B, Monthlv Service Charges. Lessee shall be liable for all set up fees, monthly service
charges, and any other fees charged by utility providers.
C, Aereements Affecting Airport Utilities. lt is specifically understood by the parties that
the agreements made in this Section Vlll are subject to that certain City of Rifle, Garfield County, and
Airport Land Partners Limited Pre-Annexation/lnfrastructure, Zoning and Subdivision Agreement, and
Garfield County Land Donation Agreement, recorded at Book 1139, Page 511 through 657 in the records
of the Garfield County Clerk and Recorder, including but not limited to Section ll, D., at Page 6L6 of said
recorded document and any amendments of record. Further, this Section Vlll is also subject to pertinent
sections of the Rifle Municipal Code.
SECTION X
NO MORTGAGE OF TEASEHOLD INTERESTS
Lessee shall not have the right to pledge its leasehold interest as security for construction
financing or any other purpose.

LtENS, SECURIW AND CONSTRUCTTON NOTTCE
A. Liens. ln the event any individual or entity attempts to assert a mechanics',
materialmen, or other type of lien against the Leased Premises, Lessee shall hold the BOCC harmless
from such claim, including the cost of defense, and shall provide the BOCC with a Release of Lien or a
Release of Verified Statement of Claim, as appropriate, recorded in the Office of the Garfield County
Clerk and Recorder,

t. Performance and Pavment Bonds. After obtaining a county building permit
and prior to any phase of construction with the initial disturbance of soils associated with
clearing, grading or excavating activities, or other construction activities on the site necessary
for erecting Hangar facilities and associated improvements, described in Sections ll,, above,

TO SITE
Lessee shall have the rights of ingress to and egress from the Leased Premises, for Lessee and
Lessee's sublessees, licensees, tenants, permittees, employees, guests, contractors, agents,
representatives and invitees, of any aircraft associated with the hangars on the Leased Premises, by
reasonable and adequate roptes of travel designated from time to time by the BOCC. Lessee shall also
have, for its use and with others to whom similar rights are granted, the use of the public Airport
facilities, such as runways, taxi ways, taxi-lanes, ramps, aprons, and the public automobile parking area
