Dear Doug,
On behalf of the Applicant, KBBS Holdings LLC, this letter confirms there is
an adequate legal water supply for the proposed development of Parcel No. 2185-
124-02-034 (the "Property'').
The Property is currently served by an existing well operating under Well
Permit No. 204416. This is an exempt well permit approved pursuant to C.R.S.$ 37-
92-6A2(3), which is capable of serving up to three single family dwellings (SFD),
irrigating up to one acre of irrigation, and providing water for domestic
animalsAivestock. The Applicant is legally entitled to 1/3 interest in this well
pursuant to a shared well agreement, which allows for domestic use in one SFD.
To serve additional dwelling units and uses, Applicant must secure a non-
exempt well permit and a Basalt Water Conservancy District water allotment
contract to augment the additional uses. Applicant is eligible for both.
Because the Property is within the District's service area (Area A), the
District confirmed the Applicant is eligible for a water a-llotment contract. We have
also spoken with the Division of Water Resources and confirmed Applicant may

secure a non-exempt well permit in addition to the existing exempt well permit so
long as the well operates pursuant to the District's contract l augmentation plan.
Accordingly, Applicant intends to apply for both the water supply contract and non-
exempt well permit.
