Reception Number 983395 of the Board of County Commissioners of Garfield
County, State of Colorado, hereby authorizes, by Land Use Change Permit, the
following activity:

The Land Use Change Permit is issued subject to the conditions set forth in the
above -mentioned resolution and shall be valid only during compliance with such
conditions and other applicable provisions of the Garfield County Unified Land Use
Resolution of 2013, as amended, Building Code, and other regulations of the Board
of County Commissioners of Garfield County, Colorado.

Recitals
A. The Board of County Commissioners of Garfield County, Colorado, (Board) received a
request for a Limited Impact Land Use Change Permit to allow for a Mini Storage Facility,
submitted by The Land Studio Inc. and Owned by MMME WG LLC as further described in Exhibit
A, Site Plan. (File No. LIPA-07-18-8659)
B. The Storage Facility is located on two parcels, approximately 14.7 and 24.39 acres
totaling 39.09 acres, each parcel is owned by MMME WG LLC. The property is further described
in Exhibit B, Legal Description.

C. The subject property is located within unincorporated Garfield County in the Rural Zone
District, off Highway 6&24 West of the City of Glenwood Springs.
D. Mini Storage Facilities may be permitted in the Rural (R) Zone District with a Limited
Impact Review Land Use Change Permit.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
Review Land Use Change Permit application resulting in issuance of a Land Use Change Permit
pursuant to the Garfield County Land Use and Development Code, as amended.
F. The Board of County Commissioners opened a public hearing on the 1 Oh day of October
2022 and continued the public hearing to November 71n, 2022. The Board of County
Commissioners opened a public hearing on November P, 2022, for consideration of whether the
proposed Land Use Change Permit should be granted or denied, during which hearing the public
and interested persons were given the opportunity to express their opinions regarding the request.
G. The Board of County Commissioners closed the public hearing on the November 7tn,
2022, to make a final decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters, and issues were submitted and that all interested parties
were heard at that meeting.
3. That for the above stated and other reasons the proposed Mini Storage Facility
application submitted by MMME WG LLC, also known as Royal Mini Storage, is in
the best interest of the health, safety, convenience, order, prosperity, and welfare of the
citizens of Garfield County.
4. That with the adoption of conditions the application is in general conformance with the
2030 Comprehensive Plan and the 2011 City of Glenwood Springs Comprehensive
Plan, as amended.
5. That the application has adequately met the requirements of the Garfield County Land
Use and Development Code as amended, including but not limited to Section 7-102,
Comprehensive Plan and Intergovernmental Agreements and Section 7-103
Compatibility.

RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Land Use Change Permit for an Mini Storage Facility, applied for by The Land Studio
Inc. and Owned by MMME WG LLC is hereby approved subject to compliance with the
following conditions:
1. All representations made by the Applicant in the application shall be conditions of approval
unless specifically altered by the Board of County Commissioners.
2. The operation of the Mini Storage Facility shall be done in accordance with all applicable
Federal, State, and local regulations governing the operation of this type of facility.
3. The Applicant shall maintain compliance with conditions of the well permit issued by the
Division of Water Resources and shall maintain the current West Divide Water
Conservancy District contract associated with the wells.
4. Prior to issuance of the Land Use Change Permit, the Applicant shall provide a complete
Drainage Plan for the site including details on Best Management Practices, all detention
calculations, address snow storage impacts on detention areas, and any issues associated
with off -site drainage including impacts on CDOT right-of-way. A CDPHE Storm Water
Permit shall also be provided.
5. Prior to issuance of the Land Use Change Permit, the Applicant shall obtain approval for
and record an Amended Final Plat for the Dever Subdivision to address merging the two
parcels, and any changes necessary to ensure the private roadway is fully located in a legal
access easement. Prior to issuance of a Building Permit the applicant shall submit proof of
the relocation of the 10 ft Mountain States Telephone easement.
6. Prior to issuance of the first Building Permit, the Applicant shall provide details on fencing
and gate proposals. Knox Box access or similar systems approved by the Fire Protection
District shall be required.
7. Prior to issuance of a Building Permit for the facility the Applicant shall provide engineered
foundation designs in compliance with the soils report and Geotech recommendations, an
engineered OWTS that demonstrates compliance with all setback requirements.
8. Roof materials shall be of a non-combustible materials or other material as recommended

by the Fire Protection District and shall be made of non -reflective materials.
9. Dust suppression during construction shall be required.
10. Compliance with the County Weed Management Plan and monitoring for weeds during the
2023 growing season shall be required. Prior to installation, the final Landscaping Plan
shall be reviewed and accepted by the County Vegetation Manager.
11. Prior to the issuance of the Land Use Change Permit the applicant shall submit a
Landscaping Plan designed by a Design Professional to include screening vegetation along
the eastern property line that is compliant with section 7-303-F. The vegetation shall be
maintained for the duration of the use. This vegetation shall be installed prior to the
issuance of a Certificate of Occupancy.
12. Rental agreements shall include specific provisions prohibiting the storage of any
flammable or explosive solids or gases and hazardous materials.
13. That the two residential units shall only be used for Workforce Housing
14. Prior to the issuance of building permits, the applicant shall provide engineering
certification that all site improvements including but not limited to rockfall protection,
debris flow mitigation and associated structures and fire protection system to include the 4
hydrants and water storage tank have been installed and completed.
