PAYMENT AGREEMENT FORM
GARFIELD COUNTY ("COUNTY") and Property owner ("APPLICANT)
agree as follows:
L The Applicant has submitted to the County an application for the following Project:
2.The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
The Applicant and the County agree that because ofthe size, nature or scope ofthe
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, establiihed for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred'
4.The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of county commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. lf actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the county to reimburse the county for the processing of the erolect'

CERTIFICATION OF MINERAL OWNER RESEARCH
This form is to be completed and submitted with any application for a Land Use Change Permit.
Mineral interests may be severed from surface right interests in real property. C.R.S. § 24-65.5-101, et seq,
requires notification to mineral owners when a landowner applies for an application for development from a
local government. As such, the landowner must research the current owners of mineral interests for the
property.
The Garfield County Land Use and Development Code of 2013 (“LUDC”) Section 4-101(E)(1)(b)(4) requires
written notice to owners of mineral interests in the subject property in accordance with C.R.S. § 24-65.5-101,
et seq, “as such owners can be identified through the records in the office of the Clerk and Recorder or
Assessor, or through other means.” This form is proof of applicant’s compliance with the Colorado Revised
Statutes and the LUDC.
The undersigned applicant certifies that mineral owners have been researched for the subject property as
required pursuant to C.R.S. § 24-65.5-101, et seq, and Section 4-101 (E)(1)(b)(4) of the Garfield County Land
Use and Development Code, as amended. As a result of that research, the undersigned applicant certifies
the following (Please initial on the blank line next to the statement that accurately reflects the result of
research):

This is an update on the mineral rights:
Having the American Land Title Association do a commitment for title insurance through the American Land Title
Association findings were reception number 218476 and book 343 page 426 that the interest may appear all oil gas
and other metal and in or underside lands and the rate of ingress and egress to explore for mine rule for any removal
of such oil on gas in other minerals , was then transferred reception number 218477 Platt of Travers Highland
subdivision recorded August 15, 1962 Lots 8 & 9 subdivision 3 as reception number 21477 was apart of the transfer
which continued to contain the mineral rights.
The property which considered of 169.07 acres more or less as stated by declaration of pulling agreement from Jean
Alberto Garfield County has a reception number 802 700 dated 5/18/2011 who continued to retain the property and
lease it to Williams production RMT as well as many other people companies notarized by Patti Rives.
Throughout this time the working interest owner Michael Burton president of Ivy energy Inc. had royalty interest
owner Exxon Mobil corporation which then lead to Williams production RMT had continued to lease the 25 lots
from travelers as well as other individuals .
The subdivision which we then said purchased Lot 8 & 9 block 3 from Uriah Heep LLC whose address is 1500
County Rd. 259 Rifle, CO 81650 with the same reception number 218477 which did not change since 1962 included
a lot 8&9 block three of travelers Highland subdivision according to the Platt thereof filed August 15, 1962 as
reception number 218477 also known by street and number is 0 Mosher Ave. parachute CO 81635.
On January 2, 2025 West or Land title insurance company schedule a commitment number 060-5105 – C issue date
January 14, 2025 purchasers with contractor rights under a purchase agreement with vested owner identified as
David Holtz and Cherri Holtz Title Company of the Rockies LLC Melanie Maloney.
It’s states in the legal description the land referred to hearing is located in the county of Garfield state of Colorado is
described as followed lots 8 and 9 parcel numbers 240928410012, 240928410011 , block three Of Travelers
Highland Subdivison according to the plat there of August 15, 1962 is the same reception number of 218477. Other
purchasers of the travelers Highland subdivision at this time are Vega Aguilar 3 parcels, BNP enterprise 1 parcel,
Kenneth White 4 parcels, David Barnes 2 parcels, Iron Man welding 1 parcel, Jaime Roark 1 parcel. These are the
surrounding owners of lots 8 & 9 purchased by Dave and Cherri Holtz.
A letter was sent out to each owner that stated “ hello this is Dave Holtz I purchased lot 8 & 9 parcel 240928410011
and 240928410012 on Mosher Avenue I want to put up a 40‘ x 64’ building I want to put the building facing east
and west the issue I have is a Garfield county says I cannot build across my center property, I have to get an
amendment done to erase the imaginary line. I have to get permission from last owners within 200 foot range of my
lots so this is why I’m asking if you will sign this paper for me to build the way I want and give it to Garfield
County. They also want your phone number “.
We have all letter letters signed and returned with phone numbers and date of return with approval from each
property owner.
These documents have been attached and given to Garfield County as well as a USB with all information required to
continue the process.
