Jace Christopher installed the system. The OWTS design is based on 4-bedrooms. An average daily wastewater flow of 525 GPD was used. The OWTS design was completed on July 12, 2020 and we were notified an inspection was needed in 2025, although a permit was not obtained for the work. Garfield County Environmental Health issued a Notice of Violation for commencing work without a permit. At the time of our inspection on May 27, 2025, we provided a punch list of items needing correction. They were as follows: • Expose septic tank. • Add clean out every 100-feet of sewer line between septic tank and distribution box. • Make knock outs in distribution box water-tight (leaking where pipes were installed). • Add flow equalizers in distribution box. • Install inspection ports at beginning and end of each trench. The existing 1250-gallon, two-compartment Copeland concrete septic tank (1990) remained in use. A sanitary tee on the inlet side of the septic tank was installed, in addition to an effluent filter on the outlet side of the septic tank. This filter must be cleaned annually, or as needed. It should be noted that the septic tank was showing signs of deterioration on the outside side of the septic tank above the water line. The deterioration should be monitored at times of routine maintenance/pumping to assure the septic tank remains water-tight. A new, 4-inch diameter Schedule 40 sewer line was installed from the septic tank to a new distribution. Schedule 40 was recommended because the area is subject to horse traffic. This pipe had minimum 1% grade from the septic tank to the distribution box and a clean outs were added. The distribution box was accessible from grade with flow equalizers installed on each outlet pipe in the distribution box to assure equal flow to each trench. The soil treatment area (STA) consisted of six gravelless chamber trenches. Each trench consists of 15 ‘Quick 4’ Low Profile Infiltrator® chambers for a total of 90 chambers and 1080 square feet of infiltrative area. There was at least 4-feet of undisturbed soil between each trench. Inspection ports must be installed at the beginning and end of each trench. Ports may be cut to grade and placed in sprinkler boxes for access. The OWTS was generally installed according to specifications. This observation is not a guarantee of workmanship and/or parts and materials. CBO Inc. should be notified if changes are made to the OWTS in the future. Any additional OWTS construction must be according to the county regulations. LIMITS: Observations are limited to components that are visible at the time of the inspection. The installer must have documented and demonstrated knowledge of the requirements and regulations of the county in which they are working. Through discussions with the OWTS designer, we understand the system was installed without obtaining an appropriate OWTS permit. In addition, this system has been partially backfilled. You submitted the OWTS design documents with the application. An unpermitted OWTS installation is a violation of Article 10 of Title 25 of the Colorado Revised Statutes the On-site Wastewater Treatment Systems Act) and the Garfield County Onsite Wastewater Treatment System (OWTS) Regulations, Resolution No. 2023-09. This letter serves as a notice of violation of Section 43.4.B.1, which states: “Prior to installing, altering, or repairing a system, the applicant must obtain a permit from the local public health agency.” The Garfield County OWTS regulations can be found online at https://www.garfieldcountyco.gov/environmental-health/wp-content/uploads/sites/16/4-20-23- Garfield-County-amended-regulation-43_OWTS_2023.pdf The following steps outline necessary actions to demonstrate to GCPH that you, the property owner, intend to correct this violation and avoid a hearing before the Garfield County Board of Health: 1. Within 2 business days of receipt of this notice, you shall contact GCPH to acknowledge receipt of this NOV and to discuss the process and timeline to bring the system into compliance; 2. GCPH shall review the previously submitted materials to determine if the OWTS design meets current Garfield County OWTS Regulations and perform a site visit to observe the site conditions and OWTS; 3. If our review indicates the OWTS design does not meet current Garfield County OWTS Regulations, you shall hire an OWTS professional or utilize the existing professional to design a regulatory compliant OWTS, remove the installed OWTS components, and submit the revised design to Garfield County for review prior to re-installing or altering the system; and, a. After any alterations are made, you must contact GCPH for a final inspection. 4. Do not backfill any components of the OWTS until final approval of both GCPH and the designer. Failure to correct this violation will result in the scheduling of a Cease-and-Desist Order Hearing with the Garfield County Board of Health to determine immediate corrective actions, which may include: A Cease-and-Desist Order – requires the owner to stop using the OWTS; Garfield County Public Health Department – working to promote health and prevent disease Monetary Fines; and Other remedies available by law. Changes to the design and permit must be approved by Garfield County Public Health and the designer prior to construction. The new OWTS will serve an existing four-bedroom residence. The existing 1,250-gallon two compartment septic tank shall be utilized. An inlet tee and an outlet tee with an effluent filter in the existing tank shall be installed. Effluent will gravity flow to a new distribution box set level with access to grade that will distribute effluent to 1,080 ft2 of STA. The new STA area will consist of six gravelless chamber trenches consisting of 15 ‘Quick 4’ chambers per trench (90 chambers total). Inspection ports will be installed at each end of each trench. Maintain all setbacks and elevations as designed. To assist in scheduling, please contact Garfield County Public Health (970-945-6614 ext. 8150) to notify the start of OWTS construction. Contact the designer and Garfield County Public Health at least 48 hours prior to requesting final inspection of the installed system prior to backfill. NO OWTS COMPONENT SHALL BE BACKFILLED WITHOUT PRIOR APPROVAL FROM GARFIELD COUNTY PUBLIC HEALTH AND THE DESIGNER. Agreement All installations must comply with all requirements of the Garfield County OWTS regulations including but not limited to the conditions specified above. In consideration of the issuance of the permit, the applicant hereby agrees to comply with all laws and regulations related to the zoning, location, construction, and erection of the proposed OWTS and associated structures for which this permit is granted. The applicant further agrees that if the above said regulations are not fully complied with in the zoning, location, erection, and construction of the above described OWTS and structure, the permit may then be revoked by notice from the Health Department and immediately become null and void. The issuance of a permit and specifications of terms and conditions therein will not constitute assumption of liability, nor create presumption that the local public health agency or its employees may be liable for the failure or malfunctioning of any system. Permit issuance will not constitute a certification that the system, the equipment used in the system, or any component used for system operation will ensure continuous compliance with the provision of the OWTS Act, the regulations adopted thereunder, or any terms and conditions of a permit. Permit Approval Plans and specifications for the proposed OWTS have been reviewed and are considered satisfactory. Permission is hereby given to the property owner(s) to perform the work indicated in accordance with the Garfield County OWTS Regulation. This Permit will expire 1 year from the date of issuance unless construction on the system has commenced.
