Inc. (“Chevron”) requests an Oil and Gas Permit under Article 9 of the Garfield County Land Use and Development Code (“LUDC”) for the existing SKR 698-10-BV Pad (“Pad”). The Pad is an existing location and was initially permitted and constructed for the drilling and completion of 22 wells with the Energy Carbon and Management Commission (“ECMC”) under location ID #336056; however, those wells were not drilled. The location was utilized instead as the Skinner Ridge Storage Facility, permitted with ECMC under location ID #447846 and with Garfield County under Limited Impact Review Amendment (“LIPA”) #6428. In addition to this application for an Oil and Gas Permit from Garfield County, Chevron is also applying to amend the existing ECMC approval to allow for the drilling and production of two horizontal wells. All existing storage equipment will be relocated to a newly proposed storage yard (the Skinner Ridge Laydown yard, Land Use Change permit submitted November 27, 2023) prior to drilling the proposed wells. The Garfield County Assessor’s parcel number is 2137-321-00-008 and the parcel size is 4331.71 acres. The parcel is zoned Resource Lands – Gentle Slopes. Chevron submitted its Oil and Gas Development Plan (“OGDP”) to amend the existing location with the ECMC on December 7, 2023. There are zero Residential Building Units, High Occupancy Building Units, Schools, Childcare Centers, or Designated Outdoor Activity Areas within 2,000 feet of the proposed location. 1.2 Project Description Chevron’s proposal includes minimal additional disturbance to the existing disturbed area to construct drill, complete and produce two (2) proposed horizontal wells on fee surface lands owned by Chevron and into fee minerals. A pilot hole for geothermal testing will be drilled in one of the wells and will be plugged prior to drilling the horizontal leg of the well. 1.2.1 Location. The existing Pad is located in a remote area off Garfield County Road 211 (Clear Creek Road) approximately 16.7 miles northwest of De Beque, Colorado. The Pad lies on Tract 72, and is situated on two sections, the SWSW of Section 10 and the NWNW of Section 15, Township 6 South, Range 98 West, 6th P.M. The existing Pad (i.e., Skinner Ridge Storage Facility) disturbance area is 6.2 acres, and an additional 0.7 acres of disturbance is proposed for construction of stormwater detention ponds and drainage channels. The working pad surface will be 3.8 acres. The Pad disturbance area will be reduced to 2.3 acres during interim reclamation. Total estimated surface disturbance is reflected in Table 1. A Project Overview Map of the Pad location is included below. Access to the existing Pad is approximately 16.7 miles northwest of De Beque, Colorado along Garfield County Road 211 (Clear Creek Road). Chevron has an established maintenance agreement with Garfield County Road and Bridge Department for winter and surface maintenance of County Road 211 and County Road 204. Chevron also contacted Mesa County on December 14, 2023, to discuss any potential concerns or impacts to the existing road lying within the county boundaries. Mesa County has the Chevron point of contact for communicating any future concerns. An existing access road, approximately 388 feet in length provides access into the Pad location and is currently gated. As Chevron is able to utilize the existing pad with minimal additional disturbance, a new additional access road approximately 140 feet in length is being proposed to provide safe ingress/egress from the smaller location during construction, drilling and production operations. The proposed new access will have an 18” culvert installed and will either have a future gate installed or a cattleguard when Chevron initiates interim reclamation operations. 1.2.3 Facilities. No occupied facilities will exist on the Pad. The wells will produce to the proposed production facility portion of the location and be tied into Chevron’s existing Central Production Facility (CPF). Liquids (condensate/oil and water) and natural gas produced from these wells will be transported via underground pipelines to the CPF for additional processing. Condensate/oil and natural gas will be transferred to midstream assets at the CPF and produced water will be transported to an existing, permitted disposal well via an underground pipeline. The proposed pipeline information is provided in Table 2. Table 2 Proposed Pipeline Details Type Description Length Liquids One (1): up to 6” Steel or Composite Fiberspar Liquids Line 5011’ Natural Gas One (1): 8-16” Steel or Composite Gas Flowline 237’ Proposed equipment on the Pad will include separators, scrubbers, pigging stations, a gas meter, pipe skid, an instrument air skid, a skid drain vault, a chemical injection skid, a communication tower, solar skids, a maintenance tank, heat trace equipment, a transformer or electric generators, switchracks, and a battery box. A temporary MLVT, located on the nearby Skinner Ridge-66S98W/22NENW Pad (ECMC Location ID# 324358) will be utilized for completion operations and freshwater will be transferred from the Kobe Pump station through existing infrastructure to Kobe Tanks. A temporary 14-inch surface layflat line will be laid from the Kobe tanks to the MLVT and from the MLVT to the Pad along existing ROWs. No produced water recycling is proposed as part of this submittal. SKR 698-10-BV Pad Oil and Gas Development Amendment 5 Revised 4-26-2024 1.2.4 Project Schedule. Table 3 below reflects the estimated start dates for each phase of operation. The Pad falls within the Alternative Location Analysis (“ALA”) criteria based on the recommended oil and gas location being within a High Priority Habitat as outlined in Rule 304.b.(2).B.viii. A majority of the existing surface disturbance associated with the Pad fall within Aquatic Sportfish Management Waters designated by Rule 1202.c. In addition, the entirety of the existing disturbance associated with the Pad fall within Elk Severe Winter Range and Elk Winter Concentration areas designated by Rule 1202.d. Both wildlife matters will be properly minimized and mitigated through this careful planning project. Chevron has consulted with CPW and obtained approval for ECMC Rules 1202.a.(3) and 1202.c.(1).S. Chevron identified the existing disturbance as an optimal drilling location that (i) maximizes protection of public health, welfare, safety, environment, and wildlife; and (ii) minimizes impacts to the community and the environment in the area of operations. 1.4 Pre-Application Process 1.4.1 Request for Pre-Application Conference. Pursuant to LUDC Article 9-203.A, Chevron requested a pre-application conference with Garfield County prior to submittal of this Oil and Gas Permit Application via written correspondence on September 11, 2023. Included in the conference request were the pre-application materials per LUDC Article 9-203.B.1, which included the Alternative Location Analysis Narrative and Alternative Location Analysis Exhibits. Garfield County set and confirmed the pre-application meeting for October 12, 2023 at 1:00 p.m. See Appendix A for the Garfield County Pre-Application Meeting Request Submittal. 1.4.2 Pre-Application Meeting. On October 12, 2023, Chevron, Garfield County and its representatives and attendees from the ECMC, Colorado Parks and Wildlife (“CPW”) and Colorado Department of Public Health and Environment (“CDPHE”) discussed the proposed Oil and Gas Permit Application. See Appendix B for the Garfield County Pre- Application Meeting Summary and Chevron’s presentation provided for the meeting. SKR 698-10-BV Pad Oil and Gas Development Amendment 6 Revised 4-26-2024 1.4.3 Neighborhood Meeting (LUDC Article 9-203.D.) There are no building units within 2,000 feet of this Pad. However, per Garfield County guidance, Chevron hosted an in-person community meeting on November 16, 2023, from 4:00 – 6:00 p.m. at the Chevron Hiner Gate Field Office for interested adjacent property owners and lessees. Notifications were sent out prior to the meeting to two tenants living along the proposed haul route for the Pad as well as the additional parties below. The notification letter included the following information: • An invitation with information about the community open house • An RSVP reply card with postage paid and a contact number for questions. Invitations were sent to: • Kirby Wynn, Garfield County LGD • Bureau of Land Management Field Office • Colorado Parks and Wildlife • Mahogany Energy Resources, LLC • Tyler Binger (tenant) • Joel Fogelsange (tenant) The event was attended by several Chevron representatives from multiple disciplines and two representatives of Mahogany Energy (Bill de Vergie and Chuck Whiteman). After a project presentation by Rick Cross, Chevron’s Ranch Manager, which included a discussion of the Alternative Location Analysis undertaken by Chevron, the two members of the public expressed support for the location and general appreciation for Chevron as their “neighbor.” A productive discussion regarding specific operations occurred including: • Haul routes for water and product. • Viability of piping water to and from the location. • Mahogany Energy discussed their efforts to contain noxious weeks on adjacent property. • The environmental review process for the proposed pad. • Country Road use and maintenance. Although they did not attend the community meeting, the two Chevron tenants who live along the proposed haul route to the Pad have been contacted by staff to ensure that they understand what is happening and to inquire about any concerns they may have regarding the project. Copies of the invitation and presentation are included in Appendix C. Audio of the meeting is available upon request. 2.0 APPLICATION SUBMITTAL REQUIREMENTS 2.1 General Application Requirements This application has been prepared in accordance with the Garfield County Comprehensive Plan and the Garfield County Land Use and Development Code, as amended. Copies of the required permit application forms and agreements below are included in Appendix D. SKR 698-10-BV Pad Oil and Gas Development Amendment 7 Revised 4-26-2024 • Land Use Application Change Form (LUDC Article 9-204.B.1.a-b, d, j.) • Payment Agreement Form • Statement of Authority Form – Power of Attorney attached along with a letter authorizing additional personnel and contractors to represent Chevron in regulatory and permitting matters. • Notification Package Names and Mailing Addresses • Ownership Deed • Mineral Ownership Certification (LUDC Article 4-101.E.1.b.4) • Evidence of Liability Insurance – Self Insurance letter attached (LUDC Article 9-204.B.1.g.) 2.2 Name and Contact Information for the Applicant (LUDC Article 9-204.B.1.a. and d.) The name and contact information (including email) for the designated Chevron representative is included on the Land Use Change Permit Application. In addition to the contact included on the application, two additional representatives are designated to represent Chevron. The Application and letter are included in Appendix D. 2.3 Vicinity Map (LUDC Article 9-204.B.1.c.) A Vicinity Map depicting the current location of the Pad is included as Appendix E. The map depicts the location of the existing Oil and Gas Location and nearby public roads. 2.4 Topographic Map (LUDC Article 9-204.B.1.e.) A Topographic Map reflecting the requirements of Article 9-204.B.1.e. is included as Appendix F. 2.5 Summary of the Variance or ALA Requested (LUDC Article 9-204.B.1.f.) Chevron is not seeking a variance for ECMC noise or light requirements. However, a detailed ALA was prepared in accordance with ECMC Rule 304.b.(2)B.viii as the Pad meets ALA criteria based on being located within High Priority Habitat. A majority of the existing surface disturbance falls within Aquatic Sportfish Management Waters designated by Rule 1202.c. and the entirety of the existing disturbance falls within Elk Severe Winter Range and Elk Winter Concentration areas designated by Rule 1202.d. Chevron identified the existing disturbance as an optimal drilling location that (i) maximizes protection of public health, welfare, safety, environment, and wildlife; and (ii) minimizes impacts to the community and the environment in the area of operations. The ALA evaluated eight (8) locations (including the recommended oil and gas location) and these alternative locations were discussed during the pre-application meeting with Garfield County and with members of the public that attended the neighborhood meeting. Extensive vetting was completed primarily through desktop review and the advantages and disadvantages of each location was reviewed in detail. The proposed disadvantages of the ALA locations included steep slopes, steep access, new disturbances and operational considerations and restrictions. The Pad is Chevron’s recommended location as it allows for efficient development of the targeted resources within the operational corridors of the OGDP while maximizing protection of public health, safety, welfare, environment, and wildlife. The Pad will feature advanced technological design solutions such as tankless production, elimination of flare stacks, and a closed loop system. While there are alternate locations located outside of Rule 1202.c. Aquatic Sportfish Management Waters NSO, the recommended Well Pad utilizes existing surface disturbance that doesn’t have SKR 698-10-BV Pad Oil and Gas Development Amendment 8 Revised 4-26-2024 other wells or production equipment taking up the Working Pad Surface and can be fully utilized for the target hydrocarbons associated with the OGDP. Although the Well Pad is within a DIC, the Working Pad Surface is not within 2,000 feet of any Residential Building Unit (“RBU”), High Occupancy Building Unit (“HOBU”), or School Facility. The Pad was selected following extensive review of operational parameters to minimize and consolidate locations while allowing for targeted mineral recovery and being mindful of the surrounding surface features. See Appendix G for the Alternative Location Analysis. 2.6 Assessment of Impacts (LUDC Article 9-204.B.1.h.) Chevron has attached the following plans in Appendix H to address potential impacts to the public health, safety, welfare, wildlife, and environment: • Cumulative Impacts Plan • Noise Mitigation Plan – Chevron has filed for a Lesser Impact Area Exemption under ECMC Rule 304.d.(2). Chevron intends on electrifying the production equipment if feasible to further reduce noise levels on location. In addition, the transportation of oil, gas and water via pipelines will further reduce noise generated from truck traffic. • Light Mitigation Plan - Chevron has filed for a Lesser Impact Area Exemption under ECMC Rule 304.d.(2). • Wildlife Plan Electricity will be supplied using electric generators during the drilling and completion phases of the development. Chevron plans to have electrical power for the production equipment, extending power south from Chevron’s Hiner gate field office south approximately 0.3 miles, with electric generators planned for backup or contingency needs. The existing Pad is located entirely on Chevron surface and requires minimal additional disturbance. Chevron intends on adhering to the HPH timing limitation restrictions and there are no RBUs within 2,000 feet of the location. 2.7 Additional Information Requested by Garfield County (LUDC Article 9-204.B.1.) During the October 12, 2023 pre-application meeting, Garfield County requested the following additional information: • Existing Garfield County permits related to the pad: Pages from LIPA 6428 are attached as Appendix I. The entire application can be provided upon request. • Any additional studies or analyses conducted by Chevron in support of the permit application to ECMC: Chevron utilized SWCA Environmental Consultants to conduct vegetative surveys and an aquatic resources inventory report (ARIR). The vegetative survey report is included in Appendix N, the ARIR is attached to the ECMC Wildlife Mitigation Plan included in Appendix L. • Submitted wildlife maps should have clarification in the legend and color coding to clearly label and identify habitats. Chevron response: Wildlife maps are included in Appendix K. SKR 698-10-BV Pad Oil and Gas Development Amendment 9 Revised 4-26-2024 2.8 Grading Permit (LUDC Article 4-203.E.) The existing pad (i.e. Skinner Ridge Storage Facility) disturbance area is currently 6.2 acres, with an additional 0.7 acres of proposed disturbance, total overall disturbance of 6.9 acres. Estimated surface disturbance is detailed in Table 1. The proposed disturbance of 0.7 acres includes the installation of two (2) detention ponds, one (1) in the southwest corner of the site, and one (1) in the southeast corner of the site. The detention ponds will be constructed with a bottom width of 12’, bottom length of 42’ and a spillway crest length of 3’. The detention ponds were designed in accordance with Chevron’s SWMP for the Skinner Ridge & South Canyon Fields to capture eroded or disturbed soil transported in storm runoff and slowly release it to allow time for settling of sediment prior to discharge. Construction details related to the current location size and the proposed disturbance area are included in Appendix K (Construction Layout – Plan View, Construction Layout – Cross Layout Detail Sheet & Construction Layout – Cross Sections). The SWMP for the Skinner Ridge and South Canyon Field is included in Appendix P. Chevron consultants discussed the need for a grading permit for this Pad with Philip Berry and Glen Hartman with Garfield County on February 2, 2024. No grading permit is being submitted at this time due to the minimal additional disturbance. Upon receipt of the full application, the county will determine if any additional information is necessary. 2.9 Notice Package (LUDC Article 9-208 & Article 4-101.E.) Chevron will provide the necessary Garfield County and ECMC notices and comply with the publication requirements. A preliminary draft of the notice package including an executed Certification of Mineral Owner Research and a list of notice recipients is included in Appendix D. This project is located in Garfield County and no other local governments are within one mile of the Pad and there are no residential or commercial properties within 2,000 feet of the Pad. 2.10 Application Fees (LUDC Article 9-204.B.1.k.) Chevron has included the required fee payment with this Oil and Gas Permit Application. The Payment Agreement form is included in Appendix D. 2.11 ECMC Form 2A and Exhibits, with exceptions as listed in Code (LUDC Article 9-204.B.2.a.) Chevron has included the Form 2A and associated exhibits, other than the excepted items below, submitted to the ECMC on December 7, 2023 in Appendix K. • Preliminary Flow Diagram (ECMC Rule 304.b.(7)(D)) • Directional Well Plat (ECMC Rule 304.b.(7)(H)) 2.12 ECMC Form 2A Plans, with exceptions as listed in Code (LUDC Article 9-204.B.2.b.) Chevron has included all ECMC Form 2A plan documents submitted on December 7, 2023 other than the excepted items below in Appendix L. SKR 698-10-BV Pad Oil and Gas Development Amendment 10 Revised 4-26-2024 • Hydrogen Sulfide Drilling Operations Plan (ECMC Rule 304.c.(c)(10)) • Gas Capture Plan (ECMC Rule 304.c.(c)(12)) • Fluid Leak Detection Plan (ECMC Rule 304.c.(c)(13)) The plans listed below were not applicable to this Pad under ECMC Rule 304.c and are not included with this permit application. • Emergency Spill Response Plan (ECMC Rule 304.c.(c)(10): Pad is not near Type III or GUDI well. • Noise Mitigation Plan: No RBU’s within 2,000 feet of the Pad; Requested Lesser Impact Area Exemption. • Light Mitigation Plan: No RBU’s within 2,000 feet of the Pad; Requested Lesser Impact Area Exemption. • Odor Mitigation Plan: No RBU's within 2,000’ feet of the Pad. • Flood Shut-In Plan: Not in a floodplain. • Community Outreach Plan: No RBU’s within 2,000’ of the Pad. 2.13 Traffic Study (Article 9-204.B.2.c.) Below are the comments that were received with the associated response to those comments from Chevron U.S.A. LLC (Chevron). 1. Application Form, Statement of Authority, Deed: Garfield County requested additional documentation to show Chevron Ownership; included Deed identifies Getty Oil but not succession of ownership to Chevron. Appendix D – Permit Application Forms, in which the record Deed lies within, has been updated to include the record Articles/Certificate of Merger records the merger of Getty Oil and Chevron U.S.A. Inc, dated April, 30, 2002, and recorded with Garfield County July 18, 2002. 2. Topographic Map: Exhibits included as Topographic Maps are aerial maps. Additionally, adjust the scale and label items from 9.204.e., specifically any waterbodies. Add third map if necessary. Appendix F – Topographic Map has been updated with the requested change from aerial to topographic basemap. Sheet 1 of Topographic Map identifies all features included in 9.204.e. Any features that are outside of the requested review areas (2,000’ & 2,640’) are noted as such. Sheet 2 of Topographic Map includes the southern extend of the pipeline easement noted. 3. Evidence of Liability Insurance: County Attorney is requesting additional information explaining how self-insurance will protect the county as per Garfield County Code – specifically, a letter from Chevron’s counsel. .................................................................................................................... 643 SKR 698-10-BV Pad Oil and Gas Development Amendment 1 GENERAL PROJECT NARRATIVE 1.1 Introduction Chevron U.S.A. Inc. (“Chevron”) requests an Oil and Gas Permit under Article 9 of the Garfield County Land Use and Development Code (“LUDC”) for the existing SKR 698-10-BV Pad (“Pad”). The Pad is an existing location and was initially permitted and constructed for the drilling and completion of 22 wells with the Energy Carbon and Management Commission (“ECMC”) under location ID #336056; however, those wells were not drilled. The location was utilized instead as the Skinner Ridge Storage Facility, permitted with ECMC under location ID #447846 and with Garfield County under Limited Impact Review Amendment (“LIPA”) #6428. In addition to this application for an Oil and Gas Permit from Garfield County, Chevron is also applying to amend the existing ECMC approval to allow for the drilling and production of two horizontal wells. All existing storage equipment will be relocated to a newly proposed storage yard (the Skinner Ridge Laydown yard, Land Use Change permit submitted November 27, 2023) prior to drilling the proposed wells. The Garfield County Assessor’s parcel number is 2137-321-00-008 and the parcel size is 4331.71 acres. The parcel is zoned Resource Lands – Gentle Slopes. Chevron submitted its Oil and Gas Development Plan (“OGDP”) to amend the existing location with the ECMC on December 7, 2023. There are zero Residential Building Units, High Occupancy Building Units, Schools, Childcare Centers, or Designated Outdoor Activity Areas within 2,000 feet of the proposed location. 1.2 Project Description Chevron’s proposal includes minimal additional disturbance to the existing disturbed area to construct drill, complete and produce two (2) proposed horizontal wells on fee surface lands owned by Chevron and into fee minerals. A pilot hole for geothermal testing will be drilled in one of the wells and will be plugged prior to drilling the horizontal leg of the well. 1.2.1 Location. The existing Pad is located in a remote area off Garfield County Road 211 (Clear Creek Road) approximately 16.7 miles northwest of De Beque, Colorado. The Pad lies on Tract 72, and is situated on two sections, the SWSW of Section 10 and the NWNW of Section 15, Township 6 South, Range 98 West, 6th P.M. The existing Pad (i.e., Skinner Ridge Storage Facility) disturbance area is 6.2 acres, and an additional 0.7 acres of disturbance is proposed for construction of stormwater detention ponds and drainage channels. The working pad surface will be 3.8 acres. The Pad disturbance area will be reduced to 2.3 acres during interim reclamation. Total estimated surface disturbance is reflected in Table 1. A Project Overview Map of the Pad location is included below. SKR 698-10-BV Pad Oil and Gas Development Amendment 3 SKR 698-10-BV Pad Oil and Gas Development Amendment 4 1.2.2 Access. Access to the existing Pad is approximately 16.7 miles northwest of De Beque, Colorado along Garfield County Road 211 (Clear Creek Road). Chevron has an established maintenance agreement with Garfield County Road and Bridge Department for winter and surface maintenance of County Road 211 and County Road 204. Chevron also contacted Mesa County on December 14, 2023, to discuss any potential concerns or impacts to the existing road lying within the county boundaries. Mesa County has the Chevron point of contact for communicating any future concerns. An existing access road, approximately 388 feet in length provides access into the Pad location and is currently gated. As Chevron is able to utilize the existing pad with minimal additional disturbance, a new additional access road approximately 140 feet in length is being proposed to provide safe ingress/egress from the smaller location during construction, drilling and production operations. The proposed new access will have an 18” culvert installed and will either have a future gate installed or a cattleguard when Chevron initiates interim reclamation operations. 1.2.3 Facilities. No occupied facilities will exist on the Pad. The wells will produce to the proposed production facility portion of the location and be tied into Chevron’s existing Central Production Facility (CPF). Liquids (condensate/oil and water) and natural gas produced from these wells will be transported via underground pipelines to the CPF for additional processing. Condensate/oil and natural gas will be transferred to midstream assets at the CPF and produced water will be transported to an existing, permitted disposal well via an underground pipeline. The proposed pipeline information is provided in Table 2. A temporary MLVT, located on the nearby Skinner Ridge-66S98W/22NENW Pad (ECMC Location ID# 324358) will be utilized for completion operations and freshwater will be transferred from the Kobe Pump station through existing infrastructure to Kobe Tanks. A temporary 14-inch surface layflat line will be laid from the Kobe tanks to the MLVT and from the MLVT to the Pad along existing ROWs. No produced water recycling is proposed as part of this submittal. SKR 698-10-BV Pad Oil and Gas Development Amendment 5 1.2.4 Project Schedule. Table 3 below reflects the estimated start dates for each phase of operation. The Pad falls within the Alternative Location Analysis (“ALA”) criteria based on the recommended oil and gas location being within a High Priority Habitat as outlined in Rule 304.b.(2).B.viii. A majority of the existing surface disturbance associated with the Pad fall within Aquatic Sportfish Management Waters designated by Rule 1202.c. In addition, the entirety of the existing disturbance associated with the Pad fall within Elk Severe Winter Range and Elk Winter Concentration areas designated by Rule 1202.d. Both wildlife matters will be properly minimized and mitigated through this careful planning project. Chevron has consulted with CPW and obtained approval for ECMC Rules 1202.a.(3) and 1202.c.(1).S. Chevron identified the existing disturbance as an optimal drilling location that (i) maximizes protection of public health, welfare, safety, environment, and wildlife; and (ii) minimizes impacts to the community and the environment in the area of operations. 1.4 Pre-Application Process 1.4.1 Request for Pre-Application Conference. Pursuant to LUDC Article 9-203.A, Chevron requested a pre-application conference with Garfield County prior to submittal of this Oil and Gas Permit Application via written correspondence on September 11, 2023. Included in the conference request were the pre-application materials per LUDC Article 9-203.B.1, which included the Alternative Location Analysis Narrative and Alternative Location Analysis Exhibits. Garfield County set and confirmed the pre-application meeting for October 12, 2023 at 1:00 p.m. See Appendix A for the Garfield County Pre- Application Meeting Request Submittal. 1.4.2 Pre-Application Meeting. On October 12, 2023, Chevron, Garfield County and its representatives and attendees from the ECMC, Colorado Parks and Wildlife (“CPW”) and Colorado Department of Public Health and Environment (“CDPHE”) discussed the proposed Oil and Gas Permit Application. See Appendix B for the Garfield County Pre- Application Meeting Summary and Chevron’s presentation provided for the meeting. SKR 698-10-BV Pad Oil and Gas Development Amendment 6 1.4.3 Neighborhood Meeting (LUDC Article 9-203.D.) There are no building units within 2,000 feet of this Pad. However, per Garfield County guidance, Chevron hosted an in-person community meeting on November 16, 2023, from 4:00 – 6:00 p.m. at the Chevron Hiner Gate Field Office for interested adjacent property owners and lessees. Notifications were sent out prior to the meeting to two tenants living along the proposed haul route for the Pad as well as the additional parties below. The notification letter included the following information: • An invitation with information about the community open house • An RSVP reply card with postage paid and a contact number for questions. Invitations were sent to: • Kirby Wynn, Garfield County LGD • Bureau of Land Management Field Office • Colorado Parks and Wildlife • Mahogany Energy Resources, LLC • Tyler Binger (tenant) • Joel Fogelsange (tenant) The event was attended by several Chevron representatives from multiple disciplines and two representatives of Mahogany Energy (Bill de Vergie and Chuck Whiteman). After a project presentation by Rick Cross, Chevron’s Ranch Manager, which included a discussion of the Alternative Location Analysis undertaken by Chevron, the two members of the public expressed support for the location and general appreciation for Chevron as their “neighbor.” A productive discussion regarding specific operations occurred including: • Haul routes for water and product. • Viability of piping water to and from the location. • Mahogany Energy discussed their efforts to contain noxious weeks on adjacent property. • The environmental review process for the proposed pad. • Country Road use and maintenance. Although they did not attend the community meeting, the two Chevron tenants who live along the proposed haul route to the Pad have been contacted by staff to ensure that they understand what is happening and to inquire about any concerns they may have regarding the project. Copies of the invitation and presentation are included in Appendix C. Audio of the meeting is available upon request. 2.0 APPLICATION SUBMITTAL REQUIREMENTS 2.1 General Application Requirements This application has been prepared in accordance with the Garfield County Comprehensive Plan and the Garfield County Land Use and Development Code, as amended. Copies of the required permit application forms and agreements below are included in Appendix D. SKR 698-10-BV Pad Oil and Gas Development Amendment 7 • Land Use Application Change Form (LUDC Article 9-204.B.1.a-b, d, j.) • Payment Agreement Form • Statement of Authority Form – Power of Attorney attached along with a letter authorizing additional personnel and contractors to represent Chevron in regulatory and permitting matters. • Notification Package Names and Mailing Addresses • Ownership Deed • Mineral Ownership Certification (LUDC Article 4-101.E.1.b.4) • Evidence of Liability Insurance – Self Insurance letter attached (LUDC Article 9- 204.B.1.g.) 2.2 Name and Contact Information for the Applicant (LUDC Article 9-204.B.1.a. and d.) The name and contact information (including email) for the designated Chevron representative is included on the Land Use Change Permit Application. In addition to the contact included on the application, two additional representatives are designated to represent Chevron. The Application and letter are included in Appendix D. 2.3 Vicinity Map (LUDC Article 9-204.B.1.c.) A Vicinity Map depicting the current location of the Pad is included as Appendix E. The map depicts the location of the existing Oil and Gas Location and nearby public roads. 2.4 Topographic Map (LUDC Article 9-204.B.1.e.) A Topographic Map reflecting the requirements of Article 9-204.B.1.e. is included as Appendix F. 2.5 Summary of the Variance or ALA Requested (LUDC Article 9-204.B.1.f.) Chevron is not seeking a variance for ECMC noise or light requirements. However, a detailed ALA was prepared in accordance with ECMC Rule 304.b.(2)B.viii as the Pad meets ALA criteria based on being located within High Priority Habitat. A majority of the existing surface disturbance falls within Aquatic Sportfish Management Waters designated by Rule 1202.c. and the entirety of the existing disturbance falls within Elk Severe Winter Range and Elk Winter Concentration areas designated by Rule 1202.d. Chevron identified the existing disturbance as an optimal drilling location that (i) maximizes protection of public health, welfare, safety, environment, and wildlife; and (ii) minimizes impacts to the community and the environment in the area of operations. The ALA evaluated eight (8) locations (including the recommended oil and gas location) and these alternative locations were discussed during the pre-application meeting with Garfield County and with members of the public that attended the neighborhood meeting. Extensive vetting was completed primarily through desktop review and the advantages and disadvantages of each location was reviewed in detail. The proposed disadvantages of the ALA locations included steep slopes, steep access, new disturbances and operational considerations and restrictions. The Pad is Chevron’s recommended location as it allows for efficient development of the targeted resources within the operational corridors of the OGDP while maximizing protection of public health, safety, welfare, environment, and wildlife. The Pad will feature advanced SKR 698-10-BV Pad Oil and Gas Development Amendment 8 technological design solutions such as tankless production, elimination of flare stacks, and a closed loop system. While there are alternate locations located outside of Rule 1202.c. Aquatic Sportfish Management Waters NSO, the recommended Well Pad utilizes existing surface disturbance that doesn’t have other wells or production equipment taking up the Working Pad Surface and can be fully utilized for the target hydrocarbons associated with the OGDP. Although the Well Pad is within a DIC, the Working Pad Surface is not within 2,000 feet of any Residential Building Unit (“RBU”), High Occupancy Building Unit (“HOBU”), or School Facility. The Pad was selected following extensive review of operational parameters to minimize and consolidate locations while allowing for targeted mineral recovery and being mindful of the surrounding surface features. See Appendix G for the Alternative Location Analysis. 2.6 Assessment of Impacts (LUDC Article 9-204.B.1.h.) Chevron has attached the following plans in Appendix H to address potential impacts to the public health, safety, welfare, wildlife, and environment: • Cumulative Impacts Plan • Noise Mitigation Plan – Chevron has filed for a Lesser Impact Area Exemption under ECMC Rule 304.d.(2). Chevron intends on electrifying the production equipment if feasible to further reduce noise levels on location. In addition, the transportation of oil, gas and water via pipelines will further reduce noise generated from truck traffic. • Light Mitigation Plan - Chevron has filed for a Lesser Impact Area Exemption under ECMC Rule 304.d.(2). • Wildlife Plan Electricity will be supplied using electric generators during the drilling and completion phases of the development. Chevron plans to have electrical power for the production equipment, extending power south from Chevron’s Hiner gate field office south approximately 0.3 miles, with electric generators planned for backup or contingency needs. The existing Pad is located entirely on Chevron surface and requires minimal additional disturbance. Chevron intends on adhering to the HPH timing limitation restrictions and there are no RBUs within 2,000 feet of the location. 2.7 Additional Information Requested by Garfield County (LUDC Article 9-204.B.1.) During the October 12, 2023 pre-application meeting, Garfield County requested the following additional information: • Existing Garfield County permits related to the pad: Pages from LIPA 6428 are attached as Appendix I. The entire application can be provided upon request. • Any additional studies or analyses conducted by Chevron in support of the permit application to ECMC: Chevron utilized SWCA Environmental Consultants to conduct vegetative surveys and an aquatic resources inventory report (ARIR). The vegetative survey report is included in Appendix N, the ARIR is attached to the ECMC Wildlife Mitigation Plan included in Appendix L. • Submitted wildlife maps should have clarification in the legend and color coding to clearly label and identify habitats. Chevron response: Wildlife maps are included in Appendix K. SKR 698-10-BV Pad Oil and Gas Development Amendment 9 2.8 Grading Permit (LUDC Article 4-203.E.) Chevron consultants discussed the need for a grading permit for this Pad with Philip Berry and Glen Hartman with Garfield County on February 2, 2024. No grading permit is being submitted at this time due to the minimal additional disturbance. Upon receipt of the full application, the county will determine if any additional information is necessary. 2.9 Notice Package (LUDC Article 9-208 & Article 4-101.E.) Chevron will provide the necessary Garfield County and ECMC notices and comply with the publication requirements. A preliminary draft of the notice package including an executed Certification of Mineral Owner Research and a list of notice recipients is included in Appendix D. This project is located in Garfield County and no other local governments are within one mile of the Pad and there are no residential or commercial properties within 2,000 feet of the Pad. 2.10 Application Fees (LUDC Article 9-204.B.1.k.) Chevron has included the required fee payment with this Oil and Gas Permit Application. The Payment Agreement form is included in Appendix D. 2.11 ECMC Form 2A and Exhibits, with exceptions as listed in Code (LUDC Article 9-204.B.2.a.) Oil and Gas code amendments adopted July 6, 2021, Garfield County and its representatives held a pre-application conference on October 12, 2023 with Chevron Rockies Business Unit, (“Chevron”), and representatives from the Colorado Energy & Carbon Management Commission (“ECMC”), Colorado Parks and Wildlife (“CPW”), and Colorado Department of Public Health and Environment (“CDPHE”). Garfield County Land Use and Development Code Section 9-203.A. requires a pre-application process for all new or modified oil and gas operations. The required pre-application conference was held in advance of the anticipated submittal of Chevron’s application for an oil and gas permit with the ECMC for their proposed SKR 698-10-BV Oil and Gas Development Plan, including the SKR 698-10-BV Pad. The SKR 698-10-BV Pad is located in Tract 72 of Sections 10 and 15, Township 6 South, Range 98 West, 6th P.M. On September 11, 2023, Chevron representative Doug Dennison requested, in writing, a Pre-Application Conference with Garfield County per Section 9-203.A. Included in Chevron’s request was the Pre- Application Request Letter and the Pre-Application materials required per Section 9-203.B.1 of Garfield Land Use Code, which included the Alternative Location Analysis Narrative and Alternative Location Analysis Exhibits. Garfield County set and confirmed the pre -application meeting for October 12, 2023, at 1:00 PM. On October 12, 2023, Garfield County and its representatives hosted the pre-application conference which included representatives from Chevron, ECMC, CPW, and CDPHE. Chevron presented their one proposed permit location: the SKR 698-10-BV pad. The permit required an Alternative Location (“ALA”) under ECMC Rule 304.b.(2).B1 due to the location being within High Priority Habitat (“HPH”). During the pre-application meeting, Chevron discussed their overall plan for development of the proposed location. The proposed site is part of Chevon’s ECMC Oil and Gas Development Plan (“OGDP”) application that is pending submittal. As part of Chevron’s presentation, representatives discussed the alternative locations reviewed as part of the ALA process, presented the advantages and disadvantages of each location, and answered questions. Chevron’s ALA included the evaluation of eight (8) alternative locations. The ALA conducted by Chevron included the evaluation of all ALA criteria listed under Rule 304.b.(2).B and the well location and siting requirements under Rule 604. Additionally, Chevron evaluated each alternative based on landscape level characteristics (i.e., slope) and mineral development potential. SKR 698-10-BV Pad The SKR 698-10-BV Pad is an existing oil and gas location located within Tract 72 of Sections 10 and 15, Township 6 South, Range 98 West, 6th P.M. Chevron is proposing to utilize the SKR 698-10-BV Pad to 1 ECMC Rule 304.b.(2) B. FORM 2A, Oil and Gas Location Assessment Application Information Requirements. All Form 2As will include the following information, unless otherwise provided in a Commission Order approving a CAP pursuant to Rule 314. Alternative Location Analysis. B. Alternative Location Analysis Criteria. 20 develop two (2) horizontal natural gas wells. The SKR 698-10-BV Pad is located on a private surface owned by the operator. Chevron stated the advantages for the proposed location as follows: 1. There are no BUs / RBUs / HOBUs / School / Childcare Center within 2,000 feet of the WPS. 2. The Oil and Gas Location (OGL) is existing disturbance. No new surface disturbance is proposed. 3. Existing nearby natural gas infrastructure allows for minimal disturbance to connect the location. 4. Chevron owns the surface. The existing SKR 698-10-BV location is adjacent to County Road 211. The location is currently 6.4 acres overall and will be reduced to 1.7 acres of disturbance after interim reclamation. Chevron also presented the disadvantages for the location: The SKR 698-10-BV is located within three High Priority Habitats: Elk Winter Concentration Area, Elk Severe Winter Range, and Aquatic Sportfish Management Waters. The OGL would be located within 500' and partially within 300' of Aquatic Sportfish Management Waters. The ALA process also required Chevron to review additional locations, as such Chevron presented eight possible locations. Proposed Alternative 1 would utilize previously disturbed surface located on private surface (Chevron) within NESW of Section 31, Township 6 South, Range 94 West, 6th P.M. Proposed Alternative 2 would be new disturbance located on private surface (Mahogany Energy Resources, LLC), located in the SESW of Section 10, Township 6 South, Range 98 West. Proposed Alternative 3 is a new location on fee surface (Mahogany Energy Resources, LLC) in the SESE of Section 10, Township 6 South, Range 98 West, 6th P.M. Alternative 4 would be a new location located on private surface (Chevron) in the NWNW of Section 15 and NENE Section 16, Township 6 South, Range 98 West. Alternative 5 is an existing location that would require an expansion of reclaimed disturbance and some new disturbance located on private surface (Chevron) in the NW quarter of Section 9, Township 6 South Range 98 West. Alternative 6 is also an existing location that would require disturbing reclaimed surface on private surface (Chevron) in the NW quarter of Section 36, Township 5 South Range 98 West. The last alternative, Alternative 7, would be all new disturbance on private surface (Chevron) located in the NESE of Section 31, Township 5 South Range 97 West. Chevron evaluated the advantages and disadvantages of each proposed alternative. The proposed alternatives had numerous disadvantages, such as steep slopes, steep access, existing locations that would require expansions and new disturbance, and some were also located adjacent to the High Priority Habitats. The location is currently zoned Resource Lands R/L Gentle Slopes; some of the alternative sites with steeper slopes may fall within the Resource Lands Talus Slopes Zone District. Based on their evaluation and the currently available information, Chevron believes that the SKR 698-10-BV Pad is the best possible oil and gas location for development of the proposed minerals and will be the best location to minimize the overall impacts to public health, safety, welfare, the environment, and wildlife resources. As part of the development of the SKR 698-10-BVD pad, Chevron would minimize road by using the existing access road. All production equipment would be located on the existing Central Gathering Facility pad, ECMC Location ID 336050. Water supply for Completion operations will be transported via temporary surface pipelines. Evaluation of High Priority Habitat (“HPH”) is required when located in proximity to a project location. Chevron evaluated the HPH as required by rule; the proposed location is within three designated High Priority Habitats: Elk Winter Concentration Area, Elk Severe Winter Range, and Aquatic Sportfish Management Waters. There will be resulting traffic from this development, and Chevron will work with CPW to establish best management practices and mitigation. Chevron has initiated preliminary discussions with CPW. Chevron is proposing to conduct drilling operations at the location outside of the Elk Winter recommended timing limitation. 21 Pre-Application Meeting Questions and Answers During the presentation there were questions directed to Chevron from represented agencies. CDPHE commented that due to the remoteness of the location, a formal consultation with CDPHE may not be necessary but final determination on consultation will occur once the OGDP has passed completeness with ECMC.CDPHE also commented that they appreciate the use of an existing location. CDPHE also clarified that while Chevron’s presentation showed an Enviroscreen score of 59, the ir preliminary review provided an Enviroscreen score of 43.94. CPW will confirm if Deer Park Gulch will require a waiver due to its potential status as ephemeral or intermittent. There was also discussion between Chevron and CPW regarding compensatory mitigation requirements if Chevron proposes realigning the access road on the NW corner of the location. Garfield County inquired if CPW requires compensatory mitigation, would the mitigation be conducted in Garfield County? CPW stated that while there is a preference to utilize compensatory mitigation within the areas it is collected, it could not confirm that any compensatory mitigation would only be used within Garfield County. Due to the proposed access route coming off of I-70 in Debeque, Garfield County asked about potential impacts to Mesa County. Chevron responded they have not consulted with Mesa County yet. Garfield County asked for additional details for the proposed pipeline to connect the location. Chevron clarified that the proposed pipeline would head north along Clear Creek Road within the existing gas pipeline Right-of-Way. Chevron anticipates the pipeline will be between 6” and 8” in diameter . Garfield County asked about additional details regarding potential geologic hazards, such as rockfall, slopes, grading concerns. Chevron indicated that the slopes were gentler coming up from the gulch and the existing location has been constructed and operational for 15 years with no signs of geologic hazard concerns. Chevron stated they have no concerns about the location. In Chevron’s pre-application materials, Chevron indicated in addition to proposing the horizontal wells, one of the wells would go vertically deeper to test geothermal potential. Garfield County asked about the geothermal test, additional drill timing required. Chevron estimates it may take an additional 30 days to drilling time. Chevron inquired of Garfield County, regarding the Community Meeting requirements, how to handle the meeting since there are no residential building units near the location. Garfield gave a brief summary of expectations – set up a meeting with adjacent property owners, and agricultural lessee s. Garfield also explained a summary of the meeting documenting attendees and subjects discussed would be expected. It was confirmed during the discussion that the radius of notification is 2,000 feet from the Working Pad Surface. Garfield County asked for a summary of the alternative locations near the preferred location. Chevron provided a brief discussion of potential negative impacts of the alternatives. Summary of Staff Comments During the Pre-Application meeting it was confirmed the proposed location will require a county Land Use Change Permit. Chevron will provide in their application all required documentation per Article 9 Section 204 in support of their proposed and alternative locations including all items as stated in the foregoing summary. Chevron will further provide the following with their application: 22 • Garfield County requested Chevron to provide any existing Garfield County permits related to the pad. • Any additional studies or analysis that are being conducted by Chevron in support of the permit application to ECMC per Rule 304.b.(2)(C) and Rule 304.b. (3) through (1) inclusive, except NOT Rule 304.b. (7)(D) (Preliminary Flow Diagrams) and (7)(H) (Directional Well Plat) should be included for review by Garfield County; • Referrals will be sent out in accordance with 9-206; • A public Hearing will be held in accordance with 9-208 and 9-209; and the Standards of Approval are contained in Sections 9-205. • Submitted wildlife maps should have clarification in legend and color coding to clearly label and identify habitats. The summary is based on current zoning, which is subject to change in the future, and upon information provided at the Pre - Application Conference. Chevron has requested a Rule Variance from ECMC for activities inside 300' from the OHWM and a Waiver from CPW for activities between 300'-500'. -Chevron will request a CPW Waiver to Rule 1202.a.(3) for the staging of refueling or chemical storage within 500' of the OHWM. -Chevron will commit to enhance pad stormwater BMPs including a perimeter collection channel routing stormwater flow to two downgradient dedicated detention ponds on the south and west sides of the pad. -The pad is located within Elk Winter Concentration and Elk Severe Winter Range HPH (1202.d.(2)). Chevron will commit to avoid the protective timing stipulation between December 1st and April 15th. -Fresh water for the project will be sourced from surface lay-flat pipe routed from the Kobe Pump Station along an approved federal right- of-way to an MLVT storage area, and then to the drill pad.
