiver does not compromise a proper and complete review, and…..
Response: The application can be properly and completely reviewed without a landscape plan, as
there are no planned changes to the existing landscaping.
4. The information is not material to describing the proposal or demonstrating compliance with
approval criteria.
Response: A landscape plan is immaterial for this application, as there is no change to the existing
conditions.
The fact is there is no intent of changing any of the site, which would affect the landscaping. The
existing conditions will remain as is and are in compliance with the County’s regulations (see photos).
We hereby request a waiver from Garfield County’s Traffic Study
Section 4-203.L Traffic Study
A waiver request shall be considered based on the following criteria:
1. The applicant shows good cause for the requested waiver.
Response: The project was going to be proposed as a complete housing project within the existing
structure until we ran into water and sewer issues. An extensive traffic study was completed and
submitted as part of this submission.
2. The size, complexity, anticipated impacts, or other factors support a waiver.
Response: The submitted traffic study is far more impactful than what is now being currently
proposed for the parcel (9 residential apartments and mini-storage). Therefore, the impact is
significantly reduced from the traffic study that was submitted.
3. The waiver does not compromise a proper and complete review, and……
Response: The County can review the submitted traffic study and provide the reduced impact
based on the currently submitted change of use. The amount of traffic that will be generated is
anticipated to be less than what the previous occupancy (offices/clinic) generated.
4. The information is not material to describing the proposal or demonstrating compliance with
approval criteria.
Response: The submitted traffic study is far more demanding, yet the currently proposed change
of use and occupancy is similar and less demanding on traffic than was previously existed in the
building.
Traffic generation is expected to be less than what exists, and is within the County’s regulations.

TYPE OF APPLICATION: Limited Impact Review – Multi-family Dwelling
ZONING: Commercial Limited (CL)
I. GENERAL PROJECT DESCRIPTION
The Property Owner – Applicant is proposing conversion of the existing building on the site
to a Residential, Multi-Family use. The site is 1.85 acres in size and the existing building is
listed by the Assessor’s Office as having 13,550 gross sq.ft. of living area. A Limited
Impact Land Use Change Permit is required for Multi-Family Residential uses in the CL
Zone District.
The building has previously been utilized for a variety of commercial and office ty pe uses,
most recently housing the Mind Springs Offices/Operations. Sample floor plans show
approximately 14 apartments ranging in size from 1 bedroom to 4-bedroom units. A total of
33 bedrooms are shown and described as “co-living” spaces. Infrastructure is existing for
the building, however, documentation of adequacy and will serve letters will be needed, in
particular for water and sanitation. Pre-Application information indicates that a well may be
utilized which will require documentation of proper well permits (legal water) along with
pump testing and water quality testing. The Pre-Application information also indicates that
sewer service would be through a tie into an existing central system located across Hwy
82. Availability of taps and capacity of the central system and sewer mains will need to be
documented as well.
Parking and circulation areas exist and would need to be reviewed for co mpliance with off-
street parking standards and dimensions. Detailed site plan drawing will need to be
provided. The site accesses directly on the State Hwy. frontage road which is regulated by
CDOT. Documentation on Access Permits and any upgrades that may be required by
CDOT will need to be addressed.
Part of the review process will include confirmation of compliance with Zone District
Requirements including dimensional requirements (setbacks, lot coverage, etc.) including
confirmation of legal lot creation.
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS

III. REVIEW PROCESS
The Application will follow the Limited Impact Review Process contained in Sections 4-101
and 4-104 and in Table 4-102 (see attached flow chart):
• Pre-application Conference
• Submittal of Application (3 hard copies plus one digital PDF copy on CD or USB Stick)
• Determination of Completeness, if Technically Complete the Applicant will be notified
and the request scheduled for a public hearing before the Board of County
Commissioners. If it is not technically complete the Applicant will be advised of the
deficiencies and has 60 days to complete the application.
• Once determined to be complete, the Application is sent out to referral agencies.
• A public hearing before the Board of County Commissioners is scheduled.
• Four additional hardcopies of the Application are provided for the Board of Co unty
Commissioners review.
• Applicant completes public notice for the public hearing (mailing, posting, and
publication) a minimum of 30 days prior to the hearing.
• Staff prepares a report including public and referral comments.
• Review and Action by the Board of County Commissioners at the public hearing.
• The Board of County Commissioners action is formalized by a resolution.
• If approved with conditions the Applicant must meet the conditions prior to issuance of
the Land Use Change Permit.
• The Applicant has one year to meet all conditions of approval.
IV. SUBMITTAL REQUIREMENTS
Application submittal requirements are detailed in Table 4-201, and Section 4-203,
Description of Submittal Requirements. Please use the summary provided below as a
supplemental check list.
General Application Materials (application forms,
agreement to pay form, Statement of Authority for Trusts,
corporations or LLC’s, authorization to represent, and
payment of fees).
Evidence of ownership such as a deed for the property
and title work.
Narrative description of the proposal.
List of property owners within 200 feet and any mineral
rights owners on the property. A statement on how
mineral owners were researched is required.
Vicinity Map (including the area generally within 3 miles of
the site).
Site plan with information on proposed use and changes
to the site including, existing structures, parking, access
roads/driveways, topography & significant site features,
easements, utilities, ditches, water lines, existing and
proposed wastewater infrastructure/sewer lines.
Improvement location survey may be needed to document
existing structures/improvements.
Grading and drainage plans. Existing conditions/improvements need to be documented
along with any proposed modifications associated with the change in use.
Landscaping Plan, existing and proposed.
Impact Analysis. This section includes information existing uses, surrounding uses and
potential impacts of the proposal many of which may be addressed by reference to the
existing improvements/condition of the property. A waiver regarding sections on
environmental impacts or wildlife may be requested with supporting justification. Please
contact the staff planner for additional information on potential waiver requests.
Legal access, physical access, and compliance with Roadway Standards Table 7 -107.
Demonstration of adequacy of the access and driveways needs to be provided.
Copies of an CDOT Access Permits.
Traffic Study: A waiver from a full traffic study may be requested, however basic traffic
generation information will need to be provided to support the waiver request. The
change in use and differing traffic generation will need to be addressed. Please contact
the staff planner for additional information on potential waiver requests.
Water Supply Plan and supporting documentation of legal, adequate, and water quality
need to be provided. Waivers can request delaying some production and quality testing
to be addressed as a condition of approval.
The submittals should address any additional fire protection demands and water
requirements.
The submittal needs to address any additional building code requirements.
Wastewater treatment plans and supporting documentation. Needs to include will
serve letters and engineering information adequate to demonstrate th at the central

Significant Article 7 Standards for this project are anticipated to include: zoning

9. ARBITRATION
The Policy contains an arbitration clause. All arbitrable matters when the Proposed Policy Amount is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Proposed Insured as the exclusive remedy of the parties. A Proposed Insured may review a copy of the arbitration rules at

Guarantee Company conducts the closing of the insured transaction and is responsible for recording the legal documents
from the transaction, exception number 5 will not appear on the Owner's Title Policy and the Lenders Policy when issued.
Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion of Exception no. 4 of
Schedule B, Section 2 of the Commitment from the Owner's Policy to be issued) upon compliance with the following
conditions:
No coverage will be given under any circumstances for labor or material for which the insured has contracted for or
agreed to pay.

The land described in Schedule A of this commitment must be a single family residence which includes a
condominium or townhouse unit.

No labor or materials have been furnished by mechanics or material-men for purposes of construction on the land
described in Schedule A of this Commitment within the past 6 months.
(B)
The Company must receive an appropriate affidavit indemnifying the Company against un-filed mechanic's and
material-men's liens.
(C)
The Company must receive payment of the appropriate premium.(D)
If there has been construction, improvements or major repairs undertaken on the property to be purchased within
six months prior to the Date of Commitment, the requirements to obtain coverage for unrecorded liens will include:
disclosure of certain construction information; financial information as to the seller, the builder and or the contractor;
payment of the appropriate premium fully executed Indemnity Agreements satisfactory to the company, and, any
additional requirements as may be necessary after an examination of the aforesaid information by the Company.
(E)
This notice applies to owner's policy commitments disclosing that a mineral estate has been severed from the surface
estate, in Schedule B-2.
Note: Pursuant to CRS 10-1-128(6)(a), It is unlawful to knowingly provide false, incomplete, or misleading facts or
information to an insurance company for the purpose of defrauding or attempting to defraud the company. Penalties may
include imprisonment, fines, denial of insurance, and civil damages. Any insurance company or agent of an insurance
company who knowingly provides false, incomplete, or misleading facts or information to a policyholder or claimant for
the purpose of defrauding or attempting to defraud the policyholder or claimant with regard to a settlement or award
payable from insurance proceeds shall be reported to the Colorado Division of Insurance within the Department of
Regulatory Agencies.

protection letter for the lender, purchaser, lessee or seller in connection with this transaction.

using real-time audio-video communication technology. You may choose not to use remote notarization for any
document.
That there is recorded evidence that a mineral estate has been severed, leased, or otherwise conveyed from the
surface estate and that there is substantial likelihood that a third party holds some or all interest in oil, gas, other
minerals, or geothermal energy in the property; and

6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
“Knowledge” or “Known”: Actual or imputed knowledge, but not constructive notice imparted by the Public Records.(a)
“Land”: The land described in Schedule A and affixed improvements that by law constitute real property. The term “Land” does not include any
property beyond the lines of the area described in Schedule A, nor any right, title, interest, estate, or easement in abutting streets, roads, avenues,
alleys, lanes, ways, or waterways, but this does not modify or limit the extent that a right of access to and from the Land is to be insured by the Policy.
(b)
“Mortgage”: A mortgage, deed of trust, or other security instrument, including one evidenced by electronic means authorized by law.(c)
“Policy”: Each contract of title insurance, in a form adopted by the American Land Title Association, issued or to be issued by the Company
pursuant to this Commitment.
(d)
“Proposed Insured”: Each person identified in Schedule A as the Proposed Insured of each Policy to be issued pursuant to this Commitment.(e)
“Proposed Policy Amount”: Each dollar amount specified in Schedule A as the Proposed Policy Amount of each Policy to be issued pursuant to this
Commitment.
(f)
“Public Records”: Records established under state statutes at the Commitment Date for the purpose of imparting constructive notice of matters
relating to real property to purchasers for value and without Knowledge.

“Title”: The estate or interest described in Schedule A.(h)

Company’s delivery to the Proposed Insured of the Commitment and the delivery of the amended Commitment, resulting from the Proposed
Insured’s good faith reliance to:

The Company shall not be liable under Commitment Condition 5(a) if the Proposed Insured requested the amendment or had Knowledge of the
matter and did not notify the Company about it in writing.
(b)
The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred the expense had the
Commitment included the added matter when the Commitment was first delivered to the Proposed Insured.
(c)
The Company’s liability shall not exceed the lesser of the Proposed Insured’s actual expense incurred in good faith and described in Commitment
Conditions 5(a)(i) through 5(a)(iii) or the Proposed Policy Amount.
(d)
The Company shall not be liable for the content of the Transaction Identification Data, if any.(e)
In no event shall the Company be obligated to issue the Policy referred to in this Commitment unless all of the Schedule B, Part I—Requirements
have been met to the satisfaction of the Company.
(f)
In any event, the Company’s liability is limited by the terms and provisions of the Policy.(g)
Only a Proposed Insured identified in Schedule A, and no other person, may make a claim under this Commitment.(a)
Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment.(b)
Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement between the parties with respect to the subject
matter of this Commitment and supersedes all prior commitment negotiations, representations, and proposals of any kind, whether written or oral,
express or implied, relating to the subject matter of this Commitment.
(c)
7. IF THIS COMMITMENT HAS BEEN ISSUED BY AN ISSUING AGENT
The issuing agent is the Company’s agent only for the limited purpose of issuing title insurance commitments and policies. The issuing agent is not the
Company’s agent for the purpose of providing closing or settlement services.
8. PRO-FORMA POLICY
The Company may provide, at the request of a Proposed Insured, a pro-forma policy illustrating the coverage that the Company may provide. A pro-forma
policy neither reflects the status of Title at the time that the pro-forma policy is delivered to a Proposed Insured, nor is it a commitment to insure.
9. ARBITRATION
The Policy contains an arbitration clause. All arbitrable matters when the Proposed Policy Amount is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Proposed Insured as the exclusive remedy of the parties. A Proposed Insured may review a copy of the arbitration rules at
http://www.alta.org/arbitration.
IN WITNESS WHEREOF, Land Title Insurance Corporation has caused its corporate name and seal to be affixed by its duly authorized officers on the date shown

This letter serves as responses to your ‘Not Technical Complete Letter’, dated December 11, 2023
1. Item 12 of the resubmission is the completed Mineral Owner Research.
2. Item 03a of the resubmission is the recorded copy of the Statement of Authority.
3. Item 11 of the resubmission is the Title Commitment.
4. Item 04a of the resubmission further addresses the impact analysis regarding section 4-203.G of
the Land Use Code.
5. Item 04a of the resubmission requests a waiver from the Traffic Study and Landscaping. We don’t
anticipate needing a waiver for parking, site lighting, snow storage, and trails.
6. Item 04a of the resubmission further addresses responses to section 7-302 of the Land Use Code
regarding parking requirements for the mini-storage and handicap/accessible parking.
7. Item 041 of the resubmission further addresses fire (7-109). All building, fire and related Codes will
be additionally addressed when submitting for a building permit.
8. Item 13 of the resubmission provides the requested conceptual water supply system. The Fire
Marshal has been unresponsive to our requests. Therefore, the water supply and fire suppression
will be further evaluated and engineered prior to submission for a building permit, and are
considered conceptual at this submission.
9. Item 14 of the resubmission provides the OWTS components as requested.
