GENERAL PROJECT DESCRIPTION Update: The applicant reached out to staff to request an extension of the preapplication. No changes to their general proposal has been made, and no changes to the County’s regulations have been made since the original preapplication. The applicant did ask for additional clarification on the site plan and pipeline alignment requirements. Since the exact location of the pipeline within the easements/ROW may be altered during construction, the site plan(s) should provide enough information to allow for a review of natural/manmade features that may be impacted by the pipeline. A copy of the as-builts may be requested as a condition of approval. The proposal is for an approximate 8-9 mile water line that will start outside of De Beque in Mesa County at the Kobe Pumping Plant and then extends into Garfield County towards Laramie’s existing Conn Creek Water Treatment Facility. At the time of the preapplication, the applicant was still considering two different alignments in the middle of the pipeline. Garfield County’s LUDC (https://www.garfieldcountyco.gov/community-development/land- use-code/ ) defines Pipelines and their related processes in Article 9. The current definition cE "larjield County 2 and applicability section of the code does not distinguish between freshwater pipelines and other liquid/gas pipelines. Article 9 provides for an Administrative Review process for pipeline applications. The process is intended to be more efficient than those that require public hearings. The application should provide the submittal requirements listed in the LUDC and provide below as a checklist for convenience. Authorization should be done in accordance with 9-102.E, which includes surface easements and agreements as methods of property owner authorization. Notice will be mailed to property owners within 200 feet of the alignment and by posting signs where the alignment crosses public roads. Vegetation management, grading and drainage, wildlife impacts, and roads impacts are expected to be important topics. Pressure /Testing (9-102.Q) is also required, as well as an Emergency Response Plan. II. COMPREHENSIVE PLAN The application will need to demonstrate conformance with the comprehensive plan’s vision, goals, and policies. III. Garfield County MEMORANDUM TO: Staff FROM: DATE: RE: County Attorney's Office Jlme 24, 2014 Mineral Interest Research Mineral interests may be severed from surface right interests in real property. Colorado revised statute 24-65.5-103 requires notification to mineral owners when a landowner applies for a land use designation by a local government. As such, the landowner must research the current owners of mineral interests for the property. The Garfield County Land Use and Development Code of 2013 ('·LlJDC") Sec tion 4- 10l(E)(l)(b)(4) requires written notice to owners of mineral interests in the subject property "as such owners can be identified through the records in the office of the Clerk and Recorder or Assessor, or through other means." It is the duty of the applicant to notify mineral interest owners. The following is a suggested process to research mineral interests: 1. Review the current ownership deed for the property (i .e. Warranty Deed, Special Wananty, Quit Claim Deed or Bargain and SaJe Deed-NOT a Deed of Trust). The ownership deed is usually one or two pages. Is there a reservation of mineral interests on the ownership deed? Are there any exceptions to title? A deed may include a list of reservations that reference mineral owners or oil and gas leases. 2. Review your title insurance policy. Are there exceptions to title listed under Schedule B- Il? If so, review for mineral interests that were reserved and oil and gas leases. 3 . Check with the Assessor's office to determine if a mineral interest bas been reserved from the subject property. The Assessor's office no longer documents the mineral reservation ownership for its tax roll records unless ownership has been proven. There are only a limited nwnber of mineral owners who have provided such information to the Assessor's office so this may not provide any infonnation, depending on your property. 8 , MEMO June 24, 2014 Page2 4. Research the legal description of the subject property with the Clerk and Recorder's computer. You can search the Section, Township, and Range of the subj ect property. You may find deeds for mineral interests for the subject property. 5. Research whether a Notice of Mineral Estate Ownership was filed for the subject property. On the Clerk and Recorder's computer, search under Filter (on the right hand side of the screen), General Recordings, Notice of Mineral Estate Ownership for the subject property. 6. If you find mineral interest owners as reservations on your deed, listed in your title insurance policy, from the Assessor's records or the Clerk and Recorder's computer, you need 10 determine whether these mineral interests were transferred by deed and recorded in the Clerk and Recorder's office. 7. Enter the name of the mineral interest owner as the Grantor in the Clerk and Recorder's computer to see if the mineral interest was transferred. If you find a transfer deed, you need to repeat this process to follow any transfer of the mineral interest to present day. 8. Include a description of your research process in your application and the name(s) and address(es) of the current mineral interest owner(s). Mineral interest research can be a difficult and time consuming process. If you are unable to determine mineral rights O\mership by yourself, consider hiring an anomey or landman. Attorneys and landmen specialize in determining mineral rights ownership, but they charge a fee for their services. Cascade Creek Water Line Project Project Description Narrative Article 4 Section 203 Pipeline Application Administrative Review Laramie Energy, LLC 3199 D Road, Bldg A2 Grand Junction, CO 81504 February 2026 Laramie Energy, LLC Cascade Creek Water Line Project Project Description Narrative Garfield County, Colorado Administrative Review: Pipeline CASCADE CREEK WATER LINE PROJECT Laramie Energy, LLC (Laramie) has submitted an Administrative Review land use change application to pursue a land use change permit for Division 9 Pipeline in Garfield County for the installation and use of approximately 9.46 miles of two water lines (surface & buried). The pipeline project’s name is the Cascade Creek (CC) Water Line. The project may also be referred to Cascade Creek to Kobe Tanks Pipeline. While this application consists of permitting a surface and buried water line within the same Right-Of-Way. Laramie is an Oil & Gas Exploration and Development Company that operates solely in Western Colorado. Larmie’s core operating areas are Plateau Valley (Collbran – Mesa County) and Cascade Creek (Garfield County) within the Piceance Basin in Western Colorado. The main function of the proposed water lines will be to increase capacity for both fresh and recycled produced water delivery to Laramie’s Cascade Creek operations area. Fresh water and recycled produced water are necessary for oil and gas drilling and completion operations. The project is situated north of DeBeque, CO. The line will start in Mesa County near the Mesa County/Garfield County boundary and end at Laramie’s Central Water Handling Facility. The CC Water Line will adhere to Garfield County rules and standards set forth in the Garfield County Land Use and Development Code (LUDC). The following application addresses the submission requirements for Division 9 Pipelines the LUDC. ARTICLE 9 SECTION 101 APPLICABILITY OF PIPELINE LAND USE CHANGE PERMIT Division 1. Pipeline Article 9-101 Applicability states a Land Use Change application & permit is required for a pipeline (including water lines) when specific length and diameter conditions are met. The surface & buried water line will be the same length and follow the same route. The proposed water lines met both criteria listed under Article 9-101.A as follows: • Section 9-101.A.1. Greater than 12 inches in diameter and over 2 miles in length or 2 cumulative miles if separated by municipal or public lands The water line ROW will be greater than 2 miles in length. Sections of the water line ROW will be located on public lands; however, portions of the ROW which will be located on private lands exceed 2 miles. The surface line will be up to 16-inch diameter, and the buried water line will be up to 12-inch diameter. • Section 9-101.A.2. Any pipeline that is more than 5 miles in length or 5 cumulative miles if separated by municipal or public lands. The water line ROW will be greater than 5 miles in length. While separated by public lands, the water lines will be more than 5 cumulative miles in length on private lands. Laramie Energy, LLC Cascade Creek Water Line Project Project Description Narrative Garfield County, Colorado Administrative Review: Pipeline ARTICLE 4 SECTION 101 PRE-APPLICATION CONFERENCE Laramie submitted a Pre-Application Request on June 13, 2025 to Garfield County Community Development Department. A Pre-Application meeting with Garfield County and Laramie was held on June 30, 2025. On July 14, 2025, Garfield County provided a pre-application summary and applicable application forms. In October of 2025, Laramie requested an extension of the Pre-Application Meeting and Garfield County provided an updated pre-application summary on November 5, 2025. Laramie invited Garfield County Community Development Department to an onsite with the Bureau of Land Management (BLM) for the CC Water Project in July 2025; but Garfield County staff were unable to attend. The updated Pre-Application Summary is provided in the Application Forms tab. ARTICLE 4 SECTION 203.B.5. PROJECT DESCRIPTION Section 9-102.A. General application materials pursuant to 4-203.B. Article 4 Section 203.B.5. - Project Description The following section addresses the requirements for the Project Description under Article 4 Section 203.B.5 of the Garfield County Land Use and Development Code (LUDC). The purpose of the proposed pipeline / waterline will be to increase capacity for both fresh and recycled produced water delivery to Laramie’s Cascade Creek operations area. Both fresh water and recycled produced water are required to conduct pre-production operations for oil & gas exploration and development. Specifically drilling and completions operations require a significant volume of water. Laramie is proposing one (1) right-of-way (ROW) with two types of waterlines: one (1) surface water line and one (1) buried water line. The ROW will be 70-foot wide for construction. The proposed waterlines will be placed in an existing ROW with previous surface disturbance. The buried water line requires a 70-foot width ROW for construction & installation. The surface water line requires a 50-foot width ROW for the placement of the surface line. The 50-foot width ROW for the surface line is within the 70-foot width ROW. Fresh water is used for drilling activities. During completions, both fresh water and recycled produced water are utilized. The two main types of wells drilled in the Piceance Basin are horizontal and directional wells. Average anticipated water volumes per well type & occupational phase in Cascade Creek are listed in Table 1. Please note these are general averages and water volume vary based on geology, well location, well depth, and various other factors. This will significantly alleviate truck trips associated with water hauling on local public roads. Any wells drilled in Colorado require an Oil & Gas Development Plan (OGDP) permitted through the Colorado Energy & Carbon Management Commission (ECMC) (formerly known as the Oil and Gas Conservation Commission - COGCC). Laramie will only drill and complete wells on well pads which are ECMC approved location (Form 2A Location Assessment). The OGDP process is a rigorous permitting process to ensure oil & gas locations meet State rules & regulations. The new water lines will be placed in existing pipeline ROW to reduce new surface disturbance and vegetation removal associated with the project (Figure 1). The water lines will start at the Kobe Tank Battery in Mesa County, Colorado. Laramie has existing water lines south of Kobe Tank Battery in Mesa County. These existing water lines provide sufficient capacity from other facilities in Mesa Couty to the Kobe Tank Battery. Laramie currently has a buried 6-inch water line from the Kobe Tank Battery to the Logan Trail 28-10 (ECMC Location # 421296) in Garfield County, Colorado. At the Logan Trail 28-10, the existing buried water line transitions to a 4-inch line which continues north to Laramie’s Cascade Creek operations area. The current buried water line (6-inch transitioning to a 4-inch) does not provide the capacity required for future development; therefore, Laramie would have to truck water the additional water needed from facilities in Mesa County to well pads located in Garfield County. The existing 6-inch water line and the 4-inch water line were installed in separate segments at different times; therefore, a Garfield County Pipeline Land Use Change Permit was not required. BLM ROW permits were obtained. BLM ROW applications are referred to Standard Form (SF) 299s. Laramie consulted with the BLM in 2025. Details regarding BLM consultation and existing federal lease for existing water lines are provided in the Article 9 Pipelines Narrative (in the Article 9 Pipelines tab). Existing Buried Water Line ROW Laramie Energy, LLC Cascade Creek Water Line Project Project Description Narrative Garfield County, Colorado Administrative Review: Pipeline The surface water line will be fresh water dedicated and will not transfer recycled produced water. This surface water line will be up to 16-inches in diameter. The surface water line will be a lay flat or poly line (High-Density Polyethylene – HDPE). Due to the recent & current fluctuation in commodity prices, Laramie has not made a final determination on the material to be used for the surface water line at the time of application submittal. Upon installation, Laramie will notify Garfield County of the material selected. The proposed buried water line will transport both fresh water & recycled produced water. This buried water line will be up to 12-inches in diameter. Due to the recent tariffs & current fluctuation in commodity prices, Laramie has not made a final determination on the material to be used for the surface water line at the time of application submittal. The 12-inch buried water may be steel, fiberglass or poly-steel. Due to tariffs, Laramie is uncertain of supply chain impacts and availability of material at the time of construction. Upon installation, Laramie will notify Garfield County of the material selected. The proposed water line ROW will be a total of 9.46 miles in length. Approximately 150 feet of the southern portion of the waterline will be located in Mesa County within the Kobe Tank Battery Facility. No new surface disturbance will occur in Mesa County as indicated in Figure 2. Of the 9.46 miles, 2.82 miles of the waterline will be located on public lands. 6.64 miles of project will be situated on private lands. Figure 2. Kobe Tank Battery Facility - Mesa County / Garfield County Boundary The project ROW will be 70 feet wide. The water line ROW will be 80.3 acres (3,497,830 sq feet). While Laramie does not anticipate the full 70-foot ROW to be disturbed for the entire length of the project, Laramie includes this acreage in the total disturbance estimates. Please note that the proposed water line will be constructed within an existing pipeline ROW and the 80.3 acres of disturbance is not new disturbance. Additional disturbance may result for staging areas. Laramie sited staging areas to be located within previously and/or currently disturbed areas as much as possible. Additional details on acreage disturbance is provided in the Article 9 Pipelines Narrative Laramie Energy, LLC Cascade Creek Water Line Project Project Description Narrative Garfield County, Colorado Administrative Review: Pipeline (in the Article 9 Pipelines tab). Purpose and Need During drilling and completions operations, activities are conducted on a continuous schedule (24 hours / 7 days a week). The proposed water line ROW is critical to Laramie’s ability to drill and complete natural gas wells within the Cascade Creek operational area. The proposed water lines will deliver water necessary for drilling and completion operations directly to Laramie’s Cascade Creek operations area, significantly reducing reliance on truck hauling. Proposed water lines will connect to existing infrastructure located in Laramie’s Conn Creek Valley, where water can be distributed by a network of existing water gathering lines. By replacing individual water-hauling truck trips with continuous waterline transfer, the project will reduce water-related truck trips in the region associated with natural resource development. Table 2 provides estimates on anticipated reduction of truck trips per well per phase. This reduction will decrease traffic, emissions, road wear, and safety risks associated with heavy truck activity. One truck equals two truck trips, both to and from the well pad. A directional development well pad typically has 20-30 directional wells. A horizontal development well pad has 4-8 horizontal wells. The right column in Table 2 gives a range of estimated truck trips removed for a full well pad development based on the average number of wells per well pad. Table 2. The ROW will be located in Section, Township, & Range (Public Land Survey System) listed in Table 3. The water line ROW will be located within privately owned parcels and Federal public lands managed by the BLM. In Table 3, all lands identified as “public” are Federal public lands managed by the BLM. The water line will be located near Garfield County public roads, County Road (CR) 213 (Conn Creek Road) and CR 204 (Road Creek Road). Emergency Response Plan Laramie requests a waiver for the provision in the Emergency Response Plan stating, “the plan shall include a provision for the operator to reimburse the appropriate emergency service provider for costs incurred in connection with emergency response for the Operator’s activities at the site.” • While the application is for an Article 9 Pipeline permit, the proposed project is for a water line, not a gas pipeline. • Laramie is committed to the safety of personnel, the public and the environment by taking all necessary precautions for preventing fire and environmental spills during this project. • Laramie paid almost 1.8 million dollars in tax to Garfield County for tax year 2025 & requests that this waterline be treated like all the other Laramie assets in Garfield County. • Laramie has a great working relationship with the De Beque Fire Protection District and reviews all new projects that have the potential to impact the fire department. For temporary surface pipeline, this Agreement shall be in effect for a period of one (1) year commencing when Grantee commences the installation of the surface pipeline. The pipeline will start in Mesa County and continue in Garfield County to Laramie Energy's Cascade Creek operations area. Resource Lands zone district. Additional Information Required: Please provide a description of how the project will be served with water and wastewater, and where you will take access. This will be a fresh water pipeline. Laramie will permit both a buried & surface water line: the buried pipeline will have a diameter up to 12 inches and Laramie will permit several surface lines within the pipeline ROW. Currently, there are two routes being proposed. Since the pipeline will cross federal surface, BLM requested both cultural and biological surveys to be conducted. These surveys started in May 2025 and will be finished by July 2025. These reports are provided to the BLM & not the Operator. Based on the field surveys, Laramie will select & permit one route. The route is approximately 7.5- 9 miles in Garfield County. The pipeline alignment will cross BLM Federal surface, but a majority of the pipeline with occur on fee surface. Several sections will be within an existing pipeline ROW. Pipeline starts at the Mesa County/ Garfield County boundary in 8S 97W and continues north into 7S 97W. The pipelines will significantly reduce truck traffic associated with water delivery in the area. What specific questions do you have? Laramie will apply for the BLM ROW & the Garfield County permit concurrently. No ECMC permitting is associated with the project.
