GENERAL PROJECT DESCRIPTION Applicant currently has a single-family residence and duplex on the 39 acre property. Building permits on record do not match all the existing structures. The single-family residence is compliant with permits, but the duplex does not have a record of building, OWTS or Land Use permits. Applicant must demonstrate in detail, access to the property, water is supplied (legal, physical, and adequate), OWTS and utilities. The duplex should comply with setback in t~. required drawings. The current property has a deceased owner listed. Applicant will need to resolve this issue before submitting the application. ' Applicant has a well permit {241239) on property that allows up to 3 single family dwellings for household purposes. Applicant also mentioned a cistern located near the duplex. Applicant will need to demonstrate if water is adequate for the single-family residence and duplex. This may include reaching out to the Division of Water Resources for options on future improvements and well permit applications. According to West Divide Conservancy, part of th!:l property is in Conservancy's Rifle Creek area and part is in Area A. Copies of the well permit will need to be included in the submittal. 1 The application needs to address Article 7, Sections 1-4. We assumed all structures on the prlperty were properly permitted. We recently started the process to create a Minor Subdivision of our 39 acres in order to give my son 3.61 acres to build a house on the south ast corner of the property. In our pre-application conference we were informed tha~ the building with the 2 apartments had been converted from a garage in 2003 without the propF r permits and this needs to be remedied prior to creating the Minor Subdivision. I I The 2 apartments, now being called, The Garza Ouplex gets water from a shared well that pumps to a 3,400 gallon cistern, has its own ow,rs and is on its own power meter. I We are asking for the Duplex be permitted so we ban proceed with our plans for the minor subdivision. Garza Duplex Garfield County Comprehensive Plan 2030 The Garza Duplex complies with the Garfield County Comprehensive Plan 2030 by providing affordable housing by permitting the Garza Duplex. The Garfield County Comprehensive Plan 2030 encourages ADU's which the Garza Duplex qualifies as such. Due to the fact that the property is within Rifle's Urban Growth Area there is potential for future access to municipal water and sewer. Currently, the well production is adequate and OWTS is functioning properly. Article 7 7-101-ZONE DISTRICT USE REGULATIONS-This land use change does not change the property's rural zoning. 7-102-COMPREHENSIVE PLAN AND INTERGOVERNMENTAL AGREEMENTS-The Land Use Change is in conformance with the Garfield County Comprehensive Plan and complies with all applicable intergovernmental agreements. 7-103-COMPATIBILITY-The proposed use of the duplex is compatible with adjacent land uses on the property. 7-104-SOURCE OF WATER-There is well on the property. See attached Well Permit #241239. The well produces approximately 1.5 gal/minute. There are two 1,700 gallon cisterns that store water for the Duplex and the Main house. The cistern is always full when we check it and we have never run out of water. The water quality is not very good but we have reverse osmosis systems installed at the kitchen sinks in both apartments for cooking and fill 5 gallon water bottles in town for drinking. 7-105-CENTRAL WATER DISTRIBUTION AND WASTEWATER SYSTEMS- We have a central well distribution system The Duplex has its own Septic system. It has always functioned properly. We had it pumped when we bought the property in May 2022. The Septic Tank lids are buried and located 17'2" from the NW corner of the building to the first lid. The second lid is 21 '5" east of the propane tank. We do not have any schematics of the septic system and are asking for a waiver regarding OWTS permits. 7-106-UTILITIES-The Duplex has underground power at 100Amps on its own meter separate from the main house. The duplex also has its own 500 gallon propane tank. 7-107-ACCESS AND ROADWAYS-The duplex has access to County Road 233 via a semi-primitive gravel driveway. Garfield County Road and Bridge issued a Driveway Exemption Letter stating the driveway meets current county standards. 7-108-USE OF LAND SUBJECT TO NATURAL HAZARDS-There are no hazards on the land the duplex is on. 7-109-FIRE PROTECTION-Adequate fire protection can be provided without difficulty. There are 2 fire hydrants on County Road 233. 7-201-AGRICULTURAL LANDS-This land use change of changing the garage to a Duplex apartment has no effect on agricultural operations in the vicinity. Domestic animals, fences, roads and ditches are unaffected by the change of the garage to Duplex apartments. 7-202-WILDLIFE HABITAT AREAS-There has been no impact to wildlife by changing the garage to a garage with 2 apartments since the building size did not change. There is native vegetation along the west side of the building for wildlife. There are small fenced areas for dogs so they do not disturb wildlife. 7-203-PROTECTION OF WATERBODIES-The distance from the building with the garage and duplex is greater than 35 ft from the irrigation ditch. 7-204-DRAINAGE AND EROSION-The building has a gutter and stormwater drainage is diverted away from the building by a french drain. 7-205-ENVIRONMENTAL QUALITY-Air quality will not be reduced by this land use change. All hazardous materials will be stored properly. 7-206-WILDFIRE HAZARDS-This property is not located in a severe wildfire Hazard Area with Slopes greater than 30% or within a fire chimney as identified by the Colorado State Forest Service. The building has a steel roof. 7-207-NATURAL AND GEOGRAPHIC HAZARDS-The utilities (power and propane) are located underground. The building is not in an Avalanche Hazard area, Landslide Hazard area, Rockfall Hazard area, Alluvial Fan Hazard area, on a slope of 20% or greater, on corrosive or expansive soils and rocks, in a mudflow area or over a fault 7-208-RECLAMATION-AII vegetation has been returned to its previous natural state since the building was changed from a garage to a garage with a duplex in 2003. 7-301-COMPATIBLE DESIGN- A.Site Organization-The site of the Duplex is organized so there is parking for 4 cars and outdoor fenced space for each apartment. Each apartment has a dog door. B. There are no noise or pollutants being emitted on the property. This does not apply. C.This does not apply. D. The Duplex has been painted to match the main house. 7-302-OFF-STREET PARKING AND LOADING STANDARD-There are 4 parking spaces in front of the Duplex and additional parking on the side of the building. 7-303-LANDSCAPING STANDARDS-Additional Dwelling Units are exempt from this section. 7-304-LIGHTING STANDARDS-Each Duplex exterior entrance door has a small solar, motion sensor activated outdoor light that is compliant with all regulations. 7-305-SNOW STORAGE STANDARDS-We are exempt from this section. 7-306-TRAIL AND WALKWAY STANDARDS-There are no public sidewalks or trails located on the property. Box 140 Mack, CO 81525 970-250-0572 Site Hi story There is an existing primary residence on the site that is served by an existing onsite wastewater treatment system (OWTS) that will remain in use. There is also an existing duplex on site with two, I -bedroom apartments. The OWTS servin g the duplex is unpennitted and also showing signs of failure and must be replaced. The site consists of approximately 39.23 acres of cultivated native soil. Drainage is approximately 3% to the southwest. A soil s evaluation and site study were conducted on the property of reference on 04/18/26 by Kachayla Schroede,.a. This OWTS design has been prepared for the project based on information disclosed during the site study mentioned above. A discussion of the engineered OWTS design follows. The location of the soil s evaluation trench is shown on the Plot Plan included in this report. Development of Design Parameters Soils evaluation trench A was extended to a depth of 84" below ground s urface (BGS). There was no evidence of ground water or periodically saturated soils in the open excavation to a depth of 84" BGS. No limiting layer was identified to a de pth of84" BGS. T he soils evaluation indicates two distinct soil horizons underlie the site. A lithological description follows: depth (in.) 0" -16" 16" -84" description sandy loam w/ mjnor rock (<35% rock), dark brown (Soil Type 2, USDA -sandy loam, blocky, strong structure) sandy loam , brown (Soil Type 2, USDA-sandy loam, blocky, moderate structure) Soils evaluation trench B was extended to a depth of 84" below ground surface (BGS), and showed the same soils lithology as described for trench A above. Based on the results from the 04/18/26 soils evaluation, a conservative Soil Type 2.A and corresponding long term acceptance rate (LT AR) of 0.50 are chosen for overall system sizing for an infiltrator trench soil treatment area designed to discharge LO subsoils below the 24" depth. • Kachayla Schroeder holds a Certificate of Attendance and l:.xamination from the CPOW Visual and Tactile Evaluation of Soils Training. -I - System Design The installer s hall confirm the feasibility of gravity discharge of sewage effluent from the foundation line lo the soil treatment area by field verificat ion of required parameters. Gravi ty sewer lines that transport solid waste material must maintain a minimum fall of 1/4" per foo t (2% s lope); gravity efnuent lines th at transport only liquid waste material must maintain a minimum of 1/8" per foot ( L % slope). If s ite conditions do not all ow for the require ments mentioned above to be maintained, g ra vity discharge of septic effluent cannot be assured, and a lift station may be required. Please contact the design engineer and Garfield County to address a ny design modifications necessary if these design assumptions are not upheld. A chamber trench soi l treahnent system is proposed for discharge of septic effluent at the site. Construction of the system will consist of excavating level trenches in th e area comprising the soil treatment area. Grading during construction may affect s lope, therefore contractor s hall verify s lope at time of in s tallation. So il treatment area orientation may be adju s ted per site variations to facilitate cons istent trench depth running parallel to final contours. The initial excavation s hall be cont inued to a level depth of 24" BGS (see Soi l Treatment Area Cross Section). If consistent trench depth cannot be maintained, INFILTRATOR chambers may be installed level at 24" minimum and 36'' maximum BGS. After removal of surface soils, the open excavations s hall be dis ked or scari fied to promote s ubsurface absorption Fol lowing completion of th e trench excavations. chambers wi ll be used to construct a sept ic effluent distribution system in the open excavations. If at any time during construction, subsurface site conditions are encountered which differ from the design parameters previously descr ibed, construction activities will stop, and the design engineer and Garfield County will be contacted to address any necessary design modifications. • In s tallation procedures including grade, location, setbacks, septic tank size. and soil treatment size shall conform with the attached graphi c details. The following precautions and construction procedures s hould be employed during installation to minimize di sturbance to native soils: 1. Excavation should proceed only when the moisture content of the soil is below the plastic limit. If a sample of soil forms a rope instead of crnmbling when rolled between the hands it is too wet and should be a ll owed to dry before excavation continues. 11. Excavation and backfill equipment should work from the surface where at all practical to avoid compaction of the soils at depth. 111. The bonom and sidewalls of the excavation should be left with a rough, open surface. The appearance should be that of broken or ripped soil as opposed to a sheared, smeared, or troweled surface. Any smoothed or smeared surfaces s hould be removed with a toothed rake or shallow ripper, taking care to remove loose residues from the bottom of the excavation by hand if necessary. iv. Care should be taken in placing fill materials in the excavation to avoid damaging the exposed soil surfaces. -5 - Operation -Maintenance and Inspections • The owner shall install a structural barrier if necessary and t ake precautions to prevent vehicular traffic, excessive surface watering, accidental flooding, o r other activities in the vicinity of the soil treatment area which may compact, sah1rate, or otherwise alter the subsurface soil parameters used in designing th e septic system. • The owner will plant and maintain grass or other shallow rooted cover crop to prevent erosion and promote evapotranspiration over the soil treatment area. Every month: • Inspect backfill over the septic tank and soil treatment area for signs of settling -provide additional mow1ding as needed. • Tn spect area of septic tank and soil treatment area for signs of intrusion by burrowing animals and deep rooted plants and take measures to prevent future intrusions as needed. Every year: • Remove tank lids and inspect outlet effl uent filter for damage and clean as needed. • Inspect soil treatment area through the ports provided at the beginning and ends of each lateral trench for signs of excessive moisture or pooling water. • In spect tank risers for signs of high water level markings that may indicate slow drainage Every fou r years: • Remove accumulated sludge from the septic tank by pumping all compartments - interval may be adjusted to less than four years or more t han four years depending on family specific usage and habits.
