TEP Rocky Mountain LLC will adhere to the current Garfield County rules and regulations regarding the five
hundred foot (500') setback. This is an issue that you will need to take up with the county.

Bryan, I just talked to Philip Berry( Philip Berryoberry rtarfieldcountyco.gov ),at the Garfield County Community Development
Department that approves building permits, about getting a variance to the 500 foot limit. He needs a letter from Terra to me that it
is acceptable for me to build a house within 500 feet of the storage tanks on the corner of the Savage property. He will handle the
variance from that point, so Terra does not need to do anything else.
