McPhee PRACTICAL LOCATION: 839 Sun King Dr. Glenwood Springs, CO 81601 TYPE OF APPLICATION: Waiver Request for Water Hauling for an ADU ZONING: Rural (R) I. GENERAL PROJECT DESCRIPTION The Applicants are planning to construct an Accessory Dwelling Unit (<1,000 sq.ft.) in conjunction with the construction of a detached garage on their property. Research by County Staff, including Casey Lawrence with the Assessor’s Office has determined that the lot was legally created, however, it is just less than 2 acres in size at 1.965 acres. In 2020, the County granted a waiver for minimum lot size for an ADU. Section 7-701 has been amended to remove the minimum lot size requirement for an ADU. The applicant is asking for a waiver to water haul for the proposed ADU attached to the garage. Applicants must complete all documents for the application to proceed. COMPREHENSIVE PLAN The comprehensive plan identifies the area as Residential Medium High. III. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS The following Sections of the Garfield Land Use and Development Code as amended apply to the proposed Application: • Garfield County Comprehensive Plan 2030 as amended. • Garfield County Land Use and Development Code as amended. o Section 7-118 Waiver from Standards including the review criteria in Section 7-118(C) o Table 4-102 Common Review Procedures and Required Notice o Table 4-201 Submittal Requirements o Section 4-203 Description of Submittal Requirements o Section 4-103 Administrative Review and Section 4-101 Common Review Procedures o Article 7, Articles 7-701 (A) Accessory Dwelling Unit Standards o Section 7-104 Sourced Water o Section 7-105 Central Water Distribution and Wastewater Systems IV. SUBMITTAL REQUIREMENTS As a convenience outlined below is a list of information typically required for this type of application. Table 5-401 outlines the specific application submittal criteria. The following list can function as a checklist for your submittal. Submit three paper copies and one digital of all application materials. Additional copies will be requested upon determination of completeness. See the land use code for additional information on submittal requirements. General Application Materials o Signed Application Form o Title Commitment (if available) o Signed Payment Agreement Form (see attached) and application fees. o Proof of ownership (copy of deed, title work) and information on any lien holders. o A narrative describing the request to provide water hauling and use a cistern for the ADU. o Names and mailing addresses of properties within 200 feet of the subject property. o Mineral rights ownership for the subject property (demonstrated through a search of Clerk and Recorders database and/or Assessor database, memo attached). o If the owner is an entity or trust, a recorded Statement of Authority, authorizing a person to encumber the property. o If the applicant is a representative of the owner, a letter of authorization to represent is needed. o A copy of the Pre-application Summary needs to be submitted with the Application. Response to the ADU Standards in Section 7-701(A). Response to Sections 7-104 and 7-105. Response to Waiver Criteria in section 4-118(C). A Vicinity Map for use in the required public notice is needed. The vicinity map should include that area within approximately 3 miles of the proposal and be on an 8½ “ x 11 “ format to allow attachment to the public notice. . An overall site plan or improvement location survey. Description of relationship to adjoining properties and improvements. A copy of any relevant Homeowners Association Documents, Covenants, and any waivers, approvals or documentation to support the request. Community Development Staff is available to meet with the Applicant to provide additional information and clarification on any of the submittal requirements and waiver requests. V. REVIEW PROCESS The Application may be “Called-Up” for review by the Director and the Board of County Commissioners. In addition, the Applicant and any affected Adjacent Property Owner can request a Call-Up for review by the Board in accordance with the procedures and review process contained in Section 4-112. GENERAL APPLICATION PROCESSING The foregoing summary is advisory in nature only and is not binding on the County. The summary is based on current zoning, which is subject to change in the future, and upon factual representations that may or may not be accurate. This summary does not create a legal or vested right. The summary is valid for a six-month period, after which an update should be requested. The Applicant is advised that the Application submittal once accepted by the County becomes public information and will be available (including electronically) for review by the public.
