This correspondence is in regard to your OWTS application originally filed with the County as ' \
Permit #SEPT-8532. Please note that the Environmental Health Department has rescinded that t\,
Permit and you have subsequently submitted a new Application for repair/replacement of the
existing OWTS on the ProPertY.
This correspondence is an update and clarification from previous correspondence dated June 28,
2024, and outlines the Director's lnterpretation of applicable sections of the Land Use and
Development Code that will allow for the issuance of the OWTS Permit for the repair/replacement
of the failing OWTS System on your property.
This Director's lnterpretation is based on supplement information and representations of the
Applicant as well as review of past submittals and documentation as outlined below:
o Updated submittals, site plans, representations and attachments from Carla Ostberg, CBO
lnc. dated 71201204.
. These updated documents reflect that no increase in impacts on wetlands will result from
the construction of the replacement OWTS system.
. These documents include detailed designs for the OWTS system that reflect compliance
with all typical and normal conditions required for installations within floodplain areas
including but not limited to elevation of the mound infiltration system above the 1O0-year

. Confirmation from Roger Neal, High Country Engineering that his previous determination
of minimal impacts from the OWTS is consistent with the revised application and
documentation from Carla Osberg CBO lnc. and K-Cronk Engineering.
r That the OWTS Permit include conditions requiring compliance with all representations
contained in the engineering documentation, compliance with all applicable Federal, State
and Local regulations, and a requirement that the area of the existing OWTS system be
fenced prior to initiating construction to prevent any expanded area of impact.
Please contact our office and/or County Environmental Health if you have any additional
questions. The information provided in this correspondence and attachments supersedes and
replaces previous determinations and pre-applications. A copy of this correspondence and
clarification/interpretation will be provided to the County Environmental Health Department and
the County Plans Examiner.

OWTS System - Floodplain Application and Wetlands Waiver

Dear Kurt:
Per Garfield County Building and Planning requirements regarding placement of new OWTS
system, the owners plan to replace the existing OWTS with a new system in the same location, in
order to keep OWTS system's impact to the wetlands as minimal as possible, limit general site
disturbance, and simplifli construction. The system was designed to have as minimal impact as
possible give the limitations of the site.
The attached floodplain review shows the OWTS design and associated site improvements
within the floodplain. The placement of the system is right at the toe of the slope where the
existing system is located. and will be elevated out of the 10O-year floodplain. Being elevated
and installed as a mound system, treatment will occur at a higher elevation and treated effluent
will percolate through the surrounding wetlands as additional treatment before entering the
normal high water of the Roaring Fork River. Improving the failing system with a functioning
system provides benefit to the community by repairing an existing system that is potentially
discharging untreated effluent into the surrounding watershed'
Two additional letters have been prepared by SGM dated May 24,2024 by Alexander Nees and
Carla Ostberg, may 8,2024, that discuss the improvements noted to the OWTS located at 5970
CR 109. SGM notes the Section 7 -203 Section B that discusses the an exemption for allowing
structures within a setback and the benefits of a new system in the existing location that should
qualify for that exemption. Carla Ostberg notes that per Garfield County OWTS Regulation
43.7 Table 7-1 thatthe "For repair or upgrading of existing OWTS where the size of the lot
precludes adherence to these distances, a repaired OWTS must not be closer to setback features
than the existing OWTS, as reviewed and approved by the local public health agency".
I concur with both of the noted code sections above and the benefit of repairing this system in
this location.

FLOODPLAIN REVIEW NARRATIVE
The owner of Lot 1A of the Snobble Exemption located near Carbondale Colorado in
Garfield County has requested us to review the effects of placing an Onsite Wastewater
Treatment System within the floodplain located on this parcel. This parcel is located within
FEMA panel 0845C161lE dated Oct 26,2011, and FEMA panel 080205 1856 B dated
January 3, 1986. This area is a part of a delineated floodplain area and requires a Special Use
Permit in accordance with Section 6 of Garfield County ZoningResolution. The purpose of
county floodplain regulations is to permit only such uses that will not endanger life, health,
public and private properties due to flood conditions.
HCE has utilized the most recent preliminary study dated 2011 that is cunently in review.
This study appears to have more detail within this area and has a cross section just upstream
of this property. HCE compared the floodplain elevations with the study that is currently in
effect from 1986 and appears to be similar 100 year flood elevations when the Datum is
convefied to the NAD 1929 datum that is referenced on the 1986 mapping. There also
appears to be greater detail identiffing the floodway from the floodplain. It is clear from the
2011 document that the proposed OWTS area is significantly out of the floodway.
The property was shown on FEMA panel 0845C161lE dated Oct 26,2071 Flood Insurance
Study of Unincorporated Garfield County produced by the Federal Emergency Management
Agency (FEMA) is determined to be located in Zone AE of the floodplain. The area is
classified as Base Flood Elevation Determined. There is a pond located just upstream of the
OWTS which is believed to create the "hook" in the floodplain. This feature will help slow
the velocities in the proposed area of the OWTS, however HCE utilized data from the
upstream cross-section to determine velocities to establish appropriate protection to the
OWTS. The mean velocity repofted for Section D was 8.3 feet/second. The proposed
erosion protection North American Green Vmax SC250 is rated up to 15 feet per second with
vegetation or 9.5 feet per second without vegetation. Erosion blanket coverage is
conservatively placed to cover all disturbed areas below the 100 year floodplain elevation
plus l'.
Review of the site and available floodplain information has indicated that the impact of a
small OWTS at this location would be negligible and can be protected from flooding, if
inundated. Development in the floodplain per definition of the floodplain and floodway is
anticipated and elevations of the floodplain are anticipated based on development occurring.
Based on this information, no public or private properlies will be caused endangerment.
