Dear Doug,
On behalf of the Applicant, KBBS Holdings LLC, this letter confirms there is
an adequate legal water supply for the proposed development of Parcel No. 2185-
124-02-034 (the "ProPerty'').
The Property is currently served by an existing well operating under Well
permit No. 204416. This is an exempt weII permit approved pursuant to C.R.S.$ 37-
92-602(8), which can serve up to three single family dwellings ("SFD"), irrigate up
to one acre of irrigation, and provide water for domestic animals/livestock. The
Applicant is entitled to 1/3 interest in this well pursuant to a private well-share
agreement.
To serve add,itional dwelling units and uses, Applicant is securing a non-
exempt well permit and a Basalt Water Conservancy District water allotment
contract to augment the additional uses. Applicant is eligible for both.
Because the Property is within the Basalt Water Conservancy District's
service area (Area A), the District confirmed that the Applicant is eligible for a
water allotment contract. We have also spoken with the Division of Water

Resources and confirmed Applicant may secure a non-exempt well permit in
addition to the existing exempt well permit. Applicant expects to secure both the
water supply contract and non-exempt well permit within the next few months.
In the meantime, the Applicant hereby can demonstrate the legal water
supply for one SFD. The current application is for two tiny homes. Because the
Applicant's ability to secure the legal water supply for more than one SFD is
certain, we wotrld. reqr.rest that the County issue the building permit for hoth tiny
homes but condition the issuing of any certificate of occupancy for the second tiny
home upon the Applicant securing the BWCD contract and non-exempt well
permit. Such would expedite the process and reduce expense for both the County
and the Applicant.
