IJHEREAS, I\,|ARY ANN PEI,|NIG, has pet'itioned the Board of County Commissioners of
Garfield County, Colorado, for an exenption under C.R,S. (.l973) Sectfon 30-28-
'l0l (fO1 (a) - (d) as amended, and the Subdivision RegulaLions of Garfield County,
Co]orado, adopted September 1, 197? and amended April 14, 1975, Sectjons 1.0?.17
(d) and 3..02.0.l, for the division of a 48 acre tract of land into three parce.ls
of 16 acres each, more or'less, and more particularly described as follows.:
A parcel of land si.tuated in the NEkSHk, NlllaSE%' SN%SE%
and the SEr6SI,tk all in Sectfon ]9, Township 7 South, Range
87 llest of the Sixth Princ'ipal l4erid'ian, County of Garfield'
State of Colorado, 1ying l,lesterly of the l'lesteriy right-of-way
line of County Road No. 100 as constructed and in place, said
parcel of land is deicribed as fo1lowsi '
Beginn'ing at a point.on a fence as constructed and in place
whence the South Quarter Corner of said Section I9 bears:

584.50 feet along said fenqe; thence N. 00o 54' 26" E.
1433.23 feet; thence East .1329.16 feet' more or less to a
' point on the-Westerly right-of-way 'line of said County Road;

right-of-way line of sajd County Road; thence S. 77o 18'05u
bl. along a fence as constructed and in place 859.47 feet,

The above described parcel of land contains 48.00 acres,

The above described parcel of land is iubiect td a 60 foot
easement running all along the'Southerly line.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of County
Connissioners of Garfield County, Coloraclo, that she desires said exemption1"or
the purpose of re-sale into single-fami'ly residential acreage; and,
I,IHEREAS, the Petitioner has demonstrated to the sati!;faction of the Board
that therre is a reasonable probability of locating dornestic water on each of
said tracts, that there is adequate ingress and egiess to said tracts, that the
location of septic tanks r.rill be permitted by the Colorado Department of Health,
that the requested division is in accordance vrith the genera'l plrposes and intent
of the Subdivision Regulations of the State of Colorado and the County of
Garfield and shou'ld, therefore, be exempted from thc definition of the terms
"subdivision" and "subdivision land" as set forth in C.R.S. (tSZA1 Section 30-
28-101 (.I0) (a) - (O) as amendedi

NOt,l THEREF0RE, upon tnotion of Flaven Cerise seconded
by Larry Velasquez and carrisd, said 48 acre tract of land is
hereby exenpted from such definitjon and transfer of said tract may be made by
division into three parcels of 16 acres each, more or less, all as is mcre
fully described above and f,urther that prior to conveyance of said tracts a
proper legai description be prepared, and further that no additional subdivision
exenptions be granted for those 16 acre tracts. A copy of the instrument or
instruments of conveyance when recorded sha'll be filed with this Resolution.
