Mineral interests may be severed from surface right interests in real property. C.R.S. § 24-65.5-101, et seq, requires notification to mineral owners when a landowner applies for an application for development from a local government. As such, the landowner must research the current owners of mineral interests for the property. The Garfield County Land Use and Development Code of 2013 (“LUDC”) Section 4-101(E)(1)(b)(4) requires written notice to owners of mineral interests in the subject property in accordance with C.R.S. § 24-65.5-101, et seq, “as such owners can be identified through the records in the office of the Clerk and Recorder or Assessor, or through other means.” This form is proof of applicant’s compliance with the Colorado Revised Statutes and the LUDC. (“Chevron”) prepared the following Alternative Location Analysis (“ALA”) associated with the SKR 698-10-BV pad (“Well Pad”) in accordance with Garfield County Code 9-203.B.1. and Rule 304.b.(2) of the Colorado Energy & Carbon Management Commission (“ECMC”). The SKR 698-10-BV is an existing surface disturbance that overlaps Sections 10 and 15 in Township 6 South, Range 98 West, 6th P.M., Garfield County, being Location ID 336056 (“Well Pad”). The Well Pad has an active status with the ECMC, but the well permits associated with the original Location ID have since expired. The Well Pad was permitted through Garfield County land use regulations and re-purposed as a storage yard for equipment. Chevron proposes to work with Garfield County and the ECMC to utilize this location to drill two (2) horizontal wells and associated equipment for the production of natural gas and associated hydrocarbons. Chevron identified the existing disturbance as an optimal drilling location that (i) maximizes protection of public health, welfare, safety, environment, and wildlife; and (ii) minimizes impacts to the community and the environment in the area of operations. The Well Pad falls within the ALA criteria based on the recommended oil and gas location being within a High Priority Habitat as outlined in Rule 304.b.(2)B.viii. A majority of the existing surface disturbance associated with the Well Pad fall within Aquatic Sportfish Management Waters designated by Rule 1202.c. In addition, the entirety of the existing disturbance associated with the Well Pad fall within Elk Severe Winter Range and Elk Winter Concentration areas designated by Rule 1202.d. Both wildlife matters will be properly minimized and mitigated through this careful planning project. During the early vetting process associated with the proposed development, Chevron evaluated eight (8) locations (including the recommended oil and gas location) to ensure the selected location reasonably protects and minimizes adverse impacts to public health, safety, welfare, the environment, and wildlife resources. The eight (8) locations that were evaluated in the site selection process are represented and differentiated on the ALA maps by various colors reflecting the level of available access to each location. The recommended Well Pad is bright yellow with a red boundary on the ALA maps. AL 1, AL 2, AL 3, and AL 7 (depicted on the ALA maps as peach in color) are of significant note, as they went through an extensive vetting primarily through desktop review based on the limited availability to fully access each location. This limited access presents far more challenge than mere economics, but rather of operational success given the issues of topography and geography. However, Chevron invested in the review regardless in order to fully assure thoroughness and interdisciplinary cohesion. AL 4, AL 5, and AL 6 (depicted on the ALA maps as red in color) represent hypothetical operational viability, and therefore went through not only an extensive review that utilized desktop review, but also presented adequate access to fully evaluate the locations onsite by Chevron staff. The Well Pad was subsequently permitted through Garfield County land use regulations and re-purposed for equipment storage related to Chevron operations. The nearest surface water is Deer Park Gulch, which is located approximately 148 feet southeast of the Well Pad. Chevron is the surface owner where the Well Pad is located. Advantages: • The Well Pad utilizes existing surface disturbance associated with an ECMC Location ID that’s currently designated as active. • The current layout and dimensions of the Well Pad will not need to be expanded for the proposed development. • Limited new disturbance associated with the location will solely be a proposed second access point to allow for a safer flow of operations by designating separate ingress and egress points given the Well Pad size constraints. • There are zero Residential Building Units (“RBUs”) or High Occupancy Building Units (“HOBUs) within 2,000 feet of the Working Pad Surface. • The Well Pad is greater than 2,000 feet from a School, School Facility, or Child Care Center. • The Well Pad is greater than 1,500 feet from a Designated Outside Activity Area. • The Well Pad is greater than 2,000 feet from a jurisdictional boundary. • There’s existing gas infrastructure within proximity of the Well Pad for easy tie-in with minimal additional surface disturbance. • The existing disturbance associated with the Well Pad is at an elevated position compared to the valley habitat that the elk in the area frequent based on Chevron observations as surface owner; meaning despite map indications, the Well Pad is located away from actual elk habitat intrusion. • The Well Pad is adequate for developing the targeted minerals associated with the proposed unit based on drilling step-out capabilities. • The Well Pad best accommodates Chevron’s intention to drill the initial well as a geothermal test. While Chevron’s permitting documentation will lay out the technical details, we note that the geothermal test portion demands a deeper vertical drill, which by extension elevates the necessity of the proposed location. Disadvantages: • The Well Pad is within Rule 1202.c. Aquatic Sportfish Management Waters NSO. • The Well Pad is within Rule 1202.d. Elk Severe Winter Range and Elk Winter Concentration density habitats. • The Well Pad is within a Disproportionately Impacted Community (“DIC”). • The Well Pad is immediately upgradient of a riparian area. • There’s no existing infrastructure for fluid takeaway at the Well Pad. A fluid line will need to be installed. 80
