Garfield County Public Health (GCPH) issued Onsite Wastewater Treatment System (OWTS) Permit # SEPT-8532 for the property
located at 5970 County Road 109, Carbondale, CO 81623 on March 15, 2024. On June 25, 2024, we were made aware of a
discrepancy regarding the floodplain mapping as well as a wetland delineation report for the property by the Garfield County
Community Development Department. The wetland delineation report was not part of the OWTS design documents that were
presented to us during the permit review process. Per Table 7-1 (Minimum Distances Between Components of an On-Site
Wastewater Treatment System and Physical Features” of the Garfield County OWTS Regulations, there are required setback
distances from OWTS components to wetlands. However, also per Table 7-1, Note: “For repair or upgrading of existing OWTS
where the size of lot precludes adherence to these distances, a repaired OWTS must not be closer to setback features than the
existing OWTS, as reviewed and approved by the local public health agency.” Further, Sections 43.4.L.6 and 43.10.I.2 of the
Garfield County OWTS Regulations are also applicable. Therefore, this letter serves as notice to you, the property owner, that
GCPH is revoking OWTS Permit # SEPT-8532.
The owner may re-apply for a major repair permit and the county will waive any new permit fees. A consistent set of drawings
for all permits must be provided that refer to the FEMA floodplain elevation found on the Flood Insurance Rate Map (FIRM) as
well as wetland setbacks. There are two options for the new design regarding the wetland delineation report:
1) Determine if the repair system is not encroaching the wetlands more than the existing system; if documents provided
in application demonstrate this, then a variance will not be required.
2) Application for a variance to the wetland setback will be required if the above cannot be demonstrated.
Once the new permit is submitted, GCPH staff shall review and determine if the new OWTS design is in accordance with
Garfield County Onsite Wastewater Treatment System Regulations. Construction of an OWTS without a valid OWTS permit is
