all rights and obligations set forth herein shall be binding upon and inure to the benefit of the parties
hereto, their respective successors and assigns, and shall be deemed to be a burden running with the
Burdened Property for the benefit of the Subdivision,

"Grantee"l, whose address is the same as that stated above.
RECITALS
1. Whereas, Grantors are the o\ rners of cErtain real property located in Section 4, T. 6 S.,R. 91 w. of the 6th p. M. within the county of Garfietd, state of colorado and
2 whereas, Grentee is the record owner of that certein real property located within thecounty of GErfield, state of coloredo, described as The Rapids on the colorado subdivision (hereinafler
"Subdivision"), according to the plat thereof filed for public record in the Office of the Clerk and Recorder
of Garfield County, Colorado as Reception No. 513353, and the Declaration of protEctiv€ Covenante for
the Subdivision recorded as Reception No, 5'13356, in ths records of thE Cierk and Recorder of Garfietct
County, Colorado, and
3. Whereas, Grantee, wlth Granto/s permission, has conslructod a domestic water supply
system for the subdivision (with sufficient wat€r supply and storage c€pacity for Grantors aajoinini
property) s portion of which is located on property owned by Granlors (the "Burdenad propertf ), more
particularly des$ibed on Exhibits "A'and'B' attached h€reto and incorporated herein; and
4' Whereas, pursuant to Paragraphs lV. A and lV. B of the Subdivision lmprovements
Agreement executed by Rapids Development corporation end the Board of commissioners of Garfield
County, Colorado and filed for public record in the Office of the Clerk and Recorder of Garfield County,
Colorado as Reception No, 513354, Rapids Development Corporation shalt at th6 time of acceptance by
the County of the Owner's certificetion of completion of improvemente for lhe domestic water supply
system, pursuant to bill of sale, convey to The Rapids on the Colorado Horneowners Association
("Associgtion') the water system improvemenls, well perrnits and other structures appurtonanl thereto
and coincident with the conveyancs of the domestic water eupply system improvaments, Rapids
Development Corporation ehall transfer by dead or dedication to the Aesocietion, for thc purpose of
operating and maintaining said improvements, the following described eesemonts:a, a width of twenty (20) feet cgntered upon the length of alt water lines, as
