Dear Theresa and Bengamin Wagenman:
This letter is sent to you as the appllcants for GAPA 0L-2+8994, Wagenman Secondary
Dwelling Unit. The application requested a Land Use Change permit to allow a Secondary
Dwelling Unit The property is located along CR 238, approximately 3.3 miles west of New
Castle and 2.5 Miles East of Silt It is known as Parcel No,218106200283 and Lot2 ofthe
Maves Subdivision Exemption at Reception No.645003.TheApplicationhas beenreviewed
in accordance with the Administrative Review procedures contained in the Land Use and
Development Code as amended. Said provisions require a decision by the Director of the
Community Development Department on whether to approvg approvewith condifions, or
deny the request for a Secondary Dwelling Unitwithin the Rural Zone DistricL
The Director's Decision is based on the following findings:
L. That proper public notice was provided as required forthe Director's Decision
2. Consideration of the application was extensive and complete, that all pertinent hcts,
matters, and issues were submitted and that all intere$ted parties were $ven an
opportunity to provide input prior to the Director's Decision.
3. That for the above stated and other reasons, the proposed Land Use Change for the

Plan 2030, as amended,

The Director's Decision is hereby issued approvingyourApplication subiect to the
following conditions of approval.
I. All representations of the Applicant contained in the Applicadon submittals shall be
conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. The Secondary Dwelling Unit shall be subject to all applicable federal, state, and local
laws.
3. Prior to the permit being issued, will-serve letterfs) from utility providers shall be
provided to staff.
4. Prior to the permit being issued, a water treatrnent plan to treat the raw well water to
eliminate coliform prior to distribution as potable water shall be provided. lt is
recommended (but not required) that the rawwell water also be treated to reduce the
Ievels of Total Dissolved Solids (TDS) and iron bring the water quality up to standards
shall be provided. The water treatment plan shall be implemented prior to issuance of a
Certificate of 0ccupancy.
5. Prior to the permit being issued, the applicantshall provide aweed inventoryfor
review by with Vegetation Management and shall create a weed management plan for
review and approval by County Vegetation Management prior to issuance of a
Certificate of 0ccupancy,
6. All building codes shall be followed and the building permit applied for according to
Garfield Gounty's policies and codes.
7. At the time of building permig appropriate grading and drainage plans shall be
provided.
8. At the time of building permit, the geotechnical report shall be updated to reflect if
rockfall or slope related hazards need to be addressed. If necessary proper mitigation
shall be provided prior to issuance of a Certificate of Occupancy.
9. At the time of building permi! an appropriate septic permit shall be applied for and
obtained.
10. Prior to Certificate of 0ccupancy, the drivewayshall complywith Section7't07's
standards provide safe and adequate ingress and egress, includinga turnaround
acceptable to the Fire District.
11. Prior to the issuance of the the Amended Final Plat IFEXA 03-24-9071) shall be

The Land Use and Development Code requires notifiation to the Board of County
Commissioners for their review and potential call-up of the Director's Decision.The Board
review is for a period of 10 calendar dala commencing on the date of the Directoy's
Decision, You may request the decision be called up to the Board during this period- The
call-up period shall expire on fuly 4th,202+Once all conditions of approrral have been
satisfied, a Land Use Change Permit will be issued. Please note that you will have one year
from the date of approval to comply with the conditions of approval. Extensions may be
requested prior to the expiration of the original time limit Please contactthe Community

Dear Ben:
As requested, a rqrresentative of Kumar & Associates observed the subject site on August l,
2\24,to assess the potential rockfall hazardto the proposed barn at the subject site. The findings
of our assessment are presented in this report. The services were performed supplemental to our
agreement for professional engineering services to Ben Wagenman dated November 7,2022.
We previously conducted a subsoil study for design of foundations at the subject site and
presented the findings in a rqlort dated January ll , 2023 , Project No. 22'7 '7l9 .
Proposed Construction: The barn/ADU will be a pole structure located near the center of the
proposed development axea as shown on Figure I of our previous report. Ground floors will be
slab-on-grade. Grading for the skucture is assumed to be relatively minor with cut depths of up
to about 3 feet.
Potential Rockfall Conditions: The ground surface in the immediate area of the proposed barn
is moderately sloping down to the south. There are medium to large sized sandstone blocks at
the base of a low sandstone outcrop about 200 feet to the northeast of the proposed bam location.
These blocks are angular, partially buried, and appear stable. Moderate to mature pinon and
juniper growth was observed within the area of sandstone blocks. No evidence of rockfall
impact southwest of the sandstone blocks or in the area of the proposed barn was observed.
Conclusions: Based on our review, the risk of rockfall impact to the proposed barn is low and no
mitigation is warranted.
